Police Report PC Gavin Mears gave the report for November which is attached at Appendix A. There were 6 housebreakings in total one of which was solved. He stated that overall HBs were starting to increase overall again. There could be various reasons for the increase including that previous perpetrators have been released from previous prison sentences. There had been a bogus workman incident in Frogston Avenue where cash had been stolen. Various operations, including some in plain clothes, were taking place in both the local and wider area leading up to the Christmas and New Year operations. In response to a question raised the clamped vehicle in Swanston Avenue is as a result of DVLA activity. Once the vehicle excise duty is paid along with other fees the vehicle will be unclamped. If no payment is made the DVLA will remove the vehicle with a view to selling it. There is also a Police Surgery on Wednesdays between 1700 and 1800 hours at Oxgangs Library. Monthly Crime Prevention Tip Make sure all you Christmas presents are hidden from view. 2. Minute Of Meeting Held On 1 November 2016 These were approved by the meeting. 3. Matters Arising: a) Pedestrian Crossing, Buckstone Terrace at Waterfield Road This was covered in Cllr Aitken s report. b) Car Club Parking Space, Braid Road The Secretary stated that following on from the comments at the last meeting he had contacted Traffic Orders at the Council with an objection to and comments on the proposed location for a car club bay. The Council had replied accepting the community council comments and stating that no bay would be installed in that part of Braid Road. The new proposed location was on Pentland Terrace just south of Comiston View. c) Data Protection Act Registration The Secretary reported that following on from the decision taken at the last meeting he had registered the community council under the provisions of the data protection act. He had received a copy of the appropriate registration document. 1

Correspondence a) CEC Licensing Liquor applications for December board meeting. b) Edinburgh Airport Setting up a Noise Management Board. c) NHS Lothian Information on Edinburgh Wellbeing Public Social Partnership forthcoming events. d) Transition Edinburgh Pentlands event on Could Edinburgh be more sustainable by Caiystane Hall, Tuesday 13 December at 7pm. e) Invest Edinburgh magazine for November to February Councillors Reports Councillor Aitken distributed copies of her report: 1. Pentland View I spoke with the Planning Officer last week. Concerns have been expressed about the roads access so the developers are now considering a revised layout. The application is unlikely to be considered by the Development Management Sub Committee until next year. 2. Waste Issues I continue to receive complaints about missed collections e.g. Biggar Road, Buckstone Place, Queen Margaret Close and Oxgangs Road and unemptied street bins. I lodged a question at the last Full Council meeting about recycling bins, including paper banks serviced by Palm Recycling and as a result the service will be monitored more strictly. This should ensure that the banks are emptied on a regular basis. 3. Winton East I attended the exhibition held in Fairmilehead Church on 29 th November by Miller Homes to view the proposals for 87 new homes with a range of two, three, four and five bed properties, including 22 affordable homes. The planning application should be lodged before Christmas for validation and the 21 day period for comments will then start. 4. Buckstone PS I met with Mrs Imrie to discuss any actions which could be taken to stop inconsiderate parking and maintain sightlines for pupils crossing the roads near the school. The section 75 payment from Cala and David Wilson Homes will be made by the end of the week which will allow the tender process to commence. 5. Faulty Lights I ve reported a number of faulty street lights in the ward and have submitted a question for Full Council this month on delays in maintenance. 6. New Crossing in Buckstone Terrace The Road Safety and Active Travel Manager, Andrew Easson, is arranging a meeting with the local Councillors in January to discuss a proposal which will then go out for consultation. 7. Traffic in Buckstone Terrace I have reported the difficulties caused by the backup of traffic waiting on the main road to turn right in to Waterfield Road to the Senior Transport Team Leader. 8. Braid Road A meeting to discuss road safety in Braid Road was held in late October, organised by Daniel Johnstone MSP. Unfortunately, Councillors for wards 8 and 10 were not invited. A follow up workshop, to which we have been invited, has been organised to look at issues raised at the meeting. A public meeting is proposed for January , Buckstone Crescent This property is being monitored by the Empty Homes Enforcement Team and our local Police following more complaints about the poor condition of the building and garden. 10. Aldi Development Preparation for demolition should start pre-christmas. With the Christmas/New Year holiday trades shut-down, it is likely demolition proper will not commence until the New Year. Construction on site is scheduled to begin February/March for an Autumn opening. 11. Former Hunter s Tryst Site I spoke to the architects yesterday. The planning application will be lodged later this week. Once the documents have been validated, comments can be made on the planning portal. 2

3 12. Barrier at Dreghorn A new vehicle height restriction barrier has been installed at Dreghorn Ranges. Councillor Rust and I have received complaints about its height, as have colleagues in the Pentland Hills Ward. It has been set at 1.5m which denies access to most cars as well as commercial vehicles. This land belongs to MOD but the area has for a long time been subjected to anti-social behaviour ranging from vandalism and arson in the former farm house site, dog waste being left on the MOD training area, and fly tipping of building material, domestic waste and surgical items. The MOD feel that they have a duty of care to maintain the area safely and responsibly for both the Service user and the public who access the area under the Scottish Outdoor Access Code. Before the barrier was installed, various stake holders were consulted. (Forestry & Natural Heritage Service, Friends of Pentlands, MOD Police, MOD Land Agents). 13. Blocked Gullies I ve reported the blocked gullies which were identified at our last meeting. 14. Footpaths Supervisors have been asked to inspect the footpaths going from Buckstone Crescent up B. Hill, Bank and Way and to include in the schedule. I have requested that these paths are inspected on a weekly basis. I also asked for the footpaths from Pentland Drive to Pentland Primary School and Cockmylane are covered with fallen leaves to be cleared I hope that you have a peaceful Festive Season and wish you all a Merry Christmas and Happy New Year. Cllr Aitken highlighted the pedestrian crossing issue; 17 Buckstone Crescent; Hunters Tryst site and footpaths. Councillor Rust circulated copies of his report: 1. I attended the planning exhibition hosted by Miller Homes and its agents at Fairmilehead Parish Church in respect of Winton East on 29 th November. A number of local residents were in attendance. The planning application is anticipated later this month and once validated by Council will be open for the period for comment. As a statutory consultee the Community Council will be notified. 2. I am meeting with officers next week, along with Elaine Aitken, to get an update on the Comiston Farmhouse planning application, which has yet to be determined. 3. I submitted questions to Full Council regarding Festive Lighting. Essentially my aim was to ascertain the budget available, the extent of equipment and who made the decisions. It has since resulted in much controversy due to Council having made apparent cutbacks, but without engaging with or directly advising local communities. 4. I have been in touch with winter maintenance regarding grit bins, particularly near to the Pentland Centre and Oxgangs Library. 5. I have received concerns about the number 4 service not operating on either Christmas Day or Boxing Day. Ultimately it is a commercial decision for Lothian Buses and I have suggested concerned passengers contact Lothian Buses directly and ask their employers to do likewise if there are concerns. 6. Along with the Council s Forestry Manager I met with residents of Swanston Park and Swanston Green regarding the trees in their area. The street sweeper truck has now been active and all drainage channels have been cleared, but we await the Forestry sections proposals regarding thinning etc. 7. Residents in Buckstone Terrace and Buckstone Wood were in contact regarding food waste uplifts. These have now taken place. There have been delays to schedules across the area. 8. I believe it was minuted at September s meeting the decision of my ward colleague, Elaine Aitken, to stand down at the local elections next year. I know how much Elaine does both in a local capacity here in Fairmilehead as well as city-wide in her role as a Bailie. I would like to add my thanks to Elaine for her efforts on our behalf and will continue to work closely with her over the coming months until Elaine s departure from Council in May. 9. I was pleased to be re-selected last month to stand in the May 2017 election, along with Philip Doggart who will be standing in place of Elaine. 10. The next public meeting of Pentlands Neighbourhood Partnership is at 7pm on Tuesday 17 th January

4 11. I wish all Community Councillors and attendees a very merry Christmas and peaceful and prosperous New Year. Cllr Rust also commented on the Schools enquiry report which should be published in January. He also commented on the current review of the Westminster parliamentary boundaries. In the absence of Councillor Lewis the Secretary distributed copies of his report. Constituency Library transformation The proposed new structure for the Schools and Lifelong Learning Service has been out to consultation with staff and unions. Once this process has been completed there will be further announcements on any changes to the library services in communities across the city. I spoke to Oxgangs library staff last Monday after the article in the Evening News, to assure them that there are no plans to shut any libraries. However, different shift patterns are being looked at as part of the Council s cost savings plans. Waste There are currently delays with the food waste collections in the Colinton and Fairmilehead area. This should be rectified today. Road issues affecting the wider constituency Colinton/Fairmilehead - BRAID ROAD at Buckstone Drive - SGN gas main repairs - Lane closures and temporary traffic lights 14/11/16-30/11/16 Colinton/Fairmilehead - BRIDGE ROAD at Spylaw Street - City of Edinburgh Council - footway resurfacing - off-peak lane closures and temporary traffic lights 21/11/16-25/11/16 Colinton/Fairmilehead - WOODHALL ROAD between Bonaly Road and Torphin Road - BT installation works 28/11/16 for 3 days - 3-way temporary traffic lights 01/12/16 for 2 days - 4-way temporary traffic lights, no left turn from Fernielaw Avenue; 03/12/16 for 2 days - 2-way temporary traffic lights Remit Oriam National Performance Centre for Sport The official opening of Oriam took place at the beginning of November with the First Minister cutting the ribbon for the world class training venue at Heriot-Watt University s Riccarton Campus. I was delighted to represent the Council and say a few words about the Council s contribution and support of the project and the benefits this will create for our athletes and local community. As part of the mix, the centre will be open for extensive community use and represents a great addition to the sporting infrastructure of South West Edinburgh. Meadowbank Sports Centre Consultation with national governing bodies and clubs is now underway and public consultation will be taking place at Meadowbank Sports Centre on the 17 th and 22 nd November. The public can find out further information and feedback their thoughts and views at Responses received so far have been broadly positive. Bedtime Stories Museum of Childhood I opened this latest exhibition at the Museum of Childhood which celebrates Bedtime Stories and how they have sparked the imaginations of children over generations. The centre piece of the exhibition is a patchwork quilt made up of over pieces of work by children and adults and each one inspired by the individual s memories of their favourite bed time story. Great British Live Music Census Group You may recall that the University of Edinburgh recently carried out a census of live music in Edinburgh. This project has now evolved into a study of live music across the UK and the census will take place between March and May Lauriston Castle Takeover Day Pupils from P6 at St David s Primary School became tour guides for the day at Lauriston Castle with support from Living History volunteers and staff from the Council s Culture Service. I was lucky enough to be invited along and experience first-hand the hard work and dedication the school pupils have put into learning about the history of the castle and what life would have been like living in such fabulous surroundings. 4

5 The Takeover Challenge is a celebration of children and young people s contributions to museums, galleries, arts organisations and heritage sites. The initiative is run by the Children's Commissioner for England and takes place in November every year with 44,000 people. Lauriston Castle is understood to be the first and only Scottish venue to participate and the new young staff members will be invited to take part in future public events. Green Pencil Award I was delighted to present the award to Amy Brand from Oxgangs Primary for her poem Amy s Garden as well as to Cara Campbell from Pentland Primary for The Magical Garden poem. The eco-themed literary competition for P4-P7 pupils in Edinburgh is a fantastic opportunity for the children to showcase their writing talents and there was no short supply of budding JK Rowling s for this year s intake. The creative writing task set by our organisers this year had the title Scotland s Glorious Gardens, with the aim of encouraging pupils to think and write about the many gardens, parks and green spaces that we are lucky enough to have, and to enjoy using, here in Edinburgh. Community Access to Schools Edinburgh Leisure have now taken over the management of community access to school sport facilities at James Gillespies High School and Portobello High School. The ambition remains for Edinburgh Leisure to be responsible for community access to all school sport facilities by the start of the 2017/18 school year, including Firrhill High School. City Art Centre autumn / winter exhibition launch I was delighted to open the new exhibitions at the City Art Centre last week. Exhibition no 1: A Sketch of the Universe: Art, Science and the Influence of D Arcy Thompson is the new exhibition on the first floor. Thompson was a pioneering biologist, born in Edinburgh in 1860, whose theories about the growth of organisms had a profound impact on 20 th century art. This exhibition showcases the highlights of the University of Dundee s D Arcy Thompson art collection, featuring over 90 artworks by modern and contemporary artists working in a range of different media. Peter Randall-Page RA: Works on Paper is the new exhibition on the second floor. Peter Randall- Page is a contemporary artist renowned for his sculpture, but drawing has always been an important part of his artistic practice. This exhibition presents a series of recent large-scale ink drawings by Peter Randall-Page, which explore themes of order and chaos in natural phenomena. 6. Pentlands Neighbourhood Partnership The Secretary reported on the seven applications that had been discussed at the meeting of the Funding Panel on 9 November. There had been one partial award, 3 full and 2 applications refused. One application was deferred. A successful application had come from the Friends of Buckstone Park and Woods. They had been granted 1705 to enable them to create a community orchard. 7. Planning and Environment Colin Anderson circulated copies of his report which can be found at Appendix B. He also circulated copies of an update report from CALA. This can be found at Appendix C. Issues highlighted were: 7 LDP Infrastructure Supplementary Guidance papers on planning website; 14 Student accommodation at Lanark Road; 16 Edinburgh Rugby proposals for Myreside; 17 Midmar proposals. Additional matters commented on were The old Royal Bank building was being auctioned with an offer price of 215,000; problems over access to Comiston Farmhouse; Millers, Winton East proposals copy of pre application report requested. 8. Transport The Secretary informed the meeting that the Council had proposed that the further introduction of the remaining 20mph zones be advanced. Further details can be found at: 9. YOUTH In the absence of Margaret Walker the Secretary read over a brief report from her: 5

6 Please put forward my apologies as I am still at work and not likely to get away before 8pm tonight. Unfortunately I don t have the results from the survey at B Muir as the person who was doing the admin for us has been off work ill. On a positive note the numbers have crept back up again and we now have the Revenue grant applications to put forward for the club and the project. If we manage to get the funding we will be able to offer a varied programme and perhaps encourage more kids to come along and join us. I would like to take this opportunity to say thank you to you all for your continued support and I wish you all a Merry Xmas and all the best for the New Year. 10. AOCB Roger West said that 2 other people were required to resurrect the Friends of Fairmilehead Park group. If that is not possible the CEC may see this as there being no interest in the Park. Cllr Aitken said she may have details of a couple of people who may be interested. Andy Lippok gave a brief report on the recent EACC AGM at which the Council Chief Executive had talked about the 2050 vision. There had also been round table discussions. The Chair said he had been the representative from FCC at the meeting and he had surprised that a lot of people did not appear to know about the neighbourhood partnerships. A lot of CCs had few members and sparsely attended meetings. He volunteered to be the community council representative to the EACC and this was agreed by the meeting. Prior to inviting those present to join him for cheese and wine the Chair thanked the Councillors; office bearers, members and those who attended the meetings and extended the compliments of the season to all. 11. ASB / NPS / incidents of note On 16/11/16 bogus workman attended at an address on Frogston Avenue advising of loose roof tiles whilst occupiers went out to get payment for work a quantity of cash was stolen from the property. Please be aware of Bogus workmen operating in the area and make elderly family members and neighbours aware. There has been an increase in Vandalisms in the area, however there is no trend to them and they do not seem connected. 20. Actions Update From Previous Meeting As predicted housebreakings have increased in the end of November please bear this in mind in the lead-up to Christmas and do not make it easy for thieves. 21. FAIRMILEHEAD CC - LIVE FAIRMILEHEAD COMMUNITY COUNCIL Planning Report Tuesday 6 December Demolition of existing buildings, erection of 37 flats, formation of new site entrance and parking area, landscaping works and all other associated works - Comiston Farmhouse, 83 Pentland View Reference :- 16/ 02397/FUL This is the application by Chamberlain Bell Limited which was the subject of a presentation at the FCC Meeting on 5 April As the development has less than 50 units, no formal pre-consultation exercise was required by the Council. Comments required to be submitted to the Planning Service by Friday 8 July The Stage 2 road safety audit is now on the website. This application is still being assessed by Planning Officials. There is no date at present for when a report on this application will be submitted to the DMC. 2. Miller Homes, Land to the East of Winton Gardens, Edinburgh Reference :- 15/02778/PAN Miller Homes now propose to lodge the application before the end of this year. The proposals indicate a development of 87 units, mainly 2/3 bedrooms, some 4s and a limited number of 5s. A public exhibition was held in Fairmilehead Parish Church on 29 November Add a new entrance lobby to existing office building, erect a new bin store and turning circle to the existing office site at Fairmilehead Water Treatment Works, 55 Buckstone Terrace Reference :- 16/05171/CLP Scottish Water propose to carry out some external and internal works to improve the efficiency of the office, and upgrading to ensure safety and adherence to technical standards. I have been in touch with the Agent about this application. B. FAIRMILEHEAD CC PENDING 4. Proposed mountain bike trails and other activities at the former Lothianburn Golf Course Swanston Farms Limited Reference :- 15/00169/PAN Nothing has been heard about this application for several months. a. Fairmilehead Water Works Development DW Homes application for non-material variation to use smooth buff block in lieu of grey eternity cladding Reference :- 14/03091/VAR2 This application lodged on 21 July 2016 seeks approval to change the external finish of the apartment block which is currently under construction at the rear of the Charwood. This finish of smooth ashlar stone is what has already been used on the houses in the development. I have been in touch with DW Homes about this. There is ongoing correspondence between Planning Officials and the applicant on this application. 5. SESplan The SESplan was published on 13 October 2016 and the 6 week period for representations ran from then until 5 pm on Thursday 24 November A preview version of the Plan and the accompanying documents had previously been available to view at SESplan are now reviewing all the representations made and will report on these in C. 11 In July 2016 the Council served an enforcement notice on the owners of the Charwood restaurant requiring them to remove 2 signs from the ground in front of the building which had been erected without the required consent. An appeal was lodged by the owner but this was rejected by a reporter appointed by Scottish Ministers in a decision letter dated 25 October (Both signs have now been removed.) 7. Edinburgh Local Development Plan (LDP) Scottish Government Appeals Division Reference: - LDP The Examination Report was approved by the Planning Committee at a meeting on 5 September The LDP as modified was published by the Council on 16 September 2016 and notified to Scottish Ministers. Those who made representations in 2014 were also notified, but there was no provision to make responses or representations at that stage. Scottish Ministers confirmed in a letter dated 9 November 2016 that the Council could proceed to adopt the LDP in his letter the Minister made a series of comments providing feedback on the timing and content of the LDP and related matters. Some of the comments were critical the Council have prepared a response which will be considered by the Planning Committee at its meeting on 8 December. The LDP was adopted by the full Council on 24 November It is the first plan of its kind for Edinburgh. The LDP is accompanied by a statutory Action Programme which requires to be prepared within 3 months a draft will be before the Planning Committee on 8 December. There will also be various pieces of Supplementary Guidance one of these relating to Developer Contributions and Infrastructure Delivery will also be before the Planning Committee on 8 December. All documents can be seen on the Council website. D. CONSULTATIONS EDINBURGH 8. New Meadowbank Sports Centre and Masterplan : pre-planning consultation Early in 2017 the Council intend to submit a planning application for a new sports centre to replace the existing Meadowbank Stadium and Sports Centre. The new sports complex will provide a modern, fully accessible high quality sports centre for sports clubs and the local community. It will also include a 400 m running track with a stand for 500 spectators. The new centre would be partly funded by selling part of the existing site. Areas of the site would also be transferred to the Council s 21 st Century Homes to provide affordable housing. A Masterplan will be submitted with the aim of gaining planning permission in principle. More details can be found on the Council website. The consultation opened on 10 November and closes on 31 December There is an on-line survey which can be completed with comments etc. E DEVELOPMENTS EDINBURGH and MIDLOTHIAN 9. Following that, other parties to the appeal will have the opportunity to comment on the statements of the appellant and the Council. The Council and the appellant will then have a final opportunity to respond the deadline is 13 December. The reporter will then consider the responses of all parties. He is currently minded that oral procedure will be required in this case; a final decision will be made on that once the exchange of responses is completed. Planning Officials have recommended the application be refused. 10 reasons are listed, e.g. within green belt, damage to character and appearance of the area, contrary to non-statutory Student Housing Guidance. 15. Extension of driving range facility and associated landscape works at Braids Hill Golf Centre. Reference :- 16/05082/PAN This is a resubmission of a previous application (10/03332/PAN) and a previously approved planning permission (12/00161/FUL expired August 2015). Display boards showing the proposals can be seen in the Golf Centre until 31 December A public meeting was held in the Golf Centre on 16 November A report on the forthcoming application will be before the DMC on 7 December. 16. Erection of 2 temporary spectator stands and ancillary facilities including TV gantry, hospitality marquee, portable food and drink units, portable retail marquee and portable toilets at Myreside Stadium for Edinburgh Rugby. Residential development comprising demolition of 2 houses and the erection of 2 residential buildings comprising 9 flats in total, with associated amenity space parking and services at 32 and 34 Midmar Drive by Midmar Developments Limited References :- 16/05444/FUL; 16/05445/FUL and 16/05626/CON These 2 applications (and the associated one related for demolition) are for a site located near the almost 90 degree bend in the road where Midmar Drive becomes Hermitage Drive. The site faces the Hermitage of Braid and Blackford Hill Local Nature Reserve. It is located at the edge of the Morningside Conservation Area. The 2 bungalows to be demolished were originally constructed as staff accommodation for the former care home at 15 Hermitage Drive, an imposing Victorian Villa. One of the proposed buildings will have an underground car park coming directly off the street. The deadline for comments is 16 December There is considerable local opposition to these applications. 18. Forthcoming application by Edinburgh University at former Royal Infirmary Site, 1 Lauriston Place. This proposes a change of use and conversion of the category A listed surgical building and the category B listed gatehouse, boundary and forecourt to provide an educational facility for the University. The gross floor area of the proposed development is circa 20,000 sqm, which includes 5,000 sqm of new build accommodation. Reference :- 16/04490/PAN This proposed development is out for consultation at present. There are no details of the specific alterations proposed at this stage.
