Laying a paper before the Parliament is an official way of bringing the attention of the Parliament to particular publications. The process for laying documents is set out in Chapter 14 of the Parliament s Standing Orders. In many cases the documents listed will have been laid before the Parliament because they require parliamentary scrutiny, for example Scottish Statutory Instruments which require the approval of Parliament. In other cases legislation may require that documents such as the annual reports of certain public bodies be brought to the attention of the Parliament. Other publications may be laid before the Parliament too.

2 How to use this fact sheet There are three kinds of laid paper listed in this fact sheet: Documents not subject to any parliamentary procedure. Most of these are Scottish Government, Scottish public body or UK government publications. Also listed are Scottish Statutory Instruments that are not subject to any parliamentary procedure. Affirmative instruments. These are statutory instruments that require the approval of the Parliament before coming into force or remaining in force. The lead committee must recommend to the Parliament either that it approves the instrument or not. Some instruments are laid under the super-affirmative procedure. This is the general title for a group of procedures prescribed by some acts. The procedures differ in each case but are all variants of draft affirmative instruments. Negative instruments. These are made (i.e. signed by the minister) before they are laid and come into force 21 days after being laid. To prevent a negative instrument coming into, or remaining in, force, a member must lodge a motion to annul it no later than 40 days after it has been laid.
