2 Introduction The Colonias Infrastructure Fund Board (CIFB) was established by the Legislature in 2010 through the enactment of the Colonias Infrastructure Act ( the Act ). The statutory purpose of the Colonias Infrastructure Board is to help address inadequate infrastructure in Colonia-recognized communities as provided for in the Colonias Infrastructure Act, NMSA 1978, Sections that has resulted in poor social, health and economic conditions. Using the resources provided through the Colonias Infrastructure Project Fund, the CIFB will support the planning and development of infrastructure in an efficient and cost-effective manner for projects that improve quality of life for Colonia residents and encourage economic development. As of September 30, 2014 the CIFB was comprised of the following voting and non- voting members: The Colonias Infrastructure Fund Board is comprised of 12 members Seven (7) voting members and Five (5) advisory, non-voting members Voting Board Members Mr. Doug Moore, Appointee from the Minority Leader of the Senate (CIFB Chair) Mr. Oscar Butler, Appointee from the President Pro Tempore of the Senate (CIFB Vice Chair) Mr. Orlando Jimenez, Appointee from the Speaker of the House of Representatives Mr. Jim Grantner, Appointee from the Minority Leader of the House of Representatives Mr. Robert Coalter, Chief Executive Officer of the NM Finance Authority (Treasurer) Dr. Tom Clifford, Cabinet Secretary of the Department of Finance and Administration (Secretary) Mr. Ryan Flynn, Cabinet Secretary of the Environment Department Advisory, Non-Voting Members Mr. Jay Armijo, Executive Director South Central Council of Governments Ms. Priscilla Lucero, Executive Director Southwest New Mexico Council of Governments Mr. Hubert Quintana, Executive Director Southeastern New Mexico Economic Development District Mr. Steven Kopelman, Executive Director New Mexico Association of Counties Mr. Jay Czar, Executive Director New Mexico Mortgage Finance Authority 1

3 Definition of a qualified colonia as defined in the act: A rural community with a population of 25,000 or less located within 150 miles of the United States-Mexico border that: Has been designated as a Colonia by the county or municipality due to: Lack of potable water; Lack of adequate sewage systems; Lack of decent, safe and sanitary housing; and Has been in existence as a Colonia prior to November Colonia communities must provide documentation to the Colonias Infrastructure Board that supports the designation by the municipality or county. Working in concert with the Colonias Infrastructure Project Fund Rules, policies and processes, the CIFB will prioritize projects for financial assistance from the Colonias Infrastructure Project Fund. In 2010, the CIFB established rules, by-laws, and policies to aid in the effective management of the the colonias program. Goals of the Colonias Infrastructure Fund Board are: Set standards for funding based on need, community impact, and feasibility utilizing sound business practices; Establish criteria for the prioritization of projects based upon health, safety and welfare; Support the public health and economic vitality of colonias in New Mexico through comprehensive planning and investment in infrastructure; Encourage participation in regional efforts to collaborate on long-term solutions with other community water systems; and Continue to work with federal agencies to fund and co-fund multiple colonias projects within those respective jurisdictions as established by federal guidelines. In developing this comprehensive framework for project prioritization and readiness, the CIFB provides guidance to agency staff and applicants regarding suitability for financial assistance from the Colonias Infrastructure Project Fund. 2

4 Colonias Infrastructure Fund Pursuant to the act, the Finance Authority may make loans and grants awards from the Colonias Infrastructure Fund to qualified entities for projects prioritized by the CIFB on the terms and conditions established by the Finance Authority. By statute, six types of projects may be funded from the Colonias Infrastructure Fund: 1. Water infrastructure 2. Waste water infrastructure 3. Solid waste infrastructure 4. Flood and drainage control 5. Road infrastructure 6. Housing pre-development infrastructure The CIFB seeks to strategically prioritize and package infrastructure projects that make the best use of local, state, and federal dollars and provide beneficial infrastructure that will have a positive impact on the quality of life for colonias residents. 5 In addition to the above list of eligible projects, the planning component is crucial to the success of any infrastructure project. The CIFB has developed and implemented a process for funding planning requests to assist communities with the planning phase of the project. La Mesa Colonias Community Water Tank The CIFB continuously strives to develop an efficient process for entities to apply for funding and complete much needed infrastructure projects that have a positive impact on the standard of living for those colonias residents. Annually, the Finance Authority staff will conduct application workshops for the public targeting the southeastern, south central and southwestern areas of the state. This is an in-depth review and instruction to all entities on the application process, requirements for eligible entities and projects, and loan/grant structures and all the rules, policies, and processes of the Colonias Infrastructure Fund. 4

6 Doña Ana MDWCA Inter-connecting water systems - extending waterlines to serve additional residents 2014 Funding Cycle For fiscal year 2014 the CIF had $14,235,640 available for awards. The application process opened on January 02, 2014 and closed on March 14, The NMFA received seventy-seven (77) applications for a total of $40,351,172 in funding requests. Forty-three (43) projects were recommended for funding from the Colonias Infrastructure Fund and four (4) additional projects were funded from USDA and BECC/EPA funds. The NMFA allotment of Senior Severance Tax Bonds (5%) was $14,235,640. The USDA amount of available funds for the projects was $6,851,765. The Border Environmental Cooperation Commission EPA Program was $3,585,521. Total funding for 2014 from all programs was $24,672,926. 5

Town of Silver City Town of Silver City Grant Roads/Drainage $489,623 Construction of Phase II street and drainage improvements on Silver Street from Pine Street to South Lamb Street. Dona Ana County Las Palmeras Dona Ana Roads/Drainage $209,292 Construction of 1,100 ft. of roadway that will connect the community to Shrode Road. Catron County Alma Catron Roads/Drainage $749,202 Road and Drainage improvement to Mineral Creek Road. Due to flooding last year and during the rain season the road becomes impassable. Grant County Rosedale Grant Roads/Drainage $692,133 Complete Construction of Rosedale Road Lower Rio Grande PWWA Mesquite/Brazito Dona Ana Waste Water $540,608 Design phase of Mesquite/Brazito waste water infrastructure to tie into the Dona Ana County trunk line. Design collection system and lift stations. City of Bayard Replace 60 year old 4" pipe with new 8" waterlines providing Bayard, Hanover, Grant Water $125,000 $946,600 adequate water supply to approx. 400 homes. 10 Summary of the Colonias Infrastructure Fund for 2012 through 2014 funding cycles FY 2012 In fiscal year 2012 the CIF had $13,207,965 available for awards. Forty (40) projects were recommended for funding. Seven additional projects were funded from USDA and HUD/CDBG funds. The NMFA allotment of Senior Severance Tax Bonds (5%) was $13,207,965. The USDA amount of available funds for the projects was $4,572,540. The Border Environment Cooperation Commission (BECC) EPA Cap Grant was $8,200,000. The Department of Finance through their CDBG-HUD Program was $368,863. Total funding for 2012 from all programs was $26,349,368. FY 2013 In fiscal year 2013 the CIF had $16,640,011 available for awards. Thirty-seven (37) projects were recommended for funding. Five additional projects were funded from USDA and HUD/CDBG funds. The NMFA allotment of Senior Severance Tax Bonds (5%) was $16,640,011. The USDA amount of available funds for the projects was $7,365,000. The Department of Finance through their CDBG-HUD Program was $992,897. Total funding for 2013 from all programs was $24,997,908. FY 2014 In fiscal year 2014 the CIF had $14,235,640 available for awards. Forty-three (43) projects were recommended for funding. Four additional projects were funded from USDA and BECC/EPA funds. The NMFA allotment of Senior Severance Tax Bonds (5%) was $14,235,640. The USDA amount of available funds for the projects was $6,851,765. The Border Environmental Cooperation Commission EPA Program was $3,585,521. Total funding for 2014 from all programs was $24,672,926.
