22 Rental Pool Agreement Q. What is the purchaser return? A proportionate share of the gross room revenue from the rental pool units based o listed price of their unit. Can the purchaser live/ reside in the unit? es, but a limited stay. In the first two years, 10 days during the high season (Nov ays during the low season (the remaining months), and thereafter a standard 1 ach year. the privileged stay period (PSP) is not used the unit will be operated as part of the active r he Purchaser will receive compensation for the unused days. The seasonality (high and low) y the operator on a yearly basis during the budget submission period.

What will happen if the hotel operator fails to secure a reasonable profit for the un eyaar has agreed with the hotel operator to specific performance tests, which if n consecutive operational years Deyaar may replace the operator. Q. Can the purchaser finance the hotel apartment? Yes, a hotel apartment in the rental pool can be financed by banks just as any othe units after a certain completion threshold. Q. If the hotel apartments are making a loss or in case of adverse market condition Purchaser required to contribute towards the loss? No, a Purchaser will not be required to bear any loss as the Purchaser s return is una costs and expenses of the hotel. However, Deyaar or the Operator may terminate t program and Deyaar will then return the unit to the Purchaser.

27 Rental Pool Agreement. Can the Purchaser sell his/her unit while it is in the rental pool? es, the new owner of the unit will have to enter in the similar SPA and RPA and will alike to the original purchaser. A sale, however can only take place after at least purchase price is paid to Deyaar as part of the off-plan payment plan.. Can the Purchaser exit the Rental Pool? es, subject to payment of compensation for loss of revenue to both Deyaar and the operator at the rate of AED 70 per square foot of the unit area.. Will Purchaser be charged service charges? o, since they are covered from the 60% of the gross rooms revenue retained by Dey therefore will not be charged to the purchaser. However if the purchaser exits the then service charges become payable directly by the purchaser.
