In keeping with the County Mission Statement to provide reliable infrastructure and quality services that are responsive, innovative and cost effective. Grand County Road & Bridge feels that it is important to the people and visitors of this County to have recreational access to public lands for recreational use from County Roads. With the approval of recreational Snowmobile use on designated roads to access public lands, Grand County Road & Bridge would recommend acceptance of OHV use on roads that would allow this same access. 16 Exhibit - 6 LARRY IVY PO Box CR 451 Granby, CO Alan Green Safety Coordinator Grand County Road & Bridge Dear Mr. Green: This letter is to follow up on our conversation of March 23 rd and to request to be placed on the Grand County Commission Agenda to request that the OHV restriction on CR 451 be removed. There are about 10 residences on CR 451. The owners have used OHV s on this short dead end road to visit each other and to help when needed for many years. I was recently made aware that it was unlawful to do this. I don t know of anyone on 451 that would object to the removal of this restriction. Thank you for helping me resolve this problem. County Road 451 does not access any public lands. There are no adjacent roads that allow OHV use to connect to public lands. County Road 451 dead ends at private property. I would like to hear comments from the public before making my recommendation.

There was a request to prohibit OHV traffic from using CR451 several years ago due to people racing around the private property, opening gates to pastures, chasing horses, driving up private driveways,and hunting on private property without permission. We have lived in this area for 32 years and as a resident on CR452 we would like to request that they BOCC be informed of our concern and to please deny this request. If it is open to one person and the sign is taken down then the increase in traffic on our narrow dirt roads will become open to anyone driving in our area. Several years ago a family who purchased a large 11 acre property and home requested that they be able to ride their ATV s up CR4 to the National forest. That request was granted and now there are as many ATV s on CR 4 as cars and trucks. They come from the many vacation rentals that are located in Colorado Angler subdivision. It is my understanding that family that had made the original request to longer rides their ATV s. Proving that if you allow 1 you will get more than you expect. We appreciate you taking the time to consider our request and hope that you will deny OHV traffic on CR 451 and we hope that you might also consider the banning of OHV traffic on CR 4. They are unlicensed and drive with children riding with them, speeding and are reckless, they have no safety equipment and have no concern for legal traffic on the road. I regret that my previous commitments kept me from making comments during the comment period. Regrettably, I have to be out of state on the hearing date as well. Our neighborhood (includes CR 451 & 452) formed the Stillwater Fire Abatement Coalition (SFAC) in 2001 a 'not for profit' entity with the Colorado Secretary of State. We formed this coalition as an avenue to network, obtain funding and bring about positive change through the years to our area (Stillwater/Bunte Small Tracts) with its close proximity to the Arapaho National Forest. We have met many challenges and helped to facilitate change at the county and federal levels for our area. Currently CR 451 is designated as 'OHV prohibited use' due to riders coming from the National Forest. It would be reversing progress and erasing measurable positive outcomes to the neighborhood to see this designation changed for the motivation of one vs. the good of many. Here are some concerns/comments that the BOCC should be aware of before a decision is made to include County Road 451 as a designated 2016 OHV route. Some safety concerns - As private landowners along CR 451 & CR 452 we are concerned for the safety of our children, horses and pets with increased OHV use. Trespassing and/or parking of OHV's on private property/drives. OHV riding at night. OHV riding at high speeds. Reckless OHV riding. Racing of OHV's side by side on CR 451/452. Near collisions with cars/equipment. Litter along CR 451 & 452 from OHV riders including tossed lit cigarettes, broken glass, ammo. Harassment of wildlife by OHV users. All the above have been witnessed in the past. The OHV use will not be contained to CR 451 it will also occur on CR 452 as they share the same turn off County Road 4 and past experience has shown this to be true. Past OHV use off CR 451 & 452 created 'pioneered trails' (trails not maintained or authorized by USFS) onto the national forest. Riders/Hunters on OHV's trespassing on private property looking for ways to access the national forest. Illegal use of OHV's on private property. Damage from OHV use on private property. The increased noise level from OHV use on CR 451 & 452. There are two vacation rentals properties - one located on CR 451 the other on CR 452, guests at these rentals properties believe they can ride around the neighborhood. We remind them of the sign posted on County Road 451 of prohibited OHV use and they comply, they go to the designated trails on the national forest (which is.02 mile away from the intersection of CR 451 & CR 4). Without that sign, not sure the outcome would be the same. There will be an increase of riders from the national forest again on CR 451 & 452 without that sign/designation. 1

32 Exhibit - 13 Many neighbors have refrained from calling law enforcement in the past with OHV incidents, as budget cuts have limited the departments ability to respond to non emergency calls. That should not to be interpreted as not having had OHV incidents off CR 451 & 452. We are witnessing a change in the mind set of some visitors to grand county and the national forest that unfortunately can encompass a uncaring mentality and a 'as we want/please' attitudes. That is both alarming and frightening. We all chose to live here for various reasons, among them to escape the 'rat race' and to enjoy our beautiful surroundings/environment. Fire mitigation and insurance: many of us on the private road 452 abutting the National Forest have recently had our long- standing homeowners' insurance cancelled because of us being in " a hazardous fire zone". We are consequently having to get high- risk insurance at an extremely high rate. In addition, although we have paid extra to be a subsidiary of the Grand Lake Fire District, our fire chief, Mike Long, feels that we indeed are in a fire- challenged mitigation area. We have witnessed otv "guests"throwing lit cigarette butts and starting raging, unattended campfires. ( Our neighborhood has for the past several summers been on patrol to report similar findings to the sherriff's department, since they lacked adequate personnel to attend multi- daily to such patrols.) B. Invasion and Damage to our private property-- although we have posted more than a dozen"private road and property signs" and pay heftily for our own road improvement and plowing, many OTV completely ignore our warnings, invade our properties,and tear up our costly road and driveway systems. Several OTVers have illegally camped out at our vacationing next door neighbors claiming they were friends. They weren't, and caused a ruckus when at our neighbors' request, we asked them to leave. c. Safety-- as recorded in your own records-- several years ago 3!hunters shot and bagged elk illegally on 451, grazing a resident's front porch, and sped off before the overworked game warden could answer our complaint. In addition, 3 years ago, a band of 4 drunken OTVers broke and entered into my house at midnight claiming " they were just lost.". Luckily, my quick- thinking son was here visiting, and averted me having a heart attack. It appears that some OTVers consider our private property rightfully theirs too-- obviously a wrong concept. D. Hazard to our children and pets : many otvers drive recklessly fast, with frequently unattended young people hellbent to race at unsafe speeds and who are also unaware of our difficult winding roads. They provide a threat to the wellbeing of our children and pets, and our strolling neighbors who have a right to walk our private roads and paths. We pay more than adequate taxes and private road maintenance funds to prevent such injustice to our safety and well- being. E. inadequate funding to provide adequate and constant patrol by all of the agencies involved to protect the rights of the citizens who have heavily vested interests in living on 451 and 452 -and do not want- nor expect our rights to be violated by many, who do not even live in our county much less understand our concerns for safety from invasion, fire, theft, and accidents and general risk. We have experienced many of the exact issues that Mandy Hanifen has expressed to you in person or in writing. But our main concern is the trespassing of our property by OHVs, whether ATVs or snowmobiles and running over newly regenerated or planted trees, scaring our horses and dogs, and in some instances scaring wildlife such as deer, elk, and moose, or simply motoring across our property as a given right. As an example, just last year, a renter drove his snowmobile across our property and our neighbor's, which included two driveways, one residence and two address signs a good quarter of a mile, because the road had no snow on it. When my wife later confronted him about it, he said he had a right to, because it was open land. We have had them even drive up our lane, looking for a shortcut to the national forest. We have lived here since 1994 and there hasn t been a year that either we or our neighbors haven t confronted OHV trespassers. My wife is concerned that when she comes out of our lane on horseback that an OHV or OHVs come roaring around the curve or over the hill not realizing there is someone on horseback coming onto the road. The current prohibition to drive an OHV on CRs 451 and 452 is frequently violated. How does the county propose to regulate its use when the violators are long gone before the law arrives. I am a resident on CR 452. I have seen numerous OHV's using these roads already, even though it is clearly marked that there is no access to national forest property and that no OHV's are allowed. Most areas of the national forest are accessible from CR 4 and the Glen Idle staging area. I have personally had to inform numerous people that they cannot park anywhere on private property or leave their vehicles on the travelled portion of the roadway while they go 4 wheeling. Also, there is no legal way for riders to get from the Glen Idle staging area to CR 451, because CR 4 is not an OHV approved road. My family and I have had numerous close calls over the past few summers with OHV's and not following the laws that are all ready in place. I can only see things getting much worse if the reigns are let loose in this area. Again, I would like to reiterate that the national forest is accessible without much restriction via CR 4 staging area. Also, a majority of CR 451 & 452 are private roads, and not maintained by the county. Added that OHV traffic to the private roads would add a larger cost to maintain. The road follows Stillwater Creek which flows down from the National Forest campground just above the last home on our road. You can t access the campground or National Forest from the road but people try or give up and drive through the meadows between the road and the creek. There is no reason CR 451 should be singled out for OHV use and in fact it should be just the opposite because of its proximity to the National Forest. Homeowners on CR 451 and CR 452 are not the people who use ATVs on these roads nor are they the ones asking for such use. If people wish to ride their ATVs in this area they have miles of trails within the National Forest designated for just such use and that is where they should ride. I would propose a NO OHV BEYOND THIS POINT sign be placed on CR 4 at the exit from the National Forest and then another similar sign at the beginning of CR 452. We should then allow OHV operation on CR 451. This would strictly limit the OHV traffic on CR 451 to those who live on CR 451 because there would be no way to access the road from CR 4. My concerns below were because people came out of the National Forest snowmobile staging area and came down CR 4 and then up CR 451. I feel if people were originally banned or at least discouraged to leave the National Forest on their OHV it would go a long way to alleviate the concerns of those on both CR 452 and CR 451. Without a sign upon exiting the National Forest onto CR 4 that traffic will continue on CR 4 not just to CR 451 but well beyond. It is a fact those of us who live on CR 451 (we have been residents for 21 years) have and do use OHV to visit and help our neighbors and I would like to see that continue. This solution would prevent possible auto/ohv collision problems on CR 4 and at the same time ease the concerns of traffic from the National Forest onto CR 451 and CR 452. I believe this solution best addresses the concerns of everyone on CR 451, CR 452 and those further down CR 4 who are affected by OHV traffic coming out of the National Forest. There are plenty of OHV trails within the National Forest so there is absolutely no need for those people to leave the National Forest on their OHV. However, individuals on OHV s have been finding routes around this gate on the private lands and perhaps in other areas. I m unaware whether this OHV use is with the permission of the private land owner or not. Fortunately people can access the nearby Idleglen Parking Area beyond the end of County Rd 4, to access a large legal and well maintained network of OHV trails and roads on the NF. County Road 451 was used by my parents, local ranchers, and residents since Stillwater small tracks was plated in My wife and I have been users and full time residents here since we purchased our lot from my mother s estate in We have had very few problems on 451 with OHV users and those were handled by talking with the individuals or by county law enforcement. Our application to reinstate CR451 for OHV use would not change the current designation of CR452. The existing sign could be moved to CR452 if those residents want to restrict their road. The worry that National Forest users would invade the community is not valid. Coming from the National Forest there are signs posted on County Road 4 stating NO OHV s BEYOND THIS POINT. Additionally, last year when I requested a sign at the entrance to CR451 indicating there was NO NATIONAL FOREST ACCESS Alan Green, Safety Coordinator for Road & Bridge, posted the sign for us and since then we have only experienced one problem with forest users. County Road 451 has always been used by residents with OHV s to visit and help each other. Only recently have we been made aware that this was no longer allowable.
