1 SUMMER 2014 JOHNSON S ISLAND NEWS Yo u r i s l a n d c o n n e c t i o n Dear Islanders, Have you enjoyed your summer so far? Those who have owned here awhile can usually tell where the new owners live, as the number of cars and guests visiting is so high the first few years, until the owners are exhausted! Welcome to all and enjoy creating your memories. Would you kindly keep your dogs on a leash? One of our athletic islanders was knocked off her bike when a friendly dog charged at her. Contusions, bruises, and a wrist brace later, she s back on the saddle again so please keep your dogs in your yard. Our JIPOA membership reached 150 out of 198, or 75.7 %. We expected and budgeted based on 150 members, so we are thrilled and thankful that you decided to join. In addition, we sent out our second and final invoice for our road fees on June 13, and as of June 26, we have received payment from 146 out of 191, or 76.4%. If you haven t done so yet, please mail your road payment right away. One important item to note: No obstructions, such as boulders, stones, or artwork are to be placed in the Right of Way (ROW) of our roads, which is defined as within 30 of the edge of the road. Please be sure to remove any items in this space as soon as possible, and read the minutes for more news. Most of you received a letter from David Bush regarding the Friends & Descendants of JI Civil War Prison. The Mayor of Marblehead, Jackie Bird, received one from F & D s attorneys, Barger & Anderson, Ltd., letting her know the F & D plans for building on the property, mentioning their disagreement with the city s interpretation of agreements and variances of the past. The Mayor has turned this information over to the Marblehead Solicitor and the Planning Commission/Board of Zoning members for their review. Some of our islanders have written the mayor and me expressing their displeasure about the F & D s plans to develop the property. You are invited to send the Mayor your thoughts at jbird4@roadrunner.com to express your support or disagreement with David Bush s project. We know we have islanders who have financially supported F & D, so we do have varying opinions on this topic. The Memorial Day Parade was a huge success with over 21 golf carts, one tractor, and eight cars patriotically decorated driving around the island. I counted over 120 homes with people watching the participants. What a tradition, especially having John Englebeck driving the fire truck and sounding the horn since about Thank you all! This past weekend Jane Eble organized our first ever Craft Fair held at the clubhouse. Attendance was good, and we thank all those participating. 2 John son s I sla nd New s Pa ge 2 JOHNSON'S ISLAND PROPERTY OWNERS ASSOCIATION Trustee Meeting Saturday, June 6, 2014 Attending: Wayne Mohler,, Karen Gannon, Ed Ibos, Mike Ibos, John Good, and Todd Kroehle. Gary Zdolshek, Vickey Carey, Erin Shine, and Bob Castele were excused. Karen called the meeting to order at 9:00 am. Road Commission: A recent incident occurred at the toll gate when a motorcycle attempted to pass through without paying the toll. The gate came down and struck a women, requiring several stitches to her chin. After initially claiming and reporting to the Marblehead Police that they had paid the toll and that the gate malfunctioned, they recanted after the video was reviewed. It can be seen on Youtube at youtu.be/ogdi3ajtdkk and Todd commented that this was certainly an effective method of determining responsibility and should be used to curb abuses of the trash dumpsters. To date over 140 property owners have paid the mandatory road fees. A second mailing will be made to 51 past due property owners, so a more accurate figure will be available for next month s meeting. The Trustees wish to thank all who have paid. Membership: The latest figures from Gray show participation in the voluntary association is approaching the association s goal of 150 members, with a fair number still expected to join. The Trustees extend sincere appreciation for all the Property Owners who have shown their support of the association and confidence in its future. Island Water: A meeting has been set for 10:00 AM, Saturday, July 19 at the JIPOA Clubhouse to allow Bob Boytim of the Marblehead Board of Public Affairs and Chuck Hall of CT Consultants to present information about the feasibility and cost of bringing public water to the island from Marblehead. All islanders are encouraged to attend this meeting as it can have significant impact on everyone who owns property here. Trash: Plans are under way increase enforcement of the trash rules. Also, Danbury Township will have large dumpsters available at the township hall from July 21 through July 25. See News, Notes, & Notices. Friends and Descendents: The Friends and Descendants group has mailed a letter to the Johnson s Island Community regarding their plans for the 17 acre dig site. As there are islanders with differing points of view about the matter, JIPOA will not officially approve or disapprove of any plans. However, the association will help in circulating any news about the issue in the hopes of preventing any misinformation from having an effect on the issue one way or the other. Executive Session: Karen moved the meeting into executive session to discuss the association s current legal issues which include the lingering effect of the Cianciola vs. JIPOA litigation decision and the association s options regarding non-payment of the road fees by some property owners. Johnson s Island Road Commission Minutes of Quarterly Meeting Johnson Island Clubhouse Saturday, May 9, 2014 In attendance: Dave Klugman, Mike Kelty, Glenn Beachy, Lou Cardinale, Jim Erickson, and Kevin Kirkpatrick. Rick Schulz was absent. The meeting was called to order by the president, Mr. Klugman. Regular Business: Dave opened the meeting with a discussion of the recent Causeway and Bridge repairs. Most of the work has been completed. Remaining work on the road includes the gravel shoulders, and center lines. Rip- rap repairs to abutments, and epoxy coating of abutments, will be performed later in the year. Work performed included the removal and replacement of road base in approximately 20 damaged sections of roadway, removal of asphalt from the 5 bridges, repair of mild damage to one beam, new membranes on all bridges installed to drain water away from the abutments, new drip edges on the bridges, and then the placement of a new asphalt top coat on the complete causeway including the bridges. The estimated cost of this work is $170,000 to $180,000. The addition of extra work found to be necessary during construction accounts for the uncertainty. Road repairs will be completed on several sections of Memorial Shoreway within the next few weeks. All road work is scheduled to be complete before the Memorial Day Holiday. It was noted that more permanent reconstruction of sections of Memorial Shoreway cannot be performed unless Drainage Agreements are negotiated with property owners in the most critical low- laying stretches of roadway. The poor condition of the roadway in these areas is primarily due to poor drainage. Continued on page 5...

Unfortunately, a woman was hurt when the gate came down on her. She filed a police report that claimed the gate malfunctioned and wanted reimbursement for medical expenses. Fortunately for the Road Commission, the whole incident was caught on tape which proved their claims to be totally false. Check it out on Youtube at: and spaces in front or behind.) (Enter letters only to browser with no ************************** Danbury Township Big Dumpsters: The BIG dumpsters will be at Danbury Township hall, 5972 E. Port Clinton Eastern Rd.. July 21 through July 25, for residents to dispose of household items, appliances, steel and metal. We will pay for Freon removal from appliances. Employees will be on hand from 7 a.m. to 7 p.m. Monday thru Thursday and on Friday from 7 a.m. until the end of clean-up at 11 a.m. They will assist you as you unload your vehicle. DO NOT bring tires, brush, oil, paint, batteries, boats, vehicles or propane tanks. Scrapping for metal is PROHIBITED and will be enforced by the Danbury Township Police Department. <<<<<<<<<<>>>>>>>>>> PLEASE READ THIS! : Recently, an islander was riding her bike around the island when a big unleashed dog came bounding towards her. Not knowing if the dog was friendly or not, she tried to avoid it and fell off her bike. Luckily, she only suffered cuts and bruises and didn t break anything. Please keep pets under control, even if they are friendly. This incident turned out ok, but could have been much more serious. THANK YOU! Public Water to Johnson s Island You are cordially invited by the Village of Marblehead to attend a meeting on July 19, 2014 at 10:00 AM. Meeting is to be held at the Johnson s Island clubhouse. The meeting will be advertised by the Village of Marblehead as a Special Water Dept. Board Meeting, to discuss the possibility of bringing City Water on to Johnson s Island. The meeting will be conducted by Robert Boytim, Director of Marblehead Water Department, with Charles Hall from the Engineering company contracted by the village. This will be a great opportunity for everyone to hear firsthand, what the Village of Marblehead has in mind, what the possibility is, and how it would be funded. The meeting should last about 1 to 1.5 hours we are estimating. All residents and especially property owners are invited, and encouraged to attend if possible. We value your time, presence and participation. Time will be allocated at the end for Q&A.

5 John son s I sla nd New s Pa ge 5 Cart Thieves Once again, a golf cart was taken from an island property owner and damaged beyond repair. This time, the cart was driven off the marina cliff into the water. It occurred early Sunday morning, June 8th. The Marblehead Police have a number of suspects and are actively working on the investigation. If you have any information, please contact them at Continued from page 3 The two road cuts near the Dock parking area were discussed. One has been repaired at JIIG expense. JIIG is also responsible for the other repair. It was noted that several homeowners have placed large rocks immediately adjacent to the edge of the roadway near their driveways. This is in an apparent effort to discourage motorists from driving off the edge of the road and on to the edge of their lawns. While this may be understandable, it is dangerous, and could result in liability to the homeowner if a car is damaged by such an obstruction. These rocks are in the road Right- Of- Way, in what should be a shoulder area of the road. This shoulder area should be free of obstructions, except for possibly mailboxes in the JIPOA areas. We understand that shoulders are not in good condition in many areas, but we are restoring them in new sections of road. Meanwhile, obstructions should not be placed in this area. It was noted that the JIPOA roads have a 40 ft. wide ROW, and the BHOA roads are platted with a 50 ft. wide ROW. This is considerably wider than the road surfaces. Following this discussion, the following motion was moved, seconded, and approved by a 6-0 vote: Obstructions or improvements shall not be placed within 30 of the edge of the road surface. Please see a Road Commission member if there are questions about this issue. The gate report was presented by Lou. Through May 3, receipts were $1,905. This is approximately $730 less than was collected in 2013 through this date. A copy of this report is posted on the web site. Gate down time due to repairs accounts for most of the reduction of fees collected. The Treasurer s report was presented and is on the web site. There are adequate funds available for the causeway and road work being performed. There would also be funding available for an additional road project of $40,000 or so, due to there being no major projects last year. However, if no projects receive the necessary drainage agreements, these funds will be carried to next year. The reserve fund for the causeway was $80,000 at the end of There was discussion as to whether this fund needs to be maintained at this level, given that we now know the bridge beams, abutments, and causeway roadway are in good condition. If it is drawn down, perhaps to $50,000, those funds would be applied to the causeway work being completed now. This would reduce the General funds required, freeing those funds for other work. Seeing as no additional road work is now planned, no decisions were made as to changes in the causeway fund at this time. A report was received that both Home Owners Associations are billing separately for road fees, and the initial payment of 50% of the fee has been received from each HOA. JIPOA reported that they would likely use Small Claims Court, not Liens, if collection action is required. Kevin reported that RC funds have been received from everyone involved in the Metzger suit and he will pursue disbursement to JIPOA. There was discussion of the need to prepare the 2015 budget. 6 John son s I sla nd New s Pag e 6 Dear Islanders, Every new season brings issues with JIPOA s trash facility. Abuse has been consistent while enforcement has not. Due to the nature of the voluntary membership of JIPOA, the association is taking a stronger stance to protect the investment of its members and reduce the unauthorized use of the dumpsters. New signs will be posted in the area indicating the nature of the violation and its legal consequences which include fines of up to $500 and 60 days in jail. The Marblehead Police have indicated their support for our actions. JIPOA s trash policy is a simple combination of three points. First, the dumpsters are for the exclusive use of JIPOA members who have paid the $350 dues invoice in full that was sent out in January. No partial payments for membership or individual association benefits were accepted. The association does not have the resources to monitor or manage a buffet style membership. Property owners were asked to either join in full or refrain from using the associations amenities including the trash service. Second, the dumpsters are intended for regular household trash. Prohibited items include tires, flammables or combustibles, construction or remodeling debris (whether it s from a contractor or the property owner), oil based paints, yard waste (everything from grass clippings to felled trees), and major appliances. Other items may be added if they are found to be a problem. And third, if it s not securely in the dumpster, it doesn t belong there. The truck drivers are not required to get out of their trucks to pick up loose trash. Leaving trash outside the dumpster is not only disrespectful to other members, but especially to those who pick up after their neighbors as if they were little children. It also occasionally costs the association money to have Mark Shortridge pick up large items. Also, the side doors of the dumpsters should remain closed at all times. When left open, raccoons and other animals can easily enter the dumpsters creating a mess and causing health concerns. Please try to keep the dumpsters closed. The signs to be made up will be as follows: Unauthorized use of this trash area is ILLEGAL DUMPING under ORC and is subject to fines of up to $500 and 60 days in jail. Violators will be cited by the Marblehead Police and prosecuted by JIPOA. JIPOA TRASH RULES 1. JIPOA Members Only 2. Household Trash Only. No: Tires, Flammables, Oil Based Paints, Construction Debris (Private or Contractor), Yard Waste, Major Appliances. 3. All trash is to be placed securely in the dumpster.
