1 12/14/10 Regular Trustees Meeting Zoning Inspector Report 1. Zoning Approvals: a. None 2. Zoning Compliance: a. 10/14/10 - Contacted Tim Shetter / Metroparks for update on building removal from 4150 S Berkey Southern; i. Contract for removal of buildings was re-written for 3'd time to include removal of buildings on other properties; ii. Contract has been signed with contractor, 4150 S Berkey Southern will be a priority for earliest building removal. b. Melvin Spencer, 6335 Jeffers; i. 8/31/10 - Wrote to John Borell asking if a notice placed in a newspaper of general circulation would constitute serving of Trustee notice of possible action on junk vehicles in yard; ii. 9/2/10 - John's response: "Yes, you must publish it in a newspaper of general circulation(blade or Legal News) AND post the notice on the main structure located on the property." iii. 10/8/10 - Legal notice provided to Trustees for action at 10/12/10 regular meeting; iv. 10/26/10 - Field report including pictures provided to Trustees. v. 11/3/10 - Requested legal opinion from John Borell re: entering private property to take pictures to develop a case to allow Trustees to remove junk vehicles; 1. 11/5/10 - John Borell asked if entering property was only way of obtaining pictures, responded that is was /8/10 - John Borell issued legal opinion - "This will confirm our telephone conference regarding entering a property to take pictures of junk cars. It is my suggestion that you ask permission of the property owners if someone is home. If permission is denied, do not enter the property. However, I understand that it appears that no one is living on the property on a regular basis. If no one is home, take the pictures from the driveway." 3. 12/5/10 -Joe Zielinski met zoning inspector at property and walked the driveway as witness while new pictures of vehicles were taken. Another vehicle was located behind a building at the end of the driveway. c. Towner Property, Archbold Whitehouse Road; i. I called various scrappers in the area to see if any might be able to help Mrs. Towner remove the house trailer, here are the results: 1. 9/7 /10 - No additional information or progress. 2. 9/29/10-10/5/10 - Multiple attempts to contact for update, no response; 3. 10/8/10 - Zoning violation mailed.
2 4. 10/18/10 - Mrs. Towner came to Zoning Commission meeting, discussion about what options she had, suggested she come to Trustees meeting 10/26/10 and tell Trustees what she was able to commit to and seek direction from Trustees /26/10 - Ms. Towner spoke to Trustees about current situation, that person has been hired to dismantle and remove one trailer but requires surgery and recovery prior to starting work, other trailer cannot be removed until new building is erected for material being stored inside; a. Trustees stated Ms. Towner should contact Zoning Inspector on a regular basis to update progress. b. 12/6/10 - No contact from Mrs. Towner, attempted to call multiple times, no answer, letter written to remind of agreement with the Trustees (attached). d. 9/2/10 - Complaint on burned out house at 4647 S. Berkey Southern relayed by Trustee Tippie; i. 9/3/10 - Owners are Lester and Judith Sparks, not current phone listing or address, property taxes have not been paid in over 18 months; ii. 9/7/10 - Google search does not provide any information on owners. iii. 9/20/10 - Mailed first class letter asking for contact to speak about potential zoning violation; iv. 9/26/10 - No response yet, will send certified letter. v. 10/9/10 - Certified letter sent vi. 10/18/10 - Received USPSconfirmation certified letter was accepted at address delivered to, no response from owners of record. vii. 10/25/10 - Called by Randy Sparks, son of owners, stated his parents intended to remove the house, but were not financially able to do so at this time; 1. Mr. Sparks was told that a zoning violation will probably be issued, his contact and information were appreciated. viii. 12/9/10 - Randy Sparks reported the family has contracted to sell off timber from property to raise money to demolish the burned out house, current lowest bid is $2,000; 1. Lowest bid requires the concrete blocks from foundation be buried on the property, requesting If there are any restrictions to doing this. 3. Zoning Request a. 11/1/10 - Walters Travel Trailer, Airport Hwy., new sign; i. 11/1/10 - Called by Harmon Sign for updated sign zoning, Walters Travel Trailers intending on installing message center sign; ii. 11/2/10 - Provided by complete current text of township zoning resolution sign language. iii. 11/29/10 - Harmon Sign reported that due to financial issues Walters Travel Trailers will not be installing message center sign, but will be replacing sign with similar sign, will request zoning permit when sign is ready for installation.

Berkey Southern 9/3/10 - Owners are Lester and Judith Sparks, no current phone listing or mailing address, property taxes have not been paid in over 18 months; 9/7/10 - Google search does not provide any information on owners. First class letter sent 9/20/10 asking for contact to discuss. No response as of 9/26/10. 10/9/10 - Certified letter asking for contact mailed. 10/18/10 - Received from USPS 9/2/10 - Complaint on burned out acceptance card for certified letter delivered to 4661 S Berkey Southern. Same house at 4647 S. Berkey Southern 10/22/10 - No response. 10/25/10 - Call from Randy Sparks (son) stating parents relayed by Trustee Tippie; intended on removing house, but did not have financial means to proceed. Mr. Sparks told a zoning violation would most likely be issued. 12/9/10 - Randy Sparks reported family is selling off timber from property to raise money to demolish house. Lowest bid is $2,000 and will require concrete blocks be buried on property, asking if there is any restriction against doing this. In process 12/9/10.

Well and septic already mitigated, house will be Metroparks legal counsel voided boarded up and drive cabled along with No Trespassing signs pending removal of 4150 S. Berkey contract for removal of buildings Metro parks Same buildings in September Verified house is secured and driveway cabled Southern due to illegal language, must be re 8/17/10. 10/14/10 - Spoke with Tim Shetter, Metroparks re-wrote contract for bid. 3rd time to include additional buildings on other properties, 4150 S Berkey Southern will be priority on list of buildings to be removed. In process 10/14/10. Towner Property Attempted to contact multiple times by phone for update 9/29/10-10/5/10. Zoning violation mailed 10/8/10. Mrs. Towner and son attended Zoning Commission meeting 10/18/10, discussed the zoning violation. Suggested that she attend the Trustees meeting on 10/26/10 and present a reasonable plan to Melvin & Archbold - Zoning request for modular home bring property into compliance. 10/26/10 - Ms. Towner attended Trustees Susan Whitehouse to replace mobile home. meeting, Trustees said as long as there was progress toward a plan to become Towner Road compliant they would be satisfied and that she should update Zoning Inspector regularly. 12/6/10 - No contact from Mrs. Towner as agreed to with Trustees, attempted multiple times to contact by phone, no response. Reminder letter sent. In process 12/8/10.
5 8/23/10 - Certified letter returned by USPSafter 15 days of attempting to deliver. 8/30/10 - Sent to John Borell asking if legal notice in newspaper of general circulation would constitute being served by Trustees. 9/2/10 - John's response: "Yes, you must publish it in a newspaper of general circulation(blade or Legal News) AND post the notice on the main structure located on the property." 10/4/10 - Inspected property again, talked to neighbor, Mr. Spencer has been at property "several times" recently, but is apparently living elsewhere. Inventoried vehicles for legal notice. 10/26/10 - Presented field report including pictures of Anonymous complainant vehicles in question to Trustees. 11/3/10 - Requested legal opinion from John contacted Fiscal Officer, multiple Borell if it is legal to enter private property to take photographs for junk vehicles vehicles in yard. No phone Melvin Spencer 6335 Jeffers Same to build case for Trustee removal. 11/5/10 - Borell asked if property was vacant, number listed for owner Melvin responded that owner is in the area, but not living at property. 11/8/10 - John Spencer, house appears to be Borell's legal opinion - "This will confirm our telephone conference regarding vacant. entering a property to take pictures of junk cars. It is my suggestion that you ask permission of the property owners if someone is home. If permission is denied, do not enter the property. However, I understand that it appears that no one is living on the property on a regular basis. If no one is home, take the pictures from the driveway." 11/15/10 - Joe Zielinski offered to assist Zoning Inspector in obtaining photographs of junk vehicles. 12/5/10 - Joe Zielinski accompanied zoning inspector as witness for obtaining new pictures of junk vehicles. In process 12/5/10.

Cleaned up down tree on Wilkins Rd. Worked on the cemetery records with Delores. Picked up trash in the cemetery. Filled the pick up with gas. Met with the electrician about the light placement on the cemetery building. Worked with Connie on the computer program for the cemetery records. November 23, 2010.:. Did a complete sign inventory. Swept Townhall and shop office. Swept dead bugs out of the bathrooms. Set up traffic control for the electricians to run wires up the electric pole. Met with Milt Keener to touch base with neighboring Township. Worked on the cemetery records with Delores. November 24,2010.:. Checked all roads. Picked up trash in the cemetery Got Kevin dialed in and ready to go. Worked on cleaning the cemetery building. Worked on the cemetery records with Delores. Got the salt spreaders mounted on both trucks. Picked up,trash at Franklin cemetery. November 25,2010.:. Holiday November 26, 2010.:. Holiday November 29, 2010.:. Picked up trash and flowers in the cemetery. Mounted new cutting edge on the big plow. Mounted wear bar on the big plow. Washed the big truck and cleaned the truck bays. Worked on cleaning the cemetery building. Worked on the cemetery records with Delores. November, :. Did payroll for Kevin. Worked on repairing the door openers. Picked up cutting edges from Kalida Truck. Mounted both plows and put away extra cutting edges. Worked with Connie on the cemetery computer program. December 1, 2010.:. Checked Scott, Shaffer, and Brindley Rds. For snow cover. Met with Providence Twp. to get crack sealer back and store in the cemetery building. Finished repairing the door openers. Lubed and adjusted door openers. Worked with Connie on the computer program.
7 December 2,2010.:. Put lifting hooks on the grave thawer. Checked on a basin grate on Co. Line. Met with Tim from Swancreek Twp. about basin grate. Replaced basin grate on Co. Line. Worked on cleaning cemetery building. Worked on cemetery records with Delores. Bought shop supplies from the hardware. December 3, 2010.:. Met with electrician to put up security light. Cleaned junk off of the walls in the truck bays. Checked all roads and did a sign inventory. Loaded scrap metal from cemetery and shop and took to M&k Metals. Worked on cleaning the cemetery building. Worked with Delores on the cemetery records. December 6, 2010.:. Salted icy roads,scott, Shaffer, Brindley, Soul, Reed, and Whitehouse-Spencer. Worked on organizing the cemetery building.cleaned the trucks interiors. Met with an oil additive salesman. Rearranged file cabinets in the shop. December 7,2010.:. Salted the roads in the southwest corner of the township. Sold a grave for Mary Williams. Dug the Williams grave. Continued cleaning and organizing the cemetery building. Moved the mowers to the cemetery building. December 8,2010.:. Loaded Providence Twp blade and the chipper and took to Providence Twp. Salted all of the roads. Mounted our scraper blade on the J-D Worked on the cemetery records with Delores..'1. December 9,2010.:. Checked north end roads for snow cover. Removed and ordered heater cable for the pickup. Sanded and painted bumper on the pickup. Loaded big dump with salt for snow tonight. Cut up tree that was going to fall across Manore Rd. Painted front wheels of the pickup. December 10, 2010.:. Plowed and salted all of the roads and the cemetery. Worked on painting the wheels on the pickup. Had the Williams funeral. Worked on the cemetery records with Delores. Picked up repair parts for the pickup.
