2 Souvereignity and Air Navigation Service Provision The meaning of Souvereignity Sovereignty is understood in jurisprudence as the full right and power of a governing body to govern itself without any interference from outside sources or bodies. Chicago Convention, Law Scholars, Bible,... Beyond international law what does Souvereignity means for your country and in your regional context? In any case it is a great good, it must be upheld and defended, it means rights and obligations.
3 Souvereignity and Air Navigation Service Provision The meaning of Air transport and ANSP Air transport is the most recent mode of transport. It is the gift of the 20th century to the world. The two world wars gave a great impetus to the development of air transport in almost all the countries of the world. The peculiar characteristic of air transport is that is does not need a specific surface track for its operations. It has no physical barriers as in the case of other mode of transport. Political boundaries are also immaterial although it has to observe the requirements of the International Law. The supreme advantage of air transport lies in its quickness. Air transport connects the countries of our world and its citizens in a way that was never before possible. Air transport can boost collaboration amongst states and the respective economies It is the fastest mode of transport. But the cost of its operation is very high Air Navigation Services are an essential part of the Air Transport System and play a crucial role in ensuring a safe, orderly and efficient conduct of Air Traffic and in guaranteeing a continuous improvement of an efficient airspace management.
4 Germany became fully souvereign Gemany gained Souvereignity with the second Deutschland Vertrag on May 5th 1955 (ratified on 23. Ocotober 1954) with some reservation kept up by the Allied Nations. E.g. Paris Treaty Art. 5 (the right to deploy froces to the territory of Germany) The Treaty on the Final Settlement With Respect to Germany (two plus four agreement) paved the way for the German reunification on October 3 in Germany became fully sovereign on 15 March 1991.

7 Sovereignity and Air Navigation Service Provision Are they mutual exclusive? Sovereignity is a great good, it must be upheld and defended, it means rights and obligations. Air sovereignty is the fundamental right of a sovereign state to regulate the use of its airspace and enforce its own aviation law. Air sovereignity or the integrity of the national airspace is (usually) monitored and protected by the national forces - in extremis by the use of fighter aircraft. The importance of an effective and efficient Air Transport System and supporting Air Navigation Service Provision for the economy, groth and prosperity of a country cannot be overstated. Beyond that an entire region can very much benefit from a seamless cross border organisation of the Air Traffic Management System.
8 Sovereignity and Air Navigation Service How do the two together? What are the obstacles? Provision A competition is often seen amongst the organizations that have responsibilities with regard to the use or the management of the rare ressource National airspace. (Who has the priority? Who has the way of right?) Often national airspace is understood or even divided into so called Military Airspace and Civil Airspace, often for execlusive use. The Air Force is the most important executive body or organization when it comes to question of monitoring and protecting the integrity of the national airspace und must be ready for that (Training). High performance fighter aircraft and ground to air systems need huge training areas to train in order to keep up and further develop the required readiness posture. Air Navigation Services play an important role in supporting national objectives e.g. in the area of tourism economy or the transport sector as such. Increasing demands in civil aviation require more capacity and a more flexible use of the common often rare resource, the National Airspace. The prevailing political framework, a volatile security situation, specific national security or commercial interests, crises or war may disrupt or limit that these two can go hand in hand.

10 FABEC States Agreement Functional Airspace Block Europe Central (FABEC) Treaty was signed on December 2 nd, Objective is to create a single FABEC airspace, being understood as one continuum. 10
11 Functional Airspace Block Europe Central (FABEC) DFS is part of FAB Europe Central (FABEC). FABEC is a collaboration of seven civil and three military ANSPs. FABEC is one of the busiest and most complex airspaces in Europe: FABEC has 60% of all European air traffic. The FABEC Treaty, which was ratified as of 1 June 2013, is the formal basis for this collaboration. 11

14 Conclusion Souvereignity is a great good and will remain a precious asset which must be upheld, defended and carefully treatend. The importance of an effective and effiecient Air Transport System and supporting Air Navigation Service Provision for the economy, groth and prosperity of a country cannot be overstated. A robust and on trust based civil-military collaboration is crucial for the upheld of the required readiness posture of the forces and the desirable high and safe performance of the ATM/ANS System and key to success. (A cross national border initiative needs also a good Civil-Civil and Military-Military Collaboration) Almost irrespective of general or specific conditions prevailing today, at least at national level an efficient and trustful cooperation and continuous improvements are feasible.
