(Behind 311 and 313 Broadway St and 248 Tennessee Ave AB2936) As required by the Ordinance, staff has reviewed the application from Hightime, LLC, Timothy S. and Brenda H. Regan, and Sandra T. Colquitt by J. Michael Dover, Attorney, for abandonment of a portion of the unopened alley right-of-way between St. Simons Heights and Forest Park s/d (behind 311 and 313 Broadway St and 248 Tennessee Ave), as shown on the attached application and map. a. SOURCE OF TTLE: Prescriptive easement based on recorded subdivision plat of St. Simons Heights, dated December 12, 1925, recorded deed book 3U, page 150. Alley width is 18.5 feet. b. PRESENT USE OF RGHT-OF-WAY: This section of right-of-way is currently not being used for public access. c. PAST HSTORY: To the best of staff s determination the alley has never been opened to the public nor maintained by the County d. POTENTAL USE N THE FUTURE: This portion of the alley could be used for access to adjacent property and to access and contain utilities. e. BENEFT TO PUBLC N CONTNUNG USAGE: The public will continue to benefit from the ability to use this alley for access and/or utilities f. BENEFT TO PUBLC N ABANDONMENT: Abandonment would return the property to the tax digest.

6 ATTACHMENT TO APPLCATON FOR ABANDONMENT OF ALLEY ADJONNG MAP AND PARCEL NUMBERS ; ; This request is to abandon portions of an unused alley running north and south between Broadway Street and Tennessee Avenue on St. Simons sland. The portion of the alley which is the subject of this application is now wild and overgrown with yards extended into a portion of the alley to the south and a portion of the alley already officially abandoned behind the property immediately to the north (315 Broadway Street). Hence the alley is inaccessible and has apparently never been used to provide governmental or utility services. The alley in its present state is a nuisance and harbors wild life which is an incompatible use for the adjoining homeowners. The proposed future use would be to add the 9 1/4 feet (representing 1/2 of the width of the alley) to each adjoining property owners yard. The square footage to be added to 311 and 313 Broadway Street would be square feet each. The amount of square footing to be added to 428 Tennessee A venue would be approximately The subdivisions involved are St. Simons Heights and Forest Park.
