3 This area committee calls for an update on the proposed upgrading of the pathways at the shops on Fassaugh Avenue. The Report to outline the reason why such bins have not yet been provided and the timescale for their provision 3907 That the Manager refer to the planning permission that has been granted by the City Council for the Bakery Site at Cross Guns Bridge, Phibsborough Planning Reference No 6818/07 and issue a report on the following matters in relation to access to and egress from the Site a) ownership of the site access road off Phibsborough Road which would appear to be a private roadway and arrangements to be made to accommodate those owners of adjoining apartments who have purchased parking spaces along this road and b)details of the location of the 2 access/egress points along the northern site boundary Motion in the name of Councillor Mary O Shea That the Manager issue a Report on progress being made in the provision of playground equipment to Mount Bernard Park, the Report to indicate when such equipment will be provided That the Manager arranges to have the lane at the rear of Cremore Drive, Glasnevin resurfaced 3911 Motion in the name of Councillor Mary Fitzpatrick The elected members of the Central Area Committee are concerned over the increasing parking problems in Dalcassian Downs, Tower View Cottages, Philomena s road, Clareville, Claremont and the Willows. We call on Dublin City Council to review the situation and make suggestions on how the problems being caused by commuter parking, workers and visitors to the cemetery and attendees at Croke Park can be addressed. The elected members wish DCC to acknowledge that they do not support the creation of an on-street car park on the Finglas Road in Clareville Green. Such a development would significantly detract from the area and dramatically alter the local environment that residents, the Finglas Road Action Group with the Cemetery Committee and DCC have worked hard over many years to develop Motion in the name of Councillor Mary Fitzpatrick The elected members of Dublin City Council call on the executive management to give a detailed report on what actions have been taken by DCC over the last year to commence construction of senior citizen housing on the grounds of the Precious Blood church and to advise specifically what is causing the delay Motion in the name of Councillor Mary Fitzpatrick The elected members of the Central Area Committee believe that Family Planning Information should be freely available to everyone and we call on the HSE to release adequate supplementary funding to the Irish Family Planning Clinic on Cathal Brugha 4

5 Street to allow them provide essential and at times crises medical services to medical card patients. Recognising the fact that it is common practice for male GPs not to provide a comprehensive family planning service we call on the HSE to advise the members how it intends to provide comprehensive family planning services in a sustainable way in the coming years to the people of Dublin Central 3914 Motion in the name of Councillor Mary Fitzpatrick The elected members of the Central Area Committee call on the Minister for Education to register Educate Together as a patron of second-level schools as a matter of urgency, and to facilitate families who wish to exercise their right to choose a second-level school with Educate Together's specific ethos Motion in the name of Councillor Mary Fitzpatrick The elected members support the request from the residents of Liscannor Road to introduce restrictions on vehicular access to the road from Killala Road so as to prevent the kind of rat running that is occurring and that has resulted in another child being seriously injured. The Central Area Committee request the executive to meet with Patient Services at the Mater hospital and to report back on what protocol and/or process can be established between the hospital and DCC to improve the processing of applications. 6

7 Tuesday 9 th September, 2008 at 2.30 p.m. in Council Chamber, City Hall, Dublin 2 MINUTES 3823 Minutes of the Central Area Committee meeting held on 8 th July, 2008 ORDER: Agreed Questions to the Area Manager 3825 With reference to European Local Democracy Week Order: Presentation noted With reference to an update by the RPA on Metro North. Order: Update noted. Agreed that the RPA will include the Councillors s for updated on Metro North, Lines C1 and D and that the RPA return to the Area Committee Meeting in six months for a further update With reference to flooding in the Central Area. ORDER: Martin Ryan Engineering gave an update on flooding in the Central Area. A document was given to all members at the City Council meeting. There are three areas in the Central Area that will be assessed over the coming weeks - Glendhu/Cabra/ Blackhorse. The Members pointed out that there was a lack of communication with residents and they did not know who to contact there needs to be a leaflet drop in the Central Area with the procedures for dealing with floods and a full list of contacts. Members were concerned that gullies were not cleaned out in the Central Area and this contributed to the flooding. There was a lack of availability of sand bags Members stated that it was agreed after the 2002 floods that sand bags would be available in public parks but they were not available when needed. It was agreed that contact would be made by area staff with the owners of flooded houses not previously contacted by DCC. It was agreed to defer any meetings with resident groups until the Engineering Department has produced it s report on the proposed works. It was agreed that a group should be set up within DCC to specifically deal with flooding. 7

With reference to Enforcement Report for Q2 of 2008 for the Central Area 3836 Planning Applications Application No: 3938/08 Applicant: A.B Properties Location: 'Hendron's' Building, Located To The East Of The Junction, Of Western Way & Dominick Street Upper, Also With Frontage Onto, Palmerston Place And Bounded By, Rear Gardens Of 1-5, Palmerston Place Dublin 7 Proposal For development of a mixed use scheme on a site of hectares, approximately, principally identified as the site of the 'Hendron's' building, located to the east of the junction of Western Way and Dominick Street Upper, Dublin 7. The site is bounded to the north and west bt Western Way, to the south by Dominick Street Upper and to the southeast partially by Palmerston Place and partially bt the rear gardens of nos. 1-5 Palmerston Place. The site contains a stone wall, which is a protected structure (Dublin City Council RPS no. 8682), extending along the site's boundary with Western Way. The overall proposed development will consist of: the demolition of the existing building on site (3,130 sq.m) and the construction of a mixed use scheme with a total gross floor area of 11,466 sq.m. The proposed development ranges in height from 8

9 single storey to 14 storeys over 1 no. basement level and comprises: 48 no. residential units (5 no. 1 bedroom apartments, 33 no. 2-bedroom apartments and 10 no. 3 bedroom apartments); 4 no. live/work units (3 no. 3 bedroom live/work units and 1 no. 4-bedroom live/work unit); 32 no. apart-hotel units (2,505 sq.m); offices (1,532 sq.m), a neighbourhood shop (675 sq.m); an artists gallery/studio (511 sq.m) and restaurant (334 sq.m). The proposed development also comprises works to the existing stone boundary wall (RPS no ) fronting Western Way (which will be retained and incorporated into the proposed development), including the creation of openings in the wall of various sizes to form pedestrian entrances to the development, and the removal of the existing ashlar stone piers, plinth and cast iron railings to Upper Dominick Street. The proposed development comprises 3 no. building elements arranged around a central landscaped courtyard at ground floor as follows: The first element comprises a block ranging in height from 4 to 14 storeys extends from site's south-western corner at the junction of Western Way and Dominick Street Upper to the site's southern corner at the junction of Palmerston Place and Dominick Street Upper. This element will comprise a neighbourhood shop at ground floor level (657 sq.m); offices extending from ground floor level to fouth floor level inclusive (totalling 1,532 sq.m); 20 residential units extending from first floor level to fifth floor level inclusive (5 no. 1-bedroom apartments, 10 no. 2-bedroom apartments, and 5 no. 3-bedroom apartments); a restaurant at fifth floor level (334 sq.m) and 32 no. apart-hotel units extending from sixth floor level to thirteenth floor level inclusive (totalling 2,505 sq.m). The second element is a primarily residential block ranging in height from single storey to 6 storeys and is located to the north of the first element. It extends along part of the western site boundary fronting Western Way. This element will comprise 15 no. residential units in total extending over each floor level (12 no. 2-bedroom apartments, 3 no. 3-bedroom apartments); 4 no. live/workunits extending from ground floor level to second floor level (3 no. 3- bedrroom live/work units, 1 no. 4-bedroom live/work unit); and a gallery/studio facility at ground floor level (511 sq.m). The third element is a primarily residential block with a height of 5 storeys (with a partial set-back at fifth floor level nearest the existing residences to the north of the site) which extends along part of the eastern site boundary fronting onto Palmerston Place. This element includes 13 no. residential units in total spread over each floor level (11 no. 2-bedroom apartments and 2 no. 3- bedroom apartments). The development also includes 1 no. basement level principally comprising: 68 no. car parking spaces; 60 no. bicycle parking spaces; plant rooms; private residential storage; and bin storage. The proposed development will provide pedestrian access/egress points along Western Way, Dominick Street Upper and Palmerston Place. Vehicular access to the basement level will be provided from the site access road off Palmerston Place. The proposed vehicular access arrangement will involve reversing the existing one-way circulatory regime along Palmerston Place so that all traffic must enter at Dominick Street Upper and exit at Mountjoy Street. In addition the section of Palmerston Place between the proposed access and Dominick Street Upper will be opened up to two-way traffic. The proposed development will result in the removal of 7 no. existing pay and display parking bays along the western kerb line of Palmerston Place. The proposed development also includes changes in level; boundary treatments; all hard and soft landscaping; balconies and terraces; vehicular access points; internal roads and pathways; pedestrian access points; site services and all associated site development works above and below ground. Registered Date: 1 st August, 2008 ORDER: Presentation noted. Councillors comments can be summarised as follows; (a)traffic will have huge implications. (b) The site should have been within the Phibsborough/Mountjoy Area Plan. (c) The height of the development is unacceptable in this location. 9

10 (d) An apart-hotel would not be suitable accommodation for this area. Member s recommended that the application be rejected. Reply: Weed removal will be scheduled for paving at Church Terrace within the next few weeks. Q2 Councillor Christy Burke To ask the Area Manager what progress has been made on the proposed scheme of providing allotments to Dublin City Council tenants. Reply: Q3 Councillor Christy Burke To ask the Area Manager when the house on O Sullivans Avenue will be in the housing stock as it has been vacant since November Reply: This property was purchased by Dublin City Council on 5/06/2008. It was assigned to Towerview Builders on 7/07/2008 for the necessary refurbishment works and is expected to be available for letting early October. Q4 Councillor Christy Burke To ask the Area Manager when the CCTV cameras will be installed at Smithfield. Reply: Dublin City Council has no proposals to install CCTV in the area in question. However the Gardai are carrying out a feasibility study with regard to installing CCTV in this area. Q5 Councillor Christy Burke To ask the Area Manager to have the trees pruned on Clonliffe Avenue. Reply: The replacement of the gutters on this dwelling has been issued to a private contractor, and is expected to be completed within the next few weeks. Reply: This operation has not stopped. In fact two additional vactors/jetting machines are now in use, for the continuing maintenance/cleaning of drainage infrastructure. Q17 Councillor Seamas McGrattan To ask the Manager to have the weeds on the raised footpaths at St. Vincent s Cottages on Blackhorse Avenue removed. Reply: Q18 Councillor Mary O Shea Reply: Q19 Councillor Mary O Shea To ask the Area Manager to say whether there are any plans to resurface the pavements on Iona Villas which are badly in need of repair. 18

19 Reply: Road Maintenance has investigated this matter and shall have any necessary repair work carried out within 6-8 weeks. Q20 Councillor Mary O Shea To ask the Area Manager to provide gates on either end of the laneway at the rear of Newgrange Road, Cabra, to alleviate the problem of anti-social behaviour and illegal dumping. Reply: The laneway in question is in charge of Dublin City Council and a public right of way exists over it. Earlier this year, the Cabra Office received a petition agreed by a number of the residents abutting the laneway to close the laneway. This was followed by a meeting in the Cabra Office with representatives of the residents from both roads to discuss the proposed closure. It was noted the petition didn t include the signatures of all the property owners and that it would take some time to contact them all, as some of the properties are rented. It was agreed in the meantime to ascertain the views of the various services to the proposed closures. The Fire Brigade objected to the proposal on the grounds that closing off the laneway could result in an increase in the response time to an emergency call. Representatives of the residents were informed of this fact on 24 th June In these circumstances the proposal cannot proceed. Q21 Councillor Mary O Shea To ask the Area Manager to arrange to extend the existing double yellow lines on Newgrange Road, Cabra at the junction of Dowth Avenue and to provide double yellow lines on Newgrange Road at the second junction with Dowth Avenue (opposite Annaly Road) to ensure safe ingress and egress of vehicles to and from Newgrange Road. Reply: This matter has been referred to the Traffic Advisory Group and a report will be prepared for a future Area Committee meeting. Q22 Councillor Mary O Shea To ask the Area Manager to have the double yellow lines outside details supplied, removed as they would appear to have been placed there in error. Reply: Q23 Councillor Mary O Shea To ask the Area Manager to confirm when the next collection of junk is scheduled for the Griffith Avenue area and the roads off Griffith Avenue including Lambay Road, Achill Road, Valentia Road, Clare Road, Bantry Road and Arran Road. 19

20 Reply: Q24 Councillor Emer Costello To ask the Area Manager to have the disabled drivers parking space removed from details supplied as the disabled person no longer lives there. Reply: Q25 Councillor Emer Costello To ask the Manager if he will survey the residents of Russell Avenue and Church Road that goes out onto Killane Road. Reply: This laneway is not in charge of Dublin City Council. As such, it is considered that a private, rather than a public right of way exists at this location. It is not necessary, therefore, to go through the extinguishment procedures as set out in the Roads Act, 1993 to have the right of way extinguished, and Dublin City Council would not be involved in this matter. Accordingly, I wish to confirm that the physical closure of this lane-way, being a private lane-way and not in charge of the Roads Authority, is a matter to be agreed by the local residents in full. Planning Permission is not required for the erection of a gate/wall provided it does not exceed two metres in height, in accordance with Class 5, Second Schedule, Part 1 of the Local Government (Planning and Development) Regulations Q26 Councillor Emer Costello To ask the Manager if he would enter into discussions with the residents of the Richmond apartments in relation to resolving the water leakages there and also if he can use his influence with the developer to ensure that the lands are vested in the management company as a matter of urgency. Reply: Q27 Councillor Emer Costello To ask the Manager to report on what efforts have been made to have the owners restore details supplied and if he will ensure that the roof is repaired and that no unauthorised works are carried out there or unauthorised vehicular routes installed. 20

21 Reply: Two members of the Conservation Team visited the site with the owners to discuss further development of the structure bearing in mind the protected status of the building. The owners hope to submit a planning application to develop the building appropriately in the near future. They have been made clearly aware that no development can proceed on site without planning permission. Reply: In the City Development Plan , the zoning of the lands is Z12 where it is the objective - To ensure the existing environmental amenities are protected in any future use of these lands. These are lands, which could possibly be developed for other uses. Where lands zoned Z12 are to be developed, a minimum of 20% of the site, incorporating landscape features and the essential open character of the site, will be required to be retained. A number of uses are permissible in this zone, such as, Cultural/ recreational buildings, Conference Centre, Education, Hotel and Residential. Office and neighbourhood shop are open for consideration. Z12 is a zone where uses not specified in either permissible or open for consideration categories will be dealt with on their merits. Reply: Waste Management Services had extra cleaning done in Auburn Walk including weed removal on Monday 1 st September This walkway is normally scheduled to be cleaned every Thursday after the refuse collection has taken place there. The covert camera has been in operation in Lucky Lane (Carnew Lane). 13 litter fines have been issued in respect of Lucky Lane since January Waste Management (Grange Gorman Depot) are cleaning the lane on an ongoing basis as required. The property, which has an area pf approx 0.24 acres is shown outlined red and coloured pink on Map Index No. PD A section of the property was the former storage area for the Moore Street Traders but is now vacated and the Traders have been compensated. It is proposed to dispose of the City Council s interest in the above site to Chartered Land Limited subject to the following terms and conditions: 38

The Agreement for Lease is not to operate as a Lease and it shall not be transferable save in the case of a Financial Institution which has entered into a mortgage with the purchaser which mortgage must be approved by the Council in writing and must have been entered into specifically for the purpose of financing the purchaser to undertake the development of the site. 8. The purchaser must apply for full planning permission for the approved development within 6 months of the date of receipt of the necessary approvals and consents to this disposal. 9. The purchaser shall build nothing on the said site except the buildings shown on the approved drawings for which Planning Permission is to be obtained. 10. The development shall comprise a mixed-use scheme, which will generally extend to 155,000m² of gross development space. Chartered Land Limited shall advise the Assistant City Manager in the event of the scheme extending beyond this level of accommodation. The proposed lessee shall commence development on the said site within twelve months of receipt of planning permission and shall carry out the approved development in an orderly fashion and workman-like manner. The proposed development must be completed within seven years of receipt of full planning permission. 11. Dublin City Council reserves the right to re-enter the site and resume possession thereof should the purchaser fail to commence and complete the buildings within the specified period or in the event of the purchasers bankruptcy or insolvency save in the case of a Financial Institution which has entered into a mortgage with the purchaser for the purposes of financing development of the site. 12. During the building period and pending grant of lease, the purchaser will insure the buildings against fire and all other insurable risks with an approved insurance company and pay all necessary premiums. The insurance shall be in the joint names of the purchaser and Dublin City Council and will be for such an amount as will provide cover for the full Reinstatement Value of so much of the building as is erected at any time together with a sum for professional fees and removal of debris charges. 39

40 The purchaser shall also indemnify Dublin City Council against any claim for compensation which might/may be made by any party arising out of building works being carried out on the site, or any working areas or any access points thereto. 13. The purchaser shall be liable for all fees, charges or contributions incidental to the undertaking and completion of the proposed development, and all site preparation, development and associated costs incurred in the delivery of the entire completed development. 14. Each party shall be responsible for its own professional fees in this case. 15. The proposed lessee shall satisfy the Council that sufficient funds are available for both the payment of the Capital Premium and the undertaking and completion of the proposed development. 40

41 Planning & Economic Development Department, Civic Offices 7 th October, 2008 The Chairman and Members of the Central Area Committee Proposed Draft Variation of the Dublin City Development Plan Initiation of procedure - Capel Street and Environs proposed Architectural Conservation Area. Proposal It is proposed to vary the Dublin City Development Plan by designating Capel Street & Environs as an Architectural Conservation Area. Capel Street is located on the western fringe of the North Inner City Centre retail and commercial core approximately 0.5 km west of O'Connell Street. The Capel St ACA area is bounded to the North by King Street North, to the South by Ormond Quay Upper and Lower, to the west by the rear of properties that can be accessed from Anglesea Row, Campbell's Court and Mary's Abbey and to the east by the rear of properties that can be accessed from Loftus Lane, Parnell St, Britain St, Jervis Lane Upper, Jervis Lane Lower and Strand Street Great. The proposed variation is attached, and the exact boundaries of the proposed Architectural Conservation Area are delineated on the map accompanying this summary document. Explanation Capel Street is one of the most historically significant streets in Dublin City. The street formed part of an extension of the city north of the river by Sir Humphrey Jervis who built his estate on the lands of St. Mary's Abbey. In 1676 Jervis built a new bridge, Essex Bridge, which established Capel Street as one of the main thoroughfares between the north and south sides of Dublin City. Capel Street was originally planned in the 17th Century for residential use. It formed part of a larger estate known as the Jervis Estate. The north side of the development, by Sir Humphrey Jervis, marked an important point in the history of Dublin's growth, and was the first largescale residential scheme to be executed in a short period of time. Today, the street is distinguished by a vibrant mix of retail uses and at above ground floors a mix of residential uses and specialist functions. Dublin City Council recognizes this importance and will seek the retention, repair, conservation and enhancement of this street. The character of the street is largely defined by its form and scale. The street is long and narrow and is further defined by its tall narrow terraced buildings. There are a variety of architectural styles, periods and uses on the street. The building types range from small early Georgian brick houses (particularly at the northern end) to tall narrow late 18 th and early 19 th century buildings. Ornate late 19 th century commercial buildings are also in evidence on the 41

42 street. The street displays an interesting array of door cases and window designs spanning the 18 Century to today. The key policies and objectives of the Architectural Conservation Area plan may be summarised as follows: - It is the overall policy of Dublin City Council to protect and conserve the character and setting of Capel Street. Through the ACA plan the Council will identify the areas of special character and architectural interest and to manage change in such a way as to preserve that special character. Owners and occupiers of non-protected structures located within the Capel Street ACA should note that the normal exemptions from seeking planning permission pertaining to certain type of developments under the Planning and Development Regulations 2001 to 2007 will no longer apply. There are views and prospects within the City that are considered to be of special amenity value because they define the City adding to its appreciation in terms of its siting and historical development and strengthening its sense of place. The clear view of City Hall from Capel St contributes to the character of the street. The view is visible from the full length of the street with the longest view from the top of Capel St before Bolton St. The view of City Hall on the southside quays is framed by the straight streetscape perspective. It is an objective of the ACA to protect this special view from encroaching development. New shopfronts and alterations to existing shopfronts require planning permission. It is the policy of Dublin City Council to seek the repair and retention of traditional timber shop and pubfronts along with later shop and pubfronts of special interest; including those, which may not be, protected structures. The traditional arrangement of small scale and/or specialist retail units/restaurants and public houses with individual frontage and access onto the street should be respected and maintained. In terms of advertising structures inappropriate signs and advertising structures including those that blacken out and/or obscure extensive areas of glazing shall not be permitted in the window display areas. Careful consideration should be given to the colours used on any advertising structure or signs. Substantial areas of inappropriate garish colours shall not be allowed as the background of any sign. It is an objective the new developments should have regard to the grain and character of the adjacent buildings, which shall include height, massing, proportions and plot width. Excellence in contemporary architecture including excellence and innovation in shopfront design shall be encouraged. Recommendation: The proposed draft variation to designate Capel Street as an Architectural Conservation Area arises following: - Objective H7 of the Dublin City Development Plan (Chapter 10 Heritage) to identify and designate at least eight new architectural conservation areas during the lifetime of the plan. It is recommended that the variation procedure be initiated. 42
