Apologies none. 14/59P Cllr Lane was running late. 2. Declarations of interest 14/60P Cllr Webster declared non-pecuniary interests in NPA 14/10457 Hampton Cottage and NFDC 14/10512 Land at Adlams Plantation. Cllr Spark declared a non-pecuniary interest in NFDC 14/10457, however under the Common Laws of bias and pre-determination he will not speak or vote. Cllr Lane arrived at 7.35pm. 3. Minutes of the last meeting (8 April 2014) 14/61P The minutes of the last Planning Committee meeting on 8 April 2014 were approved and signed as correct. Proposed by Cllr Webster, seconded by Cllr Shand, all in favour (7). 4. Matters Arising 14/62P 13/101P Steve Williams has advised at the end of May he is reviewing how internal updates are reflected on live online cases and he hopes to evaluate their online reporting after that. 14/21P Cllr Lane presented to NFALC in April on our concerns on light attenuation. The attendees were supportive, Date Yates infurred something could potentially be including in planning conditions. He will liaise with David Groom. Cllr Lane to continue to champion this at NFALC and will update the Parish Council in due course. Chairman Planning Committee 1 10 June 2014
2 14/36P - Appeal by Land at Little Pointers 13/98787 for the manege and access track. Clare Ings has advised NPA are still waiting for a date for the site meeting, the appeal decision will come 5-7 weeks after that. 14/55P - Cobley Wood Farm 13/11075 the Clerk has spoken with Richard Natt, their Agricultural Consultant is liaising with applicant s Agricultural Agent. Should amendments be submitted, we will be advised. 14/56P - Tree application by Ibsley Village Hall to removed 55 fir trees. Cllr Stokes briefed the members on the site meeting, of which the end result was the trees will be removed over the next two years with suggested replanting and screening in front of the container, and retention of some of the deciduous trees on the southern boundary. 14/58P Presence of feeding rings at Newlands Farm - Cllr Burtenshaw has chased by and left messages for an update from Steve Avery, NPA on clarification of winter months, however he is on leave until 14 May. She will obtain details for the next meeting. 5. Public Forum none. 6. Development control and TPO applications. Please note: applications are minuted in the order they were discussed, not as per the agenda. 14/63P NPA 14/00216 Hockey s Farm, South Gorley application to vary condition 6 of PP 11/97063 to allow unrestricted opening hours. Cllr Spark asked Cllr Errington to chair whilst he presented this application. Cllr Spark explained this is a request for a variation in the trading hours, the applicant Laura Burrell sent an (forwarded to all members) explaining the reasons why they wish for the hours to be extended. During the discussion the following was established:- - Current trading hours are Mon-Sat 8am-5pm and Sun 9am-1pm. - If application successful, the longest hours the applicant is likely to operate Mon-Sun 8am- 6pm. - The applicant would like the farm shop to be open for locals and visitors alike, and feedback received has been some frustration at early closing. - The alcohol license has been granted, and all staff will receive appropriate training. Cllr Spark proposed to recommend permission under option 1 with delegated powers to the NPA, with the comments that this local shop is a great benefit to the local community, and the opening hours should be fully published. Seconded by Cllr Lane, all in favour (7). Cllr Spark resumed as Chairman. 14/64P NPA 14/00227 Rockford Cottage, Highwood timber cladding; changes to fenestration; porch; reroofing; dormer window to include balcony; reconfiguration of northwest elevation. 3 Cllr Lane reminded the members of the previous application in January 2014, for which the Parish Council recommended refusal due to the excessive glazing, and the NPA also refused it. This application has taken the comments into consideration, there is considerably less glazing which results in a reduction of the size and massing of the property. To the southeast elevation the cat slide roof remains with the dormer being enlarged with a porch feature. (Note: the Planning Officer s briefing note incorrectly states the cat slide roof and dormer being new). Some windows on the ground floor have been changed to doors, and the conservatory will be updated with an orangery roof. There is no increase in habitable floorspace, and the plan is to replace the concrete roof tiles with slate. Cllr Lane proposed to recommend permission under option 3, with the following comments:- - The Parish Council is pleased that comments on the previous application have been taken into consideration; - The Parish Council would like to encourage the applicants to strive to minimise any light pollution from the property by using internal curtains and the installation of PIRs on any external lighting. Seconded by Cllr Stokes. All in favour (7). 14/65P NFDC 14/10457 Hampton Cottage, Mockbeggar Lane single-storey rear extension; cladding. Cllr Errington will chair this application; Cllr Spark has opted to not speak or vote. Cllr Burtenshaw explained the location and showed photos of the bungalow before and after the renovations. She advised this is a retrospective application as the Lawful Development Certificate was refused on a technicality relating to the ridge height and the type of cladding permitted within the Ibsley Conservation Area; the applicant was advised by NFDC that planning permission was required. During discussions it was established that:- - the property has been renamed Kookaburra. - the materials used for the cladding is cedral weatherboard. This is a cement based cladding embossed to look like wood and painted white. - The LDC was refused on the grounds that the rear extension ridge and eaves height, as they exceeded the remit of permitted development. No information was supplied - no information is included on materials used for the extension. - The stable block is not part of this application. Cllr Burtenshaw proposed to recommend option 5, advising the Parish Council are happy to accept the decision reached by the NPA Officers under their delegated powers, since they have the pertinent information about acceptable heights and materials as well as a character map for the conservation area. with the following comments:- - The Parish Council would like to encourage the applicants to strive to minimise any light pollution from the property by using presence detection on any security lights on the external rear lighting and taking into consideration the glazed roof light. - It has been a very difficult decision to make as there is no detailed plan for what is permitted within the Ibsley Conservation Area; - The Parish Council is disappointed to assess this as a retrospective application since preapplication discussions with NFDC would have enabled the applicant to proceed with more surety. 4 Seconded by Cllr Stokes, 5 in favour, 1 against, 1 non-vote. Cllr Spark resumed as Chairman. 14/66P NFDC 14/10585 The Old Church, Mockbeggar Lane use as residential dwelling. Cllr Spark explained the application is to convert the disused church from a business to a residential dwelling. The applicant has lived there for 17 years, and has no intention to change the external structure of the listed building. Some internal stud walling will be erected, with the mezzanine floor becoming a bedroom. The external signage will be removed and the internal monument for John Constable will remain (however no one has called to see it since the applicant has operated her business). Cllr Spark proposed to recommend permission under option 3 with the following comments:- - The Parish Council understand that the applicant intends to keep the internal features and are pleased to encourage this. - The property is not situated in an open space, but as part of a residential community indeed it is on mains gas and water as part of Mockbeggar Lane. Seconded by Cllr Burtenshaw, 5 in favour, 1 against, 1 abstention. Motion carried. 14/67P NPA 14/00218 & Alice Lisle Inn, Rockford replacement extraction unit (00219 is for Listed Building Consent). Cllr Lane showed photos of the existing duct which is located on the flat roof of the kitchen the opposite side of the building to the garden. She explained it is no longer effective and this application is for a slightly larger duct. Cllr Spark proposed to recommend permission under option 1 with delegated powers to the NPA. Seconded by Cllr Errington, all in favour (7). 14/68P NPA 14/00266 Old Chapel, Moyles Court School, Rockford replacement windows (Application for Listed Building Consent). Cllr Errington explained this is a retrospective application for the installation of a chamfered stone sills on the first floor windows (previously approved PP 13/98842) of the Old Chapel flat. Before and after photos were shown of the work. Cllr Burtenshaw proposed to recommend permission under option 3 to the NPA. Seconded by Cllr Shand, all in favour (7). 14/69P NPA 14/00272 McDonalds (Former Little Chef), Picket Post reconfiguration of drive thru lane and other various works to corral, plant area & patio area; erection of 2xCustomer Order Displays with canopies. Cllr Errington showed photos from the entry to the site, taking the members visually through what the site looks like and what this application is requesting to change. Currently, traffic waiting to order at the drive-thru backs up quickly, causing congestion at the entry/exit point of the site. Proposed and existing aerial elevations were shown. During the discussion it was established:- - the application requests the installation of a second customer order display and canopy on existing grass, by widening the single drive-thru lane to two lanes until it continues around the back of the building to the pay 7 collection windows. 5 - The LPG tanks are moving, and tree roots have been protected. The Parish Council noted:- - the living wall of ivy is successful; - rodent protection is being addressed; - every day cars and lorries are parking on the verge immediately adjacent to the A31 (which is not a designated parking area) and also along the white lines of the slip road outside the McDonalds site. The members stated their deep disappointment that their comments on the original application (13/98270) relating to the dangerous implications of the increase in traffic in and out of the site were not taken into consideration, reiterating that the drive-thru is not suitable in a site of this size and this is now being proven. (Original comments from PP 13/98270 noted below for information). The Parish Council feel very strongly that this application raises serious issues about: the impact of the increase in traffic levels and congestion in the area (advised at up to 200 vehicle movements/hr); the narrow visibility splays and relatively narrow width of the site entrance, particularly its suitability for articulated and other large truck deliveries; traffic safety for vehicles exiting the site due to very limited sight line to the west caused by the position of the Shell service station totem; traffic safety arising from the current level of verge parking in the vicinity, and being exacerbated by the increase in visitors to site and McDonald's staff parking - The Parish Council would like the current parking practice to be investigated by Highways and any other necessary agencies to advise land ownership, and whether it is appropriate and safe; Cllr Errington proposed to recommend option 5, advising the Parish Council are happy to accept the decision reached by the NPA Officers under their delegated powers, with the following comments:- - the Parish Council do not believe the additionally requested second customer order display and canopy will resolve the serious problem of over use of the site; - as evidenced by the abundance of dangerous parking on verges and slip roads outside the site, the Parish Council believe this site is not suitable for a drive-thru; - the Parish Council would repeat its request the applicant take steps to minimise and mitigate against accumulative light pollution at this sensitive site; it is classified as E1 - intrinsically dark skies. The Council have made this abundantly clear on all previous applications. Seconded by Cllr Burtenshaw, 3 in favour, 4 against. Motion failed. Cllr Spark proposed to suspend Standing Orders at 9.30pm. Seconded by Cllr Errington all in favour (7). Cllr Lane proposed to recommend refusal under option 4 to the NPA, with the following comments:- - the Parish Council do not believe the additionally requested second customer order display and canopy will resolve the serious problem of over use of the site; - as evidenced by the abundance of dangerous parking on verges and slip roads outside the site, the Parish Council believe this site is not suitable for a drive-thru and thus do not wish to exacerbate the issue by enabling the site to encourage even more traffic to the site ; Chairman Planning Committee 5 10 June 2014
6 - the Parish Council would like to see the highways agency involved in assessing this application as they believe this is now causing a potentially dangerous situation on the approach road adjacent to the site. - given the displays would be illuminated the Parish Council would repeat its request the applicant take steps to minimise and mitigate against accumulative light pollution at this sensitive site; it is classified as E1 - intrinsically dark skies. The Council have made this abundantly clear on all previous applications. Seconded by Cllr Stokes, 5 in favour, 2 against. Motion carried. 14/70P NFDC 14/10512 Land at Adlams Plantation 18m high monopole; equipment cabinet (removal of existing). Cllr Shand explained the location and summarised the application is to increase the monopole to 18m (from 17.4m, not 15m as incorrectly stated in the Planning Officer s Briefing Note) and change the structure slightly so it is wider and more visible at the top. The members viewed the elevations and photos Cllr Shand had taken of this and other monopoles. Cllr Stokes proposed to recommend permission under option 1 with delegated powers to the NFDC with the comment that the Parish Council would encourage steps to be taken to camouflage the monopole. Seconded by Cllr Lane, 6 in favour, 1 abstention. 7. Correspondence: 14/72P The Clerk asked if anyone is able to attend the committee meeting at Ibsley Village Hall on Thursday 15 May at 7.30pm, however no-one is available. 14/73P The Clerk reminded all of the Planning Development session with Steven Lugg on Monday 19 May at the Ellingham Church Hall at 7.30pm. 9. Other Business 14/74P Cllr Webster requested Newlands Farm be placed on a forthcoming agenda to discuss issues of winter feeding, damage to trees and extension of garden. Clerk to action. 14/75P Cllr Burtenshaw advised she is liaising with Rob Storey at HCC on the Bleak Hill application relating to extension of pumping hours, and she will update in due course. 14/76P Chairman Planning Committee 6 10 June 2014
7 Cllr Burtenshaw advised a Lawful Development Certificate has been granted at Lowlands for a shepherd s hut. 14/77P Cllr Errington advised the response deadline for comments on the Cycling Charter has been extended until end of May.
