5 Your Local Agent, ALBA PROPERTY PURCHASING PROCESS This Guide is not intended as a substitute for legal advice or the 30+ pages in our AIPP RICS Approved Guide to buying property overseas you can download that from the download section of our website. Rather,we d like to present you with a more straight forward plain speaking summary of the buying process in Spain and a detailed worked example of all the costs involved this should give you enough of an understanding to proceed until you discuss your purchase with your solicitor. Similar to the process in the UK we recommend making contact with your solicitor prior to making your offer or any commitment. Spending time choosing which property you would like to buy can be interesting but also exhausting when you see how much choice you have. Once you have decided which property you would like to buy, it s critical that you then seek professional advice from an English Speaking solicitor based locally in Spain to make sure your search will be rewarded with a wholly positive result. Alba Property Overseas only works with successful and established developers and we don t allow any high pressure sales techniques. That doesn t mean that we will not act quickly to secure your property once you have made your decision. It does mean that the whole formal buying process will be conducted by your solicitor. We are aware that many agents and developers even bank representatives will tell you that using a solicitor to buy a property in Spain is optional. You wouldn t make a formal offer for a property in the UK without using a solicitor so don t make any offers in Spain without one either! ALWAYS consult your solicitor BEFORE making any commitment or offer. REGARDLESS of any pressure you might feel regarding losing a deal.

6 Your Local Agent, OUR SAFE & SIMPLE PURCHASING PROCESS Select a Solicitor Conveyancing We currently have arrangements in place with a number of solicitors which we are happy to recommend. Each of these solicitors: Similar to the UK, the solicitor will make a series of checks against the property to make sure there are no issues with the title of the property and you are actually buying what you believe you are buying. This process generally takes days so expect to complete (and pay the balance) within that time frame. If the property is still under construction, payment terms vary, but expect to pay the balance over the course of the build with typically a 30% final payment upon completion. Has English Speaking Staff Has multi offices throughout Spain Has experience of purchasing the types of properties in the areas we operate Has an office local to where your purchase will be made (IMPORTANT because in Spain the solicitor has to attend the local notary in person to complete the purchase) Will provide you a quotation prior to starting work for you Of course you are free to use the solicitor of your choice and once instructed, your solicitor will guide you through the rest of the purchasing process. NIE registration / Bank Account / Power of Attorney Your solicitor will help you register for an NIE number similar to a UK National Insurance number. You will most likely sign a Power of Attorney so your solicitor can act on your behalf and they will also help you apply for a Spanish bank account which is also necessary. Reservation Each developer may have a slightly different purchasing process, however it is normal to sign a reservation agreement and pay a deposit to secure your property. Expect this first payment to be 3,000-12,000 dependent on the value of your property. Bank Guarantees If you are making staged payments for a property under construction it is imperative that bank guarantees are sought. This protects your down payments in the case that the developer went bust this has happened many times over the years and we only deal with developers who offer bank guarantees. Notary Once the necessary checks have been completed then the paperwork will be prepared ready for the signing. The title deed will need to be signed at the Notary. If you have given your solicitor Power of Attorney as we recommend they will attend in person and you do not need to.

7 Your Local Agent, COSTS WORKED EXAMPLE BASED ON A 300,000 PURCHASE Solicitors Fee Includes confirming that the seller of the property is the legal owner, checks whether there are any encumbrances or debts on the property which may affect the sale, verifying that the property has all the necessary licenses and authorisations, Preparation of necessary documentation for the signing of the public title deeds and arranging all necessary appointments, accompanying client to Notary and translation of all legal documents, arrangement for the payment of any fees and taxes and for the title deeds to be inscribed in the local land registry. Fixed fee of 1595 IVA Included Additional Expenses These expenses vary depend on a number of factors but should include: Notary Fee, Land Registry Fee, Land Registry Search, Obtaining an NIE number, Possible Power of Attorney, Arrangements for changing utilities and council tax, organising a Spanish bank account, preparation of purchase contract, administration fees, and control of bank guarantees for properties under construction, review of mortgage terms if appropriate. The estimated cost of these additional expenses is 3135 IVA Included Taxes The amount of purchase tax/ IVA for a new property is 10% = 30,000 AJD / Stamp Duty is 1.5% = 4,500 Total estimated purchase cost is therefore 37,635 based on a 300,000 purchase. Alba Property Overseas recommends that you request an itemised quote which will include all these costs and a detailed payment schedule prior to instructing your solicitor. We will ensure that you receive this quote in the case you are considering one of our recommended solicitors. Mortgages Alba Property Overseas can assist with a mortgage application if required. Around 50% of British buyers in Spain purchase with a mortgage. Expect to obtain a mortgage of up to 70% of the property value, dependent on your circumstance. This means you have to have at least your 30% deposit plus any finance fees and all the closing costs. There are also additional notary fees to register the mortgage. Perhaps you should also consider furniture pack costs at this time unless these are included as part of the purchase. That s the hard part over you have now successfully completed your purchase! We told you it would be simple and safe!
