They have put a lot of work into studying and verifying our documentation and test results. Receiving the Type Approval certificate from USCG is the quality stamp that our customers have been waiting for. Investing in Ballast Water Treatment systems from Optimarin is now a risk free investment for the shipowners no more concerns to worry about. 2 Optimarin secures further US BWT orders as USCG approval approaches 2 November 2016, Norway: Norwegian ballast water treatment (BWT) specialist Optimarin has secured a two-system contract with Fincantieri Bay Shipbuilding (FBS) in Sturgeon Bay, Wisconsin. The agreement, which will see two 500 m³/h capacity Optimarin Ballast Systems (OBS) fitted on a single clean products barge, further underlines the firm s segment leadership ahead of its imminent USCG approval. The ability to trade in US waters is key to global shipowners who want flexibility for their fleets, comments Optimarin CEO Tore Andersen. Our success in satisfying all of USCG s stringent testing requirements demonstrates that we are the clear choice for businesses, like FBS valued customers, who want compliant, quality and care-free operations in national waters and beyond. Our system is technically proven, with almost 300 units installed worldwide, and number one for compliance. That is a key selling point for owners and yards that want their vessels to meet all regulatory demands now and into the future. We re very pleased to confirm this latest contract with FBS and hope to announce more agreements with shipowners trading in US waters soon. 2

3 The two new systems will be installed on FBS Hull 785, a 185,000 barrel capacity barge, for delivery in November US convenience retail chain Wawa, which has more than 645 stores (over 365 with petrol forecourts), is the end customer. Alternative Marine Technologies (AMTECH) of Stamford, Connecticut, will control project management and construction supervision, with class by ABS and USCG inspection. Optimarin submitted its final documentation for USCG type approval in late September - a move that John Mauger, Commanding Officer of the Coast Guard s Marine Safety Center (MSC), called an important milestone for protecting US waterways. The firm, which has currently received orders for nearly 500 of its environmentally friendly UV-based systems, expects to hear confirmation of approval within the next few weeks. This, Andersen confirms, is helping drive Optimarin to new heights within the industry: We ve focused exclusively on BWT since our formation in 1994, he comments, so our expertise is second to none and our technology has a proven track record of success. The USCG development is really pushing awareness of our offer onto another level though, with sales up over 200% year-on-year and around 120 systems ordered in 2016 alone. We re having notable successes with yards, like FBS, while our partnerships with global engineering leaders Goltens and Zeppelin, alongside the flexible and modular nature of our system, means we re the first choice in our segments for retrofit. With the recent ratification of the IMO Ballast Water Management Convention this is a crucial time for the industry. We re proud to be in a position where we can help shipowners solve compliance issues, and achieve problem free BWT operation, worldwide. As well as satisfying all IMO and USCG requirements, OBS is certified by a comprehensive range of classification organisations, including DNV GL, Lloyd s, Bureau Veritas, MLIT Japan, and American Bureau of Shipping. 4 COAST GUARD Maritime Commons The Coast Guard Blog for Maritime Professionals 12/2/2016: Marine Safety Center issues Ballast Water Management System (BWMS) type-approval certificate to Optimarin AS Posted by LT Katie Braynard, Friday, December 2, 2016 Today, the Coast Guard Marine Safety Center issued the first U.S. Coast Guard Ballast Water Management System Type Approval Certificate to Norwegian manufacturer Optimarin AS after a detailed review of the type approval application determined the system met the requirements of 46 CFR The Optimarin Ballast System is a filtration/ultraviolet ballast water management system with treatment capacities ranging from 167m 3 /h to 3000m 3 /h. Today s decision marks a significant milestone for the maritime industry in addressing the threat posed by invasive species, stated Capt. John Mauger, commanding officer of the Marine Safety Center. The U.S. Coast Guard s testing requirements set strong standards for the performance and validation of ballast water management systems under a range of conditions. The issuance of the type approval certificate documents the ability of the Optimarin Ballast System to meet the U.S. Coast Guard s standards. A copy of the certificate may be obtained by contacting the manufacturer. The Marine Safety Center continues to review type approval applications from other BWMS manufacturers. Each type approval application includes thousands of pages of data and analysis to document compliance with the comprehensive land-based and shipboard testing requirements. In addition, the applications include detailed descriptions of materials, evaluations of component suitability for the maritime environment, and operating manuals. The Marine Safety Center remains in constant communications with the manufacturers and the Independent Laboratories to keep them apprised of the status of our review. While this is a significant milestone, it is the first of multiple system approvals that are needed to mitigate the threat of harmful aquatic invasive species, said Rear Adm. Paul Thomas, assistant commandant for prevention policy. One size does not fit all, so we will continue to evaluate other systems submitted by multiple manufactures with the intent to provide options that meet shipping s varying needs. In conjunction with the type approval certification, the Coast Guard released Marine Safety Information Bulletin which provides answers to frequently asked questions concerning: The extension program; 4

5 Vessel compliance dates; and Use of Alternate Management Systems (AMS). U.S. regulations allow the Coast Guard to grant an extension to a vessel s compliance date if the master, owner, operator, agent or person in charge (collectively owner/operator ) documents that, despite all efforts, compliance with one of the approved ballast water management methods, including installation of a Coast Guard type-approved BWMS, is not possible. Now that a type-approved BWMS is available, any owner/operator requesting an extension must provide the Coast Guard with an explicit statement supported by documentary evidence (e.g., a delay in commercial availability) that installation of the type approved system is not possible for purposes of compliance with the regulatory implementation schedule. While this certification provides vessel owners and operators with a type-approved system to meet the ballast water discharge standard, there are other ways that vessels can comply with U.S. ballast water management regulations. These include: Temporarily use of a foreign type-approved BWMS that has been accepted by the Coast Guard as an alternate management system (AMS) (5-year limitation) if installed in compliance with 33 CFR Part 151 Use of ballast water obtained exclusively from a U.S. public water system Discharge of ballast water to a reception facility No discharge of unmanaged ballast water inside 12 nm The Coast Guard s ballast water portal provides information on BWM compliance date extensions. The site also provides access to regulations, policy letters, informational bulletins, and extension application status to help the maritime industry comply with the BWM requirements. 6 Optimarin first BWT system supplier to obtain USCG approval Norwegian ballast water treatment (BWT) specialist Optimarin is celebrating today after becoming the first system supplier to gain full USCG type approval. The development, which adds to IMO approval and certification from a host of classification societies, means Optimarin s environmentally friendly UV-based technology now leads the market in terms of global compliance. This is a huge day for our company, and our customers, comments Optimarin CEO Tore Andersen. USCG has the world s most stringent testing standards, meaning that once a system has approval it is assured of total global compliance, now and into the future. There are numerous units with USCG Alternate Management Systems (AMS) certification, but this is a temporary measure to allow trading in US waters. At some point, if they haven t met full USCG approval standards, they will have to be changed. So, it really pays for shipowners to invest in fully compliant systems today for their entire fleets. The peace of mind that provides cannot be overstated. The Optimarin Ballast System (OBS) utilises a combination of filtration and powerful 35kW UV lamps to treat ballast water without the need for chemicals. DNV GL tested the system to USCG standards for fresh, brackish and marine water at the NIVA test facility in Norway. The confirmation of approval comes just weeks after John Mauger, Commanding Officer of the Coast Guard s Marine Safety Center (MSC), described Optimarin s application - the first in the industry - as a milestone in the fight to protect marine biodiversity in US waters. We ve been working on developing simple, flexible and reliable BWT technology for over 20 years now, states Andersen. In that time we ve built unrivalled expertise and a system that is market proven and easy to install on any vessel, newbuild or retrofit. From our perspective, this approval from USCG is a reward for all that hard work, and for our customers it provides confirmation that they ve made the right choice in investing in an ambitious team that are solely dedicated to this segment. We now have over 300 systems installed worldwide and have received almost 500 unit orders. With this approval confirmation we expect the business to move even further ahead and consolidate our leading position. Optimarin, which installed the world s first commercial BWT system on the Princess Regal in 2000, has had its best year in business in 2016, taking orders from a wide range of shipowners, operators and yards. These include contracts with Atlantis Tankers, Vard Group, Saga Shipholding, Fincantieri Bay Shipbuilding, Fisherman s Finest, Solvang ASA, and Carisbrooke, amongst others. Of the OBS units installed, over 60 have been retrofitted, fitted in conjunction with global engineering partners Goltens and Zeppelin Power Systems. Optimarin s technology is certified by a comprehensive range of classification organisations, including DNV GL, Lloyd s, Bureau Veritas, MLIT Japan, and American Bureau of Shipping. 6

7 IMO new G8 rules IMO MEPC 70 meeting concluded on revised G8 Guidelines last month with significant decisions regarding the Ballast Water Management treaty which will enter into force on 8 September The revised guidelines will be applied to Ballast Water Treatment systems, which start their Type Approval process from 28 October 2018 onwards. The new G8 Guideline is more prescriptive with respect to details of the control and monitoring system, test reporting, test validation and independence. Another important aspect of the revised guidelines is their harmonization with the USCG guidelines. We are currently working to verify the exact wording of G8 and will start the work to document according to the new G8 Type Approval. Expert comments state that suppliers that are approved according to USCG regulations will be given the G8 Certificate. 7

This bulletin provides answers to frequently asked questions concerning: 1) the extension program, 2) vessel compliance dates, and 3) use of Alternate Management Systems (AMS). Title 33, Code of Federal Regulations Part 151, Subparts C and D (33 C.F.R. 151 Subparts C and D) allow the Coast Guard to grant an extension to a vessel s compliance date if the master, owner, operator, agent, or person in charge (collectively owner/operator ) documents that, despite all efforts, compliance with one of the approved ballast water management methods, including installation of a Coast Guard type approved BWMS, is not possible. Now that a type approved BWMS is available, any owner/operator requesting an extension must provide the Coast Guard with an explicit statement supported by documentary evidence (e.g., a delay in commercial availability) that installation of the type approved system is not possible for purposes of compliance with the regulatory implementation schedule. Will the Coast Guard honor my existing extension letter? Extension letters will remain valid until the extended compliance date specified in the extension letter. Upon expiration of the extension, a vessel must have implemented one of the approved ballast water management methods specified in 33 C.F.R or Supplemental extensions may be requested; however, if a type approved BWMS is available, requests must provide the necessary evidence to show why compliance is not possible (see below for examples of appropriate documentation). Will the Coast Guard continue to grant extensions now that a BWMS has received Coast Guard type-approval? Commercial seagoing ships operating in U.S. waters (within 12 nautical miles) and not otherwise exempted are required to manage ballast water in one of five ways: 1. Use a U.S. type-approved BWMS to meet the discharge standard; 2. Temporarily use a foreign type-approved BWMS that has been accepted by the U.S. Coast Guard as an Alternate Management System (AMS); 3. Use and discharge ballast water obtained exclusively from a U.S. Public Water System (PWS); 4. Discharge ballast water to a reception facility; 5. Do not discharge ballast water inside 12 nautical miles. Extensions are allowed for by regulation (33 C.F.R ). Therefore, the Coast Guard will continue to accept requests for extensions. An extension to a vessel s compliance date may be granted in cases where the ship owner/operator can document that despite all efforts, compliance with the requirements listed above is not possible. If an applicant is unable to clearly document that compliance is not possible, the vessel will not be granted an extension and will have to employ one of the approved ballast water management methods specified in 33 C.F.R or This release has been issued for public information and notification purposes only.

10 If granted, the length of the extension will be for the minimum time needed, as determined by the Coast Guard and based on the documentation provided, for the vessel to comply with the ballast water discharge standard and other regulatory requirements. For example, if an applicant provides documentation that a vessel s drydocking was postponed by three months, that applicant may receive a letter extending compliance for only three months. These determinations will be made on a case-by-case basis. Examples of additional documentation in support of extension requests: Written correspondence between the owner/operator and the applicable BWMS manufacturer(s) that confirm BWMS are not available for installation on that particular vessel or class of vessels until after the compliance date. Vessel design limitations with type approved BWMS currently available. Safety concerns related to installing type approved systems currently available. Any other situation that may preclude a vessel from being fitted with a type approved system. What if the Coast Guard has received, but has not approved, my extension application? The Coast Guard has not issued extension letters to vessels with compliance dates on or after January 1, Now that a type approved system is available, the status of these applications will be changed from received to held in abeyance since the application s original criteria are no longer valid. In order to receive approval for an extension, additional information must be submitted including appropriate documentation as to why compliance with the requirements is not possible. How will the availability of a type approved system affect my vessel s compliance date and/or AMS status? The vessel s compliance date will remain the same. Any vessel with an AMS will still be allowed to use that AMS for up to five years after the compliance date. It is recommended owners/operators review Coast Guard MSIB How will the Coast Guard verify my compliance with the regulations? Coast Guard Port State Control Officers may verify compliance with the regulations at any time while the vessel is in waters subject to the Coast Guard s jurisdiction, and Coast Guard Marine Inspectors may verify compliance with the regulations at any time. In order to prevent delays to vessel schedules, the master, owner, operator, agent, or person in charge of a vessel is reminded to keep BWM records onboard the vessel and immediately available for review by Coast Guard officials. Such records may include, but are not limited to: BWM plan, current extension letter granted to the vessel, vessel certificates, contracts and/or records verifying the date the vessel entered its last dry dock, BWMS installation documents, and vessel log books. Failure to comply with the ballast water regulations may result in civil or criminal penalties as provided at 33 C.F.R Where can I get more information?
