4 General Trade Terms This document outlines Port Authority of New South Wales (Port Authority) Schedule of Port Charges, providing reference to applicable statutes, regulations and internal rules. This is in accordance with section 62 (2) of the Ports and Maritime Administration Act 1995, which contains Government Policy as approved by NSW Cabinet on 28 November 2011, is consistent with the Premier s letter dated 26 June 2012 and 11 October 2012, and also the Minister for Roads and Ports approvals dated 1 November 2012 and 3 December Statutory port charges are applied in under Part 5 of the Ports and Maritime Administration Regulation Port Authority s payment terms are 28 days from date of provision of service. The specific payment of terms for the individual statutory port charges are: Navigation Service Charge 28 days from the date of vessel arrival Pilotage Charge 28 days from the date of vessel arrival or departure Site Occupation Charge 28 days from the earliest of either the date of vessel arrival, first line ashore or cargo arrival at berth Wharfage Charge Inbound cargo: 28 days from the date of vessel arrival Outbound cargo: 28 days from the date of vessel departure Interest is chargeable on overdue accounts (in accordance with section 70 of the Ports and Maritime Administration Act 1995). 5 Navigation Service Charge The Navigation Service Charge is levied to ensure the safe navigation of vessels in Sydney Harbour and Port Botany. All commercial vessels, including cargo and passenger vessels, piloted fishing boats, research vessels and tugs entering either Sydney Harbour or Port Botany are required to pay this charge. An additional charge for Environmental Services is payable by all vessels transporting noxious liquids, gas or oil cargoes. A noxious liquid is defined as such under the Marine Pollution Act 1987, or otherwise determined by Port Authority of New South Wales. Both the Navigation Service Charge and the Environmental Service Charge are payable by the vessel owner or agent and it is based on a rate per Gross Tonnage (GT) of the vessel, as stated in the vessel s International Tonnage Certificate, NAVIGATION SERVICES CHARGE - Rate per GT, per Port entry Charge type GST exclusive GST GST inclusive Standard Navigation Charge $ $ $ Navigation Charge for Passenger, Bulk Liquids & Gas Vessels Environmental Services Charge (applicable to vessels transporting noxious Bulk Liquid, Gas and Oil cargoes) $ $ $ $ $ $ Port Authority reserves the right to apply price variations on vessels visiting the ports of Sydney on promotional visits, repairs and maintenance, bunkering, performing embarkation and disembarkation of passengers, and for vessels that leave the port of Sydney Harbour and, without leaving the territorial sea of Australia or entering another port, enters the port of Botany Bay, and vice versa. 6 Pilotage Charge Pilotage is compulsory in the ports of Sydney Harbour and Botany Bay for all commercial vessels, unless exempted by Part 6 of the Marine Safety Act 1998 and it applies to all piloted vessels movements, both In and Out. If a vessel transits from/to Sydney Harbour or from/to Botany Bay, two Pilotage charges will still apply regardless of whether a Pilot remains on board. The Pilotage Charge is calculated on a tiered basis on the GT of the piloted vessel (see examples below). In addition, a Boarding Fee will need to be added to the base Pilotage Charge. Both the base Pilotage Charge and the Boarding Fee are applied to each inbound and outbound movements of the vessel. It is payable by the vessel owner or agent. 9 Site Occupation Charge The Site Occupation Charge is a time-based fee for the use Port Authority of NSW s common user berths and non-leased berths. It is payable for the time a vessel or its cargo occupies all or part of a berth to perform activities such as: stevedoring, embarkation or disembarkation of passengers, or for any other purpose in connection to its vessel, its passengers or its cargo. Passenger Vessels The Site Occupation Charge for Passenger Vessels is levied in reference to both the number of incoming passengers arriving on the cruise vessel at any of the dedicated or non-dedicated passenger berths, and the amount of time for which the site was reserved or occupied by such cruise vessel. It was first introduced in July 2013 and it is based on the actual number of incoming passengers as recorded in the ship s Inward Passenger Manifest Declaration per slot. A slot is an allocated time between the arrival and departure of a cruise vessel at a passenger berth up to 24 hours. It is applicable to all cruise ships, regardless of whether they are in Transit 1 or if they are Turn-Around 2. A minimum fee based on 1,200 passengers per cruise vessel per 24-hours will apply for smaller vessels (excluding vessels with a stated capacity of less than 200 passengers). Please, contact the Commercial Department on for further details. The Site Occupation Charge for Passenger Vessels is payable by the principal agent acting on behalf of the cruise line. 10 SITE OCCUPATION CHARGE for PASSENGER VESSELS - Hourly rate Site Occupancy type GST exclusive GST GST inclusive At Non-Passsenger Berths (i.e. Glebe Island 1, 2, 7 & 8; White Bay 3) - (Hourly rate) Lay Up rate (for Dedicated, Non-Dedicated and Non- Passenger Berths) - (Hourly rate) * pre-approval required $ $12.18 $ $36.52 $3.65 $40.17 The Site Occupation for Passenger Vessels is framed around the following set of rules: Timeframe The Site Occcupation Charge for Passenger Vessels is charged once per slot for all cruise ships utilising either the dedicated or non-dedicated passenger berths in Sydney Harbour. If a cruise ship stays at berth for more than 24 hours it will be charged Site Occupation again for the additional slot, and so on. Minimum charge The Site Occcupation Charge for Passenger Vessels is also based on a minimum of 1,200 passengers per cruise vessel, except for the vessels with a stated passenger capacity of less than 200 passengers. Passenger Age The Site Occupation Charge for Passenger Vessels does not apply for infant passengers (i.e. two years old or under). Passenger Type The Site Occupation Charge for Passenger Vessels is based on the incoming passenger number, as recorded in the ship's Inward Passenger Manifest Declaration.The ship's crew and all non-revenue passengers are excluded from this charge. Non-revenue passengers are restricted to all temporary staff of the vessel only, such as: entertainers and hospitality staff. Any other temporary passengers on promotional activities will be charged the Site Occupation Charge for Passenger Vessels. Berth Location The Site Occupation for Passenger Vessels is applicable at individual dedicated and non-dedicated passenger berth in its own right, and not based on grouping by the berth attributes. Bookings At the time of booking, a cruise line must only book at either of the two dedicated passenger terminals: Overseas Passenger Terminal (OPT) or White Bay Cruise Terminal (WBCT). Bookings at other non-dedicated passenger vessels (WB4), non-passenger vessels or mooring buoys will not be accepted if one of the dedicated passenger terminals is available. Passenger Data Requirement The Cruise Line/Principal Agent is to provide Port Authority of New South Wales with the inward passenger number details between 48 hours prior to ship arrival and the time of ship depature. If the information is not provided within the agreed time frame, an extra 10% on top of the stated passenger capacity of each cruise vessel (i.e. 110% of capacity) will be used for billing purposes. The stated passenger capacity of each cruise vessel is recorded in the ship's International Tonnage Certificate (ITC). Page 9 of 15
11 All passenger vessels also incur Miscellaneous Charges, as per appropriate usage. 12 Security Charges On a cruise ship day, security services are carried out by Port Authority's security provider in accordance with the Maritime Transport and Offshore Facilities Security Act Duties which are undertaken by the security provider include: patrolling access to the facility, controlling access to the ship, monitoring of the ship including berthing areas and areas surrounding the ship, screening of all unaccompanied baggage and the monitoring of cargo and stores delivered to the ship. Other activities such as monitoring passengers and confiscating prohibited items are also part of the daily security tasks to ensure no threat is placed on the ship, terminal or passengers. Cleaning Services On a ship day, cleaning services are carried out by Port Authority's cleaning contractor at the terminal site. Cleaning personnel are on site from 0700 to 1700 hours to provide roaming cleaning of the terminal, rubbish management and supply of amenities to restrooms. Cleaning personnel are also responsible for cleaning external areas such as: coach bay, car park and pedestrian waklways within the precinct. Gangway Hire Port Authority's shore gangways can only be utilised by vessels that have been assessed and approved. Standard hours for the connection of Port Authority's shore gangway is 0600 to 2000 hours. If a gangway is required to remain connected outside these hours, a charge will apply (please, refer to Miscellaneous Charges for Passenger Vessels for price details). Written notification must be provided to the General Manager, Commercial & Property of the intention to use a berth for lay up purposes. Berth allocation for lay up is at discretion of the Harbour Master. Page 11 of 15
13 Mooring Fee A Mooring Fee is a time based charge applied to all vessels for the use of the buoys. A vessel is taken to be moored if it is secured to or otherwise held on a buoy or if it is one of a number of vessels secured to or otherwise held together on a buoy. It is calculated on the total time that a vessel occupies a mooring, from vessel tie-up time until vessel departure, and it is applicable on hourly periods, rounded to the nearest 15 minutes. The minimum applicable site occupancy rate for mooring is one hour. A Navigation Light Handling Fee is levied for the removal and subsequent installation on navigation lights on a buoy. It is always charged to vessels that incur a Mooring Fee and it is applied per vessel, per use. 14 Wharfage Charge A Wharfage Charge is applied to import, export and transhipped cargo in Sydney Harbour and is payable by the cargo owner, usually via the Shipping Agent. Wharfage is calculated in relation to the quantity of revenue tonnes loaded or unloaded at the site. A Revenue Tonne (RT) is the greater of mass or volume measured in units of tonnes, cubic metres or kilolitres. WHARFAGE CARGO CHARGE - Rate per Revenue Tonne All Cargo Types - Price On Application (P.O.A.) Please, contact Port Authority s General Manager, Property & Commercial (phone: ) for price enquiries. Wharfage charges include a security component for cost recovery of maritime security imposed under the Commonwealth Maritime Transport and Offshore Facilities Security Act Transhipment cargo is freight unloaded from one vessel and re-loaded onto another vessel in Sydney Harbour within 14 days from the date of unloading. Transhipment charges apply to all freight, regardless if they are inwards or outwards. Page 13 of 15

16 Other Pilotage Charges Annex 1 Anchorage An Anchorage charge applies to a piloted arrival or departure movement from/to the following locations: Bank Anchorage 1 and Bank Anchorage 2. Deferral Inward A Deferral Inward charge is applicable when a "booked and confirmed" inward movement is delayed or cancelled at late notice by circumstances that the vessel/master or agent could not reasonably forsee. In this instance, "late notice" means within two hours of the confirmed booking time. A Deferral Inward charge will also apply if the vessel does not attend the Pilot Boarding Ground (either at Port Botany or Sydney Harbour) wihtin 30 minutes of the booked movement time, causing a delay in the pilot boarding the vessel. Harbour Removal A Harbour Removal charge refers to a piloted movement from one berth to another berth within the same port. Assisting Pilot on Board An Assinsting Pilot may be allocated for specialised movements, vessels with restricted visibility and for movements into Kurnell 3. The Assisting Pilot is charged at the Pilot Stays On Board rate, although it does not apply to any Deferral charges. Deferral Outward A Deferral Outward charge applies where a pilot has proceeded to or boards a vessel for a removal or departure, however the movement time is amended to a later time or cancelled. It also applies where a departure booking time changes within two hours of the confirmed booking time, and if the vessel is not ready to sail within 30 minutes of the booked movement time, causing the pilot to be retained until departure. Master Audit A Master Audit (In/Out) charge applies when an Exempt Master requires a "Check Audit Pilot" to asses their practical ship handling skills. Master Audit are for authorised movements only. A Master Audit charge is not applicable on Harbour Removal unless specifically approved by the Harbour Master during exceptional circumstances. If an audited movement is delayed by 30 minutes or more, then a Deferral Inward (arrival) or Outward (departure or removal) charge will be applied. Note: An applicant attempting to obtain a Pilotage Exemption or an Exempt Master without a valid certificate pays the full Pilotage charge. Pilot Stays on Board A Pilot Stays on Board charge applies where a pilot is requested or instructed to stay on board a vessel on any movement type (arrival, departure or removal). An hourly rate is applied. The pilot may be requested to stay on board in circumstances such a specialised operation, compass swing, a hampered vessel, during times of adverse weather, engine failure or reduced capacity, or if a vessel is not adequately secured or for safety purposes. If a pilot is requested to stay on board beyond 30 minutes from the confirmed movement time, then a Pilot Stays On Board charge may also be applicable. The Pilot Stays On Board charge does not apply to any Deferral charges. A minimum charge of one hour will apply where a pilot stays on board for less than an hour. For over an hour, the charge is calculated to the nearest 15 minutes. Boarding Fee A Boarding Fee applies each time the Main Pilot board the vessel. If an Assisting Pilot also boards, then only one Boarding Fee is applicable. If a vessel transits from/to Sydney Harbour or to/from Botany Bay, two Boarding Fees apply regardless whether a pilot remained on board under any circumstances. The Boarding Fee does not apply to any Deferral charges. It includes a fuel surcharge of $25.00 (GST exclusive) Page 15 of 15
