3 Who must pay port dues? Definition of port dues : any due, fee or charge payable under this Ordinance in respect of a vessel which enters the waters of Hong Kong or uses any port facility (s.2 of Shipping and Port Control Ordinance) Who must pay? The owner, his agent and the master of every vessel which enters any port or other part of the waters of Hong Kong, or which uses any port facility, shall be jointly and severally liable to pay in respect of the vessel such port dues (s.52 of Shipping and Port Control Ordinance) Paid to whom? Port dues shall be paid to the Director of Marine on demand made by him (s.53 of Shipping and Port Control Ordinance) 3

6 Anchorage Dues For a vessel lying at anchor: Per ton per hour while lying in the limits of Victoria port: HK$0.02 Per ton per hour while lying elsewhere in the waters of Hong Kong: HK$0.015 (Rounded up to the nearest ton and the nearest number of hours) Minimum charge: HK$100 Tonnage is measured in accordance with Merchant Shipping (Registration) (Tonnage) Regulations (Item 1 of Schedule 13 to Shipping and Port Control Regulations) 6

7 Anchorage Dues Anchorage dues for RMS Titanic lying (above surface) at the Victoria port for 11.5 hours = 46,328 tons * HK$0.02 * 12 hours = HK$11,

8 Buoy Dues For each day a buoy is occupied or reserved Class A buoy: HK$3,685 For vessels up to 183 meters long Class B buoy: HK$2,455 For vessels up to 137 meters long (Rounded up to the nearest number of day) Where in the opinion of the Director it is essential because of the length or draft of a particular ship that adjacent buoys be left vacant, the owner or master of the ship may be charged the hire rate appropriate for each buoy so left vacant. (Item 2 of Schedule 13 to Shipping and Port Control Regulations) 8

9 Port Facilities and Light Dues On each occasion of entry to the waters of Hong Kong For vessels navigating exclusively within river trade limits: HK$18 per 100 tons River trade limits: Pearl River, Mirs Bay, Macao, other inland waters in Guangdong and Guangxi For all other vessels: HK$43 per 100 tons (Rounded up to the nearest 100 tons) Not chargeable on vessels that have never left Hong Kong (Item 3 of Schedule 13 to Shipping and Port Control Regulations) 9

10 Port Facilities and Light Dues Comparison with Singapore Hong Kong: HK$43 per 100 tons (for all vessels other than river trade vessels) Singapore: Depends on purpose of entry and period of stay Purpose of entry Very low rates for shipyard repairs and offshore support Higher rates for taking bunkers, taking supplies, changing crew, repairs Highest rates for loading/unloading cargo/passengers The longer the stay, the more expensive E.g. Staying 1 day for loading cargo: S$7.5 (~HK$43.5) per 100 tons E.g. Staying 6 days for loading cargo: S$14 (~HK$81.2) per 100 tons Provides 20% concession for container ships, vehicle carrier, passenger cruise ships, green vessels Port stay must not exceed 5 days 10

11 Pilotage Dues Compulsory Pilotage required for these ships when navigating within the waters of Hong Kong: A ship of 3,000 gross tonnage or over A ship of 1,000 gross tonnage or over proceeding to or from any approved petroleum wharves A ship of 1,000 gross tonnage or over carrying certain dangerous goods A ship of 300 gross tonnage or over which: is, for any reason, unable to proceed under its own power, manoeuvre with its own steering gear, or work with its own anchors; has any part of the hull structure removed, or under repair, which may affect the water-tight integrity of the ship; or is at risk of causing injury to persons or damage to property, any other ship or the environment by virtue of the condition of the ship or the nature or condition of its cargo. 12 Pilotage Dues How much For ships having a gross tonnage of less than tons, HK$0.07 per ton of the ship s gross tonnage For ships having a gross tonnage of or above tons but not exceeding tons, HK$0.065 per ton of the ship s gross tonnage or $2,800, whichever is the greater For ships having a gross tonnage exceeding tons but not exceeding tons, HK$ per ton of the ship s gross tonnage or $5,200, whichever is the greater For ships having a gross tonnage exceeding tons but not exceeding tons, HK$0.055 per ton of the ship s gross tonnage or $7,500, whichever is the greater For ships having a gross tonnage exceeding tons, $7,700 (Schedule to Pilotage (Dues) Order) 12

13 Pilotage Dues Who must pay The master of the ship and the person who engaged the licensed pilot shall be liable for payment Consequence of not paying The Director of marine may refuse to grant clearance to the ship (s.13 of Pilotage Ordinance) 13
