Bonuses based on the use of LNG as fuel. A coefficient of 0.5 shall be applied to ships using liquefied natural gas for offshore navigation and ships using liquefied natural gas or electricity from the quay to power their auxiliary engines while in port. Such coefficient shall not be applied to LNG carriers, unless they use electricity from the quay to power their auxiliary engines while in port. This coefficient shall be compatible with the coefficient established in Article of Spanish Royal Legislative Decree (RDL) 2/2011 of 5 th September.

5 FRESH FISH CHARGE RDL 2/2011, of 5 th September. Using fish market Articles : 218 to 222 Not using fish market Concession market Non-concession market Fish unloaded by sea 1.80% 0.40% 2.20% Fish entering the port premises overland 1.50% 0.30% 1.80% The tax base for this charge is equal to the market value of the fish and fishery products, which is determined in accordance with the following criteria: a) Their auction price at the market in the port. b) If a product remains unsold in the auction, its price shall be determined from the average value obtained for the same species in auctions held earlier that day, or, failing this, in the most recent auction held for that particular species. Alternatively, the value shall be established by the average market price in the preceding week as certified by the relevant authority. c) If the price cannot be set through any of the methods above, the Port Authority shall establish a price in accordance with usual market rates.

7 Occupation of transit and manoeuvring areas (where exceptionally authorised) When occupation of such areas is authorised for a period exceeding 4 hours for wheeled cargo, or for a period exceeding the loading or unloading day and the day immediately before or after that day for other types of cargo, the rates shall be as follows: SPECIAL USE OF TRANSIT AREA CHARGE ( T-6 ) RDL 2/2011, of 5 th September. 8 NAVIGATION AIDS CHARGE (B0) RDL 2/2011, of 5 th September. Articles : 237 to 244 Value of basic amount " A " ( Art ) 0.29 Value of basic amount " C " ( Art ) 0.28 Amount of the charge Observations Based in port Not based in port Merchant vessels and freezer fishing vessels [ GT x ( A + C ) x ] The product of multiplying the vessel s GT, starting at a minimum 100 GT, by the basic amounts ( A + C ) and by the coefficient on the first three stops at a Spanish port in each calendar year. Deep-water fishing vessels [ GT x ( A + C ) ] For vessels based in a Spanish port: the product of multiplying the vessel s GT, starting at a minimum 100 GT, by the basic amounts ( A + C ) in each calendar year (b1). For vessels which are NOT based in a Spanish port, the amount of the charge shall be equal to the product of dividing the charge resulting from the section above by the number of days in each natural year, multiplied by the number of full and partial days spent by the vessel in Spanish territorial waters. Coastal fishing vessels [ ( A + C ) x 50 ] For vessels based in a Spanish port: the product of multiplying the basic amounts ( A + C ) by the coefficient 50 in each calendar year (c1). For vessels which are NOT based in a Spanish port, the amount of the charge shall be equal to the product of dividing the charge resulting from the section above by the number of days in each natural year, multiplied by the number of full or partial days spent by the vessel in Spanish territorial waters. Recreational vessels equal to or more than 9 m in length overall if propelled by an engine, and more than 12 m in length overall if propelled by sails [ ( A + C ) x E x M x 16 ] For vessels based in a Spanish port: the product of multiplying the basic amounts ( A + C ) by the vessel s length overall in meters, by the vessel s beam overall in meters, and by the coefficient 16, in each calendar year (d1). For vessels which are NOT based in a Spanish port: for each full or partial day spent in Spanish territorial waters, the charge must be paid to the Port Authority responsible for the maritime signalling of the geographical area where the relevant port of call is located. The payment shall be made each time the ship or boat enters Spanish territorial waters and for the planned period of stay in each port of call. Recreational vessels less than 9 m in length overall if propelled by an engine [ ( A + C ) x E x M x 40 ] For vessels based in a Spanish port: the product of multiplying the basic amounts ( A + C ) by the vessel s length overall in meters, by the ship s beam overall in meters, and by the coefficient 40. The payment shall be made in one instalment and shall have indefinite validity (e1). For vessels which are NOT based in a Spanish port: for each full or partial day spent in Spanish territorial waters, the charge must be paid to the Port Authority responsible for the maritime signalling of the geographical area where the relevant port of call is located. The payment shall be made each time the ship or boat enters Spanish territorial waters and for the planned period of stay in each port of call. Proof of payment of the charge for the maritime signalling service shall be required by the relevant ship registration and inspection authority. Regional governments, government-dependent port-related organisations and holders of concessions or authorisations granted by ports, docks and port facilities shall provide the Port Authority with all the necessary details and information for the settlement of this charge. Port Authorities may enter into agreements with regional governments and relevant port-related organisations for the collection of this charge. A simplified estimation of the charge may be required at ports, docks and sailing facilities granted under concession or authorisation. The rate of the charge shall be established in accordance with the statistical data available from the last two years, with a 20% bonus applied to the amount of the rate.

Under no circumstances may the bonus exceed 40% of the amount of one single (vessel, cargo or passenger) charge within each sensitive, priority or strategic maritime or shipping service. The multiplier effect of the bonuses shall not exceed 40% of the amount of one single (vessel, cargo or passenger) charge within each sensitive, priority or strategic maritime or shipping service. Tranches not considered: 0% bonus TEU is a twenty-foot equivalent unit of cargo capacity. For the terms maritime, receipt/issue by sea, shipping service and regular shipping service, the definitions included in Annex II of the Revised Text of the Spanish State-Owned Ports and Merchant Navy Act shall apply. These bonuses shall in no case be applicable to port s utilising facilities with administrative concession status which have qualified for the application of the bonuses established for non-concession facilities under Spanish Law 48/2003. Special conditions for application: b) The split bonus percentage for each tranche is applied to the units included therein, operated after the entry into force of this Law.
