Edmonton, November 29, 2000 The Lieutenant Governor in Council, effective December 31, 2000, (a) dissolves the Village of Entwistle, (b) directs that the land in the Village of Entwistle becomes part of Parkland County, and (c) makes the order in the Appendix. Ralph Klein, Chair. 1 In this Appendix, APPENDIX ORDER (a) Entwistle means the Village of Entwistle; (b) former area of Entwistle means the land in Entwistle before its dissolution; (b) receiving municipality means Parkland County. 2 The former area of Entwistle is part of electoral division 7 of the receiving municipality until the receiving municipality passes a bylaw pursuant to section 148 of the Municipal Government Act that provides otherwise. 3 All liabilities of Entwistle, whether arising under a debenture or otherwise, and all assets, rights, duties, functions and obligations of Entwistle are vested in the receiving municipality and may be dealt with in the name of the receiving municipality. 4 If the liabilities of Entwistle exceed the assets of Entwistle, the receiving municipality may impose an additional tax under Part 10 of the Municipal Government Act on property, including linear property as defined in section 284(1)(k) of the Municipal Government Act, located in the former area of Entwistle to pay for those excess liabilities. 578

3 5 Bylaws and resolutions of Entwistle continue to apply in the former area of Entwistle until the bylaws or resolutions are repealed, amended or replaced by the council of the receiving municipality. 6 A reference to Entwistle in any order, regulation, bylaw, certificate of title, agreement or any other instrument is deemed to be a reference to the receiving municipality. 7 Revenues from the operation of the J. D. Read Building may only be used to pay or reduce a cost or liability associated with the J. D. Read Building. 8(1) The receiving municipality must deposit in a reserve fund established by the receiving municipality (a) money received from Entwistle on its dissolution, and (b) money received from the sale of any of the assets of Entwistle vested in the receiving municipality under section 3 that the receiving municipality sells on or before December 31, (2) Money in the reserve fund may only be used (a) to pay or reduce a liability vested in the receiving municipality on the dissolution of Entwistle, or (b) for projects in the former area of Entwistle. (3) Money from the sale of the J.D. Read Building, whether before or after December 31, 2003, may only be used (a) to pay or reduce a liability vested in the receiving municipality on the dissolution of Entwistle, or (b) for projects in the former area of Entwistle. 9(1) The employment of the employees of Entwistle is terminated on the effective date of the dissolution of Entwistle. (2) Nothing in subsection (1) affects the receiving municipality s responsibility with regard to any liability that may arise from the termination of employment of employees of Entwistle. 10 The Minister may decide any other matter relating to the rights, assets and liabilities of Entwistle resulting from the dissolution of Entwistle. 4 SCHEDULE 1 ORDER Definitions Special Provisions for the Organization and Operation of The Municipal District of Mackenzie No In this Order, (a) new municipality means the specialized municipality named The Municipal District of Mackenzie No. 23"; (b) old municipality means the municipal district named The Municipal District of Mackenzie No. 23" formed by Order in Council numbered O.C. 757/94. Change of status to specialized municipality 2 (1) The status of the old municipality is changed to a specialized municipality to address concerns about municipal government and management in a municipality that serves a number of unique communities within a very large territory. (2) The provisions of the Municipal Government Act and other enactments are modified to the extent necessary to accomplish the intent of this order. Council of new municipality 3 (1) The council of the new municipality is to be comprised of 10 councillors. Wards (2) One councillor must be elected from each ward. (3) The first chief elected official of the new municipality is to be appointed by the council of the new municipality from among the councillors. 4 The wards of the new municipality are those described in Schedule 2. Requirement for valid bylaw or resolution 5 Despite section 181 of the Municipal Government Act, bylaws and resolutions relating to the following matters are not valid unless passed at a council meeting at which 2/3 of the councillors present at the meeting vote in favour of the bylaw or resolution: (a) (b) (c) (d) (e) (f) procedures of the council of the new municipality; remuneration of the councillors; property tax; changing the number of councillors, the boundaries of wards or the method of selecting any chief elected official subsequent to the first chief elected official; appointing and terminating the chief administrative officer; adopting a budget; 580

5 (g) any other matter designated by the council pursuant to the procedure established under clause (a). Termination or amendment of agreements 6 (1) In this section, agreement means a revenue sharing or cost sharing agreement between (a) (b) The Municipal District of Mackenzie No. 23, and the Town of Rainbow Lake or the Town of High Level made before or after the coming into force of Order in Council numbered O.C. 264/99. ALBERTA RACING CORPORATION RACING CORPORATION ACT Horse Racing (Officials and Participants) Licensing Amendment Rule 1 The Horse Racing (Officials and Participants) Licensing Rules are amended by this Rule. 2 Section 56 is amended (a) in subsection (2)(a), by striking out the Canadian Trotting Association, and substituting Standardbred Canada (b) in subsection (3), by striking out the Canadian Trotting Association, and substituting Standardbred Canada. RACING CORPORATION ACT Alberta Horse Racing Amendment Rule 1 The Alberta Horse Racing Rules are amended by this Rule. 2 Section 24 is repealed and the following substituted: 24 Coggins Test (1) Any person who is responsible for a thoroughbred horse stabled on the grounds of a racetrack must ensure that a negative Coggins Test has been issued with respect to that horse on or after 1 October of the preceding year and before April 1 of the current year. (2) Any person responsible for a standardbred horse stabled on the grounds of a racetrack must ensure that a negative Coggins Test dated in the previous 12 months has been issued with respect to that horse. (3) No person may bring a horse onto the grounds of a racetrack or permit the entry of a horse onto the grounds of a race track after March 31, unless a negative Coggins Test certificate has been issued with respect to that horse in accordance with subsection (1) or (2). (4) A *race horse the subject of a positive Coggins Test must be immediately reported, by its *trainer or other person in charge of it, to the *official veterinarian. (5) On receipt of the report, the official veterinarian must arrange for the affected *horse to be isolated. 3 Section 30 is amended by repealing clause (a) and substituting: 604

29 (a) 48 hours after the 1 st occurrence of bleeding, and then only after being removed from the veterinarian s list; 4 Section 31 is repealed and the following substituted: 31 EIPH eligibility requirements (1) The *official veterinarian must certify a *horse as eligible for the EIPH Program if (a) a *licensed veterinarian verifies, on a *prescribed form, that the licensed veterinarian has (i) performed a fibreoptic bronchoscopic examination within 2 hours of the *horse performing in a *race or an official workout, (ii) observed during the examination that the *horse had bled into its respiratory system, and (iii) recommended the use of furosemide (lasix) to control or reduce the amount of hemorrhage in the horse, (b) the official veterinarian certifies, on a *prescribed form, that (i) the horse performed in an official workout or *race on the *day of the examination, and (ii) the *licensed veterinarian is currently licensed, and (c) the official veterinarian certifies, on a *prescribed form, that the horse is a *bleeder. (2) The official veterinarian must also certify a horse as eligible for the *EIPH Program if the *stewards board or the official veterinarian certifies, on a *prescribed form, that (a) (b) (c) they have received documentation that the horse is qualified for the EIPH Program in another jurisdiction, the certification is made by a veterinarian in the other jurisdiction who performs the duties ordinarily performed by an official veterinarian in Alberta, and the other jurisdiction is recognized by the *Corporation for the purpose of this section. 5 Section 81 is repealed and the following substituted: 81 Scheduled sweepstakes (1) All scheduled sweepstakes must be run regardless of the number of horses entered. (2) When less than 5 horses are entered, the normal purse payout applies to those horses finishing the race and all purse monies not paid out accrues to the horsemens purse account. (3) All nomination, entry and starters fees not paid out due to the number of participants must be paid to the winner of the race. 605

30 6 Section 121(1) is amended (a) by repealing clause (b) and substituting (b) horses must arrive as follows: (i) (ii) a thoroughbred horse entered for a race must arrive at the race track no later than 7:00 a.m. on the day of the race, regardless of post-time; a standardbred horse entered for a race must arrive at the race track no later than 2½ hours before the first scheduled race of the day; (b) by adding after clause (f) (g) a person entering a ship-in horse must indicate on the entry that the horse is a ship-in ; (h) a trainer racing a horse under the ship-in rule that tests positive for a prohibited substance loses their ship-in privileges for at least one year, or such longer period as a judges/stewards board specifies, following completion of their suspension. 7 Section 131(2) is amended by striking out section 144 substituting section Section 133 is amended by repealing subsection (2) and substituting: (2) 5 pounds is the limit of overweight any *horse is allowed to carry, however (a) (b) if a *trainer has arranged to waive allowances previously *claimed, an allowance may be waived with the permission of the *stewards board, or an *owner or their representative, in the absence of sufficient allowance, may request an overweight in excess of 5 pounds in all *sweepstakes and the stewards board may grant the request if they believe it is in the best interests of *horse racing. 9 Section 180 is repealed and the following substituted: 180 Redistribution of purses If within 72 hours after a *race, not counting the hours in a day on which there is no racing, a *horse is found to have been ineligible to enter a race, the *judges/stewards board must declare it to be disqualified and any purse money won must be redistributed. 606

31 10 Section 191(1) is amended by striking out the words No person may, after 7:00 a.m. on the day of a horse race, administer to a horse entered to race any of the following: and substituting: No person may, after 2½ hours before the first scheduled race of the day, administer to a horse entered to race that day any of the following: 11 Section 226 is repealed and the following substituted: 226 Limitations on sale and racing of claimed horses A *claimed *horse must not (a) be sold or transferred to anyone, in whole or in part, except in a *claiming race, for at least 60 *days after the date of the *claim, unless the judges/stewards board permits a transfer to another trainer; (b) return to the same stable or to control or management of its former *licensed owner or trainer for at least 60 days after the date of the claim, unless the horse is reclaimed; (c) be raced outside Alberta for the balance of the Alberta racing season for the breed involved, without the permission of the judges/stewards board. 12 Section 233 is amended by repealing subsection (3). 13 Section 241 is amended by adding after subsection (4): (5) When a stakes race is limited to Alberta - owners, the following rules apply: (a) an individual is to be considered an Alberta - owner if the individual (i) (ii) has resided in Alberta for more than 6 months, is liable to pay Alberta income tax, (iii) is entitled to medical coverage under the Alberta Health Care Insurance Act, and (iv) has registered title to a horse, or in the case of a horse leased by that individual, the lease is satisfactory to the judges/stewards board; (b) a stable, syndicate or corporation is to be considered an Alberta - owner if (i) (ii) it is incorporated or established in Alberta, and more than 50% of the equity of the horse is owned by partners or shareholders who are Alberta - owners under clause (a), or in the case of a horse leased by the stable, syndicate or corporation, the lease is satisfactory to the judges/stewards board. 14 Section 278 is amended (a) in clause (b), by striking out the Canadian Standardbred Horse Society and substituting Standardbred Canada ; 607
