1 1/24/12 Regular Trustees Meeting Zoning Inspector Report 1. Zoning Approvals: a. None 2. Zoning Compliance: a. Towner Property, Archbold Whitehouse Road; i. Previous notes are available on request; 1. 8/6/11- Mrs. Towner's sons have begun dismantling trailer on the inside. 2. 9/17/11- Mrs. Towner called and reported the windows are being removed from first trailer and interior structure is being taken out /23/11- Inspected trailer, all windows and inside walls have been removed. b. 9/2/10 - Complaint on burned out house at 4647 S. Berkey Southern relayed by Trustee Tippie; i. Previous notes are available in reports, only new updates will be listed; ii. 8/20/11- Randy Sparks called to inform that after multiple delays the timber company hired to remove timber to raise money to take down house has set new start date of the week of 8/29/11; forwarded suggestion from Mary Solomon to see if fire department might be interested in using house for practice burn, will contact Swanton Fire Dept. this coming week. iii. 12/7/11- Logging company representative stopped at house and stated work will begin this week on removing trees. iv. 1/21/12 - Left message for Randy Sparks for update, waiting for reply. c. 4/16/11 - Victoria Bergfeld / Esiquio Castillo, Shaffer Road, zoning violations; i. Previous notes are available on request; d. 11/28/11 - Steve Keisling, Camp Courageous, Waterville Swanton re: property issues with neighbor; i. After having survey it appears neighbor's garage and old car are on Camp Courageous property, property owned by Conrad Jankowski; ii. Mr. Keisling believes garage was built without permits, but could not remember what year it was built, checked Township records and have not been able to find zoning permit, have contacted Lucas County to determine if building permits were issues, waiting for response; iii. Mr. Keisling also concerned about large, very green grassy area at front of Jankowski property along Camp property line, surveyor pointed it out and stated it could be caused by a malfunctioning leech field, suggested Mr. Keisling contact Lucas County Health Department to have it checked. e. 11/30/11- Greensweep dba Sugar Maple Farms, Sager, apparent commercial activity; i. Owner of Greensweep had committed to Swanton Township that all activity at Sugar Maple Farms would be agricultural to avoid zoning enforcement, tons of topsoil have been moved from airport to property, no apparent agricultural purpose;

Contacted Lucas County Building Regulations to ask if they had any additional information, was told an electrician hired by Greensweep attempted to get electrical permit for 400 amp service to be installed, when asked for purpose would only say it was for a large building, permit was denied due to electrician not being able to state agricultural purpose; iii. Electrician returned for permit, stated the purpose was for a deep well for agricultural purposes, not for a building; iv. Have requested meeting with owner of Greensweep to discuss, owner has been out of town on business, returning 12/13/11, meeting is scheduled. v. 12/21/11- Requested legal opinion from John Borell re: zoning exemption for agricultural properties; 1. John's opinion clarifies the issue in that there is no blanket agricultural zoning exemption, each building proposed on a parcel used for agricultural purposes must be given an exemption individually; 2. Building that is currently proposed for Sugar Maple Farms is for automated planting operation which seems consistent with ag exemption, opinion was forwarded to Phil Klocinski at Lucas County Building Regulations, if he agrees he will order an electrical permit to be issues for this building only; 3. 1/4/12 - Discussed issue with Phil at Lucas County Bldg Regs, based on John Borrell's legal opinions an electrical permit should be issued based on owner's commitment to use new building for ag purposes only, however it is very unlikely the tons of dirt on property can be considered as ag only and retail sales will be a zoning violation. 4. 1/4/12 - Molly Maguire provided Agricultural Use Determination Form developed by Waterville Township Solicitor that would be very helpful in dealing with issues like Greensweep, sent request to Zoning Commission to discuss. 5. 1/16/12 - Discussed Ag Use Determination form with Zoning Commission, Commission members agreed it is a good tool to use going forward, recommended use. f. 12/15/11- At Trustee Tippie's request re-started conversation with Molly Maguire LCPC previously addressed with John Nagy LCPCabout how other local townships attempt to regulate cell phone towers; i. 12/22/11- Molly Maguire provided copy of ORC as well as Sylvania and Waterville Twps zoning resolutions on cellphone towers; ii. 12/25/11- Forwarded to John Borell for review, previously John had provided legal opinion that townships could not regulate cell phone towers. iii. 1/4/12 - Discussed with Molly Maguire who provided additional information, cell phone towers cannot be regulated, however language can be added to Swanton Twp Zoning Resolution requiring site plans and zoning permits prior to construction; iv. Site plan request may include request from cell phone tower owners to explain why the tower needs to be built in a residential area as opposed to a rural area, but final location of tower cannot be stopped by township, will refer to Zoning Commission for review.
3 g. 1/3/12 - Phone message from Jerri Fink re: issues with neighbor trenching cables on her property, trenching a cable to house that is to be decommissioned, potential issues related to decommissioned house being turned into barn, etc. i. 1/3/12 - Letter sent to Diana Palinski-Roberts re: neighbor's concerns asking for time to discuss issues. ii. 1/9/12 - Discussed issues with Diana Palinski-Roberts, they disagree with the cable being on Fink property but have agreed to move at spring thaw, all requirements of Zoning Variance have been met. iii. 1/9/12 - Call from Jerri Fink questioning why a hearing was not held by BZA, explained advise from LCPCwas that a hearing was not required; iv. Ms. Fink will attend 1/23/12 BZA hearing to discuss issues, Diana Palinski-Roberts will attend as well to defend actions; v. 1/20/12 - Notified Ron Oberhaus that residents will be attending BZA meeting, Ron advised he is out of town and asked the information be forwarded to Mike Sarra who will be acting as chair for the meeting, 1/21/12 - information forwarded to Mike Sarra as well as discussion of issues by phone. h. 1/4/12 - Molly Maguire requested the Zoning Commission immediately begin drafting zoning regulations for Internet Cafes, they are becoming a serious issue in Lucas County; i. Zoning Commission has already discussed and determined that since State of Oho has not provided direction on Internet Cafes that Twp can't effectively regulate; ii. Molly agrees with Commission's assessment, but still feels it is necessary to have regulations in place due to how fast they are moving into area, will refer back to Zoning Commission for further review, suggested using same regulations as written for adult book stores; iii. 1/4/12 - Sent request to Zoning Commission to consider immediately. iv.. 1/16/12 -Internet Cafes discussed by Zoning Commission, members will read through Adult Entertainment regulations in Zoning Resolution and recommend any changes they think might be needed for adding Internet Cafe regulations at the next meeting. i. 1/4/12 - Call from Amanda Rosato with Mannik & Smith about project in Swanton Township; i. Ms. Rosato was not at liberty to discuss project, only that it is "in the vicinity of Alt. 20 and Maumee Western Road"; ii. Request for copy of Swanton Township Zoning Resolution, ed to Ms. Rosato 1/4/12. iii. 1/12/12 - Received announcement of EPA hearing on wetlands and creek issues involved in 160+ acre industrial park proposed for area south of airport, hearing scheduled for 1/24/12; 1/16/12 - Matt Pocock stated he will attend hearing. j. 1/13/12 - Scientel Cellular called requesting zoning exemption for adding 2 antennae to existing cell tower at Archbold Whitehouse Road i. 1/13/12 No additional tower or building construction will be done on site, letter of exemption scanned & ed 1/13/12.
4 Road Superintendent Report for January 7, 2012 thru January 20, 2012 Prepared by Kenneth A. Biller January 9, 2012 Checked all roads and cemetery. Picked up a deer carcass on Archbold-Whitehouse road. Met with Sarah from the county to get the plans for the Co. Line project. Put the heat houser on the J.D Repaired the fuel hose on the diesel storage tank. Replaced the left front wheel bearing on the pickup. Treated the battery box cover on the backhoe with rust treatment. January 10,2012 Cleaned and swept the Town Hall and stairwells. Sold a grave to Wright. Treated some rust spots on the backhoe. Put everything together and made copies for the Co. Line project. Swept the shop office. Updated the cemetery records. Filled the l-ton with gas. January Picked up trash in the cemetery. Washed and waxed the l-ton, pickup, and Int. dump trucks. Treated the bed of the lnt. dump truck with rust treatment. Painted the battery box cover and installed on the backhoe. Cleaned out the interiors of all the trucks. January 12, 2012 Fixed a flat tire on the l-ton. Cleaned and painted the wheels on the l-ton. Met with Jeff from the county about the Meyer ditch project. Worked on repairing the fender on the lnt. dump truck. January 13,2012 Salted all roads twice. Replaced the starter on the l-ton. Rinsed the salt out of and off of the lnt. dump truck. Picked up Ansi safety gear for Mick at Thomas equipment. January 14,2012 Salted all roads and cemetery. January 16,2012 Holiday January 17,2012 Worked on repairing the fender on the Int. dump truck. Emptied the salt out of the lnt. dump truck. Washed the salt out of and offof the Int. dump truck. Pushed the salt into the salt bin. Washed the salt off of the pickup and backhoe. Checked all of the roads and the cemetery. Repaired bad berm on Co. Line road. Contacted a flag company to repair the tlag pole rope at the Town Hall.
5 January 18,2012 Picked up trash in the Town Hall yard. Worked on the fender of the lnt. dump truck. Finished painting the wheels on the l-ton and put them back on. Worked with Delores on the cemetery records. Swept the intersection at Reed and Co. Line roads. Hauled 2 loads of salt from the Manore road facility to the Scott road facility. Pushed the salt into the salt bin. Checked on the check valve on Co. Line road. January 19, 2012 Salted all of the intersections then went back around and salted all of the roads. Met with Crestline and Helms excavation companies for them to pickup the Co. Line plans. Filled the Int. dump truck with fuel. January 20, 2012 Did all of the daily reports and sent them off. Met with the Shelly company for them to pickup the plans for the Co. Line project. Mounted the plows on both plow trucks and checked them out for proper operation. Checked all of the roads for slick spots and spread a little salt where it might help for tonight. Met with Jeff Loshe about the Meyer ditch project. Filled the l-ton with gas.
