1 Full and Detailed Report of the OTA one day seminar Submitted by Trustee Dennis Tippie > Dennis reported on the classes that he attended: he was the only board member to attend: 1) (the grant writing class that he planned on attending was cancelled) so he attended HSTS Home Septic Treatment Systems; Currently local health Departments make decisions on what system is best for their county. Substitute Senate Bill 110 states that there should be some type of uniformity bill for HSTS passed by January 1, 2012 LIABILITY RISKS FOR TOWNSHIPS this was a round table type of session. Where Jim DeLucas from Burnham & Flower Insurance Group and Kim Arnold, President and CEO of KLA Risk Consulting discussed the different types of risk that Townships face and how important documentation is when there are issues facing the township. The two discussed different legal cases that some townships have faced and how the outcomes were favorable because of the proper documentation. I know that Ken has implemented pre-trip inspections & I will be working with Ken throughout the rest of this year to implement different types of documentation for the township. LEGAL REQUIREMENTS OF RECORDS RETENTION Sandy Lynskey, from the Legal Division of the Auditor of State s Office gave a lecture on the legal aspects of records retention. She explained how some low life attorney has sued a Village in Ohio for records that the Village could not produce from decades ago. This same attorney knew that the village did not have a records retention policy and pretty much knew that the records could not be produced. This went to court and the Village was fined over 1 million dollars. I gave Ms Lynskey my information and she is to send me other legal information pertaining to the Legal Requirements of Records Retention, so that we can adopt a records retention policy of our own and hopefully avoid a similar legal situation, which could potentially bankrupt our township. The other classes that I could not attend because they were taking place at the same time as the others were: New Road Sign Requirements Wind Farms Impact on Townships Township E-Government Keys to Understanding Township Finances Police Services: How Townships Protect Themselves Township Zoning Update ** I was not able to attend this session but I did collect information from another attendee about it (and have ed the information to our zoning members): FALL ZONING SESSIONS - NOW REGISTERING The OTA announced that they will be offering zoning sessions in The OTA will offer four different zoning sessions each Friday September 24 through October 15. Pavement Repairs about Dura Patching. Met with the County about paving patch on Manore Rd. Roadside mowing on Scott Rd. and Shaffer Rd. Cleaned Town Hall Meeting Room. Worked on chipper. August 24, 2010 Remove bump signs on Manore Rd. Checked E. Reed, Manore, Co. Line, and Monclova Roads. Picked up trash in the cemetery. Repaired door opener in bay #1. Roadside mowing on Brindley and Girdham Rds. Did roadsign inspection. Took shaft to Findlay for repair. August 25, 2010 Called J. B. Pavement Repairs, Zimmerman Paint Co. and National Transmission. Roadside mowing on Girdham Rd. Scraped berm on Girdham, Reed, and Jeffers Rds. August 26, 2010 LTAP Class on trenching in Whitehouse. Roadside mowing on Girdham, Sager, Whitehouse-Spencer, Express, and Berkey-Southern. August 27, 2010 Checked Co. Line, Monclova, Archbold-Whitehouse, E. Reed, Whitehouse-Spencer, Manore, and Jeffers Roads. Picked up dead deer on Whitehouse-Spencer. Picked up trash in the cemetery. Filled pickup with gas. Picked up trash at Town Hall. August 30, 2010 Spray for mosquitoes at Haas grave. Picked up flowers, raked, and seeded Ignaziak grave. Dug Haas grave. Worked on tailgate latch on INT. Dump truck. Inspected Co. Line for possible resurface. Checked on cemetery mowing. August 31, 2010 Greased Interstater. Roadside mowing on Reed Rd. Met with Jim from J. B. Pavement Repairs to start patching on Manore Rd. Did Bill Haas Funeral. Cut limbs on Girdham Rd. Checked Sager, Wilkins, Reed, and Whitehouse-Spencer Rds. September 1, 2010 Crack seal on Jeffers and Archbold-Whitehouse Rds. Ken, Denny, and Brian from Providence TWP. Checked on Dura Patching and Roadstriping. September2, 2010 Cleaned up downed limb blocking Jeffers Rd. Worked with the County to cut low hanging limbs on Girdham and Jeffers Rds. Picked up 1-ton from National Transmission. Checked Recycle Station. Took old flags to Legion for ceremony. September 3, 2010 Repaired Exit lights in Town Hall. Took 1-ton to C.F.S. angle valve repair. Cleaned Int. dump truck. Serviced chain saw. Repositioned flag pole light cover. Swept out women s bathroom. Picked up sticks in the cemetery. Worked on a way to support the wall in the salt storage building on Manner Rd. \

3 September 7, 2010 Repaired flag pole light. Went with Denny to get his C.D.L. Pulled salt away from wall in salt storage building on Manner Rd. Repaired berg on Reed at Co. Line. Got a load of stone from Waterhole for berg repair. September 8, 2010 Checked all roads and signs. Checked and repaired berg on all roads. Removed bushes in the cemetery. Raked and seeded where bushes were removed. Checked on Dour Patching. September 9, 2010 Crack sealed with Denny, Gene, and Brian from Providence TWP. Finished Archbold- Whitehouse and started on Mohler. Repaired charging system on Bomag Roller. Checked on Dura Patching. Got trailer prices from Yoder and Frey, and Zero Gravity Trailer Sales. Talked with Toledo Edison about running power to the cemetery building. Talked with Ernst about prices for 2011 chip sealing and chip sealing the cemetery. September 10, 2010 Crack sealing with Denny, Brian, and Gene from Providence TWP. ON Mohler Rd. Rolled behind the Dura Patcher in the cemetery to help repair cemetery drive. Zimmerman Paint Co. striped Soul Rd. Did daily reports work planned, work accomplished, and cemetery reports.

Zoning Compliance: a. Melvin Spencer, 6335 Jeffers; i. 8/31/10 Wrote to John Borell asking if a notice placed in a newspaper of general circulation would constitute serving of Trustee notice of possible action on junk vehicles in yard; ii. 9/2/10 John s response: Yes, you must publish it in a newspaper of general circulation(blade or Legal News) AND post the notice on the main structure located on the property. b. Towner Property, Archbold Whitehouse Road; i. I called various scrappers in the area to see if any might be able to help Mrs. Towner remove the house trailer, here are the results: 1. 9/7/10 - No additional information or progress. c. 8/24/10 - Al Mackey Enterprises, Airport Hwy; i. Al Mackey requested information on Airport Hwy. overlay district, if adding a façade to building to make it look better would require total compliance to overlay district; ii. 8/25/10 Researched zoning resolution, 5.3 Site plan review and approval is required for all new development, for any change of use, and for any existing structure that is enlarged by 25% or more or when the enlargement contains 5,000 square feet of floor area. iii. 8/26/10 Advised Al Mackey adding a façade did not meet any of the requirements that would trigger compliance to overlay district. d. Complaint on Monclova, blighting; i. 9/6/10 Continue to monitor compliance, property owner continues to make progress in cleaning up property. e. 9/2/10 Complaint on burned out house at 4647 S. Berkey Southern relayed by Trustee Tippie;

6 i. 9/3/10 Owners are Lester and Judith Sparks, not current phone listing or address, property taxes have not been paid in over 18 months; ii. 9/7/10 Google search does not provide any information on owners. f. 9/7/10 Tony, American Tower left message about work on tower at Waterville Swanton; i. 9/7/10 Returned call, left voice mail message asking for more information on scope of project; ii. 9/8/10 Scope of project includes adding additional antenna to tower, zoning approval is not required from Swanton Township for normal tower maintenance. Will only be used when main parking area is full. Swanton Township Zoning Resolution d states.nonresidential uses shall be surfaced with concrete, bituminous asphalt or other dust free material other than gravel or loose fill ; Trustees have authorized use of asphalt grindings for other non-residential parking areas, Mr. Cousino asking if this can be approved for Bittersweet Farms also. Needs answer quickly, does not want to lose offer of free material. 8/24/10 - Trustees agreed using asphalt grindings is approved for adding overflow parking to main parking lot. Closed 8/24/10.

New contract will be awarded at Metroparks directors' meeting August 25, work will resume immediately. Well and septic already mitigated, house will be boarded up and drive cabled along with No Trespassing signs pending removal of buildings in September Verified house is secured and driveway cabled 8/17/10.
