The land located in the State of South Australia, approximately 40 km west of Port Augusta referred to as Six Mile Hill Area and which is bounded as follows: Commencing at a point being the intersection of latitude S and longitude E, then east to longitude E, south to latitude S, west to longitude E, south to latitude S, west to longitude E, north to latitude S, west to longitude E, north to latitude S, east to longitude E, and north to the point of commencement, (AREA: approximately 296 square kilometres), being the land which is subject to Exploration Licence Application 2017/00171; and 4. The land located in the State of South Australia, approximately 25 km west of Port Augusta referred to as Illeroo Area and which is bounded as follows: Commencing at a point being the intersection of latitude S and longitude E, then east to longitude E, south to latitude S, west to longitude E, south to latitude S, west to longitude E, north to latitude S, west to longitude E, north to latitude S, west to longitude E, north to latitude S, east to longitude E, and north to the point of commencement, (AREA: approximately 533 square kilometres), being the land which is subject to Exploration Licence Application 2017/00173, all the within latitudes and longitudes being geodetic and expressed in terms of the Australian Geodetic Datum as defined on p of Commonwealth Gazette number 84 dated October 6, 1966 (AGD66). The general nature of the proposed mining operations that are to be carried out on the Land is: Exploratory operations to determine the geology of the Land and presence of mineralisation. Without limiting that general description, those operations may include: reconnaissance; gridding; mapping; aerial and handheld photography; airborne and ground magnetic, electromagnetic, radiometric, seismic, gravity and electrical surveying; soil and other geochemical sampling; water sampling; hydrological studies; hydrogeology surveys; shallow trenching; limited clearing for access and drilling; drilling (including diamond core drilling and other methods); downhole-probing, sampling and radiometric testing of drill core/cuttings; environmental monitoring work (including baseline work, flora/fauna surveys, geotechnical surveys) and establishment of temporary camp/storage sites and access tracks as may be necessary. The proposed activities are (or will be) authorised by the following exploration authorities under the Mining Act 1971 (SA): The exploration authorities granted in respect of Exploration Licence Applications 2017/00120, 2017/00151, 2017/171 and 2017/00173 (including any extension, replacement, renewal, regrant or subsequent exploration licence granted for or other dealings with such exploration authority granted in respect of such applications, and any other exploration authority or interest in any exploration authority for the whole or any part of the Land). The Proponent seeks to negotiate a native title mining agreement under Part 9B of the Mining Act 1971 (SA). TAKE NOTICE that if, two (2) months after this notice is given as required by the Mining Act 1971 (SA), there are no persons registered under the law of the State or the Commonwealth as the holders of, or claimants to, native title in the Land, the Proponent (or its successor or assign) may apply ex parte to the Environment, Resources and Development Court for a summary determination authorising entry to the Land for the purpose of carrying out mining operations on the Land, and the conduct of mining operations on the Land. (c) The Par es agree and consent to a Surrender in rela on to any part of a Conversion Reserve for the purpose of: (i) a Freehold Conversion (Ex nguishment) Act; or (ii) a Leasing (Ex nguishment) Act; or (iii) a Reserve Purpose (Ex nguishment) Act. (e) The Par es agree that the Surrenders described in this clause are intended to Ex nguish all Na ve Title Rights and Interests that may exist in Lot 30, the NEP Land and the land the subject of the acts referred to in clause 7.3(c) at the me of the Surrender. Easement Act means the grant of an easement pursuant to sec on 144 of the LA Act over any part of the Agreement Area for the purpose of providing access and services to the land the subject of a Freehold Conversion (NEP) Act, a Freehold Conversion (Ex nguishment) Act, a Leasing (NEP) Act, a Leasing (Ex nguishment) Act, a Reserve Purpose (NEP) Act, a Reserve Purpose (Ex nguishment) Act or a Reserva on Act. Freehold Conversion (Ex nguishment) Act means the grant of freehold of the whole, or any part, of a Conversion Reserve pursuant to clause 16(a)(i)(A) and clause 16(e). Freehold Conversion (NEP) Act means the grant of freehold of the whole, or any part, of a Conversion Reserve pursuant to clause 16(a)(i)(B) and clause 16(e). Invalid 258/259 Act means any Lot 258/259 Act that was done invalidly for the purposes of the NT Act. Invalid PHF Act means a purported Compulsory Acquisi on of Na ve Title Rights and Interests for a Specified Purpose: (a) in the Port Hedland Agreement Area from 13 April 2011; and (b) in the South Hedland Agreement Area from 8 August 2011, undertaken prior to the ILUA Registra on Date that was done invalidly for the purposes of the NT Act. Leasing (Ex nguishment) Act means the grant of a lease for a period of 50 years or more pursuant to the LA Act over the whole, or any part, of a Conversion Reserve pursuant to clause 16(a)(i)(D) and clause 16(e). Leasing (NEP) Act means the grant of a lease for a period of 50 years or more pursuant to the LA Act over the whole, or any part, of a Conversion Reserve pursuant to clause 16(a)(i)(C) and clause 16(e).
