INTRODUCTION Pawan Hans Helicopters Limited is a Government of India Enterprise having its Corporate Office, C-14, Sector -1, Noida and its regional office at Juhu Aerodrome, S.V. Road, Vile Parle ( W ), Mumbai The present Tender is for providing Room, Catering, House Keeping and Caretaking Services at Rajmundry located within 10 kms. radius from Civil Aerodrome, Madhurapudi Post, Rajahmundry , East Godavari : Dist (AP). The tender documents, duly filled in and signed on all pages should be submitted, together with earnest money deposit, in a wax sealed cover, addressed to The Base Manager, Pawan Hans Helicopters Ltd., Civil Aerodrome, Madhurapudi Post, Rajamundry , East Godavari : Dist (AP) duly superscribing on the envelope the Tender No., Tender Description as given above & due date and to be sent by Registered Post/Speed Post only, otherwise, sealed tenders may be dropped in the Tender Box provided at Pawan Hans Helicopters Ltd., Civil Aerodrome, Madhurapudi Post, Rajamundry , East Godavari : Dist (AP). Tender should be submitted in two parts in two sealed envelopes (1) Technical (2) Price bid. Thereafter, these two wax sealed should be placed in third wax sealed envelope superscribing tender for Providing Room, Catering, Housekeeping and Caretaking Services". The technical bid should have details about eligibility criteria with required certificates as mentioned at Sr No. 3 of this tender document including Demand Draft. The Price bid must given as per Annexure-B only. The technical bid will be opened first. The price bid of tenderer s will be opened provided they qualify in the technical bid and fulfill terms and conditions of tender. The bids will be opened in the presence of representatives duly authorized in writing by the tenderer. 2. DEFINITION The following terms shall have the meaning hereby assigned to them except where the context otherwise requires. 1. Pawan Hans Helicopters Limited(PAWAN HANS) having its Corporate Office at C-14, Sector -1, NOIDA and regional office at Juhu Aerodrome, S.V. Road, Vile Parle ( W ) Mumbai Tenderer shall mean the person(s), firm or Company who enters into an agreement with Pawan Hans Helicopters Ltd for execution of works covered under this tender and shall include their executors, administrators, successors, permitted assignees and legal heirs. 2

3 3. ELIGIBILITY CRITERIA The tenderer must fulfill all the following conditions to be eligible for bidding for the contract. While bidding, the tenderer must attach copies of work orders and certificates from such organizations towards rendering of satisfactory services. 1. The tenderer must have minimum one year total work experience in providing Room, Catering, Housekeeping and Caretaking Services owned by a PSU or reputed private organization/company. In support of the same, tenderer must attach attested copies of proof of certificate along with technical bid. 2. The tenderer must have minimum annual turnover of Rs.3 lakhs in the last financial year. 3. The tenderer has to attach Demand Draft drawn in favour of Pawan Hans Helicopters Limited payable at Mumbai, from any Nationalized/Scheduled Bank as Earnest Money Deposit for Rs.1,50,000/- i.e. 10% of total tender value along with technical bid. 4. The tenderer must have PAN, Service Tax number, VAT & Certificate issued by appropriate authorities. In support of the same, tenderer must attach attested copies of the relevant certificate along with technical bid. 5. The tenderer must have Provident Fund Registration certificate and should have been registered for Employees State Insurance as applicable for his workman, with the competent authority. In support of the same, attested copies of the registration certificate must be attached along with technical bid. 6. The tenderer has to attach along with Technical bid a Demand Draft for Rs.500/- towards tender fees drawn in favour of Pawan Hans Helicopters Limited, if tender document is downloaded from website. 4. ACCOMMODATION The tenderer shall arrange 04 A/C rooms with a cot and Kurl-on mattresses and side table besides a dinning hall with dinning table and chairs of good/standard quality. 5. SCOPE OF WORK The scope of work shall include but not limited to provide following: 1. House keeping & Cleaning 2. Care taking. 3. Preparation/cooking of food/catering, serving of food, snacks provisioning/procure grains, vegetables and dairy food etc. procure, cook & delivery of meals & snacks etc. 4. Changing of bed linen, hand towels, towels, blankets, curtains, up-keeping and cleaning of rooms etc. 5. Caretaking Services: Receiving guests, making them comfortable in their allotted rooms, getting necessary entries made in the records on arrival & departure of guests on need basis/24 hours basis (24 hours a day x 7 days a week ) 6. Collection of room rent, food charges from the guests besides depositing the amount with Pawan Hans officer at the end of every month. 3

4 7. Providing and replenishing wherever required items like toilet soap, toilet papers, air fresheners, mosquito repellent, liquid soap, air purifiers in toilets etc. 8. When the room is occupied continuously by the same occupant, the bed-sheet, pillow cover, bath and hand towels should be changed once in three days. 9. Whenever a guest checks-out, the line, bed-sheet, pillow cover, bath and hand towels should be changed immediately after vacation. 10. The tenderer shall provide refrigerators, water coolers, kitchen equipments, crockery, cutlery, etc. 11. The washing of personal clothes of guests, if any, is to be collected from the concerned guests. 6. CATERING SERVICES 1. Providing round the clock catering services to the officials and guests. 2. Providing all essential material for cooking purposes. The tenderer shall arrange to purchase and provide the raw materials for various like daal, rice etc & other items including the controlled items of good quality at his own cost and that the tenderer shall abide by Government/local bodies laws. The tenderer shall use branded consumables only and /or duly decided by officials of Pawan Hans like Saffola / Sunflower etc. 3. Preparation and serving of bed tea, breakfast, lunch, snack, dinner and beverages etc to guests/officials as per the rates mentioned against each items. 4. The tenderer shall charge for food & other items as per rates mentioned in Annexure-A. 5. The tenderer will have to provide food items of Indian style and as required by Pawan Hans. 6. The authorized representative of PAWAN HANS will be entitled to inspect, at any time, the kitchen or the place where food items/meals, snacks, etc are prepared cooked/ fried and will also be entitled to have inspection of the raw materials grains, vegetables, oil dairy products to be used for the aforesaid purpose. In the event of PAWAN HANS representative rejecting the raw materials procured by the tenderer of food items/meals, snacks, etc whatsoever prepared by the tenderer at any time, the tenderer should not use those materials for preparation and should not supply the rejected food, /drinks, etc. In case of recurrence of this nature the tenderer will be liable for penalty as decided by PAWAN HANS and that the tenderer will also allow the Food Inspector to inspect the food items as per the provision of Food Adulteration Act. etc. 7. The tenderer would use only permissible food colors and edible oils as approved by PAWAN HANS. 8. Catering charges for the food supplied to guests will be collected by the tenderer from them. In case of official guests (which will be advised by PAWAN HANS Office), the tenderer would prepare the bill and sign before presenting the same to PAWAN HANS for reimbursement. 9. The tenderer shall ensure that all his employees shall wear the uniform and maintain very high standard of hygiene, cleanliness, courtesy and pleasant manners. 10. The right of allotment of rooms strictly rests with the PAWAN HANS management only and PAWAN HANS officials will be allotting rooms to the various guests who are permitted to stay. The tenderer will ensure occupation as instructed by PAWAN HANS's officials. 4

5 7. PROVISION OF ITEMS BY TENDERER 1. The tenderer shall provide the rooms duly furnished with cots, tables, chairs etc. 2. The tenderer shall provide items such as soap cases, wall clocks, plastic buckets, mugs, mattresses, bed sheets, pillow covers, stool, bath towels, hand towels, blankets, waste paper baskets, water jugs/flasks, ash-trays, glass tumblers, cloth hangers, bath mats, door mats etc. 3. The tenderer shall also provide gas connection with four burner stove, micro wave, refrigerators and water purifier system in each of the kitchens. 4. The tenderer shall provide electrical items such as bulbs, switches, etc on actual basis against the fused/damaged items. No. replacement otherwise would be carried out. In case if non-receipt of fused/damaged material, charges for such replacement would be debited to the tenderer. 5. The tenderer shall reimburse PNG/gas usage charges, laundry charges and cost of material used for housekeeping/ cleaning like soaps, liquid soap, washing powder, phenyl/ naphthalene balls, paper napkins, mosquito repellent/coils/spray, air purifier, room freshener, mopping equipments, tissue papers etc on production of bills/ invoices on monthly basis. 8. DEPLOYMENT OF MANPOWER 1. The tenderer shall deploy 04 persons who are qualified and experienced persons like Supervisor, Cook, Waiter, cleaners, etc. to meet the staff requirements. Supervisors, must be able to in Hindi and /English and all others must have knowledge of Hindi. The reception /desk should be manned round the clock by educated, courteous and trained personnel who should have ability to speak in Hindi. 2. The tenderer shall employ only adult labour for the work also produce proof of residence/age. He shall employ only those staff acceptable to PAWAN HANS. 3. The tenderer shall provide the staff with uniforms at his own cost in consultation with PAWAN HANS as per their job assignment. Staff working without uniforms are liable to be turned away from being engaged in work. 4. The tenderer shall have to get the medical check-up of his staff members done periodically in the Hospital/by the Doctor as advised by PAWAN HANS at the Tenderers cost. 5. All employees of the tenderer are to be given Photo Identify Cards/Badges. The antecedents of these persons are to be got verified by local police authorities as well as medical checkup examination of such persons. 6. The tenderer shall employ his own staff for the contract work at his cost and risk. The tenderer's staff will not be treated as PAWAN HANS employees (directly or indirectly) for any purpose whatsoever and facilities/benefits applicable to PAWAN HANS employees will not be applicable to tenderer's employees. The tenderer shall duly indemnify PAWAN HANS in the event of any claims made by his employees. PAWAN HANS shall not be responsible for death, disablement, injury, and accident to tenderer's employees which may arise out of and during the course of their duties at PAWAN HANS and the Company shall not be liable to pay any damages or compensation to the tenderer's employees. 5

6 9. OTHER TERMS AND CONDITIONS 1. The rates quoted by the tenderer shall be firm and inclusive of all housekeeping, catering and other services, labour etc to be incurred in executing the jobs and include all statutory/contractual obligations to carry out the above job. The rates quoted by the tenderer shall be all inclusive, liability on account of all taxes, octroi, services tax and all other applicable levies. 2. If rates in words does not tally with rates in figure then the rate which correspond to the amount in words shall be taken as correct. 3. The rates quoted by the tenderer shall be firm for the contract period. No. escalation would be allowed during the period of Contract. The contract shall be valid for a period of three years from the date of award of contract and extendable by two years on mutually agreed terms & conditions. 4. The tenderer shall obtain all required / necessary licences from the appropriate authorities like labour etc. The tenderer cannot appoint any sub-tenderer for the work assigned to him. 5. The tenderer is liable for liquidated damages for deficiencies in providing services, inadequate staff, poor maintenance, failure to control insects, bed bugs, etc. in and deficiencies in services, in general at the discretion of authorized PAWAN HANS 1% on each occasion subject to a maximum of 10% of the monthly catering, housekeeping and caretaking services bill of the tenderer. 6. The EMD of the successful tenderer shall be retained and adjusted against security deposit for fulfilling terms and conditions of the Agreement during the tenure of the contract. The EMD of the un successful tenderers will be returned without any interest within 30 days of the conclusion of contract. 7. The successful tenderer shall be required to deposit 10% of the contract value awarded towards security deposit. The tenderer shall be permitted to give Bank Guarantee for the total value of the security deposit form a Nationalized / scheduled Bank as per format approved by PAWAN HANS. The Earnest Money Deposit and Security Deposit shall not bear any interest during the contract period. 8. The tenderer shall be responsible for fulfilling the requirements of all the existing statutory provisions of state & central governments like labour license etc. including Minimum Wages Act. shops & Establishments Act, Payment of Wages Act, Payment of Bonus Act, ESIC & Provident Fund (Miscellaneous Provisions) Act, Payment of Gratuity, the Industrial Disputes Act. Contract Labour (Regulation and Abolition) Act and all other relevant/ applicable labour/industrial enactments and as may be amended/enacted from time to time, at his own cost and risk in respect of all the staff employed/engaged by him. The tenderer shall maintain records required to be maintained under these statutory enactments and authorized representative of PAWAN HANS shall be entitled to inspect these records at any time. In general, the tenderer shall be responsible for strict compliance of all statutory provisions of the relevant labour laws applicable from time to time and particularly of the State of Maharashtra and local bodies for carrying out the above job. If due to any reason whatsoever, PAWAN HANS is made liable to pay any liabilities payable by the tenderer under any of the said laws and enactments etc, PAWAN HANS shall recover the same from any dues payable to the tenderer and/or from the security Deposit of the tenderer with PAWAN HANS. 6

7 9. The tenderer shall be responsible to either grant leave as per applicable Act or pay wages in lieu of leave. 10. The tenderer shall be responsible for Discipline, Code of Conduct of his employees and in their observing all the security and safety regulations and instructions as may be issued by PAWAN HANS from time to time. Failure to follow discipline & instructions of PAWAN HANS will be construed as misconduct and will be seriously viewed. 11. The tender shall be valid for 3 months from the date of opening of tenders for acceptance by PAWAN HANS. During this period of 3 months the tenderer shall not revoke the tender of revise or the tendered rates. In case the tenderer revokes his tender of revises the rates, the EMD of such tenderer shall be forfeited. 12. Any act on the part of the tenderer or his employees which will be prejudicial to the reputation of the Company shall be considered as grave breach of the condition of the contract and shall render the tenderer liable for immediate termination. 13. The contract can be terminated by either side by giving three months notice by either party. Also, any repetitive deficiencies in performance of the tenderer are liable for termination of contract. 14. In case of any suit or other legal proceeding arising under or relating to the contract to be entered into, the Courts at Mumbai only shall have the jurisdictions. 15. PAWAN HANS reserves the right to reject any or all tenders without assigning any reason thereof. PAWAN HANS also reserves the right to fix one or more tenderers to render the services at lowest rates. 16. Payment shall be made within 30 days after end of every month on the production of bill after deduction of TDS as applicable. 10. PRE-BID MEETING A pre-bid meeting to clarify terms & conditions of tender will be held on 22nd January, 2013 at 1500 hours at Pawan Hans Helicopters Ltd., Rajmundry. One representative of the tenderer may attend pre-bid meeting as per details given above duly authorized in writing by the tenderer. 11. JURISDICTION The agreement including all matters connected with this contract shall be governed by the Indian Law both substantive and procedural, for the time being in force and shall be subject to the exclusive jurisdiction of Indian Courts at Mumbai. 12. ARBITRATION In case of any dispute relating to the contract the matter shall be refer to a sole arbitrator for adjudication through arbitration. The arbitration shall be conducted in accordance with the provisions of the Arbitration and Conciliation Act 1996 or any statutory modifications or re-enactment thereof and the rules made there under and for the time being in force, shall apply to the arbitration proceedings. The Chairman cum Managing Director, PAWAN HANS shall nominate the Arbitrator. 13.
