1 TFC Contact No RFP No A AMENDMENT NO. 3 TO THE CONTRACT FOR ELEV ATOR MAINTENANCE SERVICES BETWEEN THE TEXAS FACILITIES COMMISSION AND EMR ELEV ATOR, INC. THIS AMENDMENT NO. 3 is entered into by and between the Texas Facilities Commission (hereinafter referred to as "TFC"), a state agency located at 1711 San Jacinto Boulevard., Austin, Texas and EMR Elevator, Inc. (hereinafter referred to as "Contractor"), located at 2320 Michigan Court, Arlington, TX 76016, to amend the original Contract, as amended, between the parties (hereinafter referred to as the "Contract"). WHEREAS, the parties agree to add funding in the amount of Seventeen Thousand Four Hundred Sixty and Noll 00 Dollars ($17,460.00); and WHEREAS, the parties desire to amend certain terms to their mutual benefit to reflect the changed circumstances; NOW, THEREFORE, the parties agree to amend the Contract as follows: 1. The parties hereby agree to modify ARTICLE I - STATEMENT OF WORK, Section SERVICE REQUIREMENTS by replacing Exhibit A-1, Building List and Compensation and Fees (Groups # l, #2, and #3), with Exhibit A-2, Building List and Compensation and Fees (Groups #1. #2, and #3). Exhibit A-2 is incorporated herein for all purposes and adds four (4) Kone KCMA3 l Traction Elevators located at the Department of State Health Services Tower Building in Group #2. 2. The parties hereby agree to modify ARTICLE III-CONSIDERATION, SECTION 3.1.(a.) - CONTRACT LIMIT AND FEES AND EXPENSES by increasing the amount to be paid to the Contractor by Seventeen Thousand Four Hundred Sixty and No/100 ($17,460.00), thus increasing the Contract total amount from One Million Four Hundred Twenty One Thousand Nine Hundred Forty and No/100 Dollars ($1,421,940.00) to a total not to exceed amount of One Million Four Hundred Fifty Nine Thousand Five Hundred Sixty and No/100 Dollars ($1,459,560.00). Except as expressly amended above, all provisions of the Contract remain in full force and effect. [This Space Intentionally Left Blank]
