B3.1 Permitted activities

1 Section B3 Hurunui Lakes area All activities in the Hurunui Lakes area managed under the rules in this section shall also comply with the district-wide rules in Section A except as specified. Additional rules, such as those relating to access beyond Lake Taylor, are applied within the Hurunui Lakes area to achieve specific objectives and policies. B3.1 Permitted activities Note: Refer to Policy 18.4 Any activity which is listed as a permitted activity and complies with the conditions in Rule B3.2 is permitted, provided it also complies with the district-wide rules: (a) Activities within reserves and areas administered by the Department of Conservation undertaken in accordance with any reserve management plan, Conservation Management Strategy or relevant conservation management plan (b) Foot tracks (c) Recreation Note: Under Rule A7.4, resource consent is required for commercial activities on the surface of water bodies in the Hurunui Lakes (d) Farming (except intensive farming) Note: Farming excludes intensive farming (e) Farm dwellings (f) Fire control equipment and works (g) Soil and water conservation works (h) Maintenance of the existing public vehicle track between Lake Taylor and Loch Katrine Note: Refer to Policy 18.1 (i) Signs and earthworks ancillary to permitted activities (j) Temporary activities (k) Utilities (l) Buildings and structures ancillary to permitted activities (m) Roads Note: Where an activity does not comply with the district-wide rules it is necessary to refer to the particular section to see how the activity will be assessed. 2 B3.2 Conditions for permitted activities (a) In addition to the conditions below all permitted activities shall comply with the conditions for permitted activities under Section A of the Management Code. Provided that utilities, temporary activities, roads, signs and earthworks ancillary to permitted activities only have to comply with the conditions for permitted activities under Section A of the Code. Note: Refer to Policies 7.3 and 18.4 (b) At Loch Katrine, there shall be no new private buildings, and in respect of the existing private buildings there shall be no: (i) Alterations which increase floor area. (ii) Fencing or other physical means of maintaining exclusive private space around a building. Note: Refer to Policy 18.3 (c) Publicly accessible huts within the Loch Katrine recreation reserve, developed in accordance with a reserve management plan, shall be limited to: (i) 50m 2 gross floor area per structure (ii) Single storey (iii) Cladding material: At least 70% of the exterior cladding of the hut shall comprise one or more of the following materials: Natural unpainted timber (including logs) Painted timber weatherboards Schist Boulders or large stones Cob (adobe blocks or rammed earth) Painted corrugated iron (iv) Roof pitch shall be at least 35 o (d) Except for the construction of foundations for new forms of publicly available huts, there shall be no clearance of indigenous vegetation around existing buildings at the Loch Katrine settlement within the recreation reserve. Provided that the following exemptions apply: (i) removal of indigenous vegetation for reasons of public or personal safety (ii) removal of indigenous vegetation for the purpose of maintenance of any existing facilities, vehicle tracks or firebreaks (iii) maintenance or construction of foot access less than 3 metres wide Note: Refer to Policy Management code Section B Last amended 7/11/2009

3 (e) Recreation shall not be a commercial activity, and shall not include the formation of a track solely for the recreational use of any vehicle, or the construction of any boat ramp or jetty. Note: Refer to Policies 4.3 and 18.4 (f) Maintenance of the existing public vehicle track between Lake Taylor and Loch Katrine shall be limited to providing a single track route of 4WD standard only. Note: Refer to Policy 18.1 (g) All ground disturbed in the creation of public access (but excluding the access itself) or other public facilities shall be restored using locally occurring indigenous vegetation, soil, and rock. Note: Refer to Policy 18.4 (h) Soil and water conservation works shall not use exotic vegetation, or indigenous vegetation which does not naturally occur in the locality. Note: Refer to Policies 1.1, 2.2 and 4.3 (i) The minimum area requirement for dwelling units shall be one dwelling per 20ha of total site area. B3.3 Controlled activities Controlled activities as specified for outstanding landscape areas (refer to Rule A2.3). B3.4 Discretionary activities (unrestricted) Discretionary activities as specified for outstanding landscape areas (refer to Rule A2.4). (a) Any activity which is not specified as a permitted activity. (b) Any permitted activity that does not comply with one or more conditions for permitted activities under Rule B3.2. (c) Recreation which is undertaken as a commercial operation. Note: Refer to Policies 18.4 and 18.5 and for commercial activities on the surface of water bodies refer to Rule A7.3(c) (d) The formation of new roads or tracks (excluding tracks which provide foot access). Note: Refer to Policies 18.1 and 18.4 In assessing applications for resource consent, Council will consider the relevant criteria in Section C1.2, in addition to any other relevant matters. 4 B3.5 Non-complying activities The construction of dwelling units which do not meet the minimum area requirements of Rule B3.2(i) by more than 10%. In assessing applications for resource consent, Council will consider the relevant criteria in Section C1.2, in addition to any other relevant matters.
