6 revelevant legislation that govern Heritage site, National Monuments and Memorial and protected structures ORDER: Agreed. Planning Department and the OPW to be advised of motion contents. 5473(b) Emergency Motion in the name of Councillor Anna Quigley That this Committee recognises the deteriorating situation in relation to litter and dumping in the North Inner City, as highlighted in today s report from Irish Business against Litter, and agrees to hold a special meeting to focus on implementing a co-ordinated response to the increasing problem. ORDER: Report to Councillor. 5473(c) Emergency Motion in the Name of Cllr Cieran Perry That this Committee objects to the proposed Loyalist protest in Dublin City Centre. The disgraceful scenes of loyalist violence currently on display in Belfast are not welcome in Dublin. City centre traders and their customers should not have to suffer similar intimidation ORDER: Agreed. 5473(d) Emergency Motion in the Name of Cllr. Seamas McGrattan This Area Committee condemns the ongoing violence in Belfast and calls on Gardai to ensure Dublin City Traders are not affected by any planned loyalists protests this weekend. Motions 5474 Motion in the name of Councillor Christy Burke That this Committee agrees that every effort be made to allocate extra homeless units to families in bed and breakfast and hostel accommodation in the Central Area. 9 Motions with replies Central Area Committee Meeting January, 2013 Item 5474 Motion in the name of Councillor Christy Burke That this Committee agrees that every effort be made to allocate extra homeless units to families in bed and breakfast and hostel accommodation in the Central Area. Report The Housing Allocations Section of Dublin City Council prioritises homeless households for housing. Every 1 in 3 homes are allocated to persons who are homeless through the Scheme of Letting Priorities. Private Emergency Accommodation (PEA) or otherwise known as B&B accommodation are used in order to avoid involuntary rough sleeping. However the role of this type of accommodation is being phased out as a priority action in favour of taking a housing led response to homelessness which is Government Policy. Focus Ireland s Homeless Action Team actively engages with families in PEA s in order to move them into suitable accommodation. There are also a range of professionals that engage with households regarding their individual needs. Item 5475 Motion in the name of Councillor Seamas McGrattan That this Committee congratulates Dublin City Council on the many events they organised around the lighting of Christmas trees in the Central Area. Item 5476 Motion in the name of Councillor Anna Quigley That this Committee supports increased representation from the local residential community on the Grangegorman Community Liaison Committee Report The matter will be taken up with the Grangegorman Development Agency if the members agree the terms of the motion. The Grangegorman Development will be executed in accordance with the approved SDZ Planning Scheme which takes cognisance of the surrounding neighbourhoods. Item 5480 Motion in the name of Councillor Nial Ring That this Committee requests the Manager to forward our congratulations to LYCS for the production of their newspaper The Champion and their report Hanging Around. 11 That this Committee requests that recommendation 2 of the Community Forum Review (merger of forums) be readdressed to ensure that the North Wall Forum remains in place as a separate forum. Report This issue has been referred back to the Central Area Joint Policing Sub Committee Steering Group with a recommendation in relation to the merging of specific forums. The matter will be re-examined with members requested to submit alternative suggestions for forum amalgamation. Councillors will be informed by of the recommendations of the Steering Group. Item 5483 Motion in the name of Councillor Padraig McLoughlin That this Committee calls for a prioritisation of a Local Area Plan for the Manor Street/Prussia Street area including a traffic management plan so that this can proceed in tandem with the developments at Grangegorman Report Section Area Specific Plans sets out the two schedules of local area/statutory plans which the City Council will prepare. Manor Street/Stoneybatter is included in the second schedule. It is not proposed to commence work on the plans for the areas in schedule two until the plans included in schedule one, the Docklands SDZ and the mandatory review of the City Development Plan are complete. The preparation of a traffic management plan for the area will proceed under the terms of the recent planning permissions granted at Grangegorman. Item 5484 Motion in the name of Councillor Mary Fitzpatrick That this Committee calls on Dublin City Council to upgrade the public lighting on Iona Road. Report The Public Lighting Section will examine the lighting on Iona Road and any improvements deemed necessary will be considered for inclusion in a future lighting programme subject to the necessary finances being made available. Item 5485 Motion in the name of Councillor Christy Burke That this Committee agrees that the extra 2million funding that has been allocated to Dublin City Council by the Department of the Environment be put to use for applicants with disabilities who are waiting for bathroom or toilet works to be done. Report The above disability works as referred are provided in the capital programme and funded by capital grants and internal capital receipts and are not provided in the revenue budget. The determination of the application of the additional 2.2M 2013 revenue general purpose grant will be discussed with elected members during the 1 st quarter in P a g e

12 Development Department Civic Offices 22 nd January 2013 To the Chairman and Members of the Central Area Committee With reference to the proposed grant of a lease of a portion of a Kiosk on Chancery Street, Dublin 7, to the Railway Procurement Agency. To facilitate the construction and maintenance of the Luas Light Rail System, The Railway Procurement Agency has been using a portion of the Kiosk on Chancery Street, shown outlined red on Map Index No SM , to store technical equipment for some time. In order to regularise this situation it is proposed to grant a lease in this portion of the Kiosk, to the Railway Procurement Agency, subject to the following terms and conditions: 1. The lease shall be for a term of 50 years and shall commence on 1 st April The rent shall be a sum of 2,500 (two thousand, five hundred euro) per annum plus VAT if applicable, to be paid quarterly in advance by direct debit. 3. The rent shall be reviewed at five year intervals and shall be linked to any increase in the Consumer Price Index. 4. The Lessee shall be responsible for the payment of all outgoings including rates, charges, fees, bills etc. that may become due on the subject area during the duration of the lease. 5. The leased area shall be used solely by the Lessee for the storage of technical equipment. In the event of it ceasing to be used for such purposes it shall revert free of charge to the Council. 6. The Lessee shall be responsible for appropriate insurances as determined by Dublin City Council, including Public Liability Insurance of 6.4 and Employer s Liability Insurance of 13m, and shall indemnify Dublin City council against all actions, proceedings, costs, claims, demands and liabilities whatsoever arising from all and every activity carried out or promoted by the Lessee and its agents in connection with the facilities on the premises. It shall not do or suffer to be done any activity in any part of the premises which would render void or voidable the insurances of the premises. 7. The Lessee shall at all times be responsible for the proper storage and removal of waste from the subject area and pay for all associated charges. 8. The lease may be terminated by either party on giving the other twelve months notice in writing of its intention. 9. The Lessee shall keep the leased area in a good state of repair and carry out all maintenance and repairs. 12 P a g e

13 10. The Lessee shall at all times ensure the leased area is not used in such a way as to be a nuisance to the public or adjacent occupiers. 11. The Lessee shall not assign or grant any sub-interests in the leased area without first obtaining the written consent of the Council. 12. The Lessee shall not carry out any alternation or development of the leased area or erect any structure or make any excavation without prior written consent of the Council. 13. On termination of the lease, the Lessee shall at their own expense remove all items not belonging to the Council and shall leave the property in a clean condition to the satisfaction of the Council. 14. The lease shall include any amendments and / or other conditions as are deemed appropriate by Dublin City Council s Law Agent. 15. Each party shall be responsible for their own legal fees. It is deemed more appropriate to grant a lease rather than a licence in this case, due to the long-term nature of Luas maintenance and technical requirements. Jim Keogan Executive Manager 13 P a g e

15 Development Department, Civic Offices 10 th January 2013 The Chairman and Members of Central Area Committee With reference to the proposed disposal of the Fee Simple in 60/61 Middle Abbey Street and 43 The Lotts, Dublin 1. Under Indenture of Lease dated 9 th December 1991 the property known as 60/61 Middle Abbey Street and 43 The Lotts was demised by Dublin City Council to J.J. Lalor Limited for a term of 99 years from 16 th April 1974 subject to an annual rent of 1, to be reviewed at the end of the eleventh year of the term and at the end of the fifth year thereafter. The current passing rent is 17,500 (seventeen thousand five hundred euro) per annum. The Law Agent had previously confirmed that the lessee has a statutory entitlement to acquire the Council s fee simple interest. Council Report 536/2009 which was assented to by the City Council at it s meeting on 7 th December 2009 (having previously been approved by the Central Area Committee at it s meeting on 10 th November 2009) had already approved of the disposal of the Council s fee simple interest in this property to J.J. Lalor Limited in consideration of the sum of 390,000 and subject to terms and conditions. However due to the financial problems of the time the applicants were unable to obtain finance to complete the disposal and the matter went into abeyance. Campion Estate Agents acting on behalf of J.J. Lalor Limited have recently contacted Dublin City Council to reopen negotiations to complete the disposal. The Council s Chief Valuer has completed the re-negotiations and accordingly it is proposed to dispose of the Council s fee simple interest in the premises known as No. 60/61 Middle Abbey Street and No. 43 The Lotts to J.J. Lalor Limited subject to the following terms and conditions: 1. That the disposal price in full and final settlement shall be in the sum of 235,000 (two hundred and thirty five thousand euro) plus VAT, if applicable. 2. That the transaction shall close no later than one month from the date of approval of the disposal by the Council. Interest at the rate of 12% per annum shall apply to any outstanding amounts. 3. That the property is as shown outlined in red and coloured pink on Map Index PD That the lessee holds the property from the Council under a 99 year lease from 16 th April 1974 at a current passing rent of 17,500 (seventeen thousand five hundred euro) per annum. 5. That all outstanding charges, rent, rates and taxes (if any) on the property for which the lessee is liable, shall be cleared prior to the completion of the disposal. 15 P a g e

16 6. That the lessee shall pay the Council s legal costs of transfer, together with the Council s Valuers fees of 2, That the above proposal is subject to satisfactory proof of title. 8. That the above proposal is subject to proof of bank funding. 9. That the above proposal is subject to the necessary consents and approvals being obtained. 10. The Chairman and Members of Central Area Committee 30 th January 2013 With reference to the proposed grant of a lease of Creche Facility at Rory O Connor House, Hardwicke Street, Dublin 1. The Lease granted by Dublin City Council to Hardwicke Street Creche Limited for the childcare centre at Rory O Connor House, Hardwicke Street for a period of 4 years and 9 months from the 11 th June 2007 subject to a rent of 55,000 per annum abated to 1,000 per annum provided the premises was used as a crèche facility has expired. The expiry date is 10 th March The property demised is more particularly delineated on Map Index No Accordingly Dublin City Council propose to grant a new lease for a period of 5 years commencing on 11 th March 2012 for the childcare centre subject to the terms and conditions set out below: 1 Hardwicke Street Crèche Limited shall be granted a lease of the property for a term of 5 years from 11 th March 2012 at an initial rent of 30,000 (thirty thousand euros) per annum. Notwithstanding the rent so reserved, the rent payable shall be abated to 1,000 per annum on condition the premises is used as a crèche facility. 2 The property shall be used for childcare purposes only and in the event of it ceasing to be used for such purposes, the lease will terminate or the appropriate open market rent will apply as determined by the Council s Valuers. 3 Hardwicke Street Crèche Limited shall not sell, assign, sub-let, sub-divide, alienate or part with possession of the subject property without the prior written consent of the Council. 4 Hardwicke Street Crèche Limited shall not use the property or any part thereof as a residence except that a caretaker will be permitted to reside on the said property in pursuance of his/her employment subject to prior written consent of the Council. 5 Hardwicke Street Crèche Limited shall insure the premises and contents thereof against all insurable risks and Dublin City Council shall be indemnified against all liabilities. 6 Hardwicke Street Crèche Limited shall be responsible for the full internal and external repairs including maintenance of the outdoor play area and will be bound by other standard covenants relating to maintenance and user of the premises as normally contained in leases of this nature. 7 Hardwicke Street Crèche Limited shall be responsible for all outgoings, rates, taxes etc. 18 P a g e

21 Development Department Civic Offices To the Chairman and Members of the Central Area Committee 31 st January 2013 With reference to the proposed grant of a lease of 12 Buckingham Street Lower, Dublin 1 to the Fire Station Artists Studios Limited The City Council granted a 99 year lease of the former Fire Station at 9-11 Buckingham Street Lower, Dublin 1 on 13 th March 1992 effective from 15 th April 1992 to the Fire Station Artists Studios Limited. The lessee has applied to lease the adjoining building at 12 Buckingham Street Lower to extend the Studios. The building, shown on the attached map, will require complete refurbishment for which the lessee has received planning permission (2106/11 refers). It is proposed to grant a lease of 12 Buckingham Street Lower to Fire Station Artists Studios Limited subject to the following terms and conditions: 1. The proposed lease will run co-terminous with the Lease of 9-11 Buckingham Street dated 13 th March 1992 and shall contain similar terms and conditions as it except where the Council s Law Agent deems otherwise. 2. The proposed rent shall be the market value (currently 10,000 pa plus VAT) abated to 6.35 pa as long as the premises is used as a community and cultural amenity. The lease will provide for five yearly rent reviews. 3. The lessee shall be permitted to refurbish the premises in accordance with planning permission granted and make it fit for use as part of the Fire Station Artists Studios 4. Prior to entry onto the premises the lessee shall obtain a high level of public liability insurance and employer s liability insurance which shall indemnify Dublin City Council against any and all claims arising from its use of the premises. The Council will have an absolute right to set a minimum level of public liability and employer s liability insurance and to review the figures on a yearly basis (the current minimum levels are 6.4million and 12.7 million respectively) 5. The lessee shall be responsible for any rates, taxes, utility bills and outgoings assessed on the property from the date of entry onto the premises. 6. 24 28 th January, To the Chairperson and Members of the Central Area Recommendation: Proposed Addition of Spencer Lift Bridge, including stone plaque and abutments, Sheriff Street, Dublin 1 to the Record of Protected Structures in accordance with Section 54 and 55 of the Planning and Development Act, Photo of Structure Procedure Followed In accordance with the procedures set out in Section 54 and 55 of the Planning and Development Act, 2000, Dublin City Council by public notice on 30/10/2012 indicated its intention to add Spencer Lift Bridge, including stone plaque and abutments, Sheriff Street, Dublin 1 to the record of Protected Structures (RPS). The bridge is owned by Dublin City 24 P a g e

25 Council. The proposed addition was advertised in the Irish Times on 30/10/2012. The public display period was from 30 th October, 2012 to 11 th December, 2012 inclusive. During this time only one observation/submission was received in response to the proposed addition. Summary of Applicants Reasons for Seeking Addition The present-day Spencer Bridge is a testament to engineering developments of the early 20th century, providing an innovative solution to problems posed in forging a crossing over the Royal Canal. Replacing an earlier drawbridge, this lifting bridge forms an important addition amongst the predominantly stone bridges of the canal. The bridge has technical, historical, architectural and social significance under the 2000 Planning and Development Act. Its sister swing bridges on North Wall Quay are already on the record of protected structures. This bridge completes the grouping and therefore the bridge along with its stone plaques, quays, steps and gates should also be included in the RPS as it is an important record of the industrial heritage of Dublin and in particular the ever changing city docklands. Site Location & Zoning Map Zoning map: The above extract is taken from Map E of the Dublin City Development Plan Spencer Bridge is located with a Conservation Area and within Zoned areas Z9 (to preserve, provide and improve recreational amenity and open space & green networks) and also Z11 (to protect and improve canal, costal and river amenities). These zones take the path of the Royal Canal beyond which lies Zoned area Z1 (to protect, provide and improve residential amenities). To the immediate south east of the bridge is the Zoned area Z 14 (to seek the social, economic and physical development and/or rejuvenation of an area with mixed use of which residential and Z6 would be the predominant use). 26 Colour Cyan: Zoned Z11 Area within Blue Line: Zoned Z 14 Summary Description Exterior: This lifting bridge is an iron lifting bridge (currently inoperable) that would have lifted a section of the Sheriff Street road to allow traffic on the Royal Canal to pass by. The bridge is made up of two large iron open trusses located at high level and running parallel to each other which are a carriageway distance apart. The trusses are separated by a large weight located on the back end and the lifting struts on the front end. The struts are connected to the section of the bridge carriageway to be lifted. The two trusses are cross-braced by means of secondary iron trusses. Originally this top section which was carefully balanced pivoted via two large iron cog wheels over the two supporting iron pillars anchored to the west side of the canal. A release mechanism would have allowed the weight to drop at the back end, in turn lift the struts at the front which were connected to the bridge carriageway thus lifting it. The flat iron and angle iron of the structure is held together by thousands of nuts and round head carriage bolts. It is visibly more corroded due to weathering on the southern side. The walls of the dock are possibly of Oranmore limestone, and steps lead down into the canal on the northern side of the bridge. The markings on the deck and the joints on the bridge carriageway indicate the section of bridge that once lifted. There are wrought iron railings and gates to either side of the bridge. A limestone plaque marking the opening date of the dock is located on the northern side of the street on the east bank of the canal. Historic Background The OS maps of 1864 depict a bridge in this location before the first swivel bridge was constructed in This 1873 bridge was the first mechanical bridge at this crossing allowing the canal to be opened up for industrial and maritime purposes. It was designed by James Price and was the first of its type. It was listed as near completion in c1873 in the Directory of Irish Architects The swivel bridge (Price s) is also indicated on OS maps dated 1907 and An article in the Irish Times dated 14 April 1873 stated that the following Tuesday their Excellencies the Lord Lieutenant, K,G, (Knight of the Garter) and the Countess Spencer, will arrive at the North Wall at two o clock... Their excellencies will then embark on board HMS Hawk, moored in the old dock, and will proceed through the entrance to the new dock, the swivel bridge being opened that that purpose for the first time. Having passed through his Excellency the Lord Lieutenant will declare the Spencer Dock open. This day in April 1873 marks the first official use of the bridge and Spencer Dock which was a historical development in terms of the expansion of the dock. A paper published by the Engineer J. A. Saner's in 1909 (SWING BRIDGES OVER THE RIVER WEAVER AT NORTHWICH) further states: "The Northwich bridges were 3 times as heavy and had twice the span of the floating swing bridges erected by Mr. Price at the Spencer Dock in Dublin. At this bridge the part of the weight not carried by the buoy was carried by a central pivot beneath the buoy, with guiding wheels bearing against the sides of the well in which the buoy floated. The idea of carrying the weight on floats was described by 26 P a g e

27 Mr. James Price in a paper given to the Institution in The Dublin bridge carries 95% of its weight on the float." The bridge that currently stands on the site is believed to have been constructed in The Irish Times reported on the opening of the new Sheriff Street drawbridge on the 17 October 1941 which had cost 18,000; it was a structure unique of its kind in these islands". References: From the OS map of 1864 it is clear that a bridge crossed the canal at this location. This was replaced by Price s swivel bridge which was nearing completion in 1873 as documented in the Directory of Irish Architects This allowed for the opening of Spencer which was an important milestone in the development of Dublin Docklands. Assessment of Special Interest Under the Planning & Development Act 2000 The bridge is a fine example of engineering and design of its time and, is an important feature of the industrial heritage of the local area. 2. The bridge stands on the site of the previously acclaimed swivel bridge and symbolises the important industrial past as well as the great engineering achievement of this type of bridge. The importance of the original swivel bridge opening was marked by the fact that the opening ceremony was performed by their Excellencies the Lord Lieutenant, John Poyntz Spencer, 5th Earl of Spencer and Countess Spencer. 3. The bridge represents a structure that was build to overcome an engineering problem derived from the meeting of two forms of early transport (water and road). It s a good example of this typology of draw bridge engineering not seen very often on current transport networks. The bridge, apart from being important as an historic edifice is also significant as it marked the opening of the Spencer Dock, essential in the development of Dublin Docklands. The lift bridge at Spencer Dock is of architectural, historical and technical significance and is an important landmark for the area. The bridge, as the previous historic lift bridge, would have been used to lift a section of Sherriff Street to give way to maritime traffic on the Royal Canal at Spencer Dock. It is a strong symbol associated with transportation that was present in this area in the past. Significance/NIAH Rating: The National Inventory of Architectural Heritage (NIAH) has not been carried out for the Dublin City Council area; however, its categories of special interest (architectural, historical, archaeological, artistic, cultural, scientific, technical & social) and its rating system has been used to assess the building in question. The NIAH identifies five categories of rating in seeking to rank buildings. The NIAH rating values are International, National, Regional, Local and Record Only (I, N, R, L, O). Structures which are considered of International, National, and Regional significance are deemed worthy of inclusion on the RPS. Using the NIAH rating system, the Spencer Lift Bridge, Sheriff Street, Dublin 1 is Regional as it has significant importance in the context of Dublin city. Submissions/ Objections Received 27 P a g e

28 One valid submission was received following the public display period. This submission from the City Engineer, Michael Phillips, states the following: 1. The lifting bridge has not been operable for several years and in its current state is an impediment to canal shipping. 2. Due to its current state of repair there are safety concerns for the public and palisade fencing has been erected to minimise danger and further vandalism. 3. Current estimates suggest that it would cost in the region of 1.6 million to make the Bridge operable, following which there would be ongoing maintenance and operational costs for the Roads and Traffic Department. 4. The preference would be for the replacement of the bridge, if monies become available. 5. The addition to the RPS of a non-functioning bridge would place an onerous financial burden on the City Engineer s Department, would involve ongoing operational maintenance expenditure and would be a poor use of public funds. Mr Phillips would advise against the addition of the bridge to the RPS and when resources become available, feels it should be replaced with a fixed bridge - in that event the plaque and abutments would be retained. (Late submissions were received after the statutory period from the Royal Canal Amenity Group Ltd. and Waterways Ireland. Both submissions were against the addition of the bridge to the RPS, as it would reduce the options for repair/replacement of the bridge in the future). Response to Observation/Objection It would appear that the heritage reasons for adding the bridge to the RPS are outweighed by practical and financial considerations as set out above. The City Engineer has indicated that if the lifting bridge is being replaced, as a gesture of goodwill it will be placed on the adjoining canal bank as a heritage feature. The plaque and abutments would also be retained by his Department. The late submissions from the Royal Canal Group and Waterways Ireland support the City Engineers case that the addition of the bridge would reduce the options for repair/replacement of the bridge in the future. The offer of the City Engineer to keep and re-use the bridge on the nearby bank and to retain the plaque and abutments in-situ is to be welcomed and this correspondence has been placed on the file. Meeting of the Area Committee The addition of the structure was brought forward to the Central Area Committee on the 8/05/2012 where it was agreed by the elected members to initiate the statutory procedure to add Spencer Lift Bridge, Sheriff Street, Dublin 1 to the RPS. Recommendation: In light of the objections received against it s addition to the Record of Protected Structures as set out above, it is recommended that the proposed addition of the Spencer Lift Bridge, including stone plaque and abutments, Sheriff Street, should NOT be added to the Record of Protected Structures. 42 Allocations & Transfers Section Housing and Residential Services 5 th February 2013 Report to the Chairperson And Members of the Central Area Committee Review of Housing Transfer List As part of an overall exercise, in November 2012 the Housing Allocations Section wrote to all tenants who were currently on the transfer list to enquire if they still wished to be considered for a transfer. The Housing Transfer list has not been revised for quite some years and it was necessary to ascertain the current details of each tenancy in order that applicants were placed appropriately on the waiting list in accordance with their circumstances and preferences. The exercise was also undertaken as part of the preparatory work required before the introduction of the new Allocations Scheme. When the elected Members of the City Council adopted the new Scheme last December, the City Council sought the requisite Ministerial approval and it is hoped that a response will issue in the near future. Approximately, 6500 enquiry letters were issued and to date 3000 have been returned and processed accordingly. It is now proposed to issue a reminder letter to tenants who did not respond to the first letter and a prepaid envelope facility will be issued with the letter. Tenants are also asked to indicate if they no longer wish to be considered for a transfer and send their reply in the prepaid envelope provided. The reminder letters will be issued in mid February and applicants will be requested to have the forms returned by 15 th March. It is then envisaged that tenants who no longer wish to be considered for a transfer and tenants who do not respond will have their applications removed from the transfer list. Tenants who are being removed from the list will subsequently be notified in due course and those who make contact within a grace period of one month thereafter will have their application re-instated. This exercise is necessary to ensure the accuracy of the transfer list. This report is submitted for noting by the members and your co-operation is requested in relation to advising your constituents of the foregoing in your regular interaction with them. 43 Allocations & Transfers Section Housing and Residential Services 5 th February 2013 Report to the Chairperson And Members of the Central Area Committee Allocation of Belmont Apartments INTRODUCTION Dublin City Council is committed to the principle of building strong communities and recognises the fact that housing people in the most appropriate accommodation for their housing need is important in achieving this objective. All City Council housing is allocated on a needs basis and the Scheme of Letting Priorities is designed to identify applicants with the highest points or most urgent need for accommodation. Occasionally, the Scheme of Letting Priorities is not deemed to be the most appropriate manner of deciding allocations. This may occur when adherence to the Scheme proves contrary to the principle of good estate management. In such circumstances it becomes imperative that a common sense approach is used to decide allocations. As you are aware, in those circumstances the Area Committee is consulted and approval is sought prior to any deviation from the Scheme. Dublin City Council will take charge of three 2 bedroom properties at Belmont Apartments, Dublin 1 shortly. These are units are in a small private development without play facilities or communal green spaces. By their nature these units are deemed inappropriate for families with young children and expanding family units. In the interests of maintaining good estate management the agreement of the Committee is sought in making allocation of these units without reference to the Scheme of Letting Priorities. The house has been vacant for some time and was in need of extensive renovation before being suitable to house a family. The gardens were being treated as a dumping ground which was a constant source of nuisance and annoyance to neighbours. In view of the high cost of refurbishment, complaint of anti-social behaviour, nature and extent of dumping, Dublin City Council engaged with Habit For Humanity Ireland to refurbish No. 5 Williams Place Upper, Dorset Street Lower, Dublin 1 Habitat For Humanity Habitat for Humanity (HFH) is a worldwide non-profit housing charity that works in partnership with families in need to build, renovate, and refurbish simple, decent affordable homes. Families receive extensive training and support from HFH Ireland to enable them to make a smooth transition to homeownership. HFH Ireland is an affiliate of the international organization. In recent years Dublin City Council has engaged with HFH Ireland to refurbish a number of social housing units that comprised part of Dublin City Council s housing stock. Most recently in April 2012, when HFH Ireland successfully under took the refurbishment of four housing units, contained at dwellings 85 & 87 Emmet Road, Inchicore, Dublin 8 Proposal It is proposed that Dublin City Council release the property at No. 5 Williams Place Upper and transfer ownership to Habitat for Humanity Ireland at a nil cost in lieu of the refurbishment works costs incurred by Habitat. The dwelling will only be sold on by Habitat to a low income family on the Councils waiting list. HFH supports homeowners in arranging a low mortgage to cover part of the cost of refurbishment works. At present it is estimated that these refurbishment works will cost approximately 75,000. All professionals involved in this refurbishment have been engaged on a voluntary basis through HFH. 50 Central Area HQ, 51/53 Sean McDermott Street, Dublin 1 7 th February 2013 To the Chairperson and Members of the Central Area Committee: With Reference to Report number 1 of the North Inner City Litter Action Group (N.I.C.L.A.G) Background The Central Area Committee at its meeting held on the 7th of January 2013 agreed to the setting up of the North Inner City Litter Action Group and the following Terms of Reference was agreed: To carry out an examination of the litter issues in the North Inner City, to identify the particular causes/sources of same and to devise and implement actions to bring about a gradual and consistent improvement in the situation. Membership Chair: Brendan Hayden, Senior Executive Officer, Central Area Representatives from Public Domain Unit, Central Area Representatives from Waste Management Section Representative from Community Development Section Representative from Area Housing Staff Representative from Iarnrod Eireann & Waterways Ireland (as required) Administration: Central Area The necessity for setting up this group was as a result of recent inspections of the area, complaints on the Litter Hotline and through other means from members of the public and also complaints from Public Representatives and the need to be proactive in dealing with the various matters complained of. A recent IBAL Report was also critical of the cleanliness of some areas of the North Inner City and it highlighted a total of 19 streets in the Central Area of which 10 received a Grade C or lower. 6 of the sites surveyed received a Grade D, which is the lowest litter grade in the report. While the contents of the IBAL Report may be correct in their reference to the high level of littering and illegal dumping in parts of the Central Area at a specific time and for a particular period, other descriptive aspects of it could be described as being inconsistent in approach in terms of comparability on a like for like basis with other areas of the country. Therefore, it is considered that if a league table is to be used by IBAL, then it should be compiled for areas that are on a par with each other, population wise, neighbourhood layout wise etc. The establishment of the Group is an acknowledgement that some parts of the Central Area are suffering from indiscriminate littering and illegal dumping of rubbish which is affecting residents and businesses alike and is causing reputational damage to the area and there has undoubtedly been an increase in the number of complaints as a result of what is happening on the ground. 50 P a g e

51 Initial Actions The North Inner City Litter Action Group (N.I.C.L.A.G) has met on 3 occasions in January 2013 to formulate a plan for the Central Area. A pilot area has been agreed, running from the North Wall Quay to Clonliffe Road and from Gardiner Street to the East Wall Road and all streets in between. Twenty to twenty five streets at a time will be selected in the pilot area, which is covered by the North Strand Waste Management Depot and these streets will be profiled and issues of littering and illegal dumping if any will be recorded. While this examination is being carried out the piloted streets will be cleaned and cleared of any rubbish with Waste Management Services continuing to carry out their normal day to day work as usual. Derelict sites or buildings will also be identified. The Waste Management truck which removes untagged bags will be accompanied by a Litter Warden. All bags will be searched and records of fines issued and numbers of bags searched will be reported back to the North Inner City Litter Action Group for the duration of the survey period. The Public Domain Crew, Litter Warden and Waste Management will work on the selected streets for approximately three to four weeks and report on all issues relating to littering and dumping. Streets that are found to be clean will be recorded and reported on. After this period the process will move on to the next set of streets in the area for attention and so on. The selection process of streets will include known litter black spots. As this process moves on special emphasis will be placed on engaging with local Community Groups and Resident Associations and other organisations and agencies as required in an effort to set up local environmental groups and to support these groups when the process and profiling has been completed in selected areas. Waste Management It is important to acknowledge the hard work of the Waste Management Section and the Public Domain Section in the Central Area; however the Group has to have a different approach to the littering and illegal dumping in the area. There is a planned approach to Waste Management across the City but in this particular area some of the work that the Waste Management Section and the Public Domain Section carry out, by its nature, is often reactionary and responsive, and that is by no means a criticism but a reality. The Group needs to be able to identify where the difficulties are arising, report its conclusions and suggest initiatives and recommendations where possible, over and above current works being carried out by Waste Management/Public Domain Sections. It should not be caught up in the normal day to day issues of littering and illegal dumping otherwise it will be just another mechanism used in order to clean streets which is no different to what is already in existence in terms of practice. It is already recognised that current reactionary actions are not solving the problems and therefore there is a requirement for new ideas and new initiatives to be implemented to complement current efforts to try and resolve and curtail some of the difficulties now being experienced. The Waste Management Section has indicated its full support for this pilot scheme and will offer both manpower and technical knowhow in an effort to seek new ways of dealing with the problems outlined. 51 P a g e

52 Current Issues: As previously advised the N.I.C.L.A.G will be reporting on a monthly basis to the Central Area Committee, and the Group will identify the causes and the sources of the problems. The monthly reports will also outline, inter alia, ways and means of tackling the issues of concern. However it is common knowledge what is happening and where the problems are and listed below are some of these identified items with comments and actions.. It is expected that the list of problems and actions will be added to with each report to the Central Area Committee, with a final and comprehensive report being published in 12 months time. Items for noting Bag collection system only is a huge negative factor in some areas The area in question (North Inner City) is a city centre location with a high footfall count 7 days a week, resulting in high levels of litter being generated This area has a high level of shops, businesses, and owner occupied residential accommodation and private & public rented accommodation and as such needs a modified approach to Waste Management as and when required Dumping of bags outside business premises, in laneways and gable ends of houses as well as open areas, railway lines and the canal is a common occurrence Dublin City Council has no knowledge as to who (individuals/residents/businesses) are registered with, in relation to the collection of their rubbish although it has the means to gather such information under the Waste Management Act 1996 Prosecution of offenders in the courts can be cumbersome and wholly reliant on an evidence based approach, which is sometimes difficult to compile Individuals, who illegally dump regularly, are unlikely to include any details in bags that may identify them. Apparent lack of Environmental Education Programmes for school children is a factor There is a legal onus on Dublin City Council to keep streets clean and some individuals will dump illegally and are very aware that eventually the Council will clean up any created mess The attitude of some Individuals in not being willing to pay their charges for waste management is the single biggest factor in the illegal dumping issue Abolishing the waiver system is likely to add to instances of illegal dumping Responsibility of landlords for the actions of their tenants needs to be addressed in some way Payment for green bags may have a negative impact going forward and this needs to be monitored Initial Recommendations Listed below are a number of initial recommendations in an effort to move the process on, and it is acknowledged that some of these may be deemed to be too inspirational or are being carried out already. However some of the recommendations will require a change or strengthening of the Law relating to litter and illegal dumping, or a more proactive approach and extra resources in implementing and ensuring proposed actions are carried out in full. It is expected that these recommendations will be increased and expanded on over the period of this pilot process. 52 P a g e More use of CCTV and other oversight methods in areas renowned as litter black spots is required as is more use of technical support from the Waste Management Section. More community involvement and encouragement and support for the setting up of environmental groups is necessary together with the organisation of more community cleanup weeks/weekends. An emphasis on educational programmes in relation to littering and dumping of rubbish and the effects on people s health and the environment are needed- Apart from engaging

53 directly with the Community on this issue, there is also a case to be made that a more comprehensive and targeted approach in educating school children should take place. It might be simplistic, however school children do bring the message home to their parents, and this is what is needed. Encouragement of private owners and dwellers to maintain their premises particularly those with basement accommodation where littering can be a problem, is required More encouragement for and targeting of recycling is needed Encouragement of greater links and communication between the Waste Disposal Companies and the Local Authority is required More targeting of businesses to encourage them to keep footpaths around their premises clean and tidy is necessary More Media campaigns highlighting the problems, the penalties and the supports for communities interested in keeping their areas and streets clean and tidy are required - There is a need to look at Dublin City Council s Media Strategy and information, the do s and the don ts and a more concerted effort made to get the message out, that illegal dumping is wrong, is damaging communities and businesses and the City s reputation and is bad for tourism, and most importantly people s health. Perhaps the assistance of well known sporting figures could be considered in any media campaign Encouragement of Waste Disposal Companies to enter into more dialogue with its customers in order to find out what the issues are and to deal with them, where appropriate, is essential. Waste operators need to be encouraged to provide a bin (as distinct from a bag) collection service where feasible and Bye-Laws will be of assistance in this regard Naming and shaming of offenders needs to be revisited. Identification of the owners of neglected multi let properties needs to be prioritised. A programme of street washing outside of and apart from the main thoroughfares is required Stiffer penalties for illegal dumping (Increased fines) are required Location & siting of litter bins needs to have a criteria driven as distinct from a request driven approach Easier access to the courts and an acknowledgement that the issue of littering and illegal dumping are very serious and must be dealt with in a stronger manner is needed The current Litter Management Plan needs to be examined in the context of issues emerging from the North Inner City Litter Action Group Report, with particular reference to the frequency of cleaning of certain streets A map of the area covered by the North Strand Waste Management Depot is attached for your information as well as a list of the first 25 streets which are the streets to be profiled and reported on, in the first instance as part of this pilot project. The March report to the Committee will outline the condition of each of the streets over a period of 3 to 4 weeks and recommendations around what actions are required to keep these streets in a reasonably clean and tidy condition.
