6 Lea Marston Parish Council c/o 4 School Lane Lea Marston Sutton Coldfield Birmingham B76 BW By leamarstonpc@hotmail.com, davidmreilly@icloud.com 8 July 216 Dear Mr Reilly I am the Director of Hybrid Bill Delivery at HS2 Ltd, which is acting on behalf of the Promoter of the High Speed Rail (London West Midlands) Bill ( the Bill ) currently before Parliament. I understand that you have a number of concerns about the impact of Phase One of HS2 (known as the Proposed Scheme ) and have submitted a petition on that basis to the House of Lords. I am writing to set out our position in relation to the issues you have raised and the measures identified to address your concerns. The House of Lords Select Committee considering the Bill was appointed on 5 May 216 to consider the issues raised by Petitioners against the Bill. However, as the Bill was debated and approved at Second Reading in the House of Lords on 14 April 216, the principle of the Bill is deemed to have been approved. Therefore, the Select Committee cannot reject the Bill outright or make any change that go against the principle of the Bill. At the very beginning of the Select Committee s proceedings, the Chairman, Lord Walker of Gestingthorpe, stated: We will be concerned only with petitions arguing for mitigation, compensation and adjustment to meet adverse effects on particular interests. We cannot entertain any objections to the principle or policy of the Bill, which was a matter for the Second Reading debate, which took place in the House of Lords on 14 April. This statement can be found in the document A Guide to Petitioners, which is published on the Select Committee s dedicated pages on the Parliament website ( The guide also sets out the order of proceedings in Select Committee. Petitioners are strongly advised to read the guide and check the website regularly for the latest updates from the Select Committee. P1788 (1) HOL/235/6

7 Engagement and the Special Management Zone My team have met with the Parish Council on five occasions since their November 214 appearance before the House of Commons Select Committee. These meetings included a meeting with HS2 Ltd Environment Director Peter Miller in February 215, a meeting in March 215 to share the draft plans for Additional Provision 2 in advance of the July 215 deposit, a meeting in September 215 to share the draft plans for Additional Provision 4 published in October 215, further meetings in January & June 216, and the next meeting is booked for July 216. In addition, an Information Event was held in the area in November 215. This was communicated to the Parish Council in advance, advertised locally with posters and over 5 postcard invitations were sent out. 346 people attended the event. At the last meeting with you on 16 June 216, the new Senior Engagement Manager for your area was introduced and a discussion took place regarding the future engagement plans and the Special Management Zone (SMZ) as provided for in an assurance to North Warwickshire Borough Council in terms set out below: In line with the Code of Construction Practice, the Secretary of State will require the nominated undertaker to ensure that appropriately experienced community engagement personnel are appointed to manage stakeholder and community relationships during the development of HS2 in the Lea Marston, Kingsbury, Curdworth, Wishaw and Middleton Parish Council areas. The community engagement team will include: A single point of contact for local authorities in the area; Named individual points of contact for affected property owners; and A senior manager accountable for effective implementation of the Code of Construction Practice within the area. The broad duties of individuals will include, but will not be limited to: Being the first point of contact for communities and local authorities along the line of route; Coordination between both proposed phases of the railway, including alignment of powers and construction approaches; Managing relationships with the local communities, businesses, local authorities and other stakeholders; Raising issues from the community within HS2 Ltd for escalation, resolution or clarification; Monitoring the progress of each item raised and keeping stakeholders informed of progress; Ensuring the HS2 stakeholder engagement framework is appropriately implemented; for the whole scheme Attending regular meetings with the lead contractors, local authorities, local communities and other stakeholders to discuss construction issues and forthcoming programmes of works; and Advising on the appropriate support mechanisms to be provided by the nominated undertaker which will be available to local businesses, land owners, voluntary and community organisations that may be affected by the works. Liaison with Lea Marston, Kingsbury, Curdworth, Wishaw and Middleton Parish Councils. At that meeting it was agreed that further discussion would take place in preparation for the development of the SMZ following Royal Assent, currently anticipated to be toward the end of P1788 (2) HOL/235/7

8 216. As I have said, the next meeting has been arranged for 21 July 216 to continue these discussions and I trust this addresses your concerns in relation to engagement. Railhead operation You raised concerns in your petition regarding understanding how the railhead will operate and requested to be properly informed. The nature and operational activity that will take place on the railhead site and its likely impacts are set out in the main Environmental Statement (ES) published in November 213. This includes the sites proposed lifespan in terms of its construction and operation. The mitigation controls are set out in the draft Code of Construction Practice (CoCP). During the operational phase of the railhead (1 year, 11 months), 24 hour working will be required for some activities and this is explained in the ES CFA2 map book report, section : The railhead will be operational twenty four hours a day. This is required to ensure trains are ready for operations the following day. Overnight works will be reduced where possible by using a just in time delivery strategy to reduce the need to load and unload wagons. Lighting will be required to provide safe working areas during hours of darkness. Low level lighting will be provided for the sidings, with floodlighting to the storage and fabrication areas. Lighting will be designed to the requirements of the draft CoCP. It is proposed that during the construction, testing and commissioning and decommissioning phases the works would be undertaken within the standard hours set out in the draft CoCP. Contractors would be required to apply to the relevant local planning authority for consent to the proposed construction works under section 61 of the Control of Pollution Act 1974 prior to 24 hour working. This is explained further in HS2 Information Paper D3, Code of Construction Practice (CoCP) and HS2 Information Paper D4, Working Hours. In addition to the information published in the ES that explains the nature of operations at the railhead, we have provided additional information which goes beyond that published in the Bill and Additional Provisions. This has included the creation of a map which gives an indicative inner layout of the positioning of different railhead functions and the creation of cross sections and the nature of operation of the railhead has been discussed in meetings. As noted in the Promoter s response to paragraphs 1a & 1 d (i) of the Parish Council s petition against Additional Provision 2 (AP2) to the Bill in the House of Commons, AP2 brought forward a significant package of mitigation for the Special Management Zone area. This includes 13.8ha of extra landscape planting, an increase to the bunds surrounding the Kingsbury Road railhead to a maximum of 5m above the rail level on the northern side of the railhead side, a maximum of 6m above the rail level at the eastern side; and a maximum of 4m above rail level at the southern side. Landscape mitigation planting would also be provided around the area of the Leeds spur, Birmingham and Derby line reception sidings and the head-shunt track. The House of Commons Select Committee s interim report recognised the Promoter s actions to address the effects of construction on the area from both Phase One and Phase Two of the railway: P1788 (3) HOL/235/8

9 Kingsbury will be the location for a very substantial construction railhead which is likely also to be used in Phase Two if that proceeds. This status has been recognised by making it part of a Special Management Zone for Warwickshire with designated liaison staff. Since introduction of the hybrid bill in November 213 the Promoter has developed better mitigation in the form of higher bunds and extended planting. Site restoration You have requested that the railhead site be returned to its current agricultural ecological state, that all the mitigation earthworks be removed and current topography be restored, and that once restored a covenant be placed on the after-use of the land or it be gifted to Lea Marston Parish Council. The planning regime established under Schedule 17 to the Bill includes a requirement that where land is used only temporarily for construction purposes its use shall be discontinued as soon as reasonably practicable after completion of the relevant works. The sites must be restored in accordance with a scheme to be agreed with the local planning authority. As stated in HS2 Information Paper B1, Main Provisions of the Planning Regime, where a site is used for construction purposes, the site must be restored in accordance with a scheme submitted to the local planning authority within four months of the discontinuation of works at the site. Where no such scheme is agreed, the site must be restored in accordance with a scheme determined by the appropriate Ministers. The original ES notes that the plans for the site after the operational period are as follows: Decommissioning of the railhead and compound operations will take approximately six months. The main elements of the landform created for the railhead will remain, including the widened cutting alongside the Birmingham and Derby Line for the reception sidings, the widened Curdworth cutting and the main sidings area. These will all be grassed and the main sidings area could be returned to agricultural use. SES3 notes that: The Bill provides for a cutting to accommodate the Kingsbury Road railhead reception sidings to facilitate access to the main construction compound area as well as to construct a permanent pumping station and associated balancing pond and access (refer to main ES maps CT R1 and CT R1, grid references C5 toc7, D6 to D1, E8 to E1, and F1, Volume 2, CFA2 Map Book). The resulting earthworks from the reception sidings would remain as a permanent feature. To fully return the site to its current ecological state as requested would likely result in additional significant environmental effects. The proposal would require a number of vehicle movements in order to transport the required material and would mean that there would be no benefit from early planting of the mitigation earthworks to provide screening. Any terms associated with the return of the land would be considered at the relevant time, and the Promoter has a duty to obtain the best terms reasonably obtainable. P1788 (4) HOL/235/9

10 Seeney Lane You raised concerns regarding the use of Seeney Lane by any HS2 construction vehicles and the Promoters Response Document provided in April 216 sets out the assurance provided to North Warwickshire Borough Council which addresses this concern. The assurance is recorded on the Register of undertakings and assurances, reference 198: The Promoter will require the Nominated Undertaker to ensure that throughout the construction phase of the Proposed Scheme, except to such extent as any vehicles associated with the HS2 Works are required to cross directly over Seeney Lane, no part of Seeney Lane identified on Bill Plan number 3-47 in the Parish of Lea Marston shall be used either: (i) (ii) By any vehicles associated with the HS2 Works entering or exiting the Kingsbury Road railhead site; or For the purposes of parking any vehicles associated with the HS2 Works. I trust this addresses your concerns in relation to this matter. Special case The House of Commons Select Committee made a statement on 15 January 215 as follows: Kingsbury we believe to be a special case because of the size of the railhead and its potential use in phase two. The House of Commons Select Committee s interim report stated: 44. Kingsbury will be the location for a very substantial construction railhead which is likely also to be used in Phase Two if that proceeds. This status has been recognised by making it part of a Special Management Zone for Warwickshire with designated liaison staff. Since introduction of the hybrid bill in November 213 the Promoter has developed better mitigation in the form of higher bunds and extended planting. The Government response stated: 18. We have received a Community Engagement Paper from the residents group and the ideas set out in the paper are being considered as part of the community engagement element of the draft Code of Construction Practice. 19. As the Select Committee is aware, in acknowledgement of the pressures faced by this particular community an assurance was given to North Warwickshire Borough Council which committed to providing a Special Management Zone, specifically for the North Warwickshire areas affected by the project. This will ensure that appropriately experienced community engagement personnel are appointed to manage stakeholder and community relationships during the development of HS2. 2. Plans for the forthcoming Additional Provision to the Bill that relate to Kingsbury have been shared with the Parish Council and we will continue to provide additional material, as it becomes available through the detailed design process, in order to help the community better understand the effects of the Proposed Scheme in advance of construction. As part of this Additional Provision, amendments are being made to the balancing pond layout and landscape mitigation areas around the Kingsbury railhead which provide an element of visual mitigation. 22. A study on the benefits of implementing traffic calming measures on Bodymoor Heath Lane will also be undertaken at the detailed design stage in recognition of the community s concerns about traffic being displaced onto the lane. 23. The Promoter will also work with the community in Kingsbury to encourage them to make a bid for funding from the Community and Environment Fund for a local project that could support improved community liaison in this area during the construction period. As I have explained, a significant package of mitigation measures at the Kingsbury railhead were brought forward in Additional Provision 2 (AP2) to the Bill in the House of Commons. The landscape mitigation design has been enhanced to provide additional visual screening. Landscape mitigation would be provided around the area of the Leeds spur, the head-shunt track, reception sidings and the balancing ponds, which were redesigned to sit alongside the head-shunt track. The height of the proposed landscape mitigation earthworks have been raised to a maximum of 5m above the rail level at the northern side of the railhead; a maximum of 6m above the rail level at the eastern side; and a maximum of 4m above rail level at the southern side. It is likely that any further increase in landscape earthworks would have a disproportionate impact itself, compared to the screening it would provide. In light of the mitigation described and the recent progress on discussions regarding the Special Management Zone, I trust that your concerns in relation to this matter are addressed. Compensation The reasons for the boundaries of the Rural Support Zone and discretionary property compensation schemes are explained in the Government's Decision Document: Property Compensation Consultation 213 for the London-West Midlands HS2 Route that announced the discretionary compensation schemes, which is available at df. Further consultation on the property schemes took place in relation to Phase 2a in 215 and the response published in the Decisions Document HS2 Phase Two: West Midlands to Crewe property consultation (215). Section 6.3 refers to comments made regarding compensation schemes in relation to construction and the Government s position on the points raised (see Additional permanent offset tree planting As explained in the Promoter s Response Document, we are providing planting on the bunds and the surrounding land around the proposed railhead to compensate for the loss of the landscape and visual benefits currently provided by the Hams Hall mitigation planting and also to compensate for P1788 (6) HOL/235/11

12 the loss of habitat due to construction of the railhead. The landscape bunds would also function as a noise screen during construction and operation of the railhead. The current proposals would therefore provide mitigation for the village of Lea Marston during both construction and operational stages of the railhead. The bunds and associated planting would remain in place when the railhead site is decommissioned and planting retained as part of the Proposed Schemes permanent mitigation. By the decommissioning stage the planting would have matured and would provide ongoing landscape and visual mitigation for the village of Lea Marston as well as providing a permanent wildlife habitat. Land has been included in the Bill to mitigate the significant effects identified as far as reasonably practicable and the Promoter does not consider that land is required outside of the current Bill limits to mitigate environmental effects over and above that already identified. Dunton Hall access arrangement In your petition you ask us to disregard a statement made by the House of Commons Select Committee in their report regarding future mineral extraction interests in light of your concerns regarding the Warwickshire County Council Minerals Strategy. I can clarify that we are only providing access which is suitable for the landowner s current business uses. Any upgrade to the access would be subject to the approval of the local planning and highway authority. Traffic concerns The Promoter is required to mitigate the effects of the Proposed Scheme in accordance with the Environmental Minimum Requirements (EMRs); further information is provided in HS2 Information Paper E1, Control of Environmental Impacts. As explained in Section 12.4 of the Volume 2 ES CFA 2 Report, road closures would in most cases be limited to no more than several overnight or weekend closures during the tie-in of new works. The effect of these closures on traffic flows and travel patterns would therefore not be significant. Section 14 - traffic and transport of the draft CoCP requires the nominated undertaker to prepare construction Traffic Management Plans, in consultation with local planning, highway and traffic authorities, as well as emergency services. An assurance was provided regarding Bodymoor Heath Lane, which was identified as one of the main areas of concern by the Parish Councils, in the following terms: The Secretary of State will require the nominated undertaker to undertake a review of traffic at Bodymoor Heath Road where it crosses the Birmingham and Fazeley Canal to investigate the potential benefits of implementing traffic calming measures at this location. This review will be carried out in consultation with the Highways Authority, and undertaken during the detailed design phase of the project. During a meeting in October 215, in light of the concerns raised regarding the traffic management in the area and the potential impacts on the Dunton Island roundabout, the Kingsbury Parish Council suggested that vehicles leaving the Dunton Island compound could exit back onto the roundabout using the arm which approaches from the M42 slip road. Following an assessment of the proposal, an assurance was offered in the following terms: P1788 (7) HOL/235/12

13 "1. Subject to paragraph 2, the Secretary of state will require the nominated undertaker in developing access arrangements for the Kingsbury Road Overbridge Main compound to consider arrangements which seek to reduce traffic impacts as far as reasonably practicable, in particular to consider access using the following arrangement: - An entrance and exit for HS2 construction traffic heading north along the Kingsbury Road from the A497 Kingsbury Road. - An exit for HS2 construction traffic directly onto the 'Dunton Island' (roundabout for Junction 9 of the M42). 2. The assurance in paragraph 1 is subject to: - the provision of notice to, or consent or approval of the highway authority as required in accordance with Schedule 4 Part 1 of the Bill; - the land on which the proposed accesses will be situated being within Bill Limits - Schedule 16 lorry route approval from the local planning authority, and any other required approvals" We have also provided Warwickshire County Council an additional assurance regarding traffic management as follows: In developing the detailed design of the Kingsbury Junction Works, the Promoter shall engage with the Highway Authority over the design of the Railhead Junction and give consideration to the merits of implementing, within the scope of the powers conferred by the Bill, one of the following alternative options: a. a left in, left out arrangement for HS2 construction traffic accessing the Railhead Site from the Railhead Junction; b. Constructing a temporary roundabout at the entrance to the Railhead Site from the Railhead Junction; c. Constructing a ghost island for right turning traffic exiting the Railhead site at the Railhead Junction; and d. A traffic management routing plan for HS2 construction traffic requiring access to the Railhead Site. I hope that the progress set out above in relation to the issues raised in your petition to the House of Lords gives you the comfort required in order to withdraw your petition.
