2 HS2 Ltd Residents Charter We recognise that as we develop, design and build the new railway, our activities will impact on the communities in which we will operate. We are committed to being a good neighbour by treating affected communities with respect and consideration, and by focusing on minimising and mitigating our impacts, whilst maximising the benefits both locally and nationally across the UK. This charter sets out our ten commitments to you and explains the roles of the Residents Commissioner and Construction Commissioner in ensuring we are held to account on the commitments we make. We will keep checking on our progress and looking for ways to improve how we do our business. Our commitments to you We will 1 Continue to build respectful, long-term relationships with communities and actively encourage our workforce to listen to local concerns and be considerate and accountable for their actions at all times. 2 Work with communities to develop local two-way engagement and communication programmes, ensuring they are accessible and tailored to local needs. 3 Make sure communities are made aware in advance of any activities taking place in their area. 4 Operate a freephone community helpline 24 hours a day, 365 days a year. 5 Make health and safety a priority for communities and our workforce. 6 Respect the wellbeing of communities, minimising disruption to their lives with local mitigation plans and activities, ensuring we meet the standards set out in the Code of Construction Practice. 7 Leave a positive and sustainable legacy for the communities in which we operate. 8 Respond to questions and complaints quickly and efficiently, with an acknowledgement within 2 working days, and responding within a maximum of 20 working days if we cannot answer the query straight away. 9 Promote awareness of all our property schemes so that anyone who may be eligible has all the information they need and is aware of the support available to them. 10 Display the Residents Commissioner s and Construction Commissioner s contact details on all relevant materials along with HS2 Helpline information and complaints procedure. 3 The Residents Commissioner The Residents Commissioner is independent and holds HS2 Ltd accountable to the commitments made in this charter. The Residents Commissioner oversees and monitors our commitments to you and produces a periodic report, published online at gov.uk/government/ collections/hs2-ltd-residents-commissioner. In addition, the Residents Commissioner meets regularly with the HS2 Ltd Chairman about emerging trends and concerns. The Residents Commissioner does not investigate individual cases, act as an arbitrator for individual resident concerns, or deal with complaints. You can contact the Residents Commissioner by ing residentscommissioner@hs2.org.uk The Construction Commissioner The independent Construction Commissioner s role is to mediate and monitor the way in which HS2 Ltd manages and responds to construction complaints. The Construction Commissioner will mediate any unresolved construction related disputes between HS2 Ltd and individuals or bodies, and provides advice to members of the public about how to make a complaint about construction. The Construction Commissioner regularly meets with HS2 Ltd s Chief Executive Officer to raise any concerns or emerging trends across the project. 4 Question At Q74 on Tuesday 24 April 2018 Mr Mould said that the embankment not only will it be planted with trees, but also, its affect will be to place the railway in a four metre deep cutting. The Chair has had a letter from Whitmore Parish Council saying that they have now been told that there will not be a cutting but a 4m noise protection fence. Could you check whether there has been a change since Mr Mould appeared before the Committee please. Answer There has been no change since the hearing of the petition of Whitmore Parish Council on 24 April The location under discussion during that part of the morning session on 24 April 2018 was Whitmore Wood and the settlement of Madeley Park Wood to the west of the HS2 Phase 2A railway, beyond the existing alignment of the West Coast Main Line. See paragraph 60 of the minutes, which records that Counsel for Whitmore Parish Council had put up his exhibit A28(15), headed Whitmore Wood, as a prompt for comment by his witness, Mr Webb of Whitmore Parish Council. At that location, the design of the railway includes the following main engineering, landscaping and noise mitigation elements (Environmental Statement Community Area Report CA4: Whitmore to Madeley paragraph ) Whitmore North cutting Whitmore Wood retaining wall A 3m noise fence barrier extending along the southern side of Whitmore North cutting to provide acoustic screening for properties on Snape Hall Road, Whitmore Heath and Madeley Park Wood Woodland restoration to the south of Whitmore North cutting Lea South embankment R392 (1) HOC/10002/0004
5 Landscape earthworks and landscape mitigation planting to both sides of the embankment and slopes graded out to help integrate the embankment into the surrounding landscape A 4m noise fence barrier extending along the top of the embankment to the start of the River Lea viaduct to provide acoustic screening for properties at Madeley Park Wood. These elements of the design of the railway at this location are shown on Plans CT and CT in Volume 2 Map Book CA4 Whitmore Heath to Madeley. In paragraph 72 of the minutes, Mr Webb agreed that the tree planting shown on the maps along the southern side of the railway would screen the retaining wall from the view of houses in Madeley Park Wood. However Mr Webb questioned whether the trees would abate noise from the railway. At paragraph 74 of the minutes, Mr Mould s submission answered that question: in terms of noise impact, the effect of providing a 4m noise fence barrier extending along the top of the Lea South embankment would be as if the railway was placed in a 4 metre deep cutting, thus provide acoustic screening for properties at Madeley Park Wood, in addition to the visual screening provided by tree planting. 25 February 2019 R392 (2) HOC/10002/0005
6 Question At paragraphs 79 to 81 on Tuesday 15 May 2018 (afternoon) the following exchange took place during the hearing of the petition of Stone Rural Parish Council 79. MR MOULD QC (DfT): The HS2 traffic will either be going northbound on the A34 through that roundabout and continuing north or coming southbound and through that roundabout and continuing south, or under this revised proposal, coming northbound on the A51 and then going north on the A34, or coming sounthbound on the A34 and going south on the A51. But the movement that you were concerned about, which was traffic going north on the A34 and then turning right to go down south on the A51, that isn t a movement that HS2 will need to undertake. 80. MR FLETCHER (STONE RURAL PARISH COUNCIL): That s the main question. I can tell my council that there isn t going to be a right turn movement there that is from HS MR MOULD QC (DfT): That is exactly the point, yes. Stone Rural District Council have now questioned whether Mr Mould QC s statement on 15 May 2018 that traffic going north on the A34 and then turning right to go down south on the A51 isn t a movement that HS2 will need to undertake was correct. Answer Mr Mould QC s statement was a correct statement of the position as it stood on 15 May Since that date, the Promoter has undertaken a review of HS2 construction traffic routes in conjunction with the preparation of Additional Provision 2 (AP2). That work has led HS2 Limited to conclude that it is now necessary to include the route under discussion on 15 May 2018, namely the right turn from the A34 northbound into the A51 southbound, as an HS2 construction traffic route in the revised transport assessment published alongside AP2. This traffic route has been introduced following AP the Yarlet South Cutting Transfer Node (South) - on the southern side of the A34 (see page 63 in SES2 and AP2 ES Volume 2 - Community Area 2 Colwich to Yarlet and plan CT a). Provision of this additional transfer node now enables construction materials to be managed from both sides of the A34. This reduces the need to route HS2 construction traffic through the A513 Beaconside in Stafford, by also routing HS2 vehicles via the A34 and A51 through the Brooms/Aston roundabout. This revised routing proposal - SES is described on page 18 and explained in paragraphs and on page 28 of SES2 and AP2 ES Volume 2 - Community Area 2 Colwich to Yarlet. 25 March 2019 R393 HOC/10002/0006
