3 PARISH OF NETHER KELLET Draft Minutes of the Meeting of the Parish Council held at Congregational Church School Rooms on Wednesday 3 rd October 2018 at 7-00 pm. Present: Councillor Mr D Whitaker (Chair) Councillor Mrs J Bentham Councillor Mr Chris Halhead Councillor Mr N Johnson Councillor Mr George Smith Councillor Mr I Williams In attendance: City Councillor Mr JR Mace & Mr S Hinde; Mr D Whiteway (standing in for the Parish Clerk) APOLOGIES FOR ABSENCE: Apologies were received from Councillor Mr P Riley and County Councillor Williamson MINUTES: It was noted that the Parish Clerk had previously been notified of some minor amendments to the previous Minutes. Comments were made at the meeting on the progress on matters referred to in the Minutes, specifically the bulging wall and leaning cherry trees in the playing field (18/051/3/l refers) which are important matters that need to be addressed. It was also requested that draft Minutes be sent out sooner to that any necessary amendments can be made, and actions noted, ahead of the following meeting. It was then RESOLVED that, subject to the amendments, the Minutes of the meeting held on Wednesday 5 th September 2018 be approved DECLARATION OF INTERESTS: There were no declarations of interests or dispensations in respect of items on the Agenda ADJOURNMENT FOR PUBLIC DISCUSSION & INFORMATION ONLY UPDATES: 1) Public discussion: There were no matters raised 2) Clerks report: The Clerks report was considered, and the following points noted: a) Information on the Radar Speed Sign Agenda item refers b) Community Fund action taken to publicise in Round and About and production of draft guidance on applications was noted. ACTION: Clerk to produce draft guidance and application form for community fund requests c) Public Realm and Grounds Maintenance The Clerks meeting with Lancaster City Council officers was noted. It was agreed to pay the outstanding invoices for the supply and delivery of plants. Members queried the current grass cutting regime by Lancaster City Council and when the next one will be due. ACTION: Clerk to make arrangements to pay disputed invoices and follow up on the grass cutting regime for Nether Kellet d) Fix my street Update noted. ACTION: Photographs of the bulging wall in the play area will be sent to the Clerk to be forwarded to Lancashire County Council. The unfinished works on Bolton Lane will be followed up and a pothole on the Bolton-le-Sands road just outside the village will be reported e) Defibrillator There was a discussion about the long running matter concerning the repairs and refitting of the cabinet for the defibrillator. ACTION: Chair of the Village Hall to liaise with the Clerk to get the matter resolved. f) Correspondence: All correspondence not covered as an agenda item was noted g) Residents survey The Chair of the Village Hall offered his assistance in putting together a revised residents survey

4 3) Members updates on issues arising since the last meeting: a) PACT: Nothing to report b) LALC: Nothing to report c) QUARRY: A meeting scheduled for 11 th September has been deferred until 30 th October 2018 d) TWINNING ASSOCIATION: Councillor Bentham reported on a very successful visit by 14 residents to France and shared photographs from the trip. A return visit is scheduled for April 2019 e) FLY-TIPPING: Councillor Halhead reported on an incident that had occurred on the morning of the meeting that is being reported by a resident. There was a discussion about the effectiveness of CCTV and whether there is scope to improve this by trimming some trees. Members are interested in the lead officer of Lancaster City Council s Enforcement Team attending a future meeting to discuss Operation Peregrine and general matters in relation to fly-tipping and the use of CCTV. ACTION: Clerk to invite the lead officer of Lancaster City Council s Enforcement Team to a meeting of the Parish Council. f) PRoW: No matters to report g) VILLAGE HALL: Nothing to report h) PROJECTS: No further update i) BA4N: Councillor Bentham gave an update on progress with B4RN. Detailed route planning is in progress and the role of Quartermaster has been filled. Viable routes are being established and ducts are being laid that will enable the Nether Kellet network to be linked to both Halton and Over Kellet. The Clerk advised that a grant of 750 had been donated to B4RN group in the village from Aggregate Industries UK Limited. ACTION: Clerk to write to Aggregate Industries thanking them for the donation j) LODGES CHARITY: It was acknowledged that the previously Minuted and agreed actions and matters relating to the ongoing promotion and viability of the charity need to be kept under review for the remainder of the year. k) LENGTHSMAN REPORT: Councillor Smith reported on a range of activities that the Lengthsman had carried out in the last month l) GENERAL MATTERS: Councillor Whitaker reported that the Christmas Tree is to be erected on Saturday 1 st December. Councillor Smith commented on the activities of the Community Speed Watch volunteers whose work continues to be productive. A resident raised the problem of a large poplar tree on the willow beds where its roots are causing a trip hazard. ACTION: Clerk to report to Lancaster City Council. It was RESOLVED that Members updates be noted, and that follow-up action be taken where necessary PLANNING APPLICATIONS/TRAFFIC ORDERS: Application No: 18/01197/FUL 18/01245/FUL Description: Erection of stables/storage building - Land To The North Of Hallfield Lane Nether Kellet Erection of extension to existing agricultural building to house livestock - Intack Farm Long Dales Lane Nether Kellet It was RESOLVED that no representation be made relating to the above planning applications

5 18065 PLANNING AUTHORITY DECISIONS: Members considered the up-to-date position on decisions of the planning authority (Lancaster City Council) on planning application previously deliberated by the parish council. Members queried application 17/0140/FUL reported as split decision and wondered what this meant in relation to the proposed scheme to erect 8 dwellings on land north east of Briarlea Road. It was then RESOLVED that the decisions be noted and that the Clerk makes further enquiries regarding application 17/0140/FUL ACCOUNTS FOR PAYMENT: Mr R Bailey, Parish Clerk s Fees and Expenses September Mr I Williams Compost and wooden barrel It was RESOLVED that the above payments be made RADAR SPEED SIGNS (SPiD): Members considered the detailed information provided by the Clerk on the ElanCity Evolis solar and mains/battery units. Councillor Smith commented that following a conversation with the Lengthsman he has agreed to recommence responsibility for replacing batteries in the existing battery-operated unit. There was some discussion around the use of a mobile unit and whether there is an opportunity to locate a second radar speed sign in the village where speeding is known to regularly occur. Councillor Halhead suggested there is potential to purchase a solar charger that can be connected to the existing SPiD battery. It was then RESOLVED that the potential for, and costs of, adding a solar charging unit to the current SPiD be investigated and further consideration be given to multiple locations being established for current/future SPiDs BANKING ARRANGEMENTS: Further to the suggestion that the Parish Council s bank accounts be transferred to the Unity Trust Bank, the Clerk had provided information on the nature if the Unity Trust Bank and the operation of current and savings bank accounts. It had been pointed out that Unity Trust are partners of Lloyds Bank Group and MasterCard and were established specifically, the purpose of local councils and charities amongst others. The Clerk had previously explained that accounts with Unity Trust will allow for the dual authorisation of payments electronically. After some discussion, it was RESOLVED that arrangements be made transfer the Parish Council accounts to Unity Trust Bank INCOME & EXPENDITURE: The Clerk provided a report setting out the income and expenditure position at the mid-point of the financial year 30 th September Income received as at that date anted to 10,024, including 7,500 precept, whilst expenditure totalled 3,001. This represents a surplus of income over expenditure of 7,022. Bank account balances as at 30 th September amount to 25,426 being Community Fund Account 3,261; Land Purchase Account 4990 and Current account 17,175. After some discussion, it was RESOLVED that income and expenditure as at 30 th September 2018 be noted COMMUNITY EMERGENCY PLAN: The Clerk has reviewed and updated the Community Emergency Plan for comment and approval. It was noted that the former local radio station, The Bay, no longer operates and needs to be amended with another suitable station. After some discussion, it was RESOLVED that subject to an update on a local radio station the revised Community Emergency Plan be noted and approved.

9 Nether Kellet Parish Council Public Rights of Way Report (Summary) October 2018 I have walked most of the paths during the past few weeks. Over the summer period the water table has not been as high as it was earlier in the year so most routes have become drier and I have only worn trainers and have not got my feet wet other than in negotiating long grass. Footpath No 1 Footpath No 2 Footpath No 3 Footpath No 4 Footpath No 5 Footpath No 6 Footpath No 7 Lawson s Farm on Shaw Lane to Parish Boundary 300m south of Cole Wood to west of M6 Motorway On exiting the paddock behind Lawson s Farm, the topping stones are now loose and could fall but Chris may well have this in hand as the wall has incurred some damage away from the step stones. The area around the prominent Sycamore tree continues to get wet and uneven and the area on the south side of the kissing gate on exiting the field also gets very wet. (however, with a bit of deft footwork both can be negotiated). The area around the wicket gate by the small copse leading to the field to the east of the M6 has been a lot drier than of late. However, I think it must be Stubb Hall Farm who have extended the stock-proof fence across their side of the gate. This has a loop of barbed wire, which can be moved giving access to the field and, whilst I was able to move this, there is a possibility that others would not be able to do so. This may well be a temporary measure which should not be allowed to remain for too long a period. The track leading up to the bridge over the M6 is overgrown and vegetation on each side requires severe pruning back. Map Ref: SD The nettles on the ramp have not been as rampant this year and with the cooler weather will now die back. The metal and concrete stile was clear. The double stile at the parish boundary becomes very slippery in wet conditions. Also, the step on the Nether Kellet side has become loose. Map Ref: SD Bridge over M6 south of Cole Wood to Kellet Lane 100m south of Pump House Farm No Problems The concrete and metal ladder stile adjacent to Kellet Lane is over grown and impassable but the gate entrance is always open, in fact there is no gate. Finger post at entrance to the path from Kellet Lane close to Pump House Farm has broken off at the base and is probably unusable. This has been reported to County several times over the past two or three years. There is now no footpath sign at all at this location. October 2018 Junction of Whorley s Lane with Bolton Lane immediately to the west of the M6 bridge on Main Road to the Parish Boundary with Bolton-le-Sands Parish by a large Ash Tree. No problems Junction of Whorley s Lane (Footpath 3 above) with Hallfield Lane to Parish Boundary with Carnforth in the Sandpits The stile leading to the Sandpits has been trashed. Whether or not this was deliberate is open to question. The stile may well now be considered to be superfluous to requirements bearing in mind the existence of the stock proof fence protecting the field with the pump and trough in it. Laithbutt s Lane to a point just beyond Aggregate Industries Offices on the boundary with Over Kellet Parish No problems Point on Back Lane to track bridge over M6 There is no sign to indicate a public right of way from Back Lane Start in Timpenny Road to east of Addington Lane junction to point north of Timpenny Road on boundary with Over Kellet Parish. No problems.

10 Footpath No 8 Footpath No 9 Footpath No 10 Footpath No 11 Footpath No 12 Concessionary Path 1 Concessionary Path 2 Concessionary Path 3 From a point east of junction with Swarthdale Road to south of Timpenny Road to a point on the Kirkby Lonsdale Road No problems From the gateway leading to Swantley Lake from Timpenny Road to the bend on Addington Lane The entrance gate to Swantley Lane can be awkward for some. No Problems other than navigation between the stile, leading into the area where the former banger racing track operated, to the other stile on Addington Lane. The assist pole by the stile leading to the rough pasture is wobbly so could be attended to. The exit onto Addington Lane could be easier but is in order. Top of Hill Lane to Longdales Lane close to Newlands Farm No problems although there may be some who consider that the vegetation needs cutting back again. Point on north-east side of Dunald Mill Lane to the east of the Gas Compressor Stations to the bend on Addington Lane Surprisingly dry but the drainage problems identified previously will no doubt return. A point on Kellet Lane south of Westfield Hamlet to the Parish boundary with Bolton-le- Sands about 100 metres from Ancliffe Lane No problems at present but, no doubt, the wet conditions previously reported will return unless the comparatively dry conditions persist which is most unlikely. There is still no sign indicating this right of way north of Westfield Hamlet. From a point on Main Road opposite No 91 parallel to Main Road and then alongside Longdales Lane to meet FP No 10 at the kissing gate leading onto the lane. No problems From point to west of Aggregate Industries Offices to point just east of Hawthorn s Caravan Park, parallel and north of Main Road. No problems From gate on FP 4 from Whorley s Lane, alongside the field to pass a stile leading to the copse that surmounts the hill and then along the crest by the fence and then down to rejoin FP 4 between the kissing-gates. The stile giving access to the plantation at the top of the field has become detached with the uprights and step being discarded close by. It requires re-instatement but new uprights will be required. (I have not used this path over the past year or more) Michael Watson ~ 1 st October 2018
