1 REPORT Council- Regular Carado's /v.orrrest wecorre MEETING DATE: November 20, 2017 TO: CC: FROM: SUBJECT: Mayor and Council Barry Romanko, CAO Dilys Huang, Senior Planner Report 7 - Inflatable Waterpark (PF15-04) TRACKING NO.: COR-521 BACKGROUND After receiving enquiries from business operators interested in establishing an inflatable waterpark in Osoyoos over the past year, Council directed Planning and Development Services staff to undertake a community survey on two shortlisted locations, and then proceeded with a Request for Proposals (RFP) for the Legion Beach site. As part of the RFP, the Town received one proposal from Okanagan Wibit. During the April 3, 2017 Regular Open Meeting, Council resolved to: Direct staff to accept the offer for a site visit with Rylie Gallagher [from Okanagan Wibit] to Legion Beach to gain appreciation of how the inflatable waterpark will fit in with the site and to ask any questions; and Direct staff to set up a public drop in meeting on the Wibit proposal. However, following the site visit and subsequent discussions over the recent months, Okanagan Wibit wishes to propose an alternative site to accommodate the proposed waterpark. The purpose of this report is to provide Council with more information and to request direction on how the Town should proceed. OVERVIEW The attached Change of Location Proposal from Okanagan Wibit identifies certain concerns that the operator has with the Legion Beach location, such as those associated with business operations, parking, accessibility, and impact on the surrounding neighbourhood (Attachment 1). After evaluating alternative locations at Cottonwood Park, Lions Park, and the north and south ends of Gyro Park (Attachment 2), Okanagan Wibit determined that North Gyro Park is the most viable for the following reasons: REG RPT 7 - Inflatable Waterpark (PF15-04) Page 1 of 3

South Gyro Park H (+) H Close to resorts and public facilities Considerations Waterpark structure would need to be sited beyond lake zoning and Town boundaries due to shallow water depths, which generates permitting issues and boat traffic concerns Adequate water depths Potential traffic and parking concerns due to one-way street near a residential area Family picnic area with resorts in close proximity Siting the waterpark in front of Town-owned lands means the structure would need to be placed at the southernmost end of the swim area; however, there are boat traffic and water depth concerns 4. North Gyro Park _(+) Adequate water depths with nearby amenities and parking Proposed Location and Space Requirements In terms of location, Okanagan Wibit is proposing to site the waterpark structure and swim markers to the north-east of the Town's proposed Gyro Park Pier and Walkway project, as shown on page 3 of the Proposal. The waterpark would be located approximately 50ft (15m) from the shore. Space would also be required for four to five 48" x 40" x 31" lifejacket storage bins, similar to the ones shown in Figure 1, and a 10ft x 10ft (3m x 3m) temporary registration kiosk. The bins and the kiosk are proposed to be placed at the south-east corner of Gyro Park's main grassed area. Figure 1. Lifejacket storage bins Other Considerations Consideration should be given to various factors in terms of locating the proposed waterpark at the North Gyro Park location, including the ones outlined below: Proposed Gyro Park Pier and Walkway Project - patrons would need to access the proposed waterpark on the other side of the future raised walkway. The waterpark would also need to be sited in such a way that the various vantage points from both the pier and the walkway are not adversely impacted. Foreshore and Lake Zoning Bylaw Amendments - in relation to the previous point, the proposed waterpark would need be positioned across the W1 - Public Water Use and W4 - Commercial Moorage zones (Attachment 1, pages 5 & 6). Therefore, in addition to adding an inflatable waterpark as a site-specific permitted use under the W4 zone in the Town's Foreshore and Lake Zoning Bylaw, rezoning a portion of the lease area from W1 to W4 would be required. Parking and Traffic - although some visitors might walk to the waterpark location since it is centrally located, visitors who travel by vehicle would likely use the Gyro Park parking lot. Cherry Fiesta Fireworks - the proposed site is in close proximity to the location of where the fireworks take place. Okanagan Wibit noted that they would temporarily relocate the proposed waterpark during the fireworks REG RPT 7 - Inflatable Waterpark (PF15-04) Page 2 of 3
3 OPTIONS 1. Council considers North Gyro Park as a potential location for the establishment of an inflatable waterpark and requests that Okanagan Wibitpresent its proposal at a public open house. 2. Council requests additional information before proceeding further. 3. Council does not considerthe establishment of an inflatable waterpark any further. 4. Council recommends any other action deemed appropriate. INFORMATION AND/OR DIRECTION REQUESTED Staff requests Council direction and position on whether the Town should consider the proposed establishment of an inflatable waterpark at the North Gyro Park location. 4 Attachment 1 Change of Location Proposal Okanagan Wibit - Rylie Gallagher, Randy Gallagher Throughout the past six months Okanagan Wibit and the Town of Osoyoos have been working together to find the most suitable location for the proposed inflatable water park. In this process we have conducted an in-depth evaluation of each location, focusing on these key factors: Safety Sustainability Water Depth Integration of existing and future amenities Public facilities Surrounding Neighbourhood Parking Sightlines With consideration of these factors, Okanagan Wibit and the Waterfront Steering Committee have found the Legion Beach location to present areas of concern. Concerns pertaining to business operations, parking, accessibility, and potential disruption of residential areas. These reasons are why Okanagan Wibit would like to proposes a change of location. m M
5 Due to water depth and parking challenges in Osoyoos there are limited locations which can be considered as viable. Through evaluation of many alternative locations along Osoyoos Lake the common issues faced are: Depth Access! Upon evaluating all location North Gyro presents itself to be the most viable, Considerations Cottonwood - Wl Public Water Use - This location provides excellent proximity to resorts and public facilities, however due to its water depth equipment would have to be anchors outside of Wl - public water use zoning. This provides permitting issues along with concerns of boat traffic. Lion - Wl Public Water Use - Lions Beach is one of few that provides adequate water depth, however located on a one-way street surrounded by residential homes it would be dealing with an unwanted fluctuation in the increasing traffic and parking. South Gyro - Wl Public Water Use - Seen as a family picnic area and situated close to local resorts South Gyro presents itself as a great location, the obstacles faced are proximity to boat traffic, water depth. Because of land parcel frontage the water park would have to be situated at the most southern end of the existing swimming area, because of this we cannot reach adequate water depth without extending the existing swimming area into the boating lane. North Gyro - W1/W4 Commercial Moorage - North Gyro provides the best water depth, facilities, and parking of all locations. Due to the safety and sustainability that North Gyro provides Okanagan Wibit strongly recommends proceeding with this location. Integration of Amenities (pier, lawn bowling, events) Safety (proximity to shore, security, swimming markers) Parking Our goal is seamless integration with existing and future amenities along with events held in the area. By locating the water park amenity North of the Gyro Beach point we are able to utilize the best suited area while avoiding obstruction of sightlines, interference of events, and safety concerns.

Sports Park: Water Park Dimensions - Sports Park M - 157ft x 82ft (Green) Located Approximately 50ft from shore Water Park Dimensions - Sports Park 'L' - 167ft x 131ft (Blue) Located Approximately 50ft from shore Installation of additional swimming markers, following Transport Canada guidelines are to be covered by Okanagan Wibit. 2. By implementing a total of 4; 5 (48" x 40" x 31") vented lifejacket bin storage system we are able to eliminate the need for a cargo trailer. These bins are positioned along the fence line to ensure they are not obstructing foot traffic. The storage system will retain a professional and clean image to continue with the areas aesthetics ft x10ft Beach Office/ Kiosk: This space will be utilized for ticketing, orientation, first-aid, and lifejacket fitting. The temporary office structure would be installed mid June, and removed shortly after the September long weekend; secured over night and accompanied by security. 4. Proposed Pier and Walkway Project
