INTERLOCAL AGREEMENT BETWEEN THE CITY OF KISSIMMEE AND OSCEOLA COUNTY FOR ANNEXATION OF SMALL ENCLAVES

1 is made and entered into this day of, 9, between sceola ounty, lorida, a political subdivision of the tate of lorida, hereinafter referred to as ounty and the ity of issimmee, a lorida municipal corporation of the tate of lorida, hereinafter referred to as ity. :, ection., lorida tatutes, known as "the lorida nterlocal ooperation ct of 99" authorizes local governments to make the most efficient use of their powers by enabling them to cooperate with other localities on a basis of mutual advantage and thereby to provide services and facilities that will harmonize geographic, economic, population, and other factors influencing the needs and development of local communities; and, each of the arties have authority pursuant to ection., lorida tatutes, to enter into nterlocal greements; and, the lorida egislature recognizes that enclaves can create significant problems in planning, growth management, and service delivery and therefore declares that it is a policy of the state to eliminate enclaves; and, in order to expedite the annexation of enclaves of acres or less into the most appropriate incorporated jurisdiction, ection., lorida tatutes, provides that a municipality may annex enclaves of developed property by interlocal agreement with the ounty having jurisdiction of the enclave; and, the ounty and ity have deemed it to be in the best interest of the citizens of sceola ounty lorida to execute this nterlocal greement for annexation of small enclaves to provide the most efficient provision of services for the general welfare of the community; and, for and in consideration of the promises, mutual covenants, terms and conditions contained in this greement, by and between the parties for the mutual benefit of ounty and ity, and their respective citizens the parties do mutually agree as follows: ection. ecitals. he foregoing recitals are true and correct and form a material part of this greement, upon which the parties have relied. ection. nnexation of mall nclaves.. he ounty agrees the ity shall annex those certain unincorporated enclaves, including all adjacent rights of way, that are developed and improved, comprise acres or less, consistent with tate statutes regulating annexation as identified in xhibit, attached hereto and made apart hereof. nnexation of mall nclaves nterlocal greement age of
