DEFINITIONS In this By-law: Authorized Emergency Vehicle means: (a) (b) a Vehicle of a fire department, police department, an ambulance (including St. John Ambulance), or any other Vehicle of any government agency or department; and a Vehicle of a private or public utility when such Vehicle is in the performance of emergency duties. Boulevard means that part of the Highway situated between the Shoulder and/or curb line of a Roadway and the property lines of the lots abutting the Highway, but does not include a Sidewalk or a Shoulder. Commercial Motor Vehicle means a Motor Vehicle having permanently attached thereto a truck or delivery body and includes ambulances, motor buses, hearses, casket wagons and tractors used for hauling purposes on a Highway. Council means the municipal council of the Corporation of the County of Grey unless otherwise specified. County Director of Transportation Services means the Director of the Transportation Services department of the Corporation of the County of Grey, or his/her designate. Currently Validated Permit means a permit issued for a Motor Vehicle pursuant to Section 7 of the Highway Traffic Act which is currently validated within the meaning of that section. Detachment Commander means the Detachment Commander of each Police Service serving the municipalities within the boundaries of County of Grey. Disabled Person means a person who has been issued a Disabled Person Parking Permit. Disabled Person Parking Permit means a current disabled person parking permit issued by and displayed in accordance with the Highway Traffic Act. Driveway means the improved land on a Highway that provides vehicular access from the Roadway to adjacent land. Page 3 of 18 By-law March 5, 2013 Amended by By-laws , , , , , , , , , , and

4 Heavy Vehicle means a commercial vehicle having a total rated vehicle weight when unloaded of two (2) tonnes or more according to the Highway Traffic Act registration permit number relating thereto, but does not include an ambulance, or police, or fire department vehicle, or public utility vehicle or a school bus engaged in transporting children to or from school functions. Heavy Vehicle Route (Full Time) means a route in urban areas on the streets designated for Heavy Vehicle traffic to travel 24 s a day, 7 days a week. Heavy Vehicle Route (Daytime) means a route in urban areas on the streets designated for Heavy Vehicle traffic to travel between the s of 6:00 a.m. and 9:00 p.m., 7 days a week. Highway means a highway as defined in the Highway Traffic Act. Highway Traffic Act means the Highway Traffic Act, R.S.O c. H.8, as amended, and all versions thereafter and the regulations thereunder. Hours of Enforcement means for parking purposes the s when a Provincial Offences Officer of the Lower Tier Municipality is available. Intersection means the area embraced within the prolongation or connection of the lateral curb lines or, if none, then of the lateral boundary lines of two or more Highways that join one another at an angle, whether or not one Highway crosses the other. Lower Tier Municipality means any of the following municipalities within the boundaries of County of Grey: The Corporation of the City of Owen Sound, The Corporation of the Municipality of Grey Highlands, The Corporation of the Town of The Blue Mountains, The Corporation of the Municipality of Meaford, The Corporation of the Municipality of West Grey, The Corporation of the Town of Hanover, The Corporation of the Township of Chatsworth, The Corporation of the Township of Georgian Bluffs and The Corporation of the Township of Southgate. Loading and Unloading Berth means a space designated for the loading or unloading or both of goods or materials for delivery of same. Motor Vehicle includes an automobile, motorcycle, motor assisted bicycle unless otherwise indicated in the Highway Traffic Act, and any other vehicle propelled or driven otherwise than by muscular power, but does not include a street car, or other Motor Vehicles running only upon rails, or a motorized snow vehicle, traction engine, farm tractor, self-propelled implement of husbandry or road building machine within the meaning of the Highway Traffic Act. 5 Municipal Law Enforcement Officer means a person appointed by the Municipality or a Lower Tier Municipality, to enforce or carry out the provisions of this by-law or any part or parts thereof and who is designated as a Provincial Offences Officer pursuant to the regulations of the Provincial Offences Act. Municipality means The Corporation of the County of Grey. Park, Parking or Parked means the standing or stopping of a Vehicle, whether occupied or not, except when standing temporarily for the purpose of and while actually engaged in loading or unloading merchandise or passengers. Parking Space means that part of the Highway, the use of which is designated for the purpose of Parking a Vehicle. Pedestrian means any person afoot, children in wheeled carriages, a person operating a wheelchair, or any person upon roller skates, or riding in or by means of any coaster, toy sleigh, sleigh, cart, express wagon or similar device. Police Officer means a member of the Ontario Provincial Police or member of any Police Service providing policing for a Lower Tier Municipality within County of Grey. Provincial Offences Act means the Provincial Offences Act, R.S.O c. P.22, as amended, and all versions thereafter and the regulations there-under. Provincial Offences Officer means a provincial offences officer within the meaning of the Provincial Offences Act. Public Lane means land adjacent to the Highway that provides access from the Highway to a Parking area on adjacent land that is used by the general public. Repair and Storage Liens Act means the Repair and Storage Liens Act R.S.O. 1990, Chapter R.25 and all versions thereafter. Residency Parking Permit means a permit issued by a Provincial Offences Officer to residents of a defined area for the purpose of allowing the residents and their guests to Park in a legal Parking Space. Roadway means the part of the Highway that is improved, designed or ordinarily used for vehicular traffic, but does not include the Shoulder, and where a Highway includes two or more separate Roadways, the term Roadway refers to any one Roadway separately and not to all of the Roadways collectively. Security Vehicle means a Vehicle that customarily is engaged in picking up, Page 5 of 18 By-law March 5, 2013 Amended by By-laws , , , , , , , , , , and

6 transporting and/or delivering cash and securities under armed guard. Set Fine means the set fine as defined in the Provincial Offences Act. Short Term Parking means Parking during the Hours of Enforcement for less than or equal to two s of permitted parking time within a Parking Space. Shoulder means that portion of the Highway lying adjacent to the Roadway that is improved with granular or paved surface and is not intended for the passage of vehicular traffic. Sidewalk means that portion of a Highway between the curb line and the property line of the lot abutting the Highway improved for the use of Pedestrians. Sign" means a Sign erected under the authority of a by-law of County of Grey for the purpose of guiding and directing traffic. "Stand" or "Standing", when prohibited, means the halting of a Vehicle, whether occupied or not, except for the purpose of and while actually engaged in receiving or discharging passengers. Stop or Stopping, when prohibited, means the halting of a Vehicle, even momentarily whether occupied or not, except when necessary to avoid conflict with other traffic or in compliance with the direction of a Police Officer or a Traffic Control Device or a Traffic Control Signal. Traffic includes Pedestrians, ridden or herded animals, buses and other conveyances either singly or together while using any Highway for the purpose of travel. Through Highway means a Highway or part of a Highway designated as such by bylaw of the Municipality, and every such Highway shall be marked by a Stop Sign or yield right-of-way Sign in compliance with the regulations of the Highway Traffic Act. Time means, whenever certain s are named herein, Standard Time or Daylight Saving Time, which ever shall be in official use in the Municipality. Traffic Control Device means a Sign, marking or other device on a Highway for the purpose of controlling, guiding or directing Traffic and/or Parking in the Municipality. Traffic Control Signal means any device, manually, electronically or mechanically operated for the regulation of Traffic and/or Parking in the Municipality. 7 direction. Vehicle or Vehicles includes a Motor Vehicle, trailer, traction engine, farm tractor, road building machine, motor cycle, trailer, bicycle and any vehicle drawn, propelled, or driven by any kind of power including muscular power, but does not include a motorized snow vehicle or street car. 2. OBEDIENCE TO TRAFFIC AND PARKING REGULATIONS 2.1 Enforcement of By-Law (a) (b) All Police Services serving the municipalities within the boundaries of County of Grey have the ability to enforce the provisions of this by-law. Notwithstanding Subsection 2.1(a), Municipal Law Enforcement Officers appointed by the Municipality and Lower Tier Municipalities within the geographical boundaries of County of Grey for that purpose are authorized to enforce the provisions of this by-law. 2.2 Obedience To Police Officers In the event of road construction, repairs or maintenance, the erection or placement of Traffic Control Devices, or in the event of a fire or other emergency or during a parade or other procession, Parking may be temporarily regulated by any Police Officer or by Signs erected or placed at the direction of the Detachment Commander or Chief of Police of the Police Service having jurisdiction as conditions may require, and no person shall disobey or refuse to comply with the orders, signal or direction of such Police Officer or such Sign. 3. ERECTION OF TRAFFIC CONTROL DEVICES (a) (b) The County Director of Transportation Services is hereby authorized to place or to erect and to maintain such Signs as may be necessary to give effect to the provisions of this by-law. No person shall place, maintain or display upon, or in view of, any Highway, any Sign, signal, marking or device which purports to be or is an imitation of or resembles any Sign, signal, marking or device or which conceals from view or interferes with the effectiveness of any Sign, signal, marking or device erected, placed or maintained pursuant to this by-law. 8 (c) No person shall willfully move, alter, deface or otherwise interfere with any Sign or marking erected, placed or maintained pursuant to the provisions of this by-law. 4. REGULATED PARKING, STANDING AND STOPPING 4.1 Method Of Parking (a) General (i) Where there is no curb on a Highway, no person shall Park a Vehicle on a Highway unless such Vehicle is Parked on the righthand side of the Highway, with the right front and right rear wheels of the Vehicle as near to the right hand limit of the Highway as is practicable without Stopping or Parking on a Side-walk or footpath or any part of the Highway where grass is grown or which is not intended for the use of Vehicles. 4.2 Parking and Stopping Prohibited (a) (b) No person shall Park or Stop a Vehicle on a Highway in any of the following places: (i) on or overhanging a Sidewalk, curb, or Boulevard; (ii) in front of or within 1 metre of a Driveway or so as to prevent ingress or egress to or from such Driveway; (iii) in front of or within 3 metres of an entrance to or from a Public Lane (iv) in such a position as to prevent the removal of any other Parked Vehicle; (v) in front of the entrance to any emergency exit from a hospital, theatre, auditorium, or other commercial, industrial, institutional or other places of public assembly; (vi) on any Highway in such a manner as to obstruct road repair; (vii) on any Highway in such a manner as to obstruct Traffic; (viii) within 3 metres from any fire hydrant; (ix) on any bridge, or on the approaches thereto; or (x) within 9 metres of an intersecting Roadway. Parking Spaces Where Parking Spaces are designated on a Highway, no person shall Park a Vehicle in such manner as to infringe upon or take up more than one Parking Space. 9 (c) (d) Parking Prohibited Where Authorized Sign is on Display When Signs have been erected and are on display prohibiting such activity, no person shall Stop, Stand or Park any Vehicle on any Highway or part of Highway set out in Schedule U. No Parking for Restricted Times When Signs have been erected and are on display prohibiting such activity, no person shall Stop, Stand or Park any Vehicle on any Highway or part of a Highway for a longer period of Time than specified as the Parking limit within the s and on the days set out on Schedule B. (e) No Parking for Restricted Times Except by Residency Parking Permit When Signs have been erected and are on display prohibiting such activity, no person shall Stop, Stand or Park any Vehicle on any Highway or part of a Highway set out on Schedule C except when displaying an authorized Residency Permit. (f) Parking for Restricted Period of Time When Signs have been erected and are on display prohibiting such activity, no person shall Stop, Stand or Park any Vehicle on any Highway or part of Highway as set out in Schedule D to this by-law for a longer period of Time than specified on the Sign. (g) Stopping Prohibited Where Authorized Sign is on Display When Signs have been erected and are on display prohibiting such activity, no person shall Stop, Stand or Park any Vehicle on any Highway or part of Highway set out in Schedule E. (h) Short-Term Parking Where Parking meters, or pay and display machines have been installed by the Lower Tier Municipality and display Parking Time limits, no person shall Park a Motor Vehicle for longer than a Short Term Parking Time, as defined in this by-law on Highways named and/or described in Column 1 of Schedule F to this by-law at the location described in Column 2 of the said Schedule, during the Hours of Enforcement. (i) No Parking Where Authorized Sign is on Display Except by Disability Parking Permit Page 9 of 18 By-law March 5, 2013 Amended by By-laws , , , , , , , , , , and

10 When Signs have been erected and are on display prohibiting such activity, no person shall Stop, Stand or Park any Vehicle in any Parking Space or area described in Schedule G provided however that the provisions of this Section shall not apply to a Motor Vehicle used for the purpose of transporting persons who hold, and have on display, a valid Disabled Persons Parking Permit issued pursuant to the Highway Traffic Act as amended from time to time. (j) No Parking for Restricted Times During Winter Season When Signs have been erected and are on display prohibiting such activity, no person shall Stop, Stand or Park any Vehicle on any Highway or part of a Highway during the s specified and on the days set out on Schedule H. (k) Removal of Vehicles (i) Where any Vehicle is Parked in contravention of this by-law, a Provincial Offences Officer may cause it to be moved or taken to and placed in storage, and all costs for removing and storing the Vehicle shall be a lien upon the Vehicle which may be enforced in the manner provided for in the Repair and Storage Liens Act. (ii) The provisions of this sub-section do not apply to the driver or operator of a Vehicle that is so disabled while on a Highway that it is impossible to avoid a contravention of the provisions of this bylaw on a temporary basis. (l) Unlicensed Vehicles No person shall Park a Motor Vehicle on a Highway unless such Motor Vehicle has evidence of a Currently Validated Permit displayed in accordance with the requirements of the Highway Traffic Act. (m) Loading and Unloading Berths (i) (ii) No Person shall Stop, Stand or Park a Motor Vehicle in a Loading or Unloading Berth. When Signs have been erected and are on display authorizing such activity, Commercial Motor Vehicles may load and unload goods and materials on the Highways named in Column 1 of Schedule I to this by-law, at the location described in Column 2 of the said Schedule for local delivery purposes. 11 (n) Blocking Intersections When approaching a Traffic Control Signal at an intersection showing a circular green or green arrow indicator, no Person being the driver or operator of a Motor Vehicle shall enter the Intersection unless Traffic in front of him or her is moving in a manner that would reasonably lead him or her to believe that he or she can clear the Intersection before the signal indicator changes to a circular red indicator. (i) (ii) This section does not apply to the driver or operator of a Motor Vehicle who enters an Intersection for the purpose of turning to the right or left into an intersecting Highway and signals his or her intention to make such turn prior to entering the Intersection, and provided the driver or operator completes his or her turn as soon as it is safe to do so. This section applies to all Intersections of Highways under the jurisdiction of the Municipality that have a Traffic Control Signal at the said Intersections. (o) Exclusions Section 4 of this by-law shall not apply to: (i) (ii) (iii) Authorized Emergency Vehicles Vehicles actually engaged in work undertaken for or on behalf of the Municipality or one of the Lower Tier Municipalities within the geographical boundaries of County of Grey, or Security Vehicles while picking up, transporting or delivering cash or securities and security personnel. 5. TRAFFIC REGULATIONS 5.1 Through Highways, Stop Signs And Yield Signs (a) Through Highways Stop (i) (ii) The Highways and/or parts of Highways set out in Column 1 of Schedule J of this by-law, from the limits set out in Column 2 of said Schedule to the limits set out in Column 3 of said Schedule are hereby designated as Through Highways. Notwithstanding Subsection 5.1(a)(i), the designation of a Highway or part of a Highway as a Through Highway shall not include any Page 11 of 18 By-law March 5, 2013 Amended by By-laws , , , , , , , , , , and

12 (iii) Intersection thereon, where the road intersected is a King s Highway or where Traffic Control Signals are installed. Stop Signs shall be erected at the Intersections of all Highways entering a Through Highway as designated in Column 1 of Schedule K to this by-law facing the direction of Traffic specified in Column 2 of said Schedule on the Highways named in Column 3 of said Schedule. (b) Yield Signs 5.2 Turns Yield right-of-way Signs shall be erected at the Intersections set out in Column 1 of Schedule L to this by-law facing the direction of Traffic specified in Column 2 of said Schedule, on Highways named and/or described in Column 3 of said Schedule. (a) Prohibition (i) (ii) U Turns Where a Sign to that effect is on display, no person operating a Vehicle shall make a U turn on any Highway or part of any Highway under the jurisdiction of the Municipality. Temporary Signs A Police Officer or the County Director of Transportation Services may authorize temporary signs prohibiting turns at any Intersection and while such sign is on display no person operating a Vehicle shall turn that Vehicle in any direction contrary to the sign. 5.3 Rates of Speed (a) Highway Speed Limits (i) (ii) (iii) Not Within Built-Up Areas The rate of speed shall be 80 km/hr on a Highway not within a built-up area, unless otherwise posted with a Sign. Within Built-Up Areas The rate of speed shall be 50 km/hr on a Highway within a built-up area, unless otherwise posted with a Sign. When Signs, marked in compliance with the regulations under the Highway Traffic Act, are on display, no person shall drive a Motor Vehicle upon the Highways named and/or described in Column 1 Page 12 of 18 By-law March 5, 2013 Amended by By-laws , , , , , , , , , , and

13 (iv) of Schedule N to this by-law from the location or Highway named and/or described in Column 2 of the said Schedule to the location or Highway named and/or described in Column 3 of the said Schedule at a greater rate of speed than is described in Column 4 of the said Schedule. When Signs, marked in compliance with the regulations under the Highway Traffic Act, are on display in a school zone, no person shall drive a Motor Vehicle upon the Highways named and/or described in Column 1 of Schedule O to this by-law at the locations described in Column 2, and during the Times set forth in Column 3 of the said Schedule. (b) Community Safety Zones Pursuant to the provisions of the Highway Traffic Act, the Municipality hereby deems that public safety is of a special concern on the Highways as set forth in Column 1 of Schedule P, at the locations described in Column 2, from a point set out in Column 3 to a point set out in Column 4 anytime. 5.4 Limited Loads on Highways (a) Heavy Vehicle Route When Signs have been erected and are on display prohibiting such activity, no person shall move, drive or operate a Heavy Vehicle at any Time on the Highway or parts of Highways except on the Highways or part of Highways set out in Column 1 of Schedule Q to this by-law, from the location or Highway named and/or described in Column 2 of the said Schedule to the location or Highway named and/or described in Column 3 of the said Schedule, anytime. (b) Heavy Vehicle Route for Restricted Times When Signs have been erected and are on display prohibiting such activity, no person shall move, drive or operate a Heavy Vehicle at any Time on the Highway or parts of Highways except on the Highways or part of Highways set out in Column 1 of Schedule R to this by-law, from the location or Highway named and/or described in Column 2 of the said Schedule to the location or Highway named and/or described in Column 3 of the said Schedule, for each and every day of the year, during the restricted time described in Column 4. 14 (c) Limited Loads on Highways When Signs have been erected and are on display and so indicate, the provisions of Subsections 1, 2, 3 and 4 of Section 122 of the Highway Traffic Act apply to the Highways named in Column 1 of Schedule S to this by-law, from the location or Highway named and/or described in Column 2 of the said Schedule to the location or Highway named and/or described in Column 3 of the said Schedule, for the period from the 1st day of March to the 30th day of April, inclusive in each and every year. If deemed necessary by the County Director of Transportation Services, the period of the load restriction in Section 5.4 (a) may be extended to include the months of February and May. This section does not apply to any Vehicle owned or operated by the Municipality, any Lower Tier Municipality, any local boards, or to any Commercial Motor Vehicle making a bona fide delivery to or collection from a destination which cannot be reached by a Highway upon which load restrictions are not imposed by this by-law. 5.5 Limited Loads on Bridges (a) When Signs have been erected and are on display and so indicate, the provisions of Subsections 1 of Section 123 of the Highway Traffic Act apply to the Highways named in Column 1 of Schedule T to this by-law, at the bridge structure named and/or described in Column 2 of the said Schedule, for the restrictions described in Column 3 of the said Schedule. This section does not apply to any Vehicle owned or operated by the Municipality, any Lower Tier Municipality, any local boards, or to any Commercial Motor Vehicle making a bona fide delivery to or collection from a destination that cannot be reached by another Highway upon which load restrictions are not imposed by this by-law. 5.6 Restrict Passing (a) When Signs have been erected and are on display and so indicate, the provisions of Section 149(1)(a) of the Highway Traffic At, R.S.O as amended: No vehicle shall be driven or operated left of the centre of a roadway designed for one or more lines of traffic in each direction when Page 14 of 18 By-law March 5, 2013 Amended by By-laws , , , , , , , , , , and

15 5.7 Coasting approaching the crest of a grade or upon a curve in the roadway or within 30 metres of a bridge, viaduct or tunnel where the driver s view is obstructed within that distance so as to create a potential hazard in the event another vehicle might approach from the opposite direction apply to the Highways named in Column 1 of Schedule V to this by-law from the location described in Column 2 of the said schedule to the location described in Column 3 of the said schedule for the time period described in Column 4 of said schedule. In this section, (a) (b) No person upon a conveyance shall go upon a highway, other than on the sidewalk, except or the purposes of crossing a highway in a perpendicular direction to its lateral property lines. Without limiting the generality of subsection 5.7.a), every person upon a conveyance shall, at all times: (i) (ii) (iii) Exercise due care and attention to his or her safety; Travel in a manner and at a speed appropriate to the surface being travelled upon; Exercise due care and attention to the safety of all other users of the sidewalk and shall yield to pedestrians; and (iv) Adhere to the provisions of the Highway Traffic Act, R.S.O. 1990, c. H.8, where applicable. (c) (d) (e) (f) No person shall coast or ride upon a conveyance in such a manner so as to cause any damage to public or private property. No person riding or coasting upon a conveyance shall fail to provide, forthwith upon demand of a police officer or by-law enforcement officer, his or her correct name, address and date of birth. No person shall coast or ride upon a conveyance in such a manner so as to obstruct or interfere with vehicular and bicycle traffic or riders on horseback. 16 6. PENALTIES (a) dangerous manner including speeding and racing. Any person who contravenes any provision of this by-law is guilty of an offence and upon conviction, shall be liable to a fine as provided for under the Provincial Offences Act. (b) (c) Every person who contravenes any of the provisions of Sections 5.2(a)(i), 5.3(a), 5.3(b), 5.4(a), and 5.6(a) of this by-law is guilty of an offence and upon conviction, shall be subject to penalties prescribed by the Highway Traffic Act. The owner of a Vehicle that is Parked or Stopped in contravention of this by-law is guilty of an offence and upon conviction is liable to the fine stated in this by-law unless such owner proves to the satisfaction of the court that at the Time of the offence the Vehicle was in the possession of another person without that owner s consent, express or implied. 7. GENERAL (a) (b) The schedules referred to in this by-law shall form and become part of this by-law and each entry in Columns of such schedules shall be read in conjunction with the entry or entries across horizontally and not otherwise. Should any section, clause or provision of this by-law be declared to be invalid by a court of competent jurisdiction the same shall be deemed to be severable and shall not affect the validity of the remainder of this bylaw. (c) Except as specified in Section 7(d) below, By-Laws No , , , , , , , , , , , , , , , , , , , , , , , , , , , , , , , , , and , and all by-laws pertaining to the regulation of Traffic and Parking on Highways in the Municipality that are inconsistent with the terms of this by-law, be and the same are hereby repealed.
