A resolution accepting the resignation of AI Bourg and appointing Tahir Ahmed to the City of Kenner Planning and Zoning Commission. 16. ORDINANCES/RESOLUTIONS IN SUMMARY (FIRST READING) 16-K. Amendments to Kenner's Unified Development Code (Ordinance No. 11,062), adopted March 17, 2016, regarding the parking and storage of recreational vehicles and recreational watercraft.

2 On motion of Councilmember, seconded by Councilmember, the following resolution was offered: RESOLUTION NO. A RESOLUTION ACCEPTING THE RESIGNATION OF AL BOURG AND APPOINTING TAHIR AHMED TO THE CITY OF KENNER PLANNING AND ZONING COMMISSION WHEREAS, on October 5, 2017, the City Council adopted Resolution B appointing Mr. AI Bourg as Council District 3 representative to the Planning and Zoning Commission for a four year term commencing on September 22, 2017 and expiring on September 21, 2021; and, WHEREAS, on November 8, 2017, Mr. Bourg officially resigned from the Planning and Zoning Commission due to a health issue; thereby creating a vacancy in the membership of the Commission; and, WHEREAS, Mr. Tahir Ahmed, a local business owner and resident of Kenner has agreed to fulfill the four year term and perform the duties and responsibilities of the Planning and Zoning Commission in accordance with the provisions of LA R.S. 33:4726 and City of Kenner Ordinance No. 7525; and, WHEREAS, it is in the best interest of the citizens of the City of Kenner that Mr. Tahir Ahmed be the appointee of Council District 3 to the City of Kenner Planning and Zoning Commission. THE COUNCIL FOR THE CITY OF KENNER HEREBY RESOLVES: SECTION ONE: That Tahir Ahmed is hereby appointed to the City of Kenner Planning and Zoning Commission, to fulfill the four year term which began September 22, 2017 and expiring on September 21, This resolution having been submitted to a vote, the vote thereon was as follows: YEAS: NAYS: ABSENT: ABSTAINED: This resolution was declared adopted on this, the day of CLERK OF THE COUNCIL PRESIDENT OF THE COUNCIL MAYOR SUBMITTED BY: COUNCILMAN KEITH REYNAUD, DISTRICT 3

4 On motion of Councilmember, seconded by Councilmember, the following ordinance was introduced: SUMMARY NO. ORDINANCE NO. AMENDMENTS TO KENNER'S UNIFIED DEVELOPMENT CODE (ORDINANCE NO. 11,062), ADOPTED MARCH 17, 2016, REGARDING THE PARKING AND STORAGE OF RECREATIONAL VEHICLES AND RECREATIONAL WATERCRAFT WHEREAS, on March 17, 2016 the Kenner City Council adopted Special Ordinance 11,062 rescinding the City of Kenner's Comprehensive Zoning Ordinance (Ordinance No. 2427) adopted December 4, 1978 and replacing it with the Unified Development Code (UDC); and, WHEREAS, Article VII, Off-Street Parking and Loading Regulations; Section 7.11 Storage of Commercial & Recreational Vehicles; subsection (b) Recreational Vehicles; (2) Setback Requirements; paragraph "a", states that recreational vehicles and recreational watercraft not parked or stored inside of a fully enclosed garage shall be parked or stored completely behind the front building line of the principal structure or not less than sixty (60) feet from the front lot line, whichever is closest to the front lot line; and, WHEREAS, based on public comments received from recreational vehicle and recreational watercraft owners impacted by the regulations, it is in the best interest of the community amend this set back requirement; and, WHEREAS, ten (1 0) asterisks separated by a single space indicate that unchanged text precedes the amended text, words in strike through type are deletions from existing law, and words underscored are additions. THE COUNCIL OF THE CITY OF KENNER HEREBY ORDAINS: SECTION ONE: That Article V, Definitions; Section 5.04 General Definitions; of the Unified Development Code, City of Kenner, Louisiana, is amended to read as follows: Section 5.04 General Definitions *** ** *** ** 81 Recreation Vehicle: A vehicle,, or similar means of human transportation, used primarily for recreational purposes. Recreational vehicles include, but are not limited to, boats and rafts, camper or travel trailers designed to be used as a temporary dvjelling for travel or recreational use, motor homes, pickup coaches designed primarily to be mounted on a pickup or truck chassis and suitable for use as a temporary d\velling for travel, recreational or vacation uses, and jet skis and other personal watercraft. 81A Recreational Vehicle: A vehicle. or similar means of human transportation, used primarily for recreational purposes or as a temporary dwelling for travel. Recreational vehicles include, but are not limited to, dirt bikes, all-terrain vehicles, campers, pop-up campers, travel trailers, motor homes, and pickup coaches designed to be mounted on a truck chassis. 81 B Recreational Watercraft: A watercraft, or similar means of human transportation over water, used primarily for recreational purposes. Recreational vehicles include, but are not limited to, boats, rafts, jet skis. personal watercraft and their trailers. SECTION TWO: That Article VII, Off-Street Parking and Loading Regulations; Section 7.11 Storage of Commercial & Recreational Vehicles; subsection (b) Recreational Vehicles, (2) Setback Requirements; of the Unified Development Code, City of Kenner, Louisiana, is amended to read as follows: (b) Recreational Vehicles: For the purpose's of this ArtiCle, recreational vehicles include all trailers, campers, jet skies, motor homes, pop up campers, boats and boat trailers, and trailers that transport

5 recreational vehicles such as dirt bikes and all terrain vehicles. Boats and boat trailers are limited to twenty five (25) feet in length: Recreational vehicles and rec.reational watercraft may be parked or stored on the sites of single-family, two-family, andthree & four-family dwellings including manufactured homes and townhouses, subject to the following conditions: (1) At no time shall parked or stored recreational vehicles and recreational watercraft be occupied or used for living, sleeping, or housekeeping purposes. (2) Setback requirements: a. "Recreational vehicles and recreational '.vatercraft not parked or stored inside of a fully enclosed garage shall be parked or stored completely behind the front building line of the principal structure or not less than sixty (60) feet from the front lot line, whichever is closest to the front lot line. b. If a variance is granted to the building line or setback requirement for recreational vehicles and recreational \vatercraft, they shall comply with the screening requirements of subsection (7) and shall in no case be parked in a required front yard. c. Recreational vehicles and recreational watercraft seven (7) feet or less in height shall be located no less than three (3) feet from a side or rear lot line, unless screened from view of the abutting property in accordance with subsection (7). R\ls recreational vehicles and recreational watercraft shall be measured from grade to their top edge and shall exclude any minor incidental projections; projections included in the measurement of height shall be considered as substantial by the discretion of the Director of Inspection and Code Enforcement. d. Recreational vehicles and recreational watercraft over seven (7) feet in height shall be located no less than five (5) feet from a side or rear lot line and shall be screened from view of the abutting property and the abutting street right-of-way in accordance with subsection (7). e. On corner lots, recreational vehicles and recreational watercraft shall not be parked or stored closer to the abutting side street than the side building line of the principal structure unless screened in accordance with subsection (7). f. Recreational watercraft may be parked or stored in front of the front building line of the principal structure, unless another area of the lot is accessible for storage of the recreational watercraft and the lot provides adequate space for it. This section shall not apply when it conflicts with any restrictive covenants or planned unit developments. For purposes of this section, the following terms mean the following: i. Accessible: The ability to enter and exit a lot without requiring any modifications to the existing improvements to the lot. Nonfunctioning locks and lost keys shall not be considered as factors in rendering an area of the lot to be inaccessible. 11. Adequate space: An opened area that exists behind the building line of the lot capable of parking or storing the recreational watercraft without creating any obvious obstructions for regular use of the lot. (3) Recreational vehicles and recreational watercraft may be parked anywhere on the premises for loading or unloading purposes no longer than twenty-four (24) hours and shall not extend into any public right-of-way. In situations such as hurricanes or similar weather phenomenon, that necessitates an evacuation, the Director of Inspection and Code Enforcement may waive the limitation on hours for loading and unloading in this section. (4) All recreational vehicles and recreational watercraft shall be in an operable condition and parked or stored on a surface that is maintained in good condition, free of weeds, dust, trash, and debris. Recreational watercraft parked or stored in front of the front

6 building line of the principal structure shall be parked or stored on a hard surface and limited to twenty-five (25) feet in length. (7) Screening requirements: ** * ******* a. Recreational vehicles and recreational watercraft must be screened by a living fence (trees, shrubs, hedgerow, etc.) or an opaque wood, brick, vinyl or masonry fence with a minimum height of six (6) feet or any combination thereof. b. Living fences shall be at least two (2) feet in height when planted and must be at least a height of six (6) feet within two (2) years and create a continuous opaque buffer. c. Recreational vehicles and recreational watercraft stored completely underneath a freestanding carport or shelter in which at least the two (2) longest sides are covered halfway from the structure's peak height to grade are exempt from the screening requirements of this section. (8) Amortization Period: 'Recreational vehicles, as defined herein, in place at the time of the adoption of this ordinance from \Vhich this section is derived will be exempt from these regulations for a period of twenty four (24) months from the effective date of this Unified Development Code, after which all recreational vehicles shall comply with all requirements of this section. SECTION TWO: That the Council President is hereby a uthorized and empowered to sign any plans or documents which may be necessary to carry into effect the foregoing. SECTION THREE: That all ordinances or parts of ordinances in conflict with this ordinance are hereby expressly repealed and rescinded but only insofar as they conflict with the provisions of this ordinance and no further.
