1 BY-LAW NUMBER BEING A BY-LAW TO AMEND THE TRAFFIC BY-LAW NUMBER , AS AMENDED WHEREAS the Council of The Corporation of the Town of Shelburne deems it expedient to amend the Traffic By-law Number as amended; AND WHEREAS By-law Number , as amended, regulates traffic within the Town limits of The Corporation of the Town of Shelburne; NOW THEREFORE the Council of The Corporation of the Town of Shelburne enacts the following: 1. By-law , Sub-section 2. 2(a) and Sub-section 2.3 are amended by replacing Works Supervisor with: Public Works Officer. 2. By-law , Section 3, sub-section 6(h), is repealed and replaced by the following: (h) On any street within Town limits daily, 12 midnight to 8 a.m. November 15 th to April 15 th. 3. By-law , is amended by inserting the following: SECTION 5.1 PARKING RESTRICTIONS SCHOOL BUS 1. Where signs in accordance with the Regulation of the Highway Traffic Act are displayed, no person shall park any school bus vehicles on any municipally owned parking lot, or roadway without a permit for parking. 4. By-law , Section 7, is repealed and replaced by the following: SECTION 7 PARKING AND STORAGE RESTRICTIONS AND PROHIBITIONS ON CERTAIN HIGHWAYS 1. Where signs in accordance with the Regulations of Highway Traffic Act are displayed, no person shall park a vehicle on any Highway at the side and between the limits set out respectively in Columns 1, 2 and 3 of Schedule B to this By-law during the prohibited times or days set out in Column 4 of the said schedule. 2. Where signs in accordance with the Regulation of the Highway Traffic Act are displayed, no person shall park a vehicle on any highway at the side and between the limits set out respectively in Columns 1 and 2 of Schedule C to this By-law during the times or days set out in Column 3 of the said schedule for a longer period than set out in Column 4 of the said schedule. 2 3. By-law , is amended by inserting the following: SECTION 7.1 GAMES OR SPORTS RESTRICTIONS 1. Unless otherwise granted under a permit to the municipality, no person shall: (a) Play or take part in any game or sport upon a highway, roadway or boulevard; (b) Place or install on a temporary or permanent basis, sports equipment including basketball nets, goal nets, skateboard ramps, or any other gaming or sporting device, on any Roadway or Boulevard. 5. By-Law , Section 17, is repealed and replaced by the following: SECTION 17 SPEED ZONES 1. No person shall drive a motor vehicle at a rate of speed greater than 50 kilometers per hour on any highway within the Corporation. 2. Notwithstanding the above, where any highway or portion of highway set out in Column 1 of Schedule M of this By-Law, between the limits set out in Column 2, is marked in compliance with the regulations under the Highway Traffic Act, the maximum rate of speed thereon shall be the rate of speed prescribed in Column 3 of said schedule. 6. By-law , as amended by By-law , Section 19, and 19.1 are repealed and replaced by the following: SECTION 19 OPERATION OF HEAVY TRAFFIC 1. Where signs in accordance with the Regulations of Highway Traffic Act have been erected, no person shall operate heavy traffic as defined in Section 1 hereof, on all highways, roadways, or boulevards within the Corporation. 2. Notwithstanding the above, the operation of heavy traffic shall be permitted on the highways or portions of highways as set out in Column 1 of Schedule O of this By-Law, between the limits set out in Column 2, during the times set out in Column 3, and marked in compliance with the regulations under the Highway Traffic Act. 3. The provisions of subsection 1 of this section shall not extend to the use of said highways or parts of highways for deliveries to or removal from any premises abutting thereon or to ambulances, police or fire department vehicles public utility emergency vehicles, vehicles actually engaged in works undertaken for or on behalf of the Corporation. SECTION 19.1 PARKING OF HEAVY TRAFFIC 1. Where signs in accordance with the Regulations of Highway Traffic Act have been erected, no person shall park a vehicle, object or contrivance for moving loads being a gross weight including the vehicle, object, or contrivance and load, in excess of (5) tones on the highways or parts of highways set out in Column 1 of Schedule O of this By-Law, between the limits set out in Column 2, during the times set out in Column 3 of the said Schedule. By-law , as amended by By-laws , , and , Section 22, is repealed and replaced by the following: SECTION 22 PENALTIES 1..Any person who contravenes any of the provisions of Sections 2, 3, 4, 5, 5.1, 6, 7, 7.1, 8, 9, 10, 11 and 21 of this By-law shall be liable to a fine recoverable under the provisions of the Provincial Offences Act. 2. Any persons violating any of the provisions of Sections 12, 13, 19, of this By-law shall be subject to a penalty recoverable under the provisions of the Provincial Offences Act. 3. Any person violating any of the provisions of Sections 14, 15, 16, 17, and 18 of this By-law shall be subject to the penalty provided for such violation in the Highway Traffic Act. 4. Any person who contravenes the provisions of Section 20.1 shall be guilty of an offence and on conviction is liable to a fine of not less than $ nor more than a fine of $300. Such fines shall be recoverable under the provisions of the Provincial Offences Act. 5. The owner of a vehicle for which a notice of violation has been issued alleging a contravention of any of the provisions of the Bylaw referred to in Section 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 20 & 21 may make payment of the fine set out in accordance with this By-law on the notice of violation out of court by remitting such payment to the appropriate authority in accordance with the instructions on notice of violation within the time limit prescribed thereon. 6. A constable or an officer appointed for the carrying out of the provisions of this By-law, upon discovery of any vehicle parked, stopped or standing in contravention of this By-law may cause it to be moved or taken to and placed or stored in a suitable place and all costs and charged for removing, care and storage thereof if any, are a lien upon the vehicle, which may be enforced in the manner provided by Section 48 of the Mechanic s Lien Act. 7. The owner of a vehicle shall incur the penalties provided for any contravention of this By-law unless at the time of the contravention the vehicle was in the possession of some person other than the owner or his chauffer without the owner s consent in which case the driver or operator of the vehicle not being the owner, shall also be liable to incur the penalties provided for any such contravention. 8. By-law , as amended, Schedule B is deleted and replaced by inserting the attached Schedule B. 9. By-law , as amended, Schedule C is deleted and replaced by inserting the attached Schedule C. 10. By-law , as amended, Schedule K is deleted and replaced by inserting the attached Schedule K. 11. By-law , as amended, Schedule O is deleted and replaced by inserting the attached Schedule O.
