2 THE CORPORATION OF THE CITY OF BRAMPTON Number _ , Being a by-law to amend the Licencing By-law No of the City of Brampton WHEREAS Council of the City of'brampton deems it desirable to amend the Licencing By-law 17-75; AND WHEREAS Section 383, paragraph 6'of The Hunicipal Act, R.S.O., 1970, Chapter 284, empowers the Municipalfty to regulate; licence, and prohibit the location of places of alt!usement, or a particular class thereof, on land abutting on any highway or part thereof and to revoke any such licence. NOW THEREFORE THE COUNCIL OF THE CORPO~TION OF, THE CITY OF BRAMPTON ENACTS as follows: 1. By-law No being a by-law "respecting the issue of licences in the Corporation of the City of Brampton" as amended, is amended by adding thereto the following definition section: la. "Amusement Arcade" means a building, premises, room or place which offers to the public the use of services of two or more of any coin-operated pinball machine or any other coin-operated amusement device or game. 2. Section 22 of Part 11 of said By-law as amended, -'. is _repealed<, and the following substituted therefore: 22. every person who owns or keeps for hire or gain an exhibition and exhibits same elsewhere a theatre, a music hall, a public

3 2 hall or other place licenced under this Subsection, or who owns or keeps a theatre, a music hall, bowling alley, moving picture show, public hall, circus-midways, miniature golf ranges, golf driving range, amusement arcade, or other place of amusement. 3. By-law as amended, is amended by adding thereto the following section: 18. no person licenced or required to be licenced under this by-law in respect of any premises or place other than under Schedule 22 to this by-law shall place or keep, or permit the placing or keeping of or at such premises or place more than one coin-operated pinball machine or any other coin-operated amusement device or game. 4. Part 22 of the fee schedule to the said By-law as amended, is amended by adding thereto the following: Amusement Arcade $ December 31st 5. The preamble to Schedule 22 to said By-law as amended, is repe~led' and the following substituted therefore: Relating to Owners or Keepers of Exhibitions Theatres, Music Halls, Moving Picture Shows, Circus, Miniature Golf Course, Golf Driving Range, Amusement Arcade and other places of amusement. 6. Schedule 22 to said By-law as amended, is amended by adding thereto the following sections: 7(1) In addition to the application requirements in the By-law, every person applying for an amusement arcade licence shall provide:

4 3 (a) An affidavit signed by the applicant, or in the c~se of a corporation, by an officer of that corporation, that he has not been convicted of an offence under the Criminal Code of Canada in relation to lotteries, games of chance, betting and gaming, sexual offences or offences tending to corrupt morals, or trafficking in drugs under any Statute during the previous five years. (b) A letter from the Building and Zoning Co-ordinator as to the sufficiency of the building or -structure for the intended use thereof as an amusement arcade and as to compliance of the lands and premises to be used for such purpose by the applicant with respect to the Ontario Building Code and the relevant Zoning By-law. (c) A letter from the Fire Chief setting out his recommendations as to any fire safety precaution which should be taken by the applicant with respect to the building or premises intended to be used by the applicant in connection with his operation of the amusement arcade. (2) Every person who operates an amusement arcade or engages in or carries on the operation of an amusement arcade, and every person who manages or is in charge of the operation of an amusement arcade shall be at least 18 years of age. (3) No building, structure or premises on or in which an amusement arcade is located or any part thereof shall be used as a dwelling or for sleeping purposes.

5 4 (4) No building, structure or premises on or in which an amusement arcade is located shall be fitted or equipped with an advertising or public address loud speaker, contrivance or device. (5) Every amusement arcade shall be kept under the constant supervision of a responsible adult person who shall maintain orderly conduct therein. (6) Every amusement arcade while in operation shall be illuminated to an average level of at least ten footcandles at floor level. (7) No person licenced under this By-law shall operate an amusement arcade between the hours of 9:00 p.m. and 9:00 a.m. Standard Time or Daylight Saving Time, whichever shall be in effect in the City of Brampton. (8) Every person licenced under this By-law shall ensure that no child under the age-of 16 years shall be admitted to the said amusement arcade unless the child is accompanied by his parent or legal guardian, and no such child shall be allowed to remain in such amusement arcade or any part thereof unless accompanied at all times by a parent or legal guardian. (9) No amusement arcade shall be located on any lands abutting the highway or part of'a highway within the City of Brampton as set out in Appendix 1 to this Schedule. (10) The owner or keeper of every amusement arcade licenced or required to be licenced pursuant to this By-law, offering the use of services of any pinball machine or other coin-operated amusement device or game in such place, shall comply with or ensure the compliance with the above regulations.
