1 NREI Conference on EB-5 Investments: Unique Opportunities and Challenges (June 16 th, 2016) On June 16, 2016 the Steven L. Newman Real Estate Institute at the Zicklin School of Business in association with Mona Shah & Associates hosted the first EB-5 conference at Baruch College entitled EB-5 Investments: Unique Opportunities and Challenges. The conference featured six distinguished panels, with guest speakers from the EB-5 industry, each expert in their respective fields. The day-long event brought together a diverse audience such as industry leaders, developers, investors, attorneys and other interested parties from across the nation and overseas to discuss the most relevant and challenging issues confronting the EB-5 program. Panel One, The Future of EB-5, What Can We Expect? discussed changes in the EB-5 program and the main issues being currently addressed by legislation and industry participants. The panel focused in particular on the reauthorization of the EB-5 program, regulatory reform on raising the minimum investment amount and integrity related provisions that have to do with the source and path of funds.

Panel Two, China and the Rest of the World, discussed the appeal of the EB-5 program for foreign investors, concentrating on the financial return and immigration status for the investor.

Panelists also spoke about issues such as ways to increase visas, whether a minor can legally sign a contract in EB-5 or be an accredited investor and issues relating to Senate Bill Panel Three, How effective is EB-5 as a source of Alternative Financing? discussed how after the tightening of the credit market American businesses and developers have turned towards EB-5 fund to raise capital for their projects. Although real estate continues to attract the majority of EB-5 funds, the panel emphasized the need for diversification of investment and expansion into other related industries such as infrastructure and transportation. Panel Four, Raising EB-5 Funds: Issues to Keep in Mind, brought attention to legislative issues currently impacting the program. The panel discussed about the role of regional centers, broker-agent conflict of interest, and the enhanced governmental oversight over the source of funds filings.

Developers on the panels discussed the complexities that arise when dealing with E-5 investors and government oversight over their projects. They also emphasized the importance of creating and maintaining relationships with Asian agents, who represent the majority of EB-5 investors.

4 Finally, Panel Six, Unique Issues in EB-5, panelists discussed areas in which conflicts of interest exist in the EB-5 space such as with immigration agents, related party control of various EB-5 entities, and the representation of projects and immigrants by the same counsel.
