2 Stone Harbor Municipal Public Access Plan EXECUTIVE SUMMARY In the spring of 2011, the New Jersey Department of Environmental Protection proposed revised rules for public access to the ocean and bay waters of the state. The proposed rules also required all municipalities adjacent to state waters to produce a Municipal Public Access Plan that describes local waterfront access availability. PUBLIC ACCESS TO CLEAN BEACHES AND NAVIGABLE WATERWAYS IS OF VALUED IMPORTANCE TO THE BOROUGH OF STONE HARBOR. The Borough of Stone Harbor is located in Cape May County on Seven Mile Island and bordered by the Atlantic Ocean and the baywaters of the state. The year-round population consists of 866 residents and the number of visitors during the summer months swells to 23,000. Public access to clean beaches and navigable waterways is of valued importance to the Borough of Stone Harbor. Therefore, the Borough is proactive in serving the needs of its residents and visitors. Stone Harbor has been a vacation and recreation destination for over 100 years and has been successful in balancing the management of increased population with natural resource protection. The oceanfront shoreline of Stone Harbor offers public access to the beach at every street end within the Borough from 80 th Street south to 123 rd Street. Access is also available from the parking lot at Stone Harbor Point to the end of Seven Mile Island. The Borough ocean-side recreational area provides on-street parking facilities at 80 th to 83 rd Streets. Bay access for fishing, crabbing, and bird watching exists at each of the numbered streets that reach back to the bay shoreline. Some on-street parking is available along each street end. The Municipal Marina at the bay shorefront on 80 th to 83 rd Streets is a public marina that offers parking and a launching ramp for vessels on trailers. The goals of this Municipal Public Access Plan are to maintain and improve existing access as well as present future plans that will enhance its waterfront access. Purpose The purpose of this document is to provide a comprehensive Municipal Public Access Plan (MPAP) for the Borough of Stone Harbor in accordance with N.J.A.C. 7:7E. The MPAP has been submitted to the New Jersey Department of Environmental Protection (NJDEP) for approval so that public access requirements for permits will be waived in Stone Harbor (Borough). 3 December 2011 Authority for Public Access Planning Responsibility As of the date of submittal, public access planning responsibility remains with the New Jersey Department of Environmental Protection. Upon approval of the submitted plan, the Borough of Stone Harbor will become the authority responsible for ensuring that public access to tidal waterways is provided in accordance with N.J.A.C.7:7E. Municipal History The Borough of Stone Harbor is a coastal resort community that proudly integrates an abundance of natural resources, residential neighborhoods and a thriving downtown business district with tourism (Figure 1). Originally a fishing and hunting village, Stone Harbor was developed as a visitor destination in the late 1800 s. The Borough s pristine beachfront property was purchased by a wealthy Philadelphia investor and soon thereafter it flourished as an upscale getaway for wealthy vacationers from Philadelphia and New York. The Borough of Stone Harbor was incorporated in Stone Harbor is located on the southern 1.6 square miles of Seven Mile Beach Island situated between The Wildwoods and Ludlum Island in Cape May County. The north-south reach of the Borough stretches from 80 th Street to Stone Harbor Point (south of 122 nd Street). The Borough of Avalon comprises the northern portion of the barrier island from 80 th Street to Townsends Inlet. The Borough experiences extreme fluctuations in population between seasonal and non-seasonal months. The year-round population is about 866 persons and that increases nearly twenty times in the summer months to more than 23,000. Recently, the Borough is experiencing a decrease in the number of permanent residents and rental housing units, and an increase in the number of second-home owners. These second-home owners spend considerably less time in the Borough than permanent residents, resulting in a shorter, less dense seasonal population. This is the second time in the Borough s history that there has been a decennial decline in year-round population. The summer increased population is welcomed by businesses and the Borough is successful in managing the challenges brought by the increased visitors on the natural resources such as the dunes and coastal wetlands. The Borough maintains significant public access to its ocean and bayside waterways and those areas are presented in this plan. 5 December 2011 Goals of the Public Access Plan Stone Harbor has been a vacation and recreation destination for almost 100 years and has been successful in balancing the management of increased population with natural resource protection. The Borough provides accessible waterfront for the enjoyment of residents and shore visitors. In order to achieve accessibility, the goals of the Stone Harbor Municipal Public Access Plan are to: Maintain existing access and enhance and create public opportunities for access to tidal waters and their shores, on a non-discriminatory basis, for recreation and commerce. Improve, as practicable, waterfront parks and recreational facilities with additional civic amenities. Protect the Borough s natural resources. Provide opportunity for public access in areas where new development adjoins tidal waters and shores. Present areas that may be restricted, in part, either seasonally, hourly, or in extent, or where use will create conditions that may be reasonably expected to endanger the health or safety of the public or environment, or will create a significant security vulnerability, consistent with federal law. Present areas that may be prohibited for public access where it is inconsistent with federal law or where it is not practicable based on the risk of injury from hazardous operations or substantial permanent obstructions, and no measures can be taken to avert these risks. Maintain consistency with the land use planning objectives outlined and adopted in the Stone Harbor Master Plan (2009), the Stone Harbor Point Conservation Plan (2008), the Beach Bird Nesting Plan (2008), the Cape May County Master Plan (2002) and the New Jersey State Development and Redevelopment Plan (2001). THE BOROUGH PROVIDES ACCESSIBLE WATERFRONT FOR THE ENJOYMENT OF RESIDENTS AND SHORE VISITORS. Page 5

6 Stone Harbor Municipal Public Access Plan Overview of Existing Public Access Facilities The Borough of Stone Harbor is bordered by the Atlantic Ocean to the east and the Great Channel, New Jersey Intracoastal Waterway (NJIWW), and coastal wetlands to the west. There is abundant public access to the beaches, bays and lagoons, as well as to other recreational and natural features such as the Stone Harbor Bird Sanctuary. THERE IS ABUNDANT PUBLIC ACCESS TO THE BEACHES, BAYS AND LAGOONS. The Borough has more than three miles of Atlantic Ocean beachfront with 42 access points. The Borough maintains the beach and dune system, and provides lifeguards at 22 beaches. Beach badges are required, and are available on a seasonal, weekly and daily basis at the Stone Harbor Beach Tag Office located at 95 th Street and 1 st Avenue. Active duty military staff, active duty NJ National Guard staff, and their dependents may use the Borough s beaches free of charge, but must show identification at the Stone Harbor Beach Tag Office. (Fees are listed on the Borough s website at Along the bay shoreline, the Borough of Stone Harbor operates a municipal marina at 81 st Street with seasonal slip rentals and boat ramp for daily users (seasonal fee). Other Marina District amenities are located at the bay shorefront at 80 th to 83 rd Street and the NJIWW. There is also physical access and limited parking at 114 th Street and the NJIWW. In addition, there are 20 street ends that offer visual and fishing access to the bay. The Borough operates public restrooms at many locations along the ocean coast and bay shoreline, including accessible facilities. All of the beaches, street ends, pavilions, marina and restrooms are operated and maintained by the Borough of Stone Harbor Department of Public Works. The lifeguards are overseen by the Borough s Beach Patrol. The Borough provides daily beach raking (seasonal) and trash and recycle containers. The Borough also provides free ambulance service to local area hospitals for the injured. A summary of access amenities is listed in Appendix A. Figure 2 shows the locations of all public access ways within the Borough. The table presented in Appendix B provides a list of the ocean and bay shoreline access points and amenities provided at each location. 8 Stone Harbor Municipal Public Access Plan Ocean Access Amenities Ocean access parking lot facilities are located at the Borough recreational area at 80 th to 83 rd and 1 st Avenue; at 95 th and 1 st Avenue; and at Stone Harbor Point south of 122 nd Street. Other ocean access points are provided at the oceanfront street ends and are usually angled to the roadway. Handicapped parking spaces are provided at 80 th, 81 st, 83 rd, 88 th, 92 nd, 93 rd, 95 th, 99 th, 101 st, 103 rd, 105 th, 111 th, 114 th, 119 th, and at Stone Harbor Point. Ramps from the street to the beach are located at 83 rd, 88 th, 92 nd, 95 th, 101 st, 103 rd, 105 th, 111 th, 114 th, and 119 th. Surf Chairs are available free of charge from the Borough to allow those with disabilities to use on the beach. The Borough owns six Surf Chairs and those must be reserved through the Stone Harbor Beach Tag Office (609/ ). SURF CHAIRS ARE AVAILABLE FREE OF CHARGE FROM THE BOROUGH TO ALLOW THOSE WITH DISABILITIES ACCESS ON THE BEACH. The Borough maintains pavilions at 88 th, 95 th, and 101 st Streets. Here, visitors can view the ocean without walking on the beach. All of the pavilions are handicapped accessible. Saturday evening services are held during the summer season at the 101 st Street pavilion. Portable rest rooms with accessible stalls are located at 95 th and 123 rd Streets. Other portable ocean side facilities can be found at 80 th and at the Stone Harbor Point parking facility. Water stations (foot rinse, shower rinse, and water fountain) are available at the beach and 95 th Street and at the Stone Harbor Point parking facility. Surfing is popular at 83 rd, 111 th and 123 nd Streets but is allowed at all ocean beaches from 5pm to 10am during the summer. Surf fishing is allowed on the ocean beaches but is at the discretion of the beach patrol for bathers safety. The Borough provides seasonal catamaran slips on the ocean beach at Stone Harbor Point Park at 123 rd Street to the terminal groin to the south. These slips are available for a small fee and can be reserved at the Beach Tag Office. A permit is required to drive on the ocean beach south of the terminal groin within Stone Harbor Point. This section of the beach is closed to driving by the New Jersey Department of Environmental Protection Division of Fish and Wildlife (F&W) to protect nesting shorebird species. The seasonal closures occur approximately April 1 to October 30. Specific dates are announced on the F&W website at Page 8

9 December 2011 Bay Shoreline Access Amenities The Borough s bay shoreline access parking lot facilities are located at 80 th -81 st, 83 rd, and 114 th. Handicap spaces are available at each of these locations with the exception of 83 rd Street. All other bay shoreline access points are provided at the bay shorefront or basin channel street ends and are parallel to the roadway. All bay shorefront access points are open for public fishing though fish cleaning stations are available only at 81 st and 83 rd Street facilities. For bay shorefront access, portable rest rooms are available at the 81 st Street parking facility. Appendix B provides the list of amenities associated with bay shorefront access. Local Constraints to Public Access Waterfront accessibility is highly regarded by the Borough as a way for local residents and visitors to enjoy the natural resources of the community. The Borough is proud of its Marina District facilities and its popularity as a community destination. Flooding can occur during extreme weather conditions and this may produce a minimal and temporary constraint for waterfront access. Complaints are rare regarding noise or safety and are promptly addressed by the Stone Harbor Police Department. At this time, there are no seasonal or hourly restrictions for fishing at the bay shorefront access points. Fishing is also allowed on the ocean beaches, though driving on the beach is not allowed at night because the beach is unlit and is a safety risk. Swimming is allowed at the guarded ocean beaches during the summer season between 10 a.m. and 5 p.m. After that time and in the off season, swimming is at your own risk. WATERFRONT ACCESSIBILITY IS HIGHLY REGARDED AS A WAY FOR LOCAL RESIDENTS AND VISITORS TO ENJOY THE NATURAL RESOURCES OF THE COMMUNITY. The Stone Harbor Master Plan (2009) ensures that the Borough will maintain the cleanliness and utilization of the waterways. The master plan identifies items that may constrain present waterfront access such as the need for way finding signs and streetscape furniture. Page 9

10 Stone Harbor Municipal Public Access Plan Public Access Vision Stone Harbor is fortunate to have a multitude of available and free public access to the Atlantic Ocean. The Borough has been a good steward of its natural resources, particularly the beaches and dune system, and will continue to carefully maintain the public access paths and fencing in the dunes. While there is available visual access to the NJIWW and bayside waterfront, additional physical access could be provided for passive and active recreation. In 2008, the Borough enacted the Stone Harbor Waterfront District Ordinance to revitalize downtown businesses and expand physical and visual access to the bay shoreline. This additional physical public access would also enhance opportunities for kayak and canoe activities. The proposed Shelter Haven Harbor Walkway provides a substantial addition and improvement for future public demand. Public access is only restricted at private residential properties and at the Yacht Club of Stone Harbor as this is a private club. STONE HARBOR WATERFRONT DISTRICT ORDINANCE WAS ENACTED TO EXPAND PHYSICAL AND VISUAL ACCESS TO THE BAY SHORELINE. Future Public Access Facilities The Borough is taking steps to open up the bayside waterfront in the scenic Town Center to provide additional physical and visual public access. Consistent with the Stone Harbor Master Plan, the Borough has proposed the Shelter Haven Harbor Walk (SHHW) at 96 th 97 th 98 th Streets and Third Avenue which is an easy stroll from the Town Center businesses. The SHHW pocket park waterfront project must be developed under the New Jersey Coastal Area Facility Review Act (CAFRA) regulations and easement requirements for waterside development and walkways. 12 Stone Harbor Municipal Public Access Plan Relationship to Local Plans The Stone Harbor Municipal Access Plan provides elements that are consistent with the land use planning objectives outlined and adopted in the Stone Harbor Master Plan (2009), the Stone Harbor Point Conservation Plan (2008), the Cape May County Master Plan (2002) and the New Jersey State Development and Redevelopment Plan (2001). Under the state plan, Stone Harbor is a designated Town Center as well as a CAFRA Town Center. Community Needs THE BOROUGH PROUDLY HOSTS A BIRD SANCTUARY FOR BIRDERS AND ECO-TOURISTS. The Borough of Stone Harbor provides ample access to its ocean beaches and bay shoreline for the enjoyment of all of its residents and visitors. Existing facilities provide access opportunities for the entire community. Access point amenities are presented in Appendix A. In addition, the Borough proudly hosts a bird sanctuary for birders and eco-tourists. Established in 1947 and designated by the National Park Service as a Registered National Landmark, this site is free and open to the public. Parking is available for access to the site on the street and in a free lot. Municipal Tools to Enhance Public Access The Borough of Stone Harbor website is a viable tool for the public to explore community issues. The site contains information regarding local ordinances, taxes, and news for property owners. The Stone Harbor Master Plan is also available for download ( The agendas and minutes of the Borough Council, Zoning and Planning Boards are also posted. Any changes to public access will follow all local planning and zoning regulations. Coordination with Municipalities, Private Owners, and Non-Profits The Stone Harbor Municipal Public Access Plan was developed in coordination with Borough planning, zoning, and council members. The plan was submitted for public viewing and comment in December A public workshop was held on December 20, 2011 to discuss elements of the plan. The plan was subsequently adopted in December 20, Page 12

13 December 2011 Security and Maintenance The Stone Harbor Municipal Public Access Plan does not present new or different elements that would change the Borough s maintenance of public waterfront access ways, nor does the plan change the Borough s methods for responding to emergencies or for emergency vehicular access. Municipal Public Access Fund At this time, the Borough does not intend to create a municipal public access fund. If one is proposed for improvements to public access, then the Borough will present the NJDEP with details on the structure and management of the fund. Access is available from the parking lot at Stone Harbor Point to the end of Seven Mile Island and Hereford Inlet. Bay Access: The Municipal Marina at 81 st Street provides physical and visual access to the waterway. There is also a small parking area and physical and visual access at 114 th Street. Visitors can also pay 25 cents per 15 minutes to park on municipal lots located at 96 th Street and 1 st Avenue and in the downtown area. Municipal metered parking is available at: 300 block 96 th (2 lots); 200 block 95 th (1 lot); and at 100 block 96 th (2 lots). There are no commercial parking lots within the Borough limits. Page 14

15 Beach Fees: To meet the increasing cost of beach maintenance and protection, fees have been established for use of the beach. Beach tags are available from the Beach Tag Office at 95 th and 1 st Street. Prior to Memorial Day, tags may be purchased at Borough Hall or through the mail. Fee Schedule: (per person 12 years of age and over) Full Season (purchased prior to Memorial Day) $21.00 Full Season (purchased after Memorial Day) $26.00 Weekly (Saturday thru Saturday) $12.00 Daily $ 6.00 Beach tags must be displayed, but are necessary only during the hours that the beach is open. Tags are required from Memorial Day weekend to Labor Day weekend. Active duty military staff, active duty NJ National Guard staff, and their dependents may use the Borough s beaches free of charge, but must show identification at the Stone Harbor Beach Tag Office. (Updated fees are listed on the Borough s website at harbor.nj.us/general.asp.) Restroom Facilities: Restrooms are located on 82 nd and 1 st, 95 th and 1 st, and 123 rd and 1 st. All restrooms are located within 200 yards of the beach. There are no showers or changing rooms. Access for Visitors with Disabilities: Over 30% of Stone Harbor beach entrances are accessible. Chairs are available on 95 th and 1 st. Free handicapped parking is available at many locations. Handicapped Ramp Access CALL Vehicles are permitted on the beach by permit only from October 1 st through March 31 st. Permits are issued from September 1 st through March 15th. Concessions: During the summer season, water and ice cream is available from roving concessionaires on the ocean beaches. Page 15
