11 Executive Summary National ATM Context Due to airspace closure in the Eastern part of Ukraine and Autonomous Republic of Crimea there was significant decrease of air traffic within Ukrainian airspace and airspace over the High Seas, where the responsibility for ATS provision is delegated to Ukraine by regional air navigation agreement approved by ICAO Council. In order to normalize air traffic flows, which have been lost in the airspace over the High Seas under the responsibility of Ukraine, a huge number of developments, tests, technical and operational measures and improvements were made. All these activities were supported by the risk assessment process to follow the corresponding international safety standards and requirements. Safety Case was developed in response to the necessity to make changes in air navigation services provision by Ukrainian State Air Traffic Services Enterprise within Ukrainian airspace and airspace over the High Seas where the responsibility for ATS provision is delegated to Ukraine by regional air navigation agreement. As a result, new special flight planning conditions and procedures for Odesa and Dnipropetrovsk UTA sectors were developed and entered into force on Following ICAO and EUROCONTROL recommendations, UkSATSE has started 24/7 post implementation monitoring of the special procedures immediately after their implementation within the defined limits of the area of responsibility of Odesa ACC. The post implementation monitoring is ongoing. 12 Hereunder a summary of the overall situation concerning Implementation Objectives in Ukraine. Objectives AOP04.1, AOP05, ITY-FMTP, ITY-SPI, NAV10, ATC16 and FCM01 are late in implementation. Objectives AOP05, ITY-SPI, ATC16 and FCM01 are planned to be completed by the end of Objective ITY-FMTP is planned to be completed by the end of Objective AOP04.1 is planned to be completed by the end of Both objectives AOP04.1 and ITY-FMTP are delayed due to financial reasons. The Objective NAV10 is expected to be completed when the Plan of Implementation of APV will be approved. The Objective SAF11 is currently in progress and expected to be completed by the end of Progress per SESAR Phase The figure below shows the progress made up to date in the implementation of the SESAR baseline and the PCP elements. The percentage is calculated as an average of the relevant objectives as shown in Chapter (PCP objectives are marked as such, the rest are considered as SESAR baseline); note that three objectives AOM19.1, FCM05 and NAV03 are considered as both part of the SESAR baseline and PCP, therefore their progress contributes to the percentage of both phases. 13 Progress per SESAR Key Feature and Phase The figure below shows the progress made so far, per SESAR Key Feature, in the implementation of the SESAR baseline and the PCP elements. The percentages are calculated as an average, per Key Feature, of the same objectives as in the previous paragraph. The overall percentage is calculated as an average of the relevant Objectives contributing to each of the relevant ASBUs. 15 Introduction The Local Single Sky ImPlementation (LSSIP) documents, as an integral part of the Master Plan (MP) Level 3(L3) /LSSIP mechanism, constitute a short/medium term implementation plan containing ECAC States actions to achieve the Implementation Objectives as set out by the MP Level 3 and to improve the performance of their national ATM System. This LSSIP document describes the situation in the State at the end of December 2016, together with plans for the next years. Chapter 1 provides an overview of the ATM institutional arrangements within the State, the membership of the State in various international organisations, the organisational structure of the main ATM players - civil and military - and their responsibilities under the national legislation. In addition, an overview of the Airspace Organisation and Classification, the ATC Units, the ATM systems operated by the main ANSP are also provided; Chapter 2 provides a comprehensive picture of the situation of Air Traffic, Capacity and ATFM Delay per each ACC in the State. It shows the evolution of Air Traffic and Delay in the last five years and the forecast for the next five years. It gives also the achieved performance in terms of delay during the summer season period and the planned projects assumed to offer the required capacity which will match the foreseen traffic increase and keep the delay at the agreed performance level; Chapter 3 provides a set of recommendations extracted from the MP L3 Implementation Report 2015 which are relevant to the state/stakeholders concerned. The State reports how they have handled those recommendations and the actions taken during the year to address the concerns expressed by those recommendations; Chapter 4 provides the main ATM national projects which contribute directly to the implementation of the MP Operational Improvements and/or Enablers and Implementation Objectives. The description, timescale, progress made and expected contribution to the ATM Key Performance Areas are provided by the State per each project included in this chapter; Chapter 5 deals with the ATM Regional Coordination. It provides an overview of the FAB cooperation and Projects and also all other regional initiatives and Projects which are out of the FAB scope. The content of this chapter generally is developed and agreed in close cooperation between the States concerned; Chapter 6 contains aggregated information at State level covering the overall level of implementation, implementation per SESAR Key Feature and implementation of ICAO ASBUs. In addition the highlevel information on progress and plans of each Implementation Objective is presented. The information for each Implementation Objective is presented in boxes giving a summary of the progress and plans of implementation for each Stakeholder. The conventions used are presented at the beginning of the section. Chapter 6.2 is completed with a separate document called LSSIP Level 2. This document consists of a set of tables organised in line with the list of Implementation Objectives. Each table contains all the actions planned by the four national stakeholders to achieve their respective Stakeholder Lines of Action (SLoAs) as established in the European ATM Master Plan L3 Implementation Plan Edition The information contained in Chapter 6 is deemed sufficient to satisfy State reporting requirements towards ICAO in relation to ASBU (Aviation System Block Upgrades) monitoring. 17 Chapter 1 National ATM Environment 1.1. Geographical Scope International Membership Ukraine is a Member of the following international organisations in the field of ATM: Organisation Membership of Ukraine since ECAC EUROCONTROL ICAO ITU European Union Not a member NATO Not a member EASA Not a member* *1. Cooperation with EASA on the basis of Working Arrangements in the framework of the transition of the Joint Aviation Authorities and collection and exchange of information on the safety of aircraft using community airports and airports of the relevant country (done at Brussels on 07 March 2007). 2. Formal Working Arrangements between the European Aviation Safety Agency (EASA) and State Aviation Administration of Ukraine (SAAU) signed in 2016 for the purpose to incorporate into Ukrainian aviation legislation the corresponding requirements and standards of the European Union (EU), including future legislative developments within the EU Geographical description of the FIR(s) Geographical scope of this document addresses Kyiv UIR and Kyiv, Simferopol, Dnipropetrovsk, Odesa, Lviv FIRs. Ukrainian airspace and airspace over the High Seas, where the responsibility for air traffic services is delegated to Ukraine by international agreements (Ukrainian ATS Airspace) borders 11 FIRs of 9 different States namely, Minsk FIR (Republic of Belarus), Moscow FIR and Rostov-on-Don FIR (Russian Federation), Ankara FIR and Istanbul FIR (Republic of Turkey), Sofia FIR (Republic of Bulgaria), Bucuresti FIR (Romania), Chisinau FIR (Republic of Moldova), Budapest FIR (Hungary), Bratislava FIR (Slovak Republic) and Warszawa FIR (Poland). The Division Flight Level (DFL) separating upper and lower ATS airspace is FL 275. Upper Information Region covers the whole Ukrainian ATS Airspace with vertical limits from FL 275 to UNL (Fig 1). The lateral boundaries of 5 existing FIRs of Ukraine are maintained within the published boundaries (Fig.2) in accordance with International Agreements and current edition of ICAO European Air Navigation Plan (ICAO Doc 7754) with vertical limits from SFC to FL 275. 19 Airspace Classification and Organisation Current classification of the airspace in Ukraine is shown in the following picture (fig 3): Fig.3 Airspace classification Note: * Airspace is unclassified. ** If flights are carried out as GAT, then airspace is classified according to the surrounding ATS airspace classification, otherwise airspace is unclassified. The Ukrainian airspace and airspace over the High Seas, where the responsibility for air traffic services is delegated to Ukraine by international agreements, is defined and established in accordance with the Standards and recommended practices of ICAO, EUROCONTROL documents, the Air Code of Ukraine, the Regulation on Use of Airspace of Ukraine, and is structured as follows: 1 Upper flight information region (UIR KYIV); 5 Flight Information Regions (DNIPROPETROVSK FIR, KYIV FIR, LVIV FIR, ODESA FIR, SIMFEROPOL FIR); Control areas and control zones (UTA, CTA, TMA, CTR), where air traffic service is provided by ATS units; Military TMAs, CTRs, where air traffic control is provided by controlling military units; Aerodrome Flight Information Zones (AFIZ) are established for providing flight information service and emergency service on AFIS aerodromes; Aerodrome Traffic Zones (ATZ) are usually established for each airfield; ATS routes and routes established for crossing the state border; Free route airspace (FRA); Prohibited Areas (P); Restricted Areas (R); Danger Areas (D) - areas, where flights are prohibited or restricted; Exercises and Training Areas (T) defined as Temporary Segregated Area (TSA) or Temporary Restricted Area (TRA). 20 1.2. National Stakeholders The main National Stakeholders involved in ATM in Ukraine are the following: - Ministry of Infrastructure of Ukraine (MoI) - Ministry of Defence of Ukraine - The Regulator, the State Aviation Administration of Ukraine (SAAU); - The ATM Services Provider - Ukrainian State Air Traffic Services Enterprise (UkSATSE). The activities the stakeholders above are detailed in the subchapters below and their relationships are shown in the following diagram: Civil Regulator(s) General Information The SAAU was created in accordance with the Decree of the President of Ukraine No. 1085, dated 10 Dec On optimization of Governmental Entities of Ukraine and its activity is regulated by the Decree of the Cabinet of Ministers of Ukraine No. 520, dated 08 Nov 2014 On approval of the Statute of the State Aviation Administration of Ukraine. The SAAU is a separate and independent regulatory and oversight body. Activity of the SAAU is controlled and directed by the Cabinet of Ministers of Ukraine through the Minister of Infrastructure of Ukraine. 22 Although Single European Sky (SES) project is not applicable to Ukraine, certification of ANSP in Ukraine is carried out in accordance with The Rules for Air Navigation Service Providers Certification approved by the order of the MoTC No. 42, dated 22 Jan 2007 (with amendments for the requirements to ANSPs that provide MET services (order of MoI N575, dated 28 Dec 2011), that was developed in line with the EC Regulation 1035/2011. The State Aviation Administration of Ukraine is a central executive body in civil aviation, whose activities are directed and coordinated by the Cabinet of Ministers of Ukraine through the Minister of Infrastructure. The State Aviation Administration of Ukraine is entitled to implement the Civil Aviation and Airspace Use State Policy, which is continuously promoted by the Ministry of Infrastructure. 2. The State Aviation Administration of Ukraine is guided by the Constitution and laws of Ukraine, decrees of the President of Ukraine and resolutions of the Verkhovna Rada (Parliament) of Ukraine, acts of the Cabinet of Ministers of Ukraine, other legislative international and national acts. 3. The main tasks of the SAAU are: - implementation of State Policy in the field of civil aviation and airspace use of Ukraine; - development and submission of proposals to the Minister of Infrastructure aimed at forming and updating the state policy in the field of civil aviation and airspace use of Ukraine; - organization and utilization of Ukrainian airspace; - execution of the State control and supervision over the safety, security and environmental protection of civil aviation and oversight of air navigation services and air traffic management. Though SAAU employs only civil specialists, appropriate Military Authorities of MoD are involved in the airspace planning process in accordance with the "Regulation on Airspace Utilisation of Ukraine". The SAAU is responsible for the provision of effective functioning of the Integrated Civil-Military ATM System of Ukraine. 26 Alerting Service According to Ukrainian legislation all ATS units are responsible for provision of alerting service within their area of responsibility. ACCs serve as the central point for collecting all information relevant to the state of emergency of an aircraft operating within the flight information region or control area concerned and for forwarding such information to appropriate regional Search and Rescue Co-ordination Centers of the State Emergency Service of Ukraine that are situated in each ACC. In case of emergency at civil aerodromes, corresponding TWR informs appropriate services within the framework of the search and rescue units and other services and units specified in the respective coordination instructions. The collection and sharing of ATS messages are performed by: Six (6) AROs, which belong to briefing offices: Dnipropetrovsk, Kyiv (Boryspil), Kyiv (Zhuliany), Lviv, Odesa, and Kharkiv Airports General information The airport network in Ukraine comprises twenty-nine (29) certified aerodromes sixteen (16) of which have international checkpoints. Kyiv Boryspil International Airport is the only Ukrainian airport included into this LSSIP edition. It is the main international airport in Ukraine, which provides ATC services for over 44% of all IFR operations at Ukrainian airports/aerodromes. Aerodromes in Odesa, Kyiv Zhuliany, Kharkiv, Dnipropetrovsk, and Lviv are considered as strategic aerodromes. Other aerodromes are domestic. In accordance with international standards, the service zone of strategic aerodromes covers the area of km Military Authorities Military Authorities (the Ministry of Defence) in Ukraine consist of: - The General Staff of the Armed Forces of Ukraine; - The Armed Forces of Ukraine (Air Forces, Army and Navy). Air Navigation Services Since April 2014 aircraft operations within the airspace over the High Seas (Simferopol FIR) where the responsibility for ATS provision is delegated to Ukraine (on the basis of ICAO Council Decision of February 17, 1997 EUR/NAT96/38-ATS incorporated to European Air Navigation Plan (EUR ANP, Doc 7754) are very limited due to the illegal publications of aeronautical information (AIP RF AMDTs, NOTAMs, AICs) issued by Russian Federation. On 13 August, 2015 Ukraine has issued procedures via the Aeronautical Information Circular (AIC) as well as series of NOTAMs that took effect on 27 August, 2015 in order to provide safe flight planning and operations of civil aircraft operators in the segments of four ATS routes over the High Seas within UTA Odesa-South. 30 A Safety Case was developed in response to the necessity to make changes in air navigation services provision by UkSATSE within Ukrainian airspace and airspace over the High Seas where the responsibility for ATS provision is delegated to Ukraine by regional air navigation agreements. Based on the Safety Case, four ATS route segments over the High Seas within UTA Odesa-South have been made available for flight planning and civil aircraft operations. All other segments of the existing ATS route network within Simferopol FIR, Odesa-South UTA and Dnipropetrovsk-South UTA over the High Seas are not available for flight planning. Special procedures for planning and use of this four ATS routes have been established. Following ICAO and EUROCONTROL recommendations, UkSATSE has initiated 24/7 post implementation monitoring (PIM) process of the special procedures immediately after their implementation within the area of responsibility of Odesa ACC. The purpose of PIM is to collect practically confirmed evidences, qualitative and quantitative data necessary to guarantee, that all applied mitigations of identified risks work properly and all risks remain acceptable. In 2015 the Black Sea Task Force (BSTF) was established according to the EANPG Conclusion 57/01. In 2016 the BSTF conducted 4 meetings (21 March, May, 7-9 September and 1 November). All meetings of the BSTF evoked great interest of the countries bordering the Black Sea. The last meeting gathered more than 40 participants from the Black Sea region states with IATA representing airspace users. The last two meetings were carried out with the attendance of the EUROCONTROL Network Manager representatives (at the request of and as a part of the Ukrainian delegation). With regard to the BSTF work, ICAO s position is following: a) According to the extant European Air Navigation Plan, Ukraine is responsible for the provision of air traffic services in the entire Simferopol flight information region (FIR) ; b) ICAO follows the United Nations policy regarding Ukraine, as found in the relevant resolution of the United Nations General Assembly which called on States, international organizations and specialised agencies not to recognize any alteration of the status of the Autonomous Republic of Crimea and the city of Sevastopol and to refrain from any action or dealing that might be interpreted as recognizing any such altered status. With the objection of the Russian Federation, the EANPG/58 agreed to the following: EANPG Conclusion 58/02 - Outcome of the Black Sea Task Force: That, in order to ensure the resumption of normal flight operations in the airspace over the Black Sea: a) Invite ICAO to consider actions similar to those that enabled the normalisation of flight operations in previous cases and specifically: i) Request the Legal and External Relations Bureau of ICAO provide clarifications concerning the power of ICAO to temporarily suspend specific portion of the Air Navigation Plan; ii) Based on the outcome of i) above, invite the BSTF to consider options and/or any other scenarios outside i) above but within the existing BSTF ToRs that would achieve the normalisation of traffic flows; b) the ICAO Regional Director, Europe and North Atlantic, in the behalf of EANPG; i) Inform the ICAO Secretary General and President on the outcome of the Black Sea Task Force; ii) Report to the COG/68. 58 Chapter 5 Regional Co-ordination 5.1. Regional cooperation Regional Cooperation Initiatives No cross-border FAB project is envisaged in Ukraine for the moment. In order to achieve some of the ESSIP objectives, Ukrainian ACC(s) will have to co-ordinate actions with certain foreign adjacent ACCs/UAC, as indicated in the CIP Status Report. The LSSIP document will help to foster regional co-ordination with neighbouring states by identifying mutually dependent actions. Ukraine has established co-operation with Belarus, Poland, Hungary, the Slovak Republic, Romania, Moldova, Bulgaria and Turkey in issues concerning the airspace structure, ATS route planning, coordination methods and ATM procedures Common Aviation Area Agreement Since Ukraine is not a Member of the European Union, it cannot apply for joining the Single European Sky. However, Ukraine is considering the issue of concluding a European Common Aviation Area (ECAA) Agreement with the European Union. By Presidential Decree dated 19 October, 2007 No 891/2007 a mandate was given to a specially established Delegation to negotiate the ECAA Agreement with the EU. To assist the Delegation the SAAU organised 4 working groups (economics, environment, safety and industry group) to prepare a draft agreement. The EC established 4 parallel working groups with the same directions. For this reporting period eight high level meetings and a number of working meetings were organised in order to develop a draft text of the Agreement. Initiation of the Common Aviation Area Agreement between Ukraine and EU and its member states took place in Vilnius on 28 November The aim of the Agreement is gradual creation of a Common Aviation Area between the European Union, its Member States and Ukraine. The CAA Agreement is founded on identical with SES rules in the areas of safety, security, air traffic management, environment, consumer protection, computer reservation systems and social issues. For this purpose the Agreement establishes the rules similar to the SES ones concerning technical requirements, administrative procedures, basic operational standards and rules applicable between the Parties. The CAA Agreement is based on free access to the air transportation market and equal conditions for competition. The Agreement shall enter into force one month after the date of the last note in an exchange of diplomatic notes between the Parties confirming that all necessary procedures for entry into force of this Agreement have been completed. 59 Cooperation in the area of Satellite Based Augmentation Systems EGNOS Extension in Ukraine On 27 November 2013 the Government of Ukraine and the European Commission signed the Joint Statement on cooperation in the area of Satellite Based Augmentation Systems EGNOS Extension to Ukraine. Global Navigation Satellite Systems (GNSS) technologies, applications and services play a key role for economic and social development and industrial competitiveness both in Ukraine and the European Union. The Government of Ukraine and the European Commission took a decision to initiate cooperation in GNSS applications and services, and particularly in the specific area of providing a satellite based augmentation service to Ukraine through the extension of the EGNOS system. Among other areas of EGNOS system application there are two main areas: research and development program within the framework of Horizon 2020 EC program and further work on Institutional Agreement for the use of EGNOS in Ukraine with the support of GSA and EU Delegation to Ukraine. Within the framework of Horizon 2020 the State Space Agency of Ukraine, UkSATSE, Kyiv Polytechnic Institute and National Aviation University took part in the UKRAINE (UKraine Replication, Awareness and INnovation based on EGNSS) project. Main components of the project are: preparation of the Ukrainian aviation market to the extension of EGNOS, identification of legislative options to support the introduction of European GNSS, development of solutions for multimodal logistics and dangerous goods transportation, and fostering commercial relationships between enterprises in Ukraine and the EU Member States Project Management Plan for EUROCONTROL support The Agreement for EUROCONTROL`s support to the State Aviation Administration of Ukraine was signed on by DG of EUROCONTROL and Chairman of SAAU. WP9 investigated the feasibility of the Future ATM Development. Different tasks of WP9 will provide input to the feasibility study. Merger of the existing 4 ACCs into one ACC is not a priority. Instead of that UkSATSE is planning to reform the team working on this subject and shift the focus to increasing the effectiveness and efficiency of current operations. UkSATSE will inform EUROCONTROL if support is required. WP9 remains frozen until UkSATSE requests a restart. WP10: Support to Ukrainian airports. Remains frozen until the Ukrainian airports request a restart. The Project Management Plan Version 4.0 was agreed and signed by EUROCONTROL and Ukraine in November The PMP V4.0 outlines the EUROCONTROL support until the end of According to the new version the EUROCONTROL will assist with: development of a strategy for the migration from the current CNS structure which can be derived from CONOPs. EUROCONTROL will provide expertise, guidance material, best practices, assist with document structure and review; assessment of the contribution of individual system components as described in the CONOPs to the overall business case; development of a CONOPs validation plan. UkSATSE suggested to start this task with a quick assessment of the potential consequences of the current crisis in Ukraine MoC between DHMI and UkSATSE On 20 June 2012 UkSATSE and DHMI signed a Memorandum of Co-operation (MoC). This MoC should be evaluated in the context of contribution to the regional co-operation in the South-Eastern Europe and proposes actions to be taken by two Air Navigation Services Providers in order to enhance co-operation and co-ordination in ATM and CNS domains. There are two aspects of the MoC which determining different cooperation lists: 1) Operational, consisting of: Harmonised ATM procedures and potential interface areas for improvements. Airspace design and ATS route network. Common operational activities. ATC requirements for Flexible Use of Airspace. 2) Technical, consisting of: Technical activities in relation with the ATM systems. Exchanging information and sharing experience on, equipment and technologies used. Harmonising the procedures and training of technical staff. The first bilateral meeting at operational level between representatives of DHMI and UkSATSE was held in Ankara, Turkey 6-7 November During the meeting representatives of DHMI and UkSATSE discussed topics of common interest in terms of: harmonisation of ATM procedures in the interface of Turkish and Ukrainian airspace, development of the route network, improvement of co-ordination between technical staff, plans for development of the ATC systems and airports in Turkey etc. The representatives of DHMI and UkSATSE also exchanged information concerning financial and economic issues. 61 UkSATSE- MoldATSA, UkSATSE ROMATSA Within the framework of regional cooperation development, UkSATSE concluded the agreement with the Moldavian Air Traffic Services Authority (MoldATSA) in 2010 on the exchange of Chisinau (Moldova) and Odesa (Ukraine) Mode S MSSRs data. In addition, UkSATSE and Romanian Air Traffic Services Administration (ROMATSA) decided to organize the exchange of Constanta (Romania) and Odessa (Ukraine) Mode S MSSRs data to provide enhanced safety and efficiency of contingency planning on the regional basis and to ensure seamless and continuous services over the High Seas. In 2015 UkSATSE agreed on the exchange of radar data with ROMATSA. Since 2015 UkSATSE has been receiving radar data directly from Constanta (Romania) Mode S MSSR UkSATSE KAZAERONAVIGATSIA UkSATSE signed a Memorandum for collaboration with air navigation service provider of the Republic of Kazakhstan. The purpose of this Memorandum is to follow the ICAO principles for regional cooperation and to share the UkSATSE best practices and experience achieved within the integrated management system including safety management. Within the framework of the Memorandum on cooperation and partnership signed by the two state enterprises in 2015, Ukrainian specialists shared their experience in applying international standards and recommendations in the field of supervision and safety management with their Kazakh colleagues. A training course complying with international requirements and approved by the State Aviation Administration of Ukraine was developed and provided by experts of UkSATSE Internal Control and Audit Inspection. Under the Training Contract three groups of seven trainees each took training courses at the premises of UkSATSE Training and Certification Centre The Black Sea-Caspian Group According to the Memorandum of Understanding between the Civil Aviation Authorities of the Republic of Azerbaijan, Georgia, the Republic of Moldova, the Republic of Turkey and Ukraine on cooperation within ICAO and representation in ICAO bodies the Parties hereof have mutually agreed and established the Black Sea-Caspian Group with the aim of ensuring close and beneficial cooperation, seeking further efficient representation in the permanent bodies of ICAO. The first coordination meeting was held in Istanbul on January Since that time series of meetings of the Group have been held. An evident outcome of this cooperation was achieved in the course of the 39th ICAO Assembly, held 27 September 07 October 2016, when the Republic of Turkey was elected to the Council of ICAO on behalf of the Black Sea Caspian Group. As per Article 4 of the Memorandum rotation scheme of the ICAO Council membership shall start following Turkish s election to the Council and continue in the following order of Ukraine, Azerbaijan, Georgia and Moldova unless otherwise unanimously agreed by the Parties. This gives Ukraine the opportunity to be shortly elected to the ICAO Council and actively support, promote and facilitate the submission and resolving of the issues of crucial concern for the Parties involved, advancing the national priorities. 62 UkSATSE - PANSA Agreement on the exchange of radar data between Ukrainian State Air Traffic Service Enterprise (UkSATSE) and Polish Air Navigation Services Agency (PANSA) was signed in February According to the agreement, UkSATSE will provide radar data from ATCR-33S / SIR-S, located in Lviv, and receive data from monopulse radar, situated in Rzeszow.
