2 Chapter 0 FOREWORD Civil Aviation Requirement Section-7, Series-D, Part-I and Civil Aviation Requirement Section-7, Series-I, Part-V has been issued by the Directorate General Civil Aviation, India under the provisions of Rule 133 A, 41A and 41B of the Aircraft Rules CAR Section-7, Series-D, Part-I contains the procedure of Approval, renewal and inspection/ Surveillance/ Audit of Flying Training Organization. Section- 7, Series-I, Part-V mainly contains the criteria for approval of Designated Examiner, Chief Flying instructor and Dy. Chief Flying Instructor for Flying Training Organizations. CAR also specifies the functions associated with these posts. This document is for the guidance of these post holders to effectively discharge their functions while ensuring compliance to Aircraft rules 1937, related CARs and Circulars. Approved vide F. 7 Chapter 1 CHAPTER 1 INTRODUCTION 1.1 are approved by DGCA in accordance with the provisions contained in Rule 41B of the Aircraft Rules Detailed requirement and procedure for Approval, renewal and inspection/ Surveillance/ Audit of Flying Training Organization is laid down in CAR Section-7, Series-D, Part-I. Post holders involved in flying training activity are approved in accordance with rule 41B whose detailed requirement, functions etc. are laid down in CAR Section-7, Series-I, Part-V. In accordance with the provision of rule 41A DGCA approves designated examiner whose detailed requirement, functions etc. are also laid down in CAR Section-7, Series-I, Part-V. This document is created for the guidance and compliance by these post holders to effectively discharge their functions while ensuring compliance to Aircraft rules 1937, related CARs and Circulars. 1.2 Designated Examiner for FTOs are required to administer the skill tests as required under Schedule-II of the Aircraft Rules 1937 for issue/ renewal of pilot licenses and associated ratings. The Examiners are approved under the provisions of the Rule 41A of the Aircraft Rules

8 Chapter Conflict of Interest Since Designated Examiners primarily are FTO employees carrying out functions on behalf of DGCA, therefore sometimes it may result in a situation of conflict of Interest. This issue has been addressed herein for the clarity of the designated examiner. Conflict of interest is defined that any relationship that might influence an approved examiner to act, either knowingly or unknowingly, in a manner that does not hold the safety of the trainee students as the primary and highest priority. The following situations are considered as possible and obvious conflict of interest between the DE and his delegated authority; (a) (b) Level of examiner s financial interest in the FTO; Examiner s direct involvement in FTO ownership, control Or Management; (c) Examiner owning a substantial number of voting shares in the FTO; (d) Examiner having family ties with FTO owners or their instructors. 2

9 Chapter 1 (e) Conducting a Test/Check on a pilot whom the examiner has trained (In case of extension of rating i.r.o. pilots already holding License) (f) The relationship between the candidate under test and the examiner. (g) Any privileges or favour, which could bias the examiner s ability to conduct his duties. The final authority for deciding whether there is any conflict of interest that might affect the Examiner s ability to conduct tests and checks in an impartial manner rests with DGCA. Any effort by an FTO to influence or obstruct a Designated Examiner, in any way, in the course of fulfilling his obligations to the DGCA, may invite enforcement action against FTO and may affect FTO s approval. The validity of any test performed by the affected Designated Examiner will also be treated as null and void. 1.4 Submission of false information, fake logging and violation of DGCA regulations by CFI/Dy. CFI/Designated Examiner regarding any examination/test conducted by him fake logging, fake certification may result in withdrawal of DGCA delegated functions temporary or permanent at discretion of higher authority in DGCA. 3

10 Chapter Becoming CFI/Dy. CFI/DE are not the right of any FIR holder, such post holders discharge DGCA delegated functions, therefore, CFI/Dy.CFI/DE shall be careful about their conduct in FTO. There conduct may result in unbecoming of CFI/Dy. CFI/DE especially in following circumstances:- a) Harassment of trainees. b) Outraging the modesty of female trainees or sexual harassment. c) Involvement in fake logging d) Willful submission of wrong material information Since, nature, gravity, situation of above aspects may vary case to case therefore decision of DGCA shall be final in these matter for consideration of CF/Dy. CFI/DE positions in FTO. 4

11 Chapter 2 CHAPTER 2 DEFINITIONS 2.1 Designated Examiner - A Designated Examiner' is a CFI/Dy. CFI designated by DGCA for conducting skill test(s) specified in schedule- II of the Aircraft Rules 1937 for Aeroplane/Helicopter. 2.2 Examiner Assessor - An Examiner Assessor' is a person certified by DGCA to assess Examiner competency of CFI/Dy. CFI for designating him/her as examiner to conduct skill test(s] specified in schedule-ii of the Aircraft Rules 1937 for Aeroplane/Helicopter. 2.3 Patter training- While flying synchronizing flying manoeuvers with air instructions. 5

13 Chapter 3 CHAPTER 3 - ELIGIBILITY FOR DESIGNATED EXAMINER 3.1 FTO may seek approval of their CFI /Dy. CFI as Examiner for administering skill tests as laid down in Schedule-II of the Aircraft Rules 1937 for issue/ renewal of pilot license and/or extension of aircraft ratings. 3.2 Criteria for approval of CFI/Dy. CFI is laid down in CAR section 7 Series I Part V. CFI and Dy. CFI are assessed for granting Designated Examiner functions in FTO. 3.3 The post of CI/CFI/Dy. CFI is not the right of an FIR holder. Since, such post holder discharges the delegated function of Designated Examiner and is overall responsible for the training of trainee pilots, implementation of TPM(training and procedure manual), QAM (quality assurance manual),therefore, DGCA may deny their candidature on the basis of their past credentials. 7

14 Chapter 4 CHAPTER 4 -APPLICATION FOR DESIGNATED EXAMINER BY FTO 4.1 Application for Designated Examiner is to be made to DGCA as per Appendix-IV of CAR Section 7 Series I Part V. Guidelines for filling up application for Designated Examiner is shown below in bold:- Application for Approval of Post holders (CI/CFI/Dy. CFI) as EXAMINER 1. 17 Chapter 5 CHAPTER 5 APPROVAL PROCESS OF DESIGNATED EXAMINER OF FTO IN DGCA 5.1 Application for grant of approval of Designated Examiner is examined in the O/o DGCA and Examiner Assessor are nominated with the approval of Director General to carry out competency test of the candidate. During the competency check, Examiner Assessor will assess the knowledge and skill of the candidate to administer the skill test on trainee pilots. The competency report shall clearly indicate the performance of the candidate and recommendation for approval as examiner on type/ types of aircraft. The candidate who fails in the test shall not be recommended for such approval for a minimum period of three months. The proforma used by Examiner Assessor for assessment of candidate is in Appendix-V of CAR Section-7, Series-I, Part-V. 5.2 CFI/Dy. CFI aspiring for DE may refer to the exercises mentioned in the said proforma and prepare themselves accordingly before they are assessed for DE. 11

18 Chapter On being recommended for considering the applicant for Designated Examiner DGCA approves the candidate as Designated Examiner which is endorsed on CFI/Dy. CFI/DE certificate (reproduced below):- Privileges: subject to validity of his license and ratings and without prejudice to Aircraft Act 1934 & the Aircraft Rules, holder of this certificate can perform the functions of CFI/Dy. CFI as specified in the CAR Sectcion-7, Series-I, Part-V, during the validity of this certificate with particular FTO. Holder may also exercise the privileges of examiner as specified overleaf on the aircraft type endorsed on his professional pilot license and for which he is current as per CAR. Validity and renewal: this certificate is valid for the period specified overleaf. Holder may apply for renewal of this certificate through his FTO at least 15 days before expiry of this certificate. 19 Chapter 6 CHAPTER 6 PRIVILEGES OF DESIGNATED EXAMINER 0F FTO 6.1 FTO requires Examiners to administer the skill tests specified in Schedule-II of the Aircraft Rules 1937 for issue/ renewal of pilot licenses and associated ratings. The Designated Examiners are approved under the provisions of the Rule 41A of the Aircraft Rules 1937 to administer the same. The provisions laid down in rule 41A are applicable to the Examiners. 6.2 CFI Designated as DE can administer following skill tests: i) skill test for issue and renewal of pilot licenses. ii) skill test for extension and renewal of aircraft ratings. iii) skill test for issue / renewal of AFIR / FIR. iv) skill test for issue / renewal of Instrument Rating. 6.3 Dy. CFI Designated as DE can administer following skill tests:- i) skill test for issue and renewal of pilot licenses. ii) skill test for extension and renewal of aircraft ratings. iii) skill test for issue / renewal of Instrument Rating. 6.4 Privileges of DE are mentioned on the certificate issued to DE (refer previous chapter to View the certificate) 6.5 A Designated Examiner of one FTO can conduct Skill tests of trainees of other FTO with prior intimation to DGCA and permission from their respective management. In this regard, the PTO may make an 13

20 Chapter 6 intimation application 3 days in advance in prescribed proforma as per Appendix-VI. Guidance material for the application is mentioned in bold. CFI in his parent FTO during this period. Such duties may be looked after by another post holder 14

21 Chapter 6 (CFI/Dy. CFI) of his parent FTO. 6.9 Designated Examiner shall ensure following before exercising the function of examiner: (a) He has a minimum of 10 hrs. of flying experience as a pilot-incommand on the type or on group/class of similar aircraft during the preceding 90 days and; (b) He has exercised the privileges of Examiner on the type or on the group / class of similar aircraft during the preceding one year except when a pilot is newly approved on the type or group/class of similar aircrafts. (c) Examiner can administer skill test only on type of aircraft on which he himself has rating and is current. (d) A Designated Examiner already approved for a ME aircraft shall not act as an examiner on another ME aircraft unless he has atleast 10 Hrs of Instructional experience followed by competency check by DGCA Examiner Assessor or by a person nominated by DGCA on that aircraft. (e) Standardization check of Examiner: Examiner can administer skill test provided he has satisfactorily undergone the standardization check for examiner within two years by a DGCA Flight Operations Inspector [FTO] or an examiner nominated by DGCA for the purpose Standardization check of DE: to administer the privileges as Examiner a DE shall have valid standardization check. Validity of the same is two years from the date of test. Single Engine and Multi Engine 15

22 Chapter 6 Standardization checks are different. DE shall not assume that once he is checked for Multi there is no need to undergo standardization check on Single and vice versa. These tests are conducted by DGCA Flight Operations Inspector (FTO) or an examiner nominated by DGCA for the purpose. Application for DE shall be accompanied with requisite fee as per aircraft rules. During standardization check a DE is assessed in respect of exercises mentioned in Appendix-V of CAR Section-7 Series-I part-v During surveillance of FTO a DE may be checked for standardization. 16

24 Chapter 7 CHAPTER 7 GUIDELINES FOR DESIGNATED EXAMINER TO FILL SKILL TEST PROFORMA 7.1 This chapter contains the information regarding the exercises conducted during various skill tests by the Designated Examiner. This also specifies how to fill up the assessments. The information is regarding following skill tests and each proforma is covered in subsequent pages. Guidance on the information and filling of assessment is shown in bold on each form. (i) (ii) (iii) (iv) (v) (vi) 120NM cross country test, 250NM cross-country test, Day test, Night Test, Instrument Rating test AFIR test (vii) FIR test 7.2 The skill tests are required to be presented to Directorate of Training and Licensing for issue or renewal of pilot licenses in sealed cover. 7.3 In case any applicant is assessed not satisfactory then further test shall be conducted after imparting necessary instructions to bring the applicant to satisfactory level. 7.4 DE may consider change of instructor if candidate is not able to improve under one instructor. 7.5 FIR holder can carry out 250Nm cross country test by day and 120 Nm 18

25 Chapter 7 cross country test by night. It must be ensured by CFI/Dy. CFI authorizing the test that the FIR holder is having minimum of 25Hrs PIC by night. 7.6 The statement made/information given in any of the proforma will be considered as an undertaking of its correctness by the signatories. 7.7 AFIR/FIR shall undergo proficiency check with DGCA approved CFI/Dy. CFI bi-annually. 19

34 Chapter Candidate who have undergone 10:00 Hr patter training as per old syllabus but has not got AFIR issued shall complete remaining 10:00Hr patter training as per new syllabus. 3.2 Candidate who want to obtain FIR on the basis of experience as laid down in Aircraft rule 1937, Schedule-II, Section-R, Para ( C ) (ii) shall undergo 40:00Hr patter training (AFIR + FIR) 28

35 Chapter 7 Instructions for DE related to AFIR/FIR: 1. As per Schedule ll Section-Q para (c) sub-para (ii) a candidate for AFIR is required to undergo not less than 10hrs of flying training as an instructor as per the syllabus prescribed by DGCA. The syllabus of flying training for AFlR(A) is as in column (2) and (4) of the AFIR(A)/FIR(A) syllabus table. Duration of the flying training is of atleast 10hrs. The flying training for AFIR(A) shall be preceded by ground lectures of atleast 20hrs covering following subject:- (i) Techniques of applied Instruction; (ii) Assessment of student performance in those subjects in which ground instruction is given; (iii) The learning process; (iv) Elements of effective teaching; (v) Student evaluation and testing, training philosophies; (vi) Training programme development; (vii) Lesson planning; (viii) Classroom instructional techniques; (ix) Use of training aids, including flight simulation training devices as appropriate; (x) Analysis and correction of student errors; (xi) Human performance relevant to flight instruction including principles of threat and error management; (xii) Hazards involved in simulating system failure and malfunctions in the aircraft. 29

36 Chapter 7 2. As per Schedule ll Section-R para ((2) sub-para (ii) a candidate for FIR is required to undergo an approved flight instructor course. This approved Fl course consist of atleast 30 hrs of flying training as an instructor as per the syllabus prescribed by DGCA. The syllabus of flying training for FIR(A) is as in column (2) and (3) of the AFIR(A)/FIR(A) syllabus table. The flying training for FIR(A) shall be preceded by ground lecture of atleast 40hrs covering following subject:- (i) Techniques of applied Instruction; (ii) Assessment of student proformance in those subjects in which ground instruction is given; (iii) The learning process; (iv) Elements of effective teaching; (v) Student evaluation and testing, training philosophies; (vi) Training programme development; (vii) Lesson planning; (viii) Classroom instructional techniques; (ix) Use of training aids, including flight simulation training devices as appropriate; (x) Analysis and correction of student errors; (xi) Human proformance relevant to flight instruction including principles of threat and error management; (xii) Hazards involved in simulating system failure and malfunctions in the aircraft. 30

37 Chapter 7 3. Before starting FIR training DE shall ensure that trainee has atleast 20 hrs of night PIC/solo flying experience (in case this experience is acquired in FTO aeroplane then solo in single engine aeroplane and PIC in ME aeroplane). 4. Duration for completion of AFIR/FIR training: Once the training for AFIR and FIR has commenced it must be completed within a period of 90 day and 150 days respectively. Deviation from this schedule may be with permission of Director Flying Training. 5. Duration of patter flights for AFlR/FIR: A maximum of one flight of duration not exceeding one hour in case AFIR trainee and two flights not exceeding one hour each in case of FIR trainee are to be carried out by the trainee, however the duration of pilot navigation flight in case of FIR trainees may exceed one hour. 6. Ground briefing lectures: Apart from the flying exercises the pilot undergoing trainee for the issue of AFIR and FIR, must take ground briefing for at least 20 lectures of one hour duration each for the AFIR and 40 lectures of one hour duration each for FIR. 7. All AFIR training is logged as dual except the successful AFIR skill test. 8. All FIR training is logged as dual except the successful FIR skill test. 31

38 Chapter 7 9. A Flying Training Progress Report (Dossier) shall be maintained for the AFIR/FIR flying training. Ground training lecture records may also be kept in the dossier or in the form of separate documents. Training records shall be duly certified/signed by DE who conducted training. Original Training record (FTPR + ground training) shall be submitted to DTL at the time of issue of AFIR/FIR, however, a photo copy of the same in sealed envelope shall be submitted to AFlR/FIR board at the time of oral. 32

39 Chapter 8 CHAPTER-8 ENFORCEMENT ACTION 8.1 In case sufficient evidence exists to demonstrate that a designated examiner has not performed his/her duties in accordance with the prescribed procedures then DGCA may initiate enforcement action as per Aircraft Rules Without prejudice to the provisions of any rules, the Director General may, after giving a show cause notice to CFI/ Dy. CFI/DE and after making such enquiry as he may deem fit, cancel, suspend, withdraw any approval or endorse on any approval or issue a warning or an admonition to CFI/Dy. CFI/DE, where he is satisfied that:- (a) the conditions stipulated by the Director General under Aircraft Act 1934, Aircraft Rules 1937 or condition stipulated/ directions issued by DGCA under the Civil Aviation Requirements or circular or order etc. are not being complied with; (b) the CFI/ Dy. CFI has performed work or granted a certificate in respect of work which has not been performed or not completed in a careful or competent manner; or has performed work beyond the scope of his approval; or failed to make proper entries and certification thereof; or has made or allowed to be made false entries; or has falsified the records related to conduct of flying training; or has failed to detect any falsification of record; or has concealed material information; or has submitted false information; or for any other reason considered by the Director-General as sufficient to cancel, suspend, withdraw or endorse an approval granted under this CAR; or to issue a warning or an admonition. ****** 33
