1 NEPA COMPLIANCE CHECKLIST FOR APPROPRIATE USE OF CE S Los Padres National Forest Name of Project: Decision to be Implemented: Mitigations and Design Criteria: Description of Public Involvement: Findings required by other laws: Zaca and Piru Fire Burn Area Level 1 and 2 Trail Maintenance The action is to complete level 1 and 2 trail maintenance on National Forest System Trails affected by the Zaca and Piru Fires as described in Appendix A, and including the resource protection measures in Appendix B. Maps displaying the location of the trails relative to the two fire burn areas are in Appendix C. Resource protection measures designed to mitigate impacts to resources are listed in Appendix B and are required for implementation. The project was posted to the projects page on the Los Padres National Forest website, and simultaneousely published in the Current Schedule of Proposed Actions (SOPA) on January 1, A scoping letter was distributed by and post to 176 individuals, organizations, and agencies on February 25, 2014 beginning a 27-day scoping period. On that same date, a consultation letter was also submitted to Santa Ynez Band of Chumash Indians, and two days later to the Tejon Tribe. Five individiuals or groups expressed interest in the proposal and four of them submitted comments. No potential effects were identified that may result in an extraordinary circumstance. A scoping comment analysis report is part of the project record. A land management plan consistency review has been completed (LMP Consistency Checklist in the project record). This project is consistent with the Land Management Plan and the National Forest Management Act of Migratory Bird Treaty Act analysis has been completed. Purpose of Checklist: For projects categorically excluded under NEPA, document that there are no extraordinary circumstances related to the proposed action that warrant further analysis and documentation in an environmental assessment or environmental impact statement. 1. 5 Appendix A Proposed Action Trail Maintenance Descriptions and Specifications Specifications for maintenance activities conducted within the Forest Service Trail System are described in USDA Forest Service (1996) Standard Specifications for Construction and Maintenance of Trails, EM Trail maintenance is categorized into three separate levels based upon the extent of ground and vegetation disturbance. Levels 1 and 2 are considered routine maintenance, and consist of activities within the existing trailway and clearing limit that do not expand the route outside its current location. The trailway is defined in Section 902 of EM as the portion of the trail within the limits of the excavation and embankment. The trail tread is defined in Section 902 of EM as the surface portion of the trail upon which traffic moves. A majority of the trails are designated for pack and saddle use and managed at a trail class 3 standard. According to the trail management objectives, the standard trail tread is 24 inches for both wilderness and non-wilderness segments. These specifications may be exceeded depending on slope and terrain, but should fall within the trail class design parameters at FSH chapter 20. The following trails have different management objectives and standard tread widths: o Big Cone Spruce (Hiker/Pedestrian use TC3) - Tread width: 18 inches. o Tinta OHV (Motorcycle use TC3) - Tread width: 18 inches. o Malduce Peak (Hiker/Pedestrian use TC2) - Tread width: 12 inches. o Alder Creek (Pack and Saddle use TC2) - Tread width: 18 inches. Clearing limits for trimming vegetation are defined generally in Section 911 of EM , and include provisions for vertical clearance, upslope and downslope limits based upon the steepness of slope, and are generally areas within 1 foot of the fill and backslope catch points. A majority of the trails are designated for pack and saddle use and managed at a trail class 3 standard. According to the trail management objectives, the standard clearing limit is 10 feet height, 72 inches width. These specifications may be exceeded depending on slope and terrain, but should fall within the trail class design parameters at FSH chapter 20. The following trails have different management objectives and standard clearing specifications: o Big Cone Spruce - Height: 8 feet; Width: 42 inches. o Tinta OHV - Height: 8 feet; Width: 42 inches. o Malduce Peak - Height: 6 feet; Width: 36 inches. o Alder Creek - Height: 8 feet; Width: 72 inches. 6 Appendix A Proposed Action Level 1 Trail Maintenance Level 1 is considered Light Trail Maintenance, and is defined as "no disturbance to the existing trail surface". This work is generally conducted by hand crews, but small mechanized equipment may be used outside of wilderness areas. It consists of activities such as: Removing slide and slough material; Clearing and grubbing; Brushing and logging out; and Clearing debris from water bars. These activities are conducted within the established trailway and clearing limits as defined in the trail guide. Work consists of clearing, grubbing, trimming, removing, and treating trees, logs, limbs, branches, and other vegetation, to within the clearing limits as defined in the trail guide (Clearing Limits found in Section 911 in EM ). Work can be performed along all sections of trail as long as the work does not result in any new ground disturbance outside of the established trailway. Slough, berm and slide material removed from the trailway can be used as fill for gully and rill repair within the trail bed. Level 2 Trail Maintenance Level 2 is considered Tread Maintenance, and is defined as the reestablishment of the trail way within previously established routes (Earthwork, Section 910, 911, 912 in EM ). Ground-disturbing activities are limited to the existing trailway. The work is performed by hand crews, or if the trail is outside of designated wilderness, mechanized equipment may be an option. If the project may affect listed species or habitat, or known cultural resources, then hand crews will do the work to minimize effects to resources. Use of mechanized equipment is also limited to the time period having adequate soil moisture, which is needed to provide proper compaction of soils after blading, and to minimize dust. All equipment operators are certified as trail operators in accordance with Forest Service policy. Level 2 work includes: Constructing and repairing water bars; Repairing shallow creek fords and rock retaining walls; Cleaning draining dips and other drainage structures; Shaping trail tread, trail bed repair, and filling gullies and rills in the trail bed with minimal barrow from the trail way; Removing obstacles/debris from the trail tread; Installing pavers or other tread armoring material to reduce erosion of the trail tread; Embankment work that may consist of extending the trailway into the existing back-slope where necessary to achieve a full bench trail bed. 7 Appendix B Resource Protection Measures All Trails: Heritage Resources: o Level 2 trail maintenance will require consultation with the Forest Heritage Program to identify where documented cultural resources are present. The heritage report (project record) identifies which trails have been surveyed for archeological properties and those without survey data. a. The project manager shall coordinate with the Heritage Program prior to any level 2 trail maintenance on un-surveyed trails to determine if further analysis by the Heritage Program is needed. b. Ground disturbance should be avoided in known cultural resource sites. If ground disturbance activities are required within a cultural resource site, the project manager shall consult with the Heritage Program prior to any work implemented. Further analysis shall be conducted by the Heritage Program to determine if proposed activities are likely to have an adverse effect to the identified cultural resources. If adverse effects are not avoidable, consultation with the SHPO and the Santa Ynez Band of Chumash Indians is required. Wildlife and Water Quality: o Implement BMPs from the Soil and Water Conservation Handbook in accordance with the Steelhead Biological Opinion (BO) and agency water quality policy. The applicable BMP s are listed at the end of this Appendix. o When possible, avoid conducting maintenance work during the breeding season for migratory birds (March 15-July 31). o Trail workers should receive a briefing on wildlife and plant species concerns prior to conducting project activities. o Vegetation removal should never exceed the prescribed clearing limits defined in the established Forest Service standards (i.e. more is not better, as vegetation removal outside the trail prism is essentially pointless habitat alteration). o Workers should avoid direct-interaction with wildlife while performing project activities. o Workers should avoid cutting all plants of the Asclepias (milkweed) genus unless they are physically within the trail way. (i.e. An occasional herbaceous plant makes little difference in terms of trail usability, but can add up to hundreds of host plants for a declining species of wildlife when applied across the entire forest). Noxious Weeds o Trail workers will be instructed in weed prevention management practices such as entering the project area with clean boots and tools prior to conducting project activities. Care should be taken to clean tools and boots when moving from a trail segment with invasive weeds to and area without weeds. If livestock are used to help move equipment, care should be takes to assure that they are weed free. Maintain staging areas and landings in a weed-free condition. o Monitor distribution and abundance of encountered weeds to determine if additional weed control measures are needed. If occurrences of noxious weeds are detected after project implementation, initiate control measures immediately and attempt to eradicate any incipient infestations. 8 Appendix B Resource Protection Measures Specific Trails: Table 1 identifies the threatened and endangered species described in the NMFS Ongoing Activities BO, FWS Hiking Trail Use and Maintenance BO, and FWS OHV Program BO. Also identified are the Forest Service Sensitive species that may occur within the project area (Wildlife Biological Evaluation). Before implementing trail work where threatened and endangered species or their habitats are located, the project manager must coordinate with a local biologist to review the work plan, where it will occur, identify potential wildlife and plant issues, where field recon will be necessary, and identify any additional site specific mitigations tiered from the BO terms and conditions. The BO terms and conditions can be found in Appendix D. For sensitive species, the project manager should coordinate with a local biologist prior to trail work and ensure resource protection measures 4, 5, 6, and 7 on page 1 are implemented. 10 Appendix B Resource Protection Measures Best Management Practices (BMPs) Storm Events (BMP 2.4): Following major storm events or snowmelt, inspect trails to mitigate rutting, damage to tread, waterbars, culverts, etc. during trail operations. Restrict operations if water quality impacts are occurring or will occur. General Maintenance (BMP 2.4; National BMP Rec-4): 1. Maintain trail surfaces to dissipate intercepted water in a uniform manner along the road by outsloping with rolling dips, insloping with drains, or crowning with drains. Where feasible and consistent with protecting public safety, utilize outsloping and rolling the grade (rolling dips) as the primary drainage technique. 2. Adjust surface drainage structures to minimize hydrologic connectivity by: a. Discharging road runoff to areas of high infiltration and high surface roughness. b. Armoring drainage outlet to dissipate energy dissipater and to prevent gully initiation. 3. Clean ditches and drainage structure inlets only as often as needed to keep them functioning. Prevent unnecessary or excessive vegetation disturbance and removal on features such as swales, ditches, shoulders, and cut and fill slopes. 4. Minimize diversion potential by installing diversion prevention dips that can accommodate overtopping runoff. a. Place diversion prevention dips downslope of crossing, rather than directly over the crossing fill, and in a location that minimizes fill loss in the event of overtopping. b. Armor diversion prevention dips when the expected volume of fill loss is significant. 5. Address risk and consequence of future failure at the site when repairing trail failures. Use vegetation, rock, and other native materials to help stabilize failure zones. 6. Maintain trail surface drainage by removing berms, unless specifically designated otherwise. 7. Install and preserve markers to identify and protect drainage structures that can be damaged during maintenance activities (that is, culverts, subdrains, and so forth). 8. Use and maintain surfacing materials suitable to the trail site and use to withstand traffic and minimize runoff and erosion. Pay particular attention to areas where high wheel slip (curves, acceleration, and braking) during motorized use generates loose soil material. 9. Use a trail design that constricts equestrian users to a designated tread, where practicable, to minimize the tendency of stock to create braided or multiple trail treads. Stream Crossing Maintenance (BMP 2.8): 1. Implement the approved erosion control plan that covers all disturbed areas, including borrow areas, stockpiles, stream diversions used during stream-crossing maintenance and culvert cleaning (BMP Erosion Control Plan). 2. Use temporary filters, berms, barriers, conveyances, or other materials to collect sediment and prevent it from entering surface waters. 3. 11 Appendix B Resource Protection Measures 4. Clean equipment used for instream work prior to entering the stream/creek. a. Remove external oil, grease, dirt and mud from the equipment, and repair leaks prior to arriving at the project site. b. Inspect all equipment before unloading at site. c. Inspect equipment daily for leaks or accumulations of grease, and correct identified problems before entering streams or areas that drain directly to waterbodies. d. Remove all dirt and plant parts to ensure that noxious weeds and aquatic invasive species are not brought to the site. 5. Fuel and service equipment used for in-stream or riparian work (including chainsaws and other hand power tools) only in designated areas (see BMP 2.10). 6. Maintain and remove buildup of sediment and debris in diversion prevention dips, rolling dips, and waterbars to ensure they are functioning properly, and do not contribute to the hydrological connectivity of the road. 7. Ensure that inside ditches are maintained properly, and are relieved at regular intervals to eliminate hydrological connectivity. Parking and Staging Areas (BMP 2.10): 1. Design and locate parking and staging areas of appropriate size and configuration to accommodate expected vehicles and prevent damage to adjacent water; aquatic, and riparian resources. a. Avoid sensitive areas such as riparian areas, wetlands, meadows, bogs, fens, inner gorges, overly steep slopes, and unstable landforms to the extent practicable. b. For staging areas, designate specific locations for fueling so that water-quality impacts are minimized. 2. Provide signage to designate parking, staging, and refueling areas, and to minimize impacts to sensitive areas. 3. Limit the size and extent of temporary parking or staging areas. 4. Take advantage of existing openings, sites away from waterbodies, and areas that are apt to be more easily restored. 5. Rehabilitate temporary parking or staging areas immediately following use. 6. Effectively prevent access to the area once site restoration activities have been completed. Equipment Refueling and Servicing (BMP 2.11): 1. Plan for appropriate equipment refueling and servicing sites during project planning and design. 2. Allow temporary refueling and servicing only at approved locations, which are well away from water or riparian resources. 3. Develop or use existing fuel and chemical management plans (for example, spill prevention control and countermeasures (SPCC), spill response plan, emergency response plan) when developing the management prescription for refueling and servicing sites. 4. Locate, design, construct, and maintain petroleum and chemical delivery and storage facilities consistent with local, State and Federal regulations. Install contour berms and trenches around vehicle service and refueling areas, chemical storage and use areas, and waste dumps to fully contain spills. 6. Use liners as needed to prevent seepage to groundwater. 7. Provide training for all personnel handling fuels and chemicals in their proper use, handling, storage, and disposal. 8. Avoid spilling fuels, lubricants, cleaners, and other chemicals during handling and transporting. 9. Prohibit excess chemicals or wastes from being stored or accumulated in the project area. 10. Remove service residues, waste oil, and other materials from NFS land and properly dispose them following completion of the project. 11. Clean up and dispose of spilled materials according to specified requirements in the appropriate guiding document. 12. Report spills and initiate appropriate clean-up action in accordance with applicable State and Federal laws, rules and regulations. The forest hazardous materials coordinator s name and phone number shall be available to Forest Service personnel who administer or manage activities utilizing petroleum-powered equipment. 13. Remove contaminated soil and other material from NFS lands and dispose of this material in a manner according to controlling regulations. 14. Prepare a certified SPCC Plan for each facility, including mobile and portable facilities that have oil storage capacity of at least 1,320 gallons in containers 55 gallons or greater. a. Install or construct the containment features or countermeasures called for in the SPCC Plan to ensure that spilled oil does not reach groundwater or surface water. b. Ensure that each SPCC Plan includes a spill contingency plan at each facility that is unable to provide secondary spill containment. c. Ensure that clean-up of spills and leaking tanks complies with Federal, State and local regulations and requirements. 15. Prepare a contingency plan when quantities of petroleum products are capable of violating Basin Plan water-quality objectives. 16.
