If you have not yet climbed all the peaks, you are an aspirant and the renewal should be sent to Mike Dwyer. If you have been assigned a number, you are a member and dues should be sent to Dave White. Dues/ renewals are on a calendar year basis. If you joined mid-year, a partial year renewal can get you back on track. Each quarter you will receive an when the Canister is available (even if you elected to receive a paper copy.) The message will indicate your dues status. Additional member items are available for purchase; see the online dues form for pricing. Your Donations Your club supports a number of projects that we believe are in the best interests of the hiking community. We do that with the contributions that members make. Life Members and Life Aspirants who opt for electronic delivery of their Canister, also provide funds. During the last quarter, a large number of you have opted to join or renew at that level of support. All of us thank you. Injury at Kaaterskill Falls A 26-year-old woman who was hiking along the base of the upper Kaaterskill Falls slipped and fell approximately eighty feet, suffering head trauma and other injuries. Nine Forest Rangers, assisted by several local fire department personnel, secured the victim and transported her to an awaiting helicopter, where she was airlifted to Albany Medical Center. The victim was hiking on an undesignated trail. DEC and ADK have undertaken extensive work at the falls to improve public safety at Kaaterskill Falls. All visitors must stay on designated trails, observe posted warnings and protective enclosures, and follow important winter safety tips at press.html. Views from the Top The President's Column With this final submission my short lived writing career comes to an end. My two years as President have passed quickly. I want to thank you for the opportunity. We have accomplished a lot over the years and we can be proud. Most recently our support of the Summit Steward Program, which will be starting it s third year, has been very successful as reported by the DEC and NYNJTC. The Mesonet Weather Station was downsized from a tower measuring 100 to one of 33, lessening it s visual impact in the Platte Clove area. The diligent work of our members, with the help of the ADK, made this happen. Another undertaking was cleaning up the Blue Hole. With the help of our volunteers, the NYNJTC and the DEC the area is much cleaner. Illegal parking and over crowding persist but have improved. I want to thank those that endlessly volunteer and encourage those that have yet to participate. There are so many diverse opportunities from attending a Woolly Adelgid workshop to building and/or refurbishing a lean-to. This spring the CIC will be working on their Riparian Buffer Project and the club will be out doing road clean-up and trail maintenance. Again, I thank you for the honor of being your president and wish you all many wonderful days working and playing in the Catskills. Happy hiking. Connie Sciutto - President

Conservation Corner A Note from our Conservation Chair, Carol White Resorting to Law Interpretation Belleayre Resort Background The Catskill Heritage Alliance (CHA) brought suit against Crossroads Ventures, the Belleayre Resort s parent company, and the Town of Shandaken Planning Board, arguing that the board acted beyond its authority by granting permits for the resort s multi-family dwellings. These are clearly not allowed by the zoning code, which allows single-family homes and duplexes but not multi-family dwellings in residential zones. Detached housing units in the proposed project don t meet Shandaken Zoning Code s definition of accessory use they are habitable and the issue of accessory buildings is straightforward: If they are not an accessory use, Crossroads cannot include them without obtaining a variance. Ulster County Supreme Court Judge Richard Mott referred the issue back to the Town of Shandaken Planning Board, instructing the Planning Board to refer the case to the Zoning Board of Appeals (ZBA) for a decision on whether these units, which developers plan to sell as timeshares, are allowed in residential zones. The Planning Board, supporting the Belleayre Resort, suggested a red-herring question: what is a lodge under the zoning code? Lodges could be defined for transient occupancy and thus permitted under the zoning code. Citizens urged the ZBA at a public hearing not to show favor to the resort when interpreting the clear law. The CHA had said, Members of the ZBA recognize the seriousness of the issues and are courageous enough to apply the Town s zoning code. So what happened? Mid-February, 2017 The ZBA with their attorney ruled on Feb. 15th that lodge units are in conformity with existing zoning regulations, a unanimous decision. The Planning Board can now issue permits, unless legally challenged again. The CHA makes the salient point that this decision could lead to massive over-development, not only at the proposed resort, but throughout the Town of Shandaken. This interpretation of the clear text of Shandaken s zoning code will justify placing this type of multi-family dwelling in every residential-zoned district in Shandaken! The CHA is examining options going forward.

3 April June 2017 The Catskill Canister Page 3 One remaining holdup to the resort was that the Belleayre Ski Center had not been upgraded. A Crossroads Ventures spokesman said, We have a unique piece of land if it s next to a first-class ski facility. Next to a second-class ski facility, we don t have that unique a piece of land. (We think it s a fine piece of land!). Crossroads would not build the resort if New York State taxpayers did not finance these improvements. The day after the ZBA decision, Governor Cuomo announced that the state will invest $8 million for Belleayre Ski Center upgrades a high-speed gondola, multiple lodge expansions, and the addition of modern amenities for two primary lodges. The press release issued by the Central Catskills Chamber of Commerce declares that these improvements will expand economic growth and investment opportunities for surrounding communities, a major boost to tourism in the Catskills and its economy; that the installation of this lift and other proposed changes will elevate Belleayre to a higher level of resort experience. Yet tourism in the region was doing quite well $1.83 billion in 2015, a 13% increase in 5 years and visitation up 14% in that period 11 million visitors in Tourism provides 17,000 jobs, 15% of the region s employment. Upgrades coming to Belleayre Ski Center: The new gondola system will include 65 cabins to transport guests to the summit in under six minutes. The Gondola will provide additional all-season revenue opportunities: Nordic and Cross Country skiing at the expansive summit of the mountain; Year-round scenic gondola rides as sold at Whiteface & Gore Mountains; Mountain biking from the mountain summit; Wedding and private party rentals at mountain summit. Overlook Lodge accesses upper mountain offerings and handles the majority of food and beverage offerings; Discovery Lodge at the lower area services beginner terrain and rental facilities. The state will provide $1.5 million for upgrades: For Overlook Lodge Increase seating capacity, storage and locker areas, daycare facilities, and expansion of food and beverage offerings. For Discovery Lodge Increase seating capacity, retail space, increased food/beverage locations, and additional office space to provide for a fully functioning learning area for all ages, with necessary amenities to service guests including bar and restaurant offerings. In Memoriam Jim Furey, member #2676, died on 11/23/16 at the age of 62. He and his brother Mike, and friend Ray Lynch climbed all the peaks together. They had annual pilgrimages to the Catskills in October since Later they added April trips as well as the required winter peaks. Battling cancer, Jim completed the list with Lone and Rocky last October, the month before he died. The estate of Judith Weiner, former Aspirant Chair of the club, has sent a bequest of $5000 (less estate taxes.) She was member #1287 and W#491 and a life member. See the April-June 2015 Canister. 4 Page 4 The Catskill Canister April June 2017 Rambles and Brambles: Hike Schedule April June 2017 Assumed Risk: Hiking involves certain inherent risks and persons participating do so at their own risk. In cool weather, hike participants should avoid cotton clothing, as it retains dampness and the resulting chill can result in hypothermia, which can lead to death. Instead, wear (and have available in your pack) garments of wool or fleece. Silk or polypropylene make the best base layers, as they tend to wick moisture away from the body. Hats, gloves, and a headlamp must be part of the standard early spring kit. Ice and snow can still be found unexpectedly in these peaks. In early spring, if there is any doubt about the conditions that may be encountered, each hiker is strongly advised to bring snowshoes and full crampons to the trailhead; the leader may advise that these do not have to be taken on the hike, but be aware that while there may be bare ground at the trailhead, there is often very significant ice and snow as the elevation increases, which could result in those improperly prepared being sent back. Anyone not properly equipped may be refused permission to participate, at the leader s absolute discretion. Don t be seduced by buds on the trees at the trailhead, early spring in the Catskills is not to be treated lightly. Rating System: Please be advised that the hikes listed herein would most likely be rated more difficult by clubs who hike in non-mountainous terrains Private Property: All Catskill 3500 Club hikes respect No Trespassing signs and the owners wishes in such regards; leaders shall obtain permission to cross private property when so required. Volunteer to Lead: If you are a member of the Club please consider becoming a hike leader. Just contact Bill Winterbottom: outings@ catskill-3500-club.org; (7 p.m.-9 p.m.), and he will arrange to add you to the low-volume private Yahoo list through which hikes are coordinated. You will be contacted via this means when hikes are needed. Group Size: All Club hikes are limited to 12 participants including the leaders. The DEC limits group size to 12 in the Wilderness Areas.
