1 MINUTES OF ROXWELL PARISH COUNCIL HELD ON WEDNESDAY 10 TH JANUARY, 2018 AT 7.30PM IN ROXWELL READING ROOM PRESENT:- IN ATTENDANCE:- Cllrs:- C. Pavitt, M. Wallace, Dr. V. Bradbury, M. Plom, Mrs D. Goodwin and M. Page. Mrs L. Green (Clerk) 3 Parishioners ECC John Aldridge 97. DEMOCRATIC 15 MINUTES A parishioner, Chris Philpot, discussed the planning application for Land adjacent to Tiggers and The Lees. There were a number of points raised. He was concerned about the size of the property and included in it is a footpath. The property is on Green Belt land. The ridge height is 7m, Tiggers which is right next door is 5.6m and The Lees is 6.6m. The proposed property is bigger than The Lees on a smaller plot. The bedroom window is overlooking The Lees and looks into the upstairs landing. The residents of Tiggers had applied for an extension which had been refused. The Chairman advised that the Parish Council did not object to the application. Chris Philpot asked the Parish Council to reconsider their response and resubmit with objections. The Chairman advised that from the information the Parish Council had received regarding the application the planning sub-committee had tabled no objections After discussing the points raised it was agreed the following further comments would be submitted to Planning: It has been brought to our attention that the application is on Green Belt land and the Parish Council were not aware. The size of the property is not in keeping with those that would surround it. The proposed side elevation 3 window is overlooking the adjacent property. Please add to Parish Council s earlier comments. A parishioner, Judith Woolley, advised that the white lines in the Memorial Hall car park were a planning condition. The Chairman reported that unofficial road signs had appeared in the village without any legislation. Cllr. Aldridge to look at and arrange removal if necessary. MINUTES OF THE MEETING HELD ON 8 TH NOVEMBER 2017 The minutes of the Meeting held on 8 th November 2017 were taken as read and the Chairman was authorised to sign them VACANCIES ON PARISH COUNCIL FOLLOWING ELECTIONS The Chairman advised that there were still 2 vacancies. Nobody had officially come forward, but Mrs. Chivers from Stone House was very interested. The Chairman had asked her to send a note to the Clerk expressing her interest and then the Clerk could invite her to the next meeting COUNCILLORS DECLARATION OF INTERESTS ON ANY AGENDA ITEMS FOR THIS MEETING. Nothing to report MATTERS ARISING:- Nothing to report REPORT BY CHELMSFORD CITY CLLR. MRS NICOLETTE CHAMBERS. Cllr. Chambers had advised the Clerk she will be holding a Ward Surgery on 23 rd January 2018 in the Village Store.
2 104. REPORT BY ESSEX COUNTY CLLR. JOHN ALDRIDGE. Cllr. Aldridge advised that ECC were in the middle of a 6-week consultation on traffic. There were concerns at the number of changes of roads and cycle paths. Pedestrianisation of Tindal Square will create rerouting of traffic. Cllr. Aldridge reported that it is historical that if there is a change of monarchy it is announced on the County Hall steps by the High Sheriff. Following a complaint by a resident, Cllr. Aldridge had requested a traffic survey at Radley Green on the A414. He advised it is a 60mph speed limit with good sight lines and he cannot see what can be done. Cllr. Aldridge to let Chairman have a copy of the traffic survey once it is available. The Development Committee Meeting will be held on 18 th January to discuss the Local Plan which affects Great Leighs, Broomfield, Little Waltham and Writtle. Cllr. Aldridge has questioned why Hammonds Farm is not in the mix as they are prepared to put in infrastructure. Cllr. Plom said he had noticed the increase in speeding through the village. Cllr. Wallace commented on the speed of traffic going through the village, particularly down Galleons Hill. He reported that the complaints are all over Facebook. Cllr. Aldridge advised that PCSO s used to check speeding with a speed gun. He advised that he could ask for a speed survey to be done. Cllr. Aldridge had attended a meeting this week with a representative of Essex Police. Parish Councils can now apply to have a Special Constable who have the same powers as a Police Constable. Parish Councils can recruit someone locally at a cost of up to 1k a year. This Special Constable would be dedicated to the Parish and is fully equipped by the Police. The Special Constable would do a minimum of 16 hours per month. No transport is provided. Clerk to contact Writtle Clerk for details. Cllr. The Financial Regulations had been circulated to all Councillors and were approved by all present. e) Charging a returnable deposit to new owners of allotments. The Chairman advised there was no further action so Clerk could remove the item from the Agenda. f) Grant request from Roxwell Memorial Hall Re markings to car park. A letter had been received from Glynn Eastman, Treasurer of Roxwell Memorial Hall. An estimate had been received for 1, including VAT to do the markings to the car park. The Chairman proposed the Parish Council give a grant of Cllr. Wallace seconded the proposal. All in favour. g) Any Other. The Chairman advised that had been received from Chelmer Wanderers FC (Reserves) for recent pitch hire PLANNING MATTERS & APPLICATIONS a) 1 CHURCH GREEN - Garage conversion into an office. The Parish Council commented that apart for reservation about removal of existing conifers to allow access from vicarage Road, no other comments. APPROVED. b) 78 ST MICHAELS DRIVE Single storey rear extension. No Objections. APPROVED. c) LAND SOUTH OF CHAPEL LANE Construction of two four bedroom detached dwellings with attached garages, retaining all existing boundary, hedgerow and trees. The Parish Council made the following comments:- This land lies within the Green Belt. These open green spaces here and throughout the Parish are part of the characteristics and are synonymous with Cooksmill Green. Therefore object to this application. There is in correct detail within this application as follows:- Item11 - FOUL SEWAGE. Application states use of mains sewer- all houses and properties in Cooksmill Green are using septic tanks. Item 12:- FLOOD RISK Whilst there is no immediate flood risk. Some properties do suffer from flooding during exceptional weather. Therefore object to this application until further investigations on these points are carried out, and those raised regarding the Green Belt. As stated in the application there will be disruption to protected species, and habitats. All hedges must be protected. No other comments/objections. REFUSED.
4 d) LAND WEST OF 4 CHURCH GREEN Ornamental cherry (1)- fell Reason: Tree is diseased to the core and may cause damage or injury. No replacement as too close to the road side. APPROVED. e) STORAGE YARD, ASH TREE FARM, BISHOPS STORTFORD ROAD Variation of condition 1 of planning permission 17/00106/FUL (Retrospective application for the use of vehicle storage compound as a scaffolders yard, demountable site office, five pole mounted flood lights and two building mounted floodlights). AMENDMENT ADDED TO DESCRIPTION: to allow vehicles to enter and leave the site from 6am Monday to Saturday. The Parish Council commented that the company operating this business are currently working outside the allowable hour. To allow any further change would only cause further anti-social activity for the local residents. Therefore the proposal put forward in this application should not be allowed. The applicant is currently in breach of existing planning consent with total disregard for the local residents. This requested amendment should be rejected. REFUSED. f) 47 GREEN LANE Proposed front porch, two and single storey rear and side extension. No Objections. No Decision Yet. g) LAND AT 48 ST. MICHAELS DRIVE Part-retrospective amendments to previously approved permission 16/00243/FUL to include two dormer windows and a roof light to the front of roof pitch, a rear dormer window, and a ground floor side window. No Objections. No Decision Yet. h) LAND AT TIFFANYS, BISHOPS STORTFORD ROAD Demolition of two existing buildings and construction of three new dwellings. No Objections. No Decision Yet. i) LAND ADJACENT TO TIGGERS, BISHOPS STORTFORD ROAD Proposed detached 4 bed dwelling and two new vehicular crossovers. No Objections. No Decision Yet. The following further comments to be submitted to Planning: It has been brought to our attention that the application is on Green Belt land and the Parish Council were not aware. Please add to Parish Council s earlier comments. j) LAND ADJACENT BROADACRES, VICARAGE ROAD Proposed new single storey bungalow. The following comments/observations are made by Roxwell Parish Council. ARBTECH -BAT SURVEY was carried out during October to Point 4.2 Evaluation -B1 & B2 states that three bat emergency/re-entry surveys are required during the bats active season which is May -September). Therefore this survey is of no value the application at this point in time. The site in general, having in the past been an orchard in a countryside location is surrounded by well substantiated trees/bushes and hedgerows, offering good habitats for wild birds and insects. Although there are no watercourses on the site, it should be noted that during exceptional wet weather Vicarage Road from the bridge close by the Hare PH, and Thatchers Farm can flood, and at times it can be too deep for motor vehicles to drive through. Design and Access Statement _ Page 9 Photograph shown of an existing house in Roxwell. It should be queried if this fact is correct. The proposed development is very loosely covered by policies DC12 & DC 23. The design of the proposed property is not in keeping with the current properties within the Parish of Roxwell. The proposed entrance onto Vicarage Road is going to be hazardous as this Road is subject to a current maximum speed limit of 60 mph, with no pathway for pedestrians. Technical Notes 2.0 Development proposals.
5 Point 2.2 Although existing is listed as industrial the usage by the previous owner was very ad-hoc, as for many years no known works had been carried out on the premises, it has been used more as a storage facility for dysfunctional machinery. Vehicles movements were very few and far between, and certainly did not reach the figures offered in this application. With reference to the appeal decision (for properties in Northumberland) put forward as part of the application it bears no relevance to this site in the Parish of Roxwell. This proposed development cannot in my view be classed as sustainable. With the facts presented in this application I strongly object to this application being granted permission. Cllr.C.Pavitt -1 st January 2018 Pp7 -Refers to 5 bus services running from the village to Chelmsford on an hourly basis between the hours of , in support of their claim and argument that this is a sustainable development. The current timetable for the 46 bus service run by the present operator show 6 services throughout the day, these are not on an hourly basis. The Context Analysis & Design Principle makes a number of statements regarding local build architecture that have no bearing to that within the village, and is highlighted by the image Of a supposed existing house in Roxwell pp9 that does not exist. The design is not in keeping with its surroundings or building design within the Parish of Roxwell. The NPPF review the and use of the Northumberland Planning Appeal has no similarities to this application as it is an urban context. The bat survey has been put together using details from visual inspections only, and as stated 2 surveys are required during their active season. I therefore object to this application. Cllr.M.Page 8 th January 2018 This application contains many, of what can be considered to be incorrect statements and facts. The bat surveys carried out are inadequate, as highlighted in previous comments offered. B1 states the destruction of the existing buildings could result in death/injury of bats. The proposed access point is of concern due to the lack of visibility available for vehicles on Vicarage Road and those exiting the site. The design and materials to be used do not conform to the other properties in the surrounding area. I therefore object to this application. Cllr.M.Plom 9 th January 2018 k) 5 BOYTON CROSS - Condition 4 - Blind window details. CONDITIONS REFUSED. l) BARNS AT MOUNTNEYS, ELM LANE - Non-material amendment to planning permission 17/01214/FUL (Conversion and alteration of existing barns to three residential units to include partial demolition and alteration of modern utilitarian appendage and provision of glazed link. Construction of new boundary treatment.) to change roof finish from a metal seam roofing to a natural grey slate. APPROVED. m) ASH TREE FARM The Chairman had written to the Planning Enforcement who had replied advising that a breach of condition 4 was issued on 11 th May Breach of condition 10 was issued on 11 th May Breach of condition 2 was issued on 11 th August The landscaping
6 work has not been fully implemented and remains an outstanding breach of planning control. Max Nicholls had advised the Chairman that the application has not yet been submitted. The proposed site is a Rural Exception site,the 2012 survey is now considered out of date, an up to date survey will be carried out during February 2018 and the application is due mid The survey will be organized by RCCE. The only cost to the Parish Council is for the printing. English Rural had purchased the land from the Diocese. If the scheme goes ahead it will need a draft S106 agreement. This allows for three other local parishes to be included in case the homes cannot be filled by village residents. Cllr. 7 116. DRAINAGE ON CORNER OF THE STREET/VICARAGE ROAD BY WARWICKS Minute 74 & 96. Nothing to report GREEN LANE RESURFACING The Chairman reported that the work will be carried out on 24 th January for 3 days weather permitting. This will include surface dressing, remarking and sweeping excess away DEFIBRILLATORS Minute 78. Cllrs. Wallace and Bradbury had received information on Defibrillators. They agreed to have a meeting and then do a presentation at a future Parish Council meeting. Cllr. Bradbury reported that Community Heart Beat scheme was very helpful. The local ambulance and Red Cross would assist with training. The person using the Defibrillator would need to know how to do CPR. Cllr. Wallace advised that a light would be needed, and BT will pay for the electricity for 2 years then the cost would be down to the Parish Council. The Defibrillator would cost between 1,400-2,200 and 150 for an electrician to fit it. A new battery would be needed every 4 years and a set of pads cost Cllr. Bradbury advised that someone in the village is prepared to provide funding for probably half of the cost of the Defibrillator. MEETING CLOSED 8.51pm CHAIRMAN.
