1 Item 3 North York Moors National Park Authority Public minutes of the site visit held at Church Farm, Kilburn on Friday 4 May 2018 at 10am. Mr D Hugill (Chair), Mr JR Bailey, Mr M Bowes, Mrs H Moorhouse, Mrs A Fisher, Mr C Pearson Mrs J Frank (Deputy Chair), Mrs C Patmore, Mrs S Oswald, Mr L Atkinson National Park Authority Officers: Mark Hill (Head of Development Management), Hilary Saunders, (Planning Team Leader) Applicant: Mr Thompson Parish Representatives: Mr J Harron and Mrs J de Cogan NYM/2017/0787/FL: Erection of manure store at Church Farm, Kilburn. The Members and Planning Officers met the applicant and the Parish Council at the entrance to the farm yard where the Chair opened the meeting. Hilary Saunders set out the details of the application, in terms of the size, design and location, and reason for proposal, and reminded Members that the reason that Members had agreed a site visit was to consider both the visual impact of the development on the Conservation Area and nearby properties, as well as to assess the amenity issues raised by objectors, in terms of the farm operations in general and the storing of manure in particular. Everyone then walked through the farm yard, where Mr Thompson explained the uses of his existing buildings; explained the use of his silage clamp and explained his livestock numbers and methods of spreading manure on his fields. He also confirmed the submitted design would need amending to allow trailers to tip manure and plans would be submitted before the next planning committee meeting. The tour of the farm finished at the location of the proposed manure store where members assessed the views out of the site, up to High Kilburn, the public footpath and the church. Everyone other than Jane de Cogan and the applicant then walked up the footpath towards High Kilburn and then walked down the road a little way to assess views back down to the application site, and then walked back down the footpath, through the church yard to the public car park adjacent to the Forresters Arms PH. The Members and Planning Officers met the Parish Council and Highways Authority representatives at the application site where David Hugill, the Chairman opened the meeting at 1.30pm. Chris France described the proposal and identified the two main issues in need of consideration. The issues being the impact the proposal would have on residential amenity and the highways network. It was reiterated that an objection had been received from the neighbours at Hall Farm, Stainsacre due to the risk that the proposal would cause additional noise late at night, and the Highways Authority had objected due to insufficient parking at the site and the risk that cars would park on the highway. It was explained why a site visit was thought required at the previous committee meeting in April where Members had voted 6-5 in favour of deferring the application to allow for a site visit to be carried out. The location of the shepherd s huts was identified to be at the rear of the Windmill Inn and that the applicant proposed to run them on a Bed and Breakfast basis, with breakfast being served at the Windmill Inn. The Members were informed that the shepherd s huts would be advertised to walkers, keeping vehicles on-site to a minimum. It was highlighted that the site layout of the scheme had been recently amended to allow for more spacing between huts in line with licensing requirements. The representatives from the Highways Authority were then offered to explain their concerns to the Meeting, their main concern being the inability to control the number of cars visiting the site as a result of the proposal. The constraints in the road network including the crest in the road to the north and the bend either side of the entrance to the Windmill Inn restricting visibility was highlighted. A suggestion was made by Mr D Rowland to extend the 30mph limit in order to reduce the speed of vehicles passing the site. However, the Highways Authority stated that even though this might be possible, it would not remove the problem of cars possibly parking on the road and there being reduced visibility to manoeuvre around them. A suggestion was also made to possibly extend the double yellow lines to prevent cars parking on the road, but again the Highways Authority thought that this would not address the problem and would only cause cars to park further along the road towards the centre of the village.

3 Once the two key issues had been discussed, the Chairman suggested that the Meeting now inspect the application site. A board was presented to the Meeting that displayed the drawings of the revised scheme. The Applicant talked through the proposal specifying the sections of fence to be removed, the approximate location of the shepherd s huts and his intensions for the site. It was reinforced to Members that the current use of the site for the erection of a marquee for small gatherings would cease, as the shepherd s huts would be the sole use of the land at the rear. The existing play area would also most likely be removed. Mr D Rowland offered words of support in response to this as the current use of the land for gatherings was apparently quite loud with music playing into the early hours, and the proposed use was deemed to be less so. Mrs H Moorhouse asked whether each hut would need an electric and water supply, in which the applicant stated they did not. The Applicant pointed out that the visitors to the huts would use the WC located in the Windmill Inn, and that there is not a requirement for a shower to be located on-site. The Chairman invited final questions and no more questions were raised. The meeting was closed at 2.40pm. Hilary Saunders set out the details of the application, in terms of the size, design and location, and reason for proposal, and reminded Members that the reason that Members had requested a site visit was to consider the principal of the siting of a commercial enterprise in this location, away from the existing businesses in the Bay, and to assess the character of the Quarterdeck in relation to the rest of the village and the Conservation Area. It was also clarified that whilst the issue of the moving of the benches had been raised by objectors, this was something that would require a separate consent of the Borough and Parish Council and did not form a material planning consideration. Both the objectors and supporters representatives re-iterated their views relating to harm to tranquillity, increased activity but also benefits to the village in terms of a wider tourism product. Members asked questions relating to the siting of the cabin (the area had been pegged out by the applicant), the location of the proposed retaining wall and bank stability. Everyone then walked along the Quarterdeck and down the steps onto the beach to view the site from their but also to understand better the use of the beach. Hilary Saunders pointed out the steps up from the Quarterdeck which connected to the Cleveland Way, and comments were also made by supporters and objectors regarding the way the beach is used in terms of how the tides change, and the facilities provided by the ice cream van on the beach, including hot drinks.

5 Everyone then walked along the beach and up the slipway, outside the NT Visitor Centre, where other facilities within the village were discussed and pointed out. The Chair then closed the Meeting, and Members walked a little further up the road, past several shops and cafes to the minibus. Hilary Saunders Planning Team Leader
