10 General conditions of sales Tourist Office Luberon Coeur de Provence - EPIC Office de tourisme Luberon Luberon Monts de Vaucluse Place François Tourel - BP Cavaillon cedex Organisme immatriculé au registre des opérateurs de voyages et de séjours : IM SIREN: Code APE: 7990Z I Article 1 1 I General Provisions Tourist Offices with authorisation under the law of 13 July 1992 may book and sell all types of services. I Article 1 2 I The incoming department of the Luberon Cœur de Provence Tourist Office may book and sell all leisure and hospitality services that lie within the Tourist Office s sphere of responsibility. It facilitates processes for suppliers, offering a wide range of services and providing fast and reliable bookings. It is able to assist all kinds of customers, analysing their requirements and giving quotations for many different types of services. I Article 1 3 I These general conditions of sale come into force on 1 October 2016 and shall be considered valid unless specific agreements dictate otherwise. I Article 3 I Bookings Bookings are only considered confirmed when you have paid a deposit corresponding to 30% of the total cost and returned a signed copy of the booking contract to the Luberon Cœur de Provence Tourist Office before the deadline shown on the contract. Bookings are made for a specific number of people. If, on the day of departure, the actual number of people in the group is higher than the number on the booking, the Luberon Cœur de Provence Tourist Office may refuse the additional guests if the intended accommodation does not have room for them. If you are booking a circuit, you must pay a deposit corresponding to 30% of the total cost at the time of booking, unless you are booking less than one month before departure, in which case the full amount is due at the time of booking. Failure to pay the deposit will result in your booking being cancelled with no right of recourse. Bookings cannot be made merely upon request. I Article 4 I Payment of the balance The Luberon Cœur de Provence Tourist Office will invoice you for the outstanding balance, which you formally undertake to pay one month prior to the date on which the services agreed are due to begin. Unless previously agreed otherwise, you will be considered to have cancelled your stay if your fail to pay the balance by the agreed date. If this happens, any deposit you may have paid will be refunded, minus any applicable cancellation fees as per Article Seven of these General Conditions of Sale. I Article 5 I Late booking For bookings made less than thirty days prior to the start of the service, full payment is due at the time of booking unless specifically agreed otherwise. I Article 6 I Changes Any changes to a booking contract must be agreed in advance by the Groups Department. In the event of changes made by the Groups Department, said department undertakes to inform the group leader at the earliest possible opportunity. In the event of the duration being extended, the Luberon Cœur de Provence Tourist Office may have to charge extra for the additional service provided. In the event of any of the fundamental elements of your stay being changed seven days before the start date, either by the Groups Department or by one of its service providers, you may: Cancel the booking. Accept the new arrangements by signing an addendum to the contract. In the event of a significant drop in the number of participants prior to the provision of the service, the per-person price will have to be adjusted. In the event of a no-show by one or more participants, no allowances will be made for their absence when the service is invoiced. No refunds will be made under any circumstances. I Article 7 I Cancellation by you If you want to cancel your booking you must inform the Luberon Cœur de Provence Tourist Office by registered letter. Cancellation charges will apply as follows (days shown are in advance of the start date of the services): Between 30 and 21 days: 30% of the total cost of the services. Between 20 and 8 days: 50% of the total cost of the services. Between 7 and 2 days: 75% of the total cost of the services. Less than 2 days: 100% of the total cost of the services. If you paid a deposit, the Luberon Cœur de Provence Tourist Office may deduct applicable cancellation charges from the deposit prior to refunding any remaining balance. No refunds will be made for no-shows. No refunds will be made for unused portions of the services in the event that you curtail. I Article 8 I Cancellation by the tourist office If the Luberon Cœur de Provence Tourist Office cancels your booking for any reason other than force majeure, you will be entitled to a full refund of all monies paid. You will also be entitled to receive compensation in the same amount that you would have been liable to pay had the cancellation been made by you. The amount of any compensation is calculated on the basis of the schedule set forth in Article Seven of these General Conditions of Sale. These provisions will not apply if you have accepted an alternative service as part of an amicable agreement. I Article 9 I Changes by the Luberon Cœur de Provence Tourist Office to a significant element of your booking contract In the event that the Luberon Cœur de Provence Tourist Office informs you that it has been forced to make a change to one of the fundamental elements of your booking prior to the start date of the services, you may, without prejudice to compensation claims for eventual damages suffered, either: Cancel your booking without penalty and receive a full refund of all monies paid; or Accept the change or the alternative service offered. An addendum to the booking contract will then be signed by both parties. If the price of the new service is cheaper than the original, the outstanding balance will be adjusted accordingly or, if you have already paid in full, you will be refunded the difference prior to the start of the service. I Article 10 I Special conditions It is agreed that the 30% deposit shall not be required in the event of group bookings made by or on behalf of associations or other organisations. In such cases the service will be invoiced in its entirety as soon as it has been provided. The conditions relating to cancellations and changes apply exactly as shown above. I Article 11 I Liability The Luberon Cœur de Provence Tourist Office is your only intermediary in respect of the services booked through it, and shall be liable to you for the performance of its responsibilities as set forth in the booking contract. The Tourist Office declines liability in the event of force majeure or fortuitous events, errors made by you, or the fact of any person not involved in the organisation of the trip fully or partially preventing the Tourist Office from fulfilling its obligations. If you have a complaint, we will try to come to an amicable agreement with you. In the event of disputes, the law applicable to these General Conditions of Sale will be French Law. Any disputes relating to the interpretation and/or performance of these General Conditions of Sale will be resolved by the French courts. You acknowledge that you have read and agree to these General Conditions of Sale.
