The informaion abou he programme/offer he package ravel included in he programme/brochure, is binding for Pullmanur Cruises (hereinafer Pullmanur or Organiser) or Reailer, oher han in any of he following circumsances: a) Changes in such pariculars have been clearly communicaed in wriing o he Consumer before conclusion of he Conrac and ha possibiliy was expressly menioned in he programme/offer b) Changes are subsequenly made, following an agreemen in wriing beween he paries o he Conrac. The Ships are markeed under he Pullmanur rademark. Hereinafer, he Ship. The consumer or user or passenger is any person ha is he main conracor, Beneficiary or Assignee. The Main Conracor is he naural or legal person who buys or agrees o buy he ravel package. The Beneficiary is he person on behalf of whom he main conracing pary underakes o buy he ravel package. The assignee is he person o whom he principal conracor or oher beneficiary ransfers he ravel package. The Organizer is he naural or legal person who organizes non-occasional ravel packages and sells hem or offers hem for sale eiher direcly or hrough a reailer. The Reailer is he naural or legal person who sells or offers for sale he ravel package proposed by an Organizer. The Carrier is any person who eners ino, or on whose behalf a conrac of carriage is enered ino, wheher he ranspor is carried ou by ha person or by a performing carrier. The price of he rip includes: 1) The round-rip ransporaion, when his service is included in he program/offer booked, wih he ype of ransporaion, characerisics and caegory se ou in he passenger voucher and in he program/offer. 2) Accommodaion in he Ship on all-inclusive basis, which includes breakfas, lunch and dinner in he main resaurans (dinner according o assigned schedule), and in he buffe service, wih he following drinks: waer, juices, coffee, beers, ea, sof drinks and alcoholic beverages from leading brands. 3) Fees and oher charges. The price of he rip includes he fees and charges of embarkaion, disembarkaion, pors and airpors, as well as any oher fee and/or charge, ha is charged eiher individually or on a proraed basis for services of managemen and processing wih he saff of he pors, including, among ohers auxiliary vessels, walkways, agens and baggage. 4) Service and adminisraive charges. The service and adminisraion charges are inended for he Shipping company s personnel who primarily offer coninuous and personalized aenion o passengers o ensure heir fully saisfacory say on board. Upon booking, Pullmanur Cruises, S.L. will, on behalf of he Shipping company, invoice and charge he amoun ha corresponds o hese charges. 5) All oher services and add-ons specifically referred o in he program/offer booked or expressly saed in he Conrac. 2.2 The price of he rip does no include: Visas, and/or governmen fees for enry o or exi from any of he counries included in he iinerary, which will be paid direcly by he passenger if hey are required by local auhoriies. Nor does i include ouris fees for accommodaion, which shall be duly specified in he ravel offer and ha mus be paid direcly on arrival, or excess baggage, or vaccinaion cerificaes. Also, no included are opional packages of so-called premium beverages or similar, or any oher producs ha are opional, or exras ha are published in he ravel package offer or in he program/caalogue, or he consumpion of beverages in bars called premium, boled waer, boled sof drinks, naural juices, and lunches and dinners a seleced resaurans. Nor does i include spa services, hairdressing, beauy and well-being, purchases in duy free shops, Inerne and Wi-Fi service in reserved areas, 24-hour room service, babysiing service, access o faciliies and services of The Waves Whie The Waves Black and he Sun Lounge, laundry and ironing services, phone calls or messages o land, medical service and excursions and, in general, he price does no include any oher service ha is expressly lised as opional or exra in he program, or ha i is no specifically conraced by he consumer and herefore does no appear in he conrac Excursions or opional visis. Their publicaion in he caalogue has merely informaional characer, and he consumer can decide wheher o conrac hem or no Exraordinary services conraced on board, which will have o be paid for by he Passenger on he las day of he Cruise Price revision. The price of he rip has been calculaed on he basis of he exchange raes, ranspor coss, including he cos of fuel and axes and fees applicable a he dae of publicaion of he caalogue. Any variaion in he price of hose iems may give rise o a revision of he final package price eiher upward or downward, sricly in he amouns of he aforesaid price variaions, which will be properly deailed. These modificaions shall be noified o he consumer by any means ha would make i possible o record he communicaion made. In no case shall he price be revised upwards in he 20 days prior o he deparure dae of he rip wih respec o bookings already made Special offers. When he conracing of he rip is a resul of special offers, las minue offers, or equivalen, a a price differen from ha one specified in he program/brochure, he services included in he price are only hose ha are specified in deail in he special offer. These offers are subjec o availabiliy ime limis, pursuan o he crieria of which he consumer will be duly informed by he Organizer on each occasion. 2.5 Opional packages and beverage menus. Packages opional, premium beverages or similar published iems can be purchased on board or before boarding. Those purchased before boarding mus be purchased for all he nighs of he Cruise, and may be cancelled or modified up o 4 days before deparure wihou penaly for he change or cancellaion. The refund will be made hrough he raveller s agency reailer. If he Passenger cancels he cruise, he amoun of beverage packages will be refunded. Premium drink or similar packages may also be purchased on board up o hree nighs before he end of he cruise for all remaining nighs. In mini cruises wih duraion of 3 and 4 days, hey may be purchased up o he firs nigh on board. On-board conracing is no available for one or wo-day cruises. Beverage packages purchased aboard may be cancelled, bu shall no be refunded excep in cases of force majeure. Beverages consumed prior o purchase of he on-board package will no be refunded. Persons who, for medical reasons arising on board, canno make use of conraced drinks packages, will receive a refund equal o he cos of he days hey have no been able o enjoy he package. I will be necessary o provide proof issued by he docor on board. The drinks package is personal and no ransferable. Beverages canno be shared wih oher passengers. The owner of he package may no order more han one drink a a ime. Persons below he age of 18 may no consume alcoholic beverages. Reservaions shall be valid only when hey are confirmed by he Organizer. In he even ha, before he confirmaion of he booking and he signing of he conrac, he Organizer is unable o provide any of he services requesed by he Consumer, his will be duly communicaed, and he Consumer may wihdraw he reques, recovering only he amouns paid in advance, if any, ha will have o be paid by he Reail Agency hrough which he booking was made and such amouns were paid, wihin a maximum period of 15 days. 3.2 Form of paymen. In order o formalize he regisraion, he reail ravel agency may reques you a minimum down paymen of 50 euro/ 40 USD a he ime of booking and issuing he relevan receip specifying, in addiion o he amoun paid in advance by he consumer in respec of he journey requesed, he remaining amoun o be paid a he ime of he signing of he conrac and delivery of he vouchers, as well as any oher ravel documenaion. The remaining paymen mus be made a leas 45 days before he dae of deparure or embarkaion. Regisraions requesed wih less han 45 days noice prior o he dae of deparure or embarkaion shall be paid for he oal amoun upon confirmaion of he booking and along wih he subsequen signing of he Conrac and delivery of he ravel or Cruise vouchers. In he even of special offers made in he marke, paymen mus be made according o wha is se ou in he offer. Accepance of bookings by he Organizer shall be subjec o he availabiliy of places on he requesed daes, and is compleed upon dispach of confirmaion by he Organizer. Reservaions made by children under he age of 18 shall no be acceped. Reservaions for under-age passengers mus be made by he people exercising heir parenal righs or by oher individuals of legal age who have he necessary legal powers. In addiion, such bookings will only be acceped if he child is ravelling accompanied by heir parens or guardians or wih a leer signed by he paren or guardian auhorizing he minor o ravel wih anoher person of legal age acing as he person responsible for he minor during he rip, where such leer mus be duly auhorized by he compeen auhoriy if required. The published prices should be considered per person, based on he chosen form of occupaion of his cabin. Insurance premiums and any managemen coss of modificaion or assignmen of reservaions are no refundable. All refunds due for any reason shall be execued in he same way ha paymen of he rip had been made, and here shall be no refund whasoever for services no used volunarily by he consumer, excep in case of consumer wihdrawal owing o reasons of force majeure. 3.4 Paymens on board. Each Passenger, on he firs day of he cruise, will need o open an accoun wih a credi card or a cash deposi of 200 /USD (wo hundred). 4. CONSUMER WITHDRAWAL AND ASSIGNMENT 4.1 In ravel packages, you do no have righ of wihdrawal regulaed in aricles 102 and following of he Royal Legislaive Decree 1/2007, which specifically consiss in he righ o cancel he services requesed wih he righ o a refund of he oal amoun for any cause for a period of 14 calendar days from he signing of he conrac. A any ime, he Consumer and User may cancel services requesed or conraced, wih he righ o he reurn of any amouns paid, bu shall indemnify he Organiser or Reailer in he amouns indicaed below, unless such erminaion akes place for reasons of force majeure. The package is subjec o special economic condiions of conracing, wih he following cancellaion coss per cancelled passenger applicable: 1. Cancellaions made more han 30 days prior o he dae of deparure are subjec o managemen coss in he amoun of 50 euros/ 40 uds per person. 2. Cancellaions made more han seven and less han 16 days prior o he dae of deparure are subjec o a charge of 67% of he price of he rip/cruise including he fligh if is booked (excluding he amouns relaing o secion 2.1.3) 2.1.4) above). 4. Cancellaions made wihin 7 days prior o deparure are subjec o a charge of 100% of he price of he rip/cruise including he fligh if is booked (excluding he amouns relaing o secion 2.1.3), 2.1.4) above). 4.2 Assignmen of reservaions. In all rips, he main conracing pary or any Beneficiary may ransfer he booking o a hird person by making a reques in wriing 15 days prior o he sar dae of ravel. The ransferee shall have o mee he same requiremens as he ransferor, required for he rip, and boh will be joinly and severally liable o he Reailer or, as he case may be, he Organizer for he paymen of he price of he rip as well as jusified addiional coss of he assignmen. 5. SIGNIFICANT MODIFICATION OF THE CONTRACT PRIOR TO DEPARTURE, TERMINATION OF THE CONTRACT FOR REASONS ATTRIBU- TABLE TO THE ORGANIZER AND CANCELLATION OF THE TRIP The Organizer underakes o provide is cusomers all conraced services conained in he program/caalogue and in he ravel package ha has given rise o he ravel conrac, wih he sipulaed condiions and characerisics: 5.1. In he even ha, before deparure, he Organizer is compelled o significanly modify an essenial elemen of he conrac, he Organizer shall immediaely bring his o he aenion of he Consumer In such a case, and unless he paries agree oherwise in individually negoiaed erms, he consumer may choose beween erminaing he Conrac wihou any penaly or accep a modificaion of he conrac in which he changes and he impac on he price are specified. The Consumer mus noify he Organizer of he decision wihin hree days afer being noified of he modificaion referred o in paragraph 5.1). If he Consumer does no noify heir decision in accordance wih he erms indicaed, i will be undersood ha he Consumer chooses o erminae he conrac wihou any penaly In he even he Consumer chooses o erminae he conrac pursuan o paragraph 5.2), or he Organizer decides o cancel he rip before he dae of deparure for any reason no aribuable o he Consumer, he Consumer shall be eniled, from he ime of he erminaion of he conrac, o reimbursemen of all amouns paid in accordance wih he same, or o anoher rip of equivalen or higher qualiy, provided ha he Organizer is in a posiion o offer such a rip. In he even he qualiy of he rip offered is of lower qualiy, he Organiser and/or Reailer mus refund he Consumer, when appropriae, in accordance wih sums previously paid, he price difference according o he Conrac. In any case, he Consumer may demand reimbursemen of sums paid o he company o which hey were direcly paid (eiher o he Organizer or he Reailer), and which mus be refunded as soon as possible and, in any even, wihin a maximum period of 14 calendar days from he noificaion of erminaion of he conrac by he Consumer or from he circumsances causing he cancellaion. 5.4 In he foregoing cases, he Organizer and he Reailer will be responsible for paymen o he consumer of compensaion ha in no case may be less han 5% percen of he oal price of he package, if he breach occurs beween wo monhs and fifeen days immediaely prior o he expeced dae of he journey; 10% percen if i occurs beween 15 days and hree days prior, and 25 percen if he breach occurs in fory-eigh hours prior o he rip. There shall be no obligaion o compensae when: 1) The cancellaion is due o he fac ha he number of people regisered for he rip is less han he number required and he Consumer is advised of his in wriing o he consumer prior o he deadline se for ha purpose in he Conrac a leas 10 days prior o he sar dae of he rip. 2) If cancellaion of he rip, excep in he cases of overbooking, is due o reasons of force majeure, which consiue circumsances beyond he conrol of he person invoking hem ha are abnormal and unforeseeable, he consequences of which could no have been avoided, even if one had aced wih due diligence. 6. CONSEQUENCES OF NON-PROVISION OF SERVICES 6.1. In he even ha, afer deparure, he Organizer will no provide or verify ha i canno supply a significan porion of he services provided for in he Conrac, such Organizer shall ake he appropriae soluions for he coninuaion of he organized rip, a no exra cos o he consumer and, where appropriae, he laer shall be paid he amoun of he difference beween he benefis conraced and hose acually provided. If he Consumer coninues he journey wih he soluions given by he Organizer, hey shall be deemed o have acily acceped hese proposals. If he soluions adoped by he organizer were no feasible or he Consumer does no accep hem on reasonable grounds, he Organizer mus provide he Consumer, wih no exra cos, a means of ranspor equivalen o ha used in he journey o reurn o he place of deparure or o any oher agreed locaion, wihou prejudice o any compensaion. In he above cases, in he even of a claim, he Reailer or, as he case may be, he Organizer mus work diligenly o find appropriae soluions In he even he rip is cancelled due o mechanical failures, he Consumer shall be eniled o a refund of he oal price of he cruise in case of cancellaion or a parial refund or a refund of he difference beween he benefis provided and hose finally supplied in case ha cancellaion occurs once he rip has begun, due o such failures. The consumer shall be eniled o be ranspored o he por of landing or o he ciy of origin of he Consumer a he discreion of he company in he even ha he cruise ends early due o mechanical failures. The consumer shall have he righ o accommodaion in case of erminaion of he cruise due o mechanical failure if disembarkaion is required and if an overnigh say a an unscheduled por becomes necessary The Organizer shall no be liable for any failure in he performance of ouris services ha are hired direcly by he Consumer, wihou any inervenion of he Organizer in heir conracing Consumers ha desis from using any services included in he program are no eniled o claim reimbursemen for such volunarily unused services, unless wihdrawal occurs due o reasons of force majeure. 7. CONSUMER NOTIFICATION OF NON-COMPLIANCE IN PERFORMANCE OF CONTRACT DURING TRIP 30

The communicaion mus be made in wriing or in any oher appropriae form ha leaves a record. 8. CLAIMS MADE TO THE AGENCY 8.1. Wihou prejudice o he legal acion o which hey are eniled, he Consumer may make wrien claims pursuan o breach or fauly performance of he conrac o he reail agency. 2. Wihin a maximum period of 30 days, he organizing agency or he reail agency mus answer he claims in wriing. Complains addressed o Pullmanur should be direced o he claims deparmen, he Feedback Managemen deparmen via he address reclamaciones@pullmanur.es In his phase, he consumer and he agency may seek he mediaion of he compeen auhoriy or of bodies creaed for his purpose o find a soluion o he conflic ha is saisfacory o boh paries If he conflic canno be resolved by means of a complain o he agency, he Consumer may submi o consumer arbiraion if he agency receiving he claim previously acceded o he consumer arbiraion sysem or if he agency acceps he arbiraion even if i has no previously acceded hereo. In any case, he consumer can file a claim in cour. 9. LIMITATION OF ACTIONS If he dispue is no submied expressly by he paries o arbiraion, he consumer may file a claim in cour. Any possible cour acions arising from he ravel conrac are limied by he elapse of he erm of wo years. 10. LIABILITY General. The Organizing Travel Agency and he Reailer will be liable o he Consumer for he correc fulfilmen of heir obligaions under he conrac, irrespecive of wheher hese are performed by hemselves or by oher service providers, and wihou prejudice o he righ of he Organizers and Reailers o ac agains such service providers. The ravel Organizers and Reailers shall be liable for any damages o he consumer resuling from non-performance or fauly performance of he Conrac. Such liabiliy shall cease in he even of any of he following circumsances: 1) The defecs observed in he performance of he conrac are aribuable o he Consumer. 2) The defecs are aribuable o a hird pary unrelaed o he provision of he services under he conrac ha are unpredicable or insurmounable in naure. 3) The defecs referred o, are due o reasons of force majeure, which are circumsances beyond he conrol of he person invoking hem, ha are abnormal and unforeseeable consequences of ha could no have been avoided, even if one had aced wih due diligence. 4) Where he failures are due o an even ha he Reailer or, as he case may be, he Organizer, even if exercising all due care, could no foresee or foresall. However, in he case of exclusion of liabiliy for any of he circumsances provided for in numbers 2, 3 and 4, he Organizer and he Reailer paries o he ravel package conrac shall be bound o give all necessary assisance o he consumer in difficuly Limis of compensaion for damages. In accordance wih he laws and inernaional reaies, in any circumsance of need or danger, and, especially, when, for reasons of safey of he Ship, he passengers and/or crew of he Ship, he capain has full powers o assis and ow oher vessels; diverge from he planned roue; make sopovers in any por; ransfer o anoher Ship passengers and baggage; rejec he boarding of anyone who, in his judgemen, does no mee he condiions of healh necessary for carrying ou he cruise; o disembark in por during he cruise anyone who, in his view, is in condiions of healh ha do no allow he coninuaion of he same, or in general anyone who may pose a danger o he safey of he Ship or o he oher passengers, or hose who carried ou on board he Ship commercial or oher aciviies involving a violaion of he company s policies relaing o passenger conduc on board and, in paricular, he conduc policy of he company provided on board and available on he websie. All passengers shall be subjec o he auhoriy of he capain, and especially in relaion o he safey of he Ship or navigaion. In he even of a refusal o accep hese orders or insrucions, he rip may be erminaed immediaely, where he passenger shall assume any cos resuling from such non-compliance On board docor The Ship has a qualified docor on board should he passenger would wan or need o reques medical assisance during he Cruise. Access o he benefis of he on-board docor is volunary, and he cos of he care will be a he expense of he passenger. The docor is no a specialis and he Ship s medical cenre does no have he same sandards as a hospial on land, nor is he Ship obliged o comply wih such sandards. The Ship s medical cenre is no designed o provide exensive or ongoing medical reamen. The Ship has medical supplies and equipmen in accordance wih he requiremens laid down by he laws of he flag sae of he vessel. Regular fees will be charged for he services provided and he medicines dispensed in he Ship s medical cenre. Paymens via healh insurance are no allowed on board. INFORMATION THAT THE RETAIL AGENCY MUST PROVIDE TO THE CONSUMER. PASSPORTS, VISAS AND DOCUMENTATION The agency has a duy o repor healh formaliies required for he journey and say, and on he condiions applicable o ciizens of he European Union wih respec o passpors and visas, and documenaion required for minors, where he agency shall be responsible for he accuracy of he informaion i provides. If he Reail Agency acceps he consumer s reques for processing he necessary visas for any of he desinaions specified in he iinerary, i may require he paymen of he cos of visas as well as he managemen fees for procedures o be carried ou wih diplomaic or consular offices. In his case, he Reail Agency shall be liable for any damage for which i is responsible in accordance wih he diligence normally required due o delays in obaining he necessary documenaion or he absence or insufficiency of he same. In any case, he Consumer mus obain he necessary documenaion for he rip, including he passpor and visas and healh documenaion, and documens required for minors. Any damages ha may resul from he lack of such documenaion shall be a he Consumer s expense and, in paricular, coss incurred from he inerrupion of he rip and any repariaion. All children under 18 years of age or younger, in accordance wih he legislaion of he counry, ravelling wihou heir parens or wih any person oher han heir parens, mus also provide a wrien auhorizaion from heir parens or guardians, enclosing a copy of he credenials of such parens or guardians. I is also expressly recommended ha auhorizaion of he compeen body be carried, in anicipaion ha such auhorizaion may be requesed by any auhoriy, also including informaion needed o locae parens in case of emergency. 14. AIR TRANSPORT The flighs offered for cerain Trips/Cruises included in his caalogue may be charered only by he organizer wih he airlines or charer conraced by he organizer wih oher our operaors, and he airlines or regular flighs Liabiliy of airlines (carriers) in relaion o incidens in air ranspor in accordance wih he provisions of Regulaion 261/2004. Regulaion 261/2004 of he European Parliamen and of he Council of 11/02/2004, lays down he rules on compensaion and assisance o passengers in he even of denied boarding, cancellaion or long delay. The above regulaion shall apply only o: a) Passengers deparing from an airpor locaed in he erriory of a Member Sae. b) Passengers deparing from an airpor locaed in a hird counry o anoher in he erriory of a Member Sae, provided ha he carrier responsible for he fligh is an EU carrier. In accordance wih he provisions of Regulaion 261/2004, when he airline cancels a fligh or causes a long delay, i will be responsible for providing due assisance and aenion o he affeced passengers, acceping he coss of meals, ranspor and overnigh calls, if applicable, in accordance wih he EEC Regulaion 261/2004, laying down common rules on compensaion and assisance o passengers in cases of denied boarding and of cancellaion or long delay of flighs. In addiion, his Regulaion provides ha, in he even of cancellaion or long delay on he fligh, he airline also shall be bound o pay compensaion o he passenger, as well as o refund he price of he plane icke if he passenger chooses his opion. If he cancellaion is due o exraordinary circumsances which could no have been avoided even if all reasonable measures had been aken, he air carrier shall no be obliged o pay he compensaion, bu o provide due care and aenion o he affeced passengers and o reimburse he price of he icke if hey choose his opion. 15. BAGGAGE AND INSURANCE On he Ship, he passenger may board wih up o 25 kilos of baggage free of charge. Any excess will be checked a he curren price of baggage, wihou prejudice o he righ of he carrier o limi he weigh of such baggage excess. The consumer has he power o conrac an insurance policy wih an insurance company ha covers a single ime and up o he amoun specified in he policy according o he desinaion of he rip, for hef wih violence or inimidaion agains people or use of force in hings, of he baggage hey own, as well as loss and hef, accredied in complain o he compeen auhoriies, or damage caused as a resul of an acciden of any kind, or fire o he means of ranspor. In he even of a hef, loss, hef or damage o baggage in he circumsances described above, in accordance wih he erms of he opional insurance offered, you mus direcly noify he headquarers of he Insurance Company wihin a maximum period of 15 days, and aach he documen cerifying he complain o he compeen auhoriy, or of he inciden, as he case may be, and he value of he iems solen or damaged. This period shall begin from he day on which he cusomer has compleed he journey. Expressly excluded from such coverage of he opional insurance are jewellery or works of ar, money or any documen represening i, picures, sound equipmen, compuers, radios, any ype of documens, movies filmed and, in general, any objecs ha do no consiue he insured pary s baggage Liabiliy of carriers by sea for loss or damage o baggage under Regulaion 392/2009 on he liabiliy of carriers of passengers by sea in he even of an acciden. The Carrier is presumed o be liable deemed responsible for he loss or damage suffered in he baggage o is own faul or negligence or ha of is employees or agens if hey were acing in he performance of heir duies. Their liabiliy is limied: (I) In he case of loss or damage o baggage in cabin, up o 2,250 SDR per passenger and ranspor; (ii) for loss or damage o oher iems of baggage, 3,375 SDR, where such liabiliy may be subjec o a deducible of no more han 149 SDR; and (iii) for he loss or damage suffered in he vehicles ranspored shall no exceed 12,700 SDR, where such liabiliy may be subjec o a deducible of no more han 330 deg.
