1 RS Chairperson and Committee Members OPERATIONS & FINANCE COMMITTEE 17 AUGUST 2017 Meeting Status: Public Purpose of Report: For Information ALCOHOL REGULATORY AND LICENSING AUTHORITY ANNUAL REPORT JULY 2016 TO JUNE 2017 PURPOSE OF REPORT 1 This report is to inform the Council of the contents of the Alcohol Regulatory and Licensing Authority (ARLA) Annual Report that is required to be provided to ARLA each year pursuant to Section 199 of the Sale and Supply of Alcohol Act 2012 (the Act). DELEGATION 2 The Operations and Finance Committee has the authority to deal with all Regulatory and Planning matters from an operational perspective. BACKGROUND 3 Within three months of the end of every financial year, every territorial authority must prepare and send to ARLA a report of the proceedings and operations of its licensing committee during the year. ISSUES AND OPTIONS Issues 4 Pursuant to section 199 (2) of the Act, ARLA may specify the form of the annual report and matters to be included in the annual report. Attached as Appendix 1 is the request from ARLA for the annual report. 5 The matters that were required to be covered in this report include Overview of District Licensing Committee (DLC) workload DLC initiatives Local Alcohol Policy Current legislation Any other matters Statistical information 6 A copy of the Annual report is attached as Appendix 2 Page 1 of 2

2 RS CONSIDERATIONS Policy considerations 7 There are no policy considerations. Legal considerations 8 This report is required to be prepared pursuant to section 199 of the Act. Financial considerations 9 The statistical information portion of this report deals with ARLA s portion of any fees collected from application fees and annual fees. Tāngata whenua considerations 10 There are no Tāngata whenua considerations. SIGNIFICANCE AND ENGAGEMENT Significance Policy 11 This matter has a low level of significance under Council Policy. Publicity 12 This report will be published on the Councils DLC webpage. OVERVIEW OF DISTRICT LICENSING COMMITTEE (DLC) WORKLOAD DLC s structure and personnel The DLC Chairperson is Councillor Fiona Vining. The DLC Deputy Chairperson is Councillor Janet Holborow, and an alternate Deputy is Councillor Jackie Elliot. We have four list members as noted below: Hilary Wooding Michael Dodson Trevor Knowles Philip Parkinson The Secretary of the DLC role is delegated to Kevin Currie, Group Manager Regulatory Services. The Committee Advisor is Jacquie Muir, Environmental Standards Manager. In addition Committee support roles are shared between staff in the Secretary s and Council s Democracy Services teams. With regard to the Inspectorate, we currently have the following team members: One full time Alcohol Licensing Inspector One full time Alcohol Licensing Inspector/Administrative Officer One Chief Licensing Inspector, the Team Leader of Environmental Health, contributing approximately 35% FTE Any staff training undertaken relating to the Sale and Supply of Alcohol Act 2012 Two Licensing Inspectors attended the NZILLI Conference this year. The Environmental Health team as a whole attended confident conversations workshops. The DLC members attended a day s training facilitated by Al Lawn, Commissioner for Christchurch City Council. The DLC members and Committee Advisor attended a recent webinar facilitated by LGNZ DLC hearings or meetings The DLC convened 22 Temporary Authority Hearings. There were four other hearings: New Managers Certificate Declined but overturned on appeal to ARLA Renewal of Grocery Store Off Licence - granted

7 New Bottle Store granted but awaiting an appeal to ARLA on conditions Renewal of Tavern style On Licence awaiting decision The DLC met as a group twice this year to discuss issues. 2. DLC INITIATIVES New initiatives adopted or tried by the DLC The Council continues to notify all Elected Members and Iwi group representatives (from Te Whakaminenga o Kāpiti, Te Āti Awa, Ngāti Toa Rangatira) and Iwi representatives to standing committees of Council of all applications related to new and the renewal of licences. The Inspectorate has implemented a quality management system which includes clear processes and a document management system. 3. LOCAL ALCOHOL POLICY Does the Territorial Authority have a draft or provisional Local Alcohol Policy, and if so, any comment on this? The development of a Local Alcohol Policy is not on the current Kāpiti Coast District Council Policy Work Programme. 4. CURRENT LEGISLATION Any comment on the Sale and Supply of Alcohol Act 2012 The way the requirements for the different licence types are spread through various sections in this Act is still a problem for Inspectors, especially when training staff. The DLC applauds the announcement by the Associate Justice Minister Mark Mitchell that the Government intends to make changes to the Act to address the unintended effects of tobacco excise tax increases on grocery store off-licences. The unintended consequences of the Act as it was, had the potential to stop our small provincial grocery stores holding Off licences and we see these proposed changes as a very positive move to ensure the continued economic viability of these stores in our community. 5. ANY OTHER MATTER THE TA MIGHT WISH TO DRAW TO THE ATTENTION OF THE AUTHORITY Any noticeable trends or issues faced by the DLC The reporting agencies (Police, MOH and Licensing Inspectors) have been working with Offlicence bottle stores (new and renewal applicants) to gain agreement to reduce opening hours back to 9pm in line with current Alcohol Control in Public Places Bylaw. This Bylaw restricts public place drinking in all urban areas of Kapiti after 9.00pm. When no agreement has been reached applications have generally been opposed by one or all of the reporting

8 agencies. Recent appeals to ARLA where conditions on hours have been overturned have contributed to an increase trend towards applications for later trading hours. 6.
