1 COU 14/04/01 QLDC Council 17 April 2014 Report for Agenda Item: 1 1. Mayor s and Chairpersons report Purpose 1 To summarise the Mayor's activities since the date of the last report and to raise other items of democratic and general interest, including a summary of actions taken in response to the decisions made at previous Council meetings. Recommendation That Council: a. Note the report. b. Approve the formation of a hearings panel comprising three Councillors [to be named] to hear any objections to applications from the Queenstown Winter Festival for licences to occupy Council reserves and delegate to this hearings panel the authority to make a final decision on the applications; c. Approve, if there are no submissions received, the applications for a licence to occupy the following reserve areas for the Queenstown Winter Festival 2014, subject to the following conditions i. Licence to Occupy the Village Green: Rent: $1 plus GST (not charged) Operating expenses: N/A Rent Reviews: N/A Installation and running costs: To be met by the applicant Assignments: Not permitted Insurance: applicant must have Public Liability Insurance of $2,000,000 (Two Million Dollars) Hours of operation: 10am to 10pm daily for the duration of the festival Uses: For the purpose of operating a Community accessible Ice Rink Sub-letting: Permitted at the discretion of Council Ground reinstatement: To be completed to the satisfaction of the Manager Parks, Operations

Licence to Occupy Marine Parade: Rent: $1 plus GST (not charged) Operating expenses: N/A Rent Reviews: N/A Installation and running costs: To be met by the applicant Assignments: Not permitted Insurance: applicant must have Public Liability Insurance of $2,000,000 (Two Million Dollars) Hours of operation: 4:00pm to 10:00pm daily for the duration of the festival Uses: For the purpose of operating a Community accessible bar along with associated seating. Site coverage: To be approved annually by Council Sub-letting: Permitted at the discretion of Council iii. Licence to Occupy Earnslaw Park: Rent: $1 plus GST (not charged) Operating expenses: N/A Rent Reviews: N/A Installation and running costs: To be met by the applicant Assignments: Not permitted Insurance: applicant must have Public Liability Insurance of $2,000,000 (Two Million Dollars) Hours of operation: 9am to 10pm daily for the duration of the festival, excluding any bars which will be limited to specific hours at the discretion of Council Uses: For the purpose of creating a festival hub on the reserve along with one permanent bar and associated seating Site coverage: To be approved annually by Council Sub-letting: Permitted at the discretion of Council Ground reinstatement: To be completed to the satisfaction of the Manager Parks, Operations d. Approve the formation of a hearings panel comprising three Councillors [to be named] to hear the objections to the placement of a bus shelter in Hallenstein Street, Queenstown and make a recommendation back to Council. e. Approve the formation of a hearings panel comprising three Councillors [to be named] to hear submissions on the application for an easement over the north-western corner of Jack Reid Park and make a recommendation back to Council.

5 5 Winter Festival Requests for Use of Open Space During the 2014 Festival On 10 April 2014 the Property Subcommittee considered an application from the Queenstown Winter Festival for licences to occupy various public spaces for activities during the 2014 festival. The areas sought are the Village Green for an ice rink; Marine Parade for a pop-up bar and 40 th anniversary exhibition including enhanced tree lighting; and Earnslaw Park for a hub, including a bar. The Property Subcommittee determined that the licences to occupy should be publicly notified and requested the Council to appoint a hearings panel should submissions need to be heard. To expedite an outcome, if there are no submissions received, I would like the Council to approve the licences to occupy for Winter Festival The proposed conditions of the licences are detailed in the recommendation. If submissions are received, there needs to be a hearings panel in place to hear them. Again, to provide an expeditious result for the festival organisers, I believe it is appropriate to delegate authority to this panel to make a final decision on the applications and this is also covered in my recommendation. 6 Bus Shelter on Hallenstein Street (outside St Joseph s School) As part of the 2013/14 Annual Plan consultation process, the children of St Joseph s School requested a bus shelter on Hallenstein Street on the other side of the road from the school. This request was accepted by Council and the school notified that the project could proceed, with the proviso that residents needed to be consulted. This consultation occurred in September The location of the shelter was to be somewhere outside 37 or 41 Hallenstein Street. There was specific opposition from residents at 37 Hallenstein Street, but the son of the owners commented that although they did not support the bus shelter, belonging to society means we all have to make sacrifices. Hence the installation of the shelter was added to the infrastructure works programme. However, on 27 March 2014 the owner of 37 Hallenstein Street telephoned the Council asking about the bus shelter, expressing opposition to its installation and wanting to know more about what was planned. More recently, another resident of Hallenstein Street and a neighbour of the original complainant also contacted the Council, concerned about the installation of a shelter. This prompted a review of the complaints process. Section 339 of the Local Government Act 1974 covers the erection of Transport Shelters. This requires the servicing of notices that a shelter will be installed to the owner of any land the frontage of which is likely to be injuriously affected by the erection of the shelter. If an owner objects then the Council is required to hear the objection. Accordingly, the Council needs to establish a hearings panel for this purpose and three Councillors are sought for this task.
6 7 Easement request from the Community Housing Trust On 27 March 2014 the Property Subcommittee considered an application by the Community Housing Trust (CHT) for an easement over the north-western corner of Jack Reid Park for access to six of the residential units. The CHT assessed all options and determined the best access to the site would be off Inverness Crescent, due to the steep topography of the road reserve and the location of numerous utilities nearer the intersection of Kent Street and Inverness Crescent. A map of the site and the easement proposed is Attachment E. The Property Subcommittee determined that the easement should be publicly notified and requested the Council to appoint a hearings panel should submissions need to be heard. The submission period closes on 7 May. 8 Local Government New Zealand Annual Conference Councillors Cocks and Gilmour attended the Local Government New Zealand Conference held in Hamilton in July Their attendance required them to complete a full written report upon their return and I am pleased to advise that a very comprehensive report has been supplied. This is attached for members information. The 2014 Local Government New Zealand Conference will be jointly hosted by the Nelson City and Tasman District Councils and will take place from July in Nelson. The 2014 conference theme is Powering Local Economies; Building Vibrant Communities and the registration fee is $1,410 (until 4 June) and $1,510 after this date. The Council s policy is to fund the Mayor, Chief Executive and one elected member attending the conference. I should point out the Councillor Cocks attended the 2013 conference as LGNZ s Zone 6 representative which is why two Councillors attended. Expressions of interest from elected members who wish to attend the conference are sought.
