Memorandum TO: FROM: Charles Stewart, County Administrator Jim Bruner, County Engineer DATE: May 16, 2006 RE: Application for Abandonment of a portion of Myrtle Street right-of-way and Ocean Street right-of-way, in Arnold Subdivision As required by the Ordinance, staff has reviewed the application of Robert Cummingham, Attorney for Don Gentile for abandonment of a portion of Myrtle Street right-of-way between Postell Avenue and Ocean Street and a portion of Ocean Street right-of-way between Myrtle Street and Cedar Street in Arnold Subdivision as shown on the attached sketch. a. SOURCE OF TITLE: Recorded plat April 9, 1889 deed book DD, page 642 and 643. It does not show a width on Ocean Street. The tax map indicates 50 feet right-of-way. The plat does not have a name, but the prior deed was executed by W. Arnold. The tax map calls this Arnold Block Subdivision b. PRESENT USE OF RIGHT-OF-WAY: This portion of the right-of-way proposed for abandonment currently contains the Johnson Rocks and is not currently used by the public as a street. c. PAST HISTORY: To the best of staff s determination, this portion of the right-of-way has not been opened as a street to the public since d. POTENTIAL USE IN THE FUTURE: This portion of the right-of-way could be used for access to adjacent property and it could be used to access and contain utilities. e. BENEFIT TO PUBLIC IN CONTINUING USAGE: The public will continue to benefit from the protection of adjacent property by the Johnson Rocks. f. BENEFIT TO PUBLIC IN ABANDONMENT: Abandonment would return the property to the tax digest. For the above reasons, we do not concur with the request for abandonment of a portion of Myrtle Street right-of-way between Postell Avenue and Ocean Street and a portion of Ocean Street right-of-way between Myrtle Street and Cedar Street in Arnold Subdivision and recommend denial by the Board of Commissioners. Subsequent to the original application, Mr. Gentile gave us a letter dated May 5, 2006 (copy attached) making some revisions to the application. In this letter, he has reduced the area for abandonment slightly and stated his intention for the abandoned property. In addition to the sketch and original application, I have attached a list of all property owners with their addresses within 500' of this street. /js
