1 Memorandum TO: FROM: Alan Ours, County Administrator Jim Bruner, County Engineer DATE: November 9, 2010 RE: Application for Abandonment of a portion of the 20 feet wide alley in Block 9, East Beach, St. Simons Island As required by the Ordinance, staff has reviewed the application of Ed Mecchella, agent for Gail Cook, for abandonment of a portion of the 20 feet wide alley between Fifth and Sixth Street, adjacent to lots 1, 2, 5, 6, 7, and 8 in Block 9, East Beach as shown on the attached sketch. a. SOURCE OF TITLE: Prescriptive easement based on recorded plat of East Beach Subdivision in deed book 3G pages and amended plat recorded in plat book 3, plat 71. Both plats indicate both portions of the alley are 20 feet wide. b. PRESENT USE OF ALLEY: Currently the portion of the alley to the north of Lot 6 contains a drainage ditch which serves all of the adjacent lots. The portion of the alley to the west of Lot 6 provides access to the north drainage ditch and to a Georgia Power pole. c. PAST HISTORY: The past history of the alley is the same as the present use in that the north portion contains a drainage ditch that serves adjacent property and the west portion provides access for ditch maintenance and access to a Georgia Power facility. d. POTENTIAL USE IN THE FUTURE: Future public use of the portion of the alley proposed for abandonment could be for drainage and access to drainage and utility facilities. e. BENEFIT TO PUBLIC IN CONTINUING USAGE: The portion of the alley proposed for abandonment that is north of Lot 6 could continue to be used by the public for drainage. The portion of the alley west of Lot 6 could continue to be used to access the north drainage ditch and to access and contain utilities. f. BENEFIT TO PUBLIC IN ABANDONMENT: Abandonment would return the property to the tax digest. For the above reasons, staff recommends abandonment of only that portion of the 20 feet wide alley between Fifth and Sixth Street, adjacent to Lots 1, 2, and 6 in Block 9, East Beach and recommend approval by the Board of Commissioners provided a Georgia Power easement and a drainage access easement is reserved over the entire 20 feet wide alley. The applicant has agreed to this recommendation. RECOMMENDED MOTION I move to approve the abandonment of the portion of the 20 feet wide alley between Fifth and Sixth Street, adjacent to Lots 1, 2, and 6, in Block 9, East Beach with a utility and drainage access easement being retained over the full width of the 20 feet wide alley. In addition to the sketch and original application, I have attached a list of all property owners with their addresses within 500 feet of this alley. PJB/jb Attachments
