1 Association fall membership and LID annual meetings August 27 The fall membership meeting of the Lake Shamineau Association will be held Saturday, August 27 th, 9:00 AM followed by the first Lake Shamineau Lake Improvement District annual meeting, 10:00 AM at Lincoln Evangelical Free Church. The meeting is being held one week earlier than usual to accommodate holding the LSLID in the required time frame on the same day. The Association meeting will include a presentation by DNR Hydrologist Kenneth Zeik about the elevated lake level of Shamineau. The Lake Improvement District meeting will include a report on first year projects, the 2017 budget and election of a new board member who must be a full time resident of the district to replace Judy Kumpferschmidt. Zeik provided the group with information and programs available for possible help. The committee has invited him to provide a presentation and answer questions at the annual meeting. I hope your summer has been going well. We are definitely experiencing challenging times with the high water level and fragile shorelines. Ice jacking in the winter continues to raise havoc as well. It seems that just as we start to make progress with water levels going down, we get a significant rain event and we lose all that was gained. Hopefully, Mother Nature will be a little more friendly in the future. We have met with county staff, DNR representatives and hydrologists to try to identify possible remedies. Meanwhile, lots of work has been done with our LSLID committee. They are working on the budget for next year, meeting with the Morrison County Commissioners, and other organizations. Thank you to our committees for all their hard work and time commitment. Our area has experienced near tragic events lately with a near drowning event on Lake Alexander and one on Shamineau just a few days later. Both events involved very young children. Luckily, they are expected to make full recoveries. It emphasizes the importance of wearing life jackets when on docks or in the water. I hope to see you all at the fall meeting at the end of the month. Due to the LSLID meeting being held immediately after ours, I promise to keep the agenda moving along. Slow down to avoid shoreline damage Boaters are reminded to drive slowly near shore because of the high water levels. Many properties are suffering damage from wave erosion. Association board member Pat Held has spoken to the Sheriff's water patrol. They are extending the no wake zone on Shamineau to 300 feet from the shore. The normal zone is 150 feet. They will be posting signs to that effect at both accesses and reminding boaters on the lake about this distance. Pat has spoken to both of the resorts to ask them to inform their guests of this change on the lake. Public hearing scheduled A public hearing will be held for people to express concerns and support for a change in the assessment structure of the Lake Shamineau Lake Improvement District (LSLID). The change would be to assess each parcel of a property owner and each association and deeded access lot a share. Commercial property owners would be assessed a full share for each parcel and an additional 35% of the residential fee for each rental unit site and cabin. Having more owners assessed will reduce the assessment amount for each parcel. The hearing is scheduled for Tuesday, August 23rd, 7 PM Morrison County Government Center Written comments can be submitted in advance to Morrison County Administrator s Office, (Deb Gruber), 213 SE 1st Avenue, Little Falls, MN debg@co.morrison.mn.us Phone (320) In the opinion surveys submitted at the spring meeting, 86.4% agreed and strongly agreed that properties that generate more users (i.e. resorts and properties with multiple dwellings) should be assessed higher payments. 2

3 Membership Report as of August 12, 2016 By Kim Salisbury I hope everyone is having a good summer. I am slowly learning the ins and outs of learning how to do this position. Thank you to all and especially the membership captains for their time and patience with me. Welcome new members. I hope the new Shamineau signs that were requested were found at the right places. If not, please let me know and I will try to make it right. We have had 93 families renew their memberships this summer. Thank you. Together we invest in many programs and build a stronger community. Your dues make it possible for our newsletter, website, annual meetings, presentations, educational efforts, support for the LSLID, projects and programs Membership Captains serve each area of the lake and have been a huge help to me and our lake. If you are interested in helping out these volunteers please let me know. It is a great way to meet your neighbors. Note: Please do not attach signs to utility poles. Have a great fall season. Lake Levels Last reading: ft. (08/15/2016) = 1.02 ft above OHWL Ordinary High Water Level (OHWL): ft. Highest recorded: ft. (07/12/2014) Lowest recorded: ft. (09/06/1962) Kim Salisbury, Membership Chair Ph kbsalisbury@gmail.com A large cattail bog rode the northwest wind toward the east boat landing recently. High water levels are eroding shorelines and detaching vegetation. Lake Shamineau Association members can use the Association s floating bog permit to remove smaller bogs (less than 6 X 6 feet), but larger ones such as this can only be pushed and staked. Permit holders must inspect the bog for loon nests before moving them. High water level concerns inspire volunteers Membership opinion surveys collected at the spring meeting indicated that the consistently high lake levels is the most pressing concern that members are currently facing. A group of volunteers formed a water level committee to begin looking into causes and what can be done. The group met July 16 with DNR Area Hydrologist Kenneth Zeik and also invited him to share information at the fall membership meeting August 27 th. Thorough study is needed before any action can take place. The expense of such a survey will be best covered by the LSLID with their assessed funds. The work of these Association volunteers should help the LSLID get started. Minutes of the committee s meeting follow. 3

It takes 40 million gallons to lower lake one inch. Possibly more if water table high Today the lake is 1.04 above Ordinary High Water Level (OHWL) Ken thinks using this volume of water for irrigation is not feasible. Evaporation removes approximately 25 of water per year. Precipitation has been higher than evaporation since Audience members had objections on pollution and lake level control that may come from today s farming practice Lowest point out of lake is Lake Lena and then to Fishtrap Creek Water level would need to reach 1280 elevation to flow out of the lake basin. Currently lake level is There is tiling in the Shamineau watershed for farming Kathy Smith of New Prague can provide maps on tiling. Deryl will contact. Water table can add to the water needed to be removed if we go to pumping. Ken did not know the water table vs. Shamineau level. The most likely direction to pump water out is through Fish Trap Creek. Beaver dam was near Hwy 10 at one time. (audience) The four lane Highway 10 may have changed the water flow in area surface or water table (audience) Should get engineering drawings of old and new highway 10 (audience) Membership survey results At the spring annual membership meeting of the Lake Shamineau Association, 56 surveys were submitted and three came in the mail for a total of 59 responses. In Part I, there was a clear majority of favorable responses to the past projects and programs done by the Lake Shamineau Association. In Part II, there was a more mixed response to prospective statements about the Lake Shamineau Lake Improvement District, including a number of No Opinion responses, whereas there were none in that column for Part I. This perhaps may indicate that people are unsure of how the two organizations will operate. On the statements about how payments should be assessed, a mixed response was given. A clear majority agreed or strongly agreed that it was Ken thought Fishtrap Creek pumping is possible Ken mentioned that there is a flood reduction Program. Suburban lots, lots cut into woods, tiling will add water to lake. Everyone in Watershed will affect water level. The maximum amount that will be allowed to be pumped is 1.5 below OHWL. Ken will look into the pumping option in depth. Ken will present at the next Lake Association Meeting August 27 th. Minutes by Dale Williams fair that all property owners pay. On the statement that all should pay the same amount, there was an almost equal division with 38.8% disagreeing and 39% agreeing. For the statement that more shoreline should mean higher payments, 23.6% disagreed and 41.8% agreed. This statement also had the highest number of neutral responses as well as 10.2% No Opinion. There was strong agreement that properties generating more users should pay more with 86.4% agreeing. Part III of the survey was short answers about projects and presentations members would like to see. Lake level was the most predominant topic mentioned. 5 Fall 2016 Eurasian watermilfoil (EWM) Update By Rick Rosar, LSLID Board Member This is the first year that the Lake Shamineau Lake Improvement District (LSLID) took over the management of Eurasian watermilfoil (EWM) and other lake quality issues. Residential property owners contributed over $10,000 of the funding while commercial riparian property owners contributed $105 collectively. We started out the year by acquiring two permits from the DNR to help deal with the EWM. Last year the scuba divers believed that we would have to begin using chemical treatments to stay ahead of the spreading EWM. They reported there were two large patches that were too thick to pull by hand. One patch was to the west of Auger s Pine View Resort and the other was between the west public access and Shamineau Acres Resort. It appears the largest amount of EWM is being found around the high traffic areas of the lake where water activity is most concentrated and where the highest volume of boats are coming and going. This is often typical with exotic species. This spring the LSLID received a grant to do a rake toss survey. Although not the most scientific survey, it was one we hadn t done in over ten years and being it was paid for by a grant, we would take what we could get, especially for free. The survey showed positive results due to the diligence of the LSLID and the Lake Shamineau Associations efforts prior to We also had another team of scuba divers come out and take a visual survey with LSLID president, Bob Koll. They discovered the EWM was very hard to see from a boat, which was another indicator that we were doing things the right way. After the first hand pull by scuba divers in early July, they reported that they believed there would be no need for chemical treatments this year. So weather permitting, a second hand pull was scheduled for the second week in August. Depending on the results of that effort, we will determine if a third pull will be needed. All of the property owners deserve a great round of applause for taking the high road and stepping up to help protect our beautiful lake. A special thanks to Shamineau Acres for making their pontoon and lodging available for the scuba divers when needed on short notice. Much more work is needed, so we will continue to work hard toward a fair and equitable way for all to share in the effort to help improve our lake. Divers from Waterfront Restorations have done two pulls of Eurasian watermilfoil this summer. They found some of the invasive plant in the northwest bay near Shamineau Acres, but the quantity was way down compared to There were plants also found out from the public landing and near Auger s Pine View Resort--all areas of higher use and boat launching. 5

6 Lake Shamineau Association Spring Meeting May 28, 2016 Lincoln Evangelical Church, 9 a.m. Board members present: Randy Heltemes, Pat Held, Dave Graning, Sandy Williams, Jacquie Rognli, Randy Kevern, Mike Fedde, Bob Ingle, and Kerry Kupferschmidt President s Welcome and Open Forum The meeting was called to order and President Randy Heltemes welcomed the members present and asked for any questions or comments from the membership. The question was raised on behalf of anticipated questions from renewing or prospective members as to why the association is needed now that there is a Lake Improvement District. Pat Held and Bob Koll listed the aspects of building a community, education, build and preserve wildlife and aquatic habitat, and social aspects of getting to know others on the lake. The member survey listed the many projects and programs the association has undertaken. The Lake Improvement District, as a government entity, has stricter guidelines of what it can do and does not have the ability to respond quickly to short term needs. Both are complimentary and not meant to replace the other. Other open forum comments included suggesting more user fees for lake access as a funding option for the state to consider to help support invasive control and regarding fishing, the concern over Muskies and suggesting taking off the slot limit on northern pike. Secretary Report The minutes, as provide in the spring newsletter, were approved as written. Finance Report Pat reported the bank balances, $ in checking and $6, in savings, for a total of $7, Pat proposed the loan to the Lake Improvement District board with interest at 1% over the prime interest rate, to be repaid in two payments, in order to begin projects prior to the taxes becoming available to them. The proposal was approved. Fishing Report Rick Rosar, in absentia, reported that spring crappie fishing was excellent. Water Quality Al Doree reported that we had 2.8 inches of rain in April and 1.56 inches in May to date. The water level was at , 0.89 feet over the official high water level. Secchi disk reading of water clarity was at 17 feet. See the RMB web site for reporting results. Membership Report Volunteers are making rounds and the committee encourages members to renew their membership. Loons and Wildlife Report Diane Schroepfer volunteered to be our loon reporter. Bob Koll set out a 6 foot by 6 foot loon raft covered by vegetation, and a loon made a nest on it this spring. Boaters are respecting the area. 6 Communications Thanks to Jacquie for her continued excellent work on the newsletter. She encourages use of addresses for distributing the newsletter and saving on the cost of mailings. Also good information is on the website and the association has a Facebook account where photos and information is regularly posted. Lake Shamineau Lake Improvement District Report Bob Koll listed the board members: Bob Koll, Fred Comb, Dale Mashuga, Judy Kupferschmidt, and Rick Rosar. Judy will be moving in the near future and Bob encouraged other lake residents to volunteer for the open position when that occurs. Three of the five are required to be residents at the lake. Bob reported that they received a county grant for Aquatic Invasive Species (AIS) which is funding a lake survey by RMB our lake quality monitoring company approximately $2,600. Also funded are signs at the boat accesses regarding the invasive species in the lake. Bob proposed a new funding process that will go to the county commissioners if the lake membership supports this. It will tax based on the value and will include a service charge per rental unit on commercial properties. There are other LID s that tax with this method and various versions of it. There were many comments in favor of this being fair, especially as it increases taxes for commercial properties that have heavy boating traffic coming into the lake from other places, potentially spreading or introducing AIS. Door Prizes Door prizes were awarded including items or gift certificates from Scandia Valley Winery, Pine Ridge Golf Course, The Landing restaurant some fishing accessories and an original painting by Kerry Kupferschmidt. As a gift from our departing president, Randy Heltemes personally donated some of the prizes. New Business A motion was made to change the date of the fall meeting this year to accommodate having the LID meeting following the Association meeting. It was approved to have the 2016 fall Lake Association meeting on August 27. New board members were elected, Tim Swanson, Duane Hendricks, Mark Frisk, and re-elected members included Jacquie Rognli and Bob Ingle. Dale Williams volunteered to head a high water committee to get facts about our high water on the lake. Also Deryl Ramey and Dave Graning volunteered to be on this committee. The board approved continuing the membership with Minnesota Waters, a lake and rivers advocacy group. The board agreed to the summer planning meeting date of July 16 at 9 am at the Hitching Rail. Finance Report Pat Held provided the finance report showing $1, in checking and $8, in savings, totaling $9, as of July 15, Pat moved (Jacquie seconded) to defer the loan repayment from LID until funds available. Taxes collected were less because about 60 parcels consolidated their properties to one owner. Jacquie moved to accept the treasurers report, Mark seconded approved. Membership Survey Results Survey results from the spring association meeting were presented by Jacquie, who compiled the results. She encouraged us to reach out to members who volunteered to be involved in different committees such as water quality, and loons. Jacquie also noted that the survey results are on line on our web site. Results indicate that our focus should be about the water level. High Water committee is meeting after board mtg. Morrison County Soil and Water District letter to Lake Shamineau Property Owners The board discussed the letter from the county Soil and Water District. Helen will be invited to our LSA and LID meetings. Requested that she provide information for the fall newsletter. It was noted that past inquiries about what is allowed was that property owners can restore the damage to last year s shape and size (this was their answer 3 years ago), no answer was received to the same question this year. Discussion was held regarding water level issues on low lying areas. Jacquie will include contacts and responsibilities of the agencies that manage the lakeshore and adjacent property (ordinances, regulations and laws) in the fall newsletter. Pat suggested that there may be grants 7 available for sewer inspections and grants to assist with upgrades. Water Level Concerns Possible suggestions for getting help with the water level included Tim Swanson s mention of a Secchi Disk reading meeting he attended where there was mention of water quality and how high water causes erosion that can affect the water clarity and quality. He suggested that the Minnesota Pollution Control Agency might be a source of assistance. Another concern was mentioned about how to get a No Wake zone established and reminding people about the damage that can be done with their boating wake. Pat Held volunteered to talk to Augers and Shamineau Acres about reminding their renters about the water level and wakes. The next allotment received will be after October. The budget will be revised to include X into the milfoil. Possible alterations to shoreland are regulated In June, the Morrison County Soil and Water District sent letters to Lake Shamineau property owners warning them of violations and unpermitted alterations. The Minnesota DNR has set statewide minimum shoreland standards for lakes and rivers. These standards apply to the use and development of shoreland property including: a sanitary code, minimum lot size and water frontage, building setbacks and heights, land use, shoreland alterations, subdivision and PUD regulations. The Shoreland Management Act regulates all land within 1,000 feet of a lake and 300 feet of a river and its designated floodplain. Stricter local standards may apply. Check your local zoning office for guidance and approval. A list of offices to contact can be found for Morrison County in the permit section of the DNR website: mit_contacts_wrapper.html?id=morr AIS: RMB s Survey found no EWM in the NW section of the bay. Divers found some there and pulled, but they were low, not visible from the surface, and limited compared to last year. RMB found some near the DNR Public Access and a dense area in the SW section of the bay near Augers. Chemicals may have to be used there. Rick is negotiating with control contractors. RMB found curly leaf scattered all over, with dense areas in the West central, SE and South central areas of Shamineau. Funding: Agreed on language to request change to Article 4, Section three regarding funding. Resolutions: To move forward with requesting changes to subsequent year funding in a July 19 th meeting with the Morrison County Commissioners. We ll need to get mailing labels from Joe develop our ballot, and Annual Meeting Agenda for mailing to all riparian property owners and Helen McLennan in early August. We may also need to put a notice in the Morrison County Record.
