Market Street. Mr. Hobbie recently found evidence of somebody making a crash pad in his basement, including cigarette butts and a case of beer. Mr. Hobbie said in his opinion the neglected and willful disrespect to neighbors that the slumlord owner of these properties is causing is an emergency situation by creating an attractive nuisance for vandals. There is a wide open window and in multiple rooms graffiti exists. Mr. Hobbie said that if cigarette butts would be found inside, an emergency situation is caused by open flame or possible smoldering embers in an unattended building that is already being abused by vandals with no respect for the law or for the property. Mr. Hobbie explained that 6 years ago he experienced a fire by a vandal. Mr. Hobbie said neither he nor Duncannon needs another fire or disrespecting landlord. He said that Harrisburg refuses to let slumlords buy more property in the city until they observe basic public safety codes on properties they already own. Mr. Hobbie said for public safety he calls upon the owner to give permission for the demolition of N. Market Street and to pay for it. He feels this is a public safety issue and he is scared. Mr. Lauster asked Mr. Hobbie if he noticed accumulation of trash behind the N. Market Street units. Mr. Hobbie said he has noticed this along with broken glass and windows with no glass in them. Ms. Smith asked Mr. Hobbie if he would be willing to make an affidavit as to his observations and concerns to his properties. Mr. Hobbie said he would absolutely. He also noted that his tenants have no direct visability as there is a garage that he owns in between the apartment buildings. Page1

2 President Hammaker acknowledged that Mr. Hobbie did come into the Borough Office and fill out a citizen s action complaint on the properties at N. Market Street. President Hammaker said that the Borough s Engineer did perform an inspection of the buildings at N. Market Street and Section Uniform Construction Code regulation allows a building code official to declare a building unsafe because of inadequate maintenance which means a building that is unsecured against entry. Mr. Brown did not attempt to enter the building. Mr. Brown did note on his report that there is a broken window on the South side allowing direct access to the interior of the building, to the rear of the building there is a pile of debris, and to the West side of N. Market Street there is soffit open which is allowing pigeons to nest. All exteriors on the building appear to be locked. Mr. Brown said that the building can be declared unsafe by the building codes officer. Mr. Brown said the building codes official has the forms to declare the building unsafe but when he arrived at the building there was already something posted on the property declaring the building unsafe. Ms. Smith gave an update as to what actions have been taken by the Borough on the properties at N. Market Street. Ms. Smith said we are now in a position to proceed through the courts, potentially also through the Redevelopment Authority with Mr. Hobbies help, to seek to have the buildings declared blight, but also proceed in the courts to burden the property owner with the financial responsibility for handling the repairs or endure legal consequences for not doing so. President Hammaker asked if there is anything the Borough can do legally in the interim to make the building less unsafe. Ms. Smith said the Borough could coordinate with the Police to secure the open window and bill the owner of the building for that repair. Mr. Bomberger asked Mr. Hobbie where the broken window is located. Mr. Hobbie said it is on the South side facing his building. A lengthy discussion followed. Correspondence Ryan Fortenbaugh Delinquency Dispute President Hammaker said the Borough received a dispute on a delinquency from Ryan Fortenbaugh for 6 S. Market Street. President Hammaker finds the dispute troubling because he s not sure that the Borough is in a position where they should be. Mr. Fortenbaugh is disputing a recent water leak. He said he had a water leak a few years ago and the Borough made the repairs in his basement. Mr. Fortenbaugh was told that the recent water leak is due to heat tape not being properly applied to these same pipes which have now cracked and caused the recent water leak. Mr. Fortenbaugh feels that the Borough should repair the leak and credit his bill for the water lost since they originally fixed the leak incorrectly. Mr. Conrad thinks that the Borough should get dates and more information verified because he doesn t understand why we would fix something in someone s basement. Ms. Smith said before any action is taken Mr. Fortenbaugh should have the opportunity to come in and state his facts on the matter. President Hammaker said he will ask Ms. Roche to respond back to Mr. Fortenbaugh and have Ms. Roche try to find some information on the matter. Ms. Smith said that the Borough may want to ask for permission to go in and inspect and photograph the conditions. CDBG President Hammaker received a letter from Perry County inviting the Borough to participate with CDBG (Community Development Block Grant) in another round of funding. Mr. Brown said the Borough should first decide what project they would use the funding for. President Hammaker said for the year 2013 Perry County has an estimated $235, Project Proposals will be accepted until Friday, June 28, Bomberger/Corsnitz: motion to submit a CDBG Grant Application to Perry County for the Chestnut Street Water Line Project - PASSED Page2

3 Bell/Lauster: motion to support the Duncannon Borough Municipal Authority s application for a grant through CDBG if they decide to do so PASSED Duncannon Fire Company 2011 Federal Tax Return President Hammaker said that the Borough received a copy of the Duncannon Fire Company s 2011 Federal Tax Return and he passed the report onto the Finance Committee for review. Emergency Communications Network President Hammaker said the Borough received correspondence from the Emergency Communications Network dated June 13 th, He said currently the Borough s call out system provider is Global Connect and they are selling out to a company called Code Red Solution. In order for Global Connect to transition the Borough s account to Code Red Solution they must institute an account minimum fee of $1, per year for client communities of the Borough s size. Code Red Solution is offering additional amenities that the Borough is not currently receiving such as notification on twitter and facebook accounts, smtp (Simple Mail Transfer Protocol) texting and Code Red mobile alerts. President Hammaker asked what the Borough is currently paying Global Connect. Mr. Bomberger thinks the initial contract was for $ Ms. Smith asked if the contract is still in place. President Hammaker said, Yes, this will not take effect until contract renewal. Ms. Smith asked when the renewal date is. President Hammaker said 12:01 a.m. on January 1 st, If the Borough chooses not to go with Code Red Solution their current contract with Global Connect will continue until the contract expiration date, at which time all access to the Global Connect account will be terminated. President Hammaker would like to request a service agreement from Code Red Solution, so Council can look at what the Borough would be getting for $1, since the letter doesn t say. President Hammaker said, if Council tells Code Red Solution they are interested, Code Red Solution will send the service agreement. Council will have until the expiration date of the current agreement to enter into it or let it expire. President Hammaker said he is in favor of seeing what Code Red Solution s service agreement offers. He passed the correspondence to Ms. Smith for her review. Girl Scouts Gold Award Recipients President Hammaker said the Borough received a letter from the Girl Scouts in the Heart of PA (Pennsylvania) with an attached list of the current Girl Scout Gold Award recipients. The Girl Scouts would like the Borough to give recognition to the recipients by sending a letter of accommodation and a United States Flag that will be presented to the recipients at the Girl Scouts in the Heart of PA Gold Award Ceremony. President Hammaker said the Borough provides a certificate for young men earning their Eagle Scout medal and he would be inclined to do this for young ladies earning the Gold Award if Council wishes. Bell/Corsnitz: motion to prepare and send letters of commendation for recognition to the two Girl Scout Gold Award recipients PASSED Questions Mr. Corsnitz asked how many recipients were there. President Hammaker said two; Stephanie Anspach and Christina Cornell, both from Duncannon. Gibson-Thomas Engineering Certified Mail Page3

4 President Hammaker said the Borough received certified mail from Gibson-Thomas Engineering. He said Gibson-Thomas Engineering notified DEP (Department of Environmental Protection) of the stream work associated with the temporary water line and the water line with the Market Street Bridge project. Council doesn t have to do anything unless they disagree with what Gibson- Thomas Engineering is proposing. Follow-Up to Emergency Communications Network Ms. Smith said Council s response to Emergency Communications Network should be to ask for more information about Code Red Solution s contract proposal and then Council will give them a response. She said Council should not respond using Code Red Solution s form, or Council will be boxed into a commitment of $1, and their service. President Hammaker asked if Council has any objection to sending a letter to Code Red Solution, asking for a service agreement proposal that explains what they are providing for $1, No Objections. Mr. Conrad said it might be a good idea for Ms. Roche to check into what other Boroughs are doing for their call out system. Mr. Corsnitz said Ms. Roche could also check into other call out companies. REPORTS Mayor s Report No report submitted at this time. Police Report Lieutenant Karlsen Penn Township Police; Lieutenant Karlsen handed out flyers of a violent sexual predator that is moving into 17 Cumberland Street, Duncannon tomorrow. He reported that police have notified all of the neighbors, businesses, daycares, churches and everyone that can possibly be notified. He said police have hung the flyer at different grocery stores, police stations and at the Borough office. Not to cause this individual any grief, but to make sure nothing happens to any of our children. If anyone sees him out in public, please keep your eyes on him and if you see him doing anything suspicious let the police know right away. Mr. Conrad asked if this individual is currently under prosecution. Lieutenant Karlsen replied, Yes, he is finishing his term today and will be released tomorrow to the residence at 17 Cumberland Street tomorrow morning. Lieutenant Karlsen reported Penn Township Police has purchased a dog and cat chip reader, so when the police get lost dogs and cats if they have the chip in them, the police can scan the animal and identify who the owner is. He said Chief Pickles applied for a grant due to the problem with a lot of stray cats. The grant would allow the police to take three cats a week to the Humane Society to be spayed and neutered; they will put a chip in them and then release them back to the area they came from. Mr. Conrad said there is a person that goes by Angel Pets who is located in Dauphin. She will give citizens traps to use. President Hammaker asked if Angel Pets will keep the cats. Mr. Conrad said she doesn t keep the cats, but she will try to find homes for them. Lieutenant Karlsen said there has been a change in personnel with the Police Department. He said three officers picked up full time employment with other agencies. Two of the three officers will continue to work on a part-time basis, but their availability has been cut back. He said they have hired four more officers and they are up to eight officers. Two of the officers have prior experience, one was a Susquehanna Township officer and the other was a York City officer. The other two officers came out of the academy and have no prior experience. He said they ve hired a second female officer and training is ongoing for all of them. The Susquehanna Township officer whose name is Jason Cleck is out on the street by himself already, the female whose name is Page4

5 Melinda Lancaster is still riding along with a partner until she feels more comfortable with the area and the other two officers are still transitioning. Questions Mr. Corsnitz said he heard there was a burglary in the Cove yesterday and asked if this was a first or an ongoing occurrence. Lieutenant Karlsen said it was the first burglary and Penn Township Police have recovered some of the items and have a suspect. Mr. Bell asked if the police are enforcing, regulating and checking on the parking in the square. Lieutenant Karlsen said there have been some parking tickets issued and when they receive a complaint they go down and check on it. He said it s always the same two cars that belong to apartment dwellers who live there and who get tickets at least once a month, but they always pay the tickets and don t seem to mind. Mr. Eppley said he received a complaint about the intersection of Cemetery Street and Lincoln Street. Lincoln Street running north and south has a stop sign coming either way, but there is no stop sign on Cemetery Street coming down. The person filing the complaint is requesting a stop sign be placed on Cemetery Street coming down. Mr. Eppley looked at the intersection and there is a honeysuckle bush on the property at the corner that should probably be cut down. He feels people are not stopping at the stop signs on Lincoln Street and does not feel putting a stop sign on Cemetery Street is going to correct the problem. Lieutenant Karlsen said a stop sign can t be put at this intersection on Cemetery Street unless cause can be shown. The easiest way to show cause is to show how many motor vehicle accidents have happened there. A stop sign cannot be put there just to slow people down. He said there have not been any accidents at this intersection as long as he has been at the Borough. Lieutenant Karlsen agrees with Mr. Eppley a hundred percent, to cut the bush back and to have some police enforcement at this intersection. Ms. Smith said the Borough cannot by law post a stop sign unless they have met the warrants required by the law. Mr. Eppley said he is not sure if the honeysuckle bush is on the Borough right of way or if the property owner is the owner of it. He would like to know how to approach the property owners about cutting it back. Ms. Smith said if the bush is on the Borough right of way the Borough s work crew can go up and cut it back, but there is also a requirement that there be a clear sight distance for the intersection of 25 feet. Mr. Eppley asked who should make the initial contact with the property owner. President Hammaker said the Borough work crew can make contact with the property owner. Lieutenant Karlsen said sometimes if the Borough makes contact that could end in grief and it is better sometimes if the Police make contact. President Hammaker said whatever works. Secretary s Report written report Treasurer s Report written report Bomberger/Corsnitz: move to accept the Treasurer s Report subject to audit PASSED Borough Manager s Report written report attached - Ms. Roche reported that the electronics recycling day on June 8 th, 2013 that Advanced Green Solutions conducted went very well. She said the Borough wants to make this part of the annual Spring Clean-Up. Page5

6 At the Special Sewer Authority Meeting held in June, the Market Street Sewer Line Replacement Project was reviewed and approved for G & R Charles Excavating to start the project. Ms. Roche said she does not have a tentative start date at this point. Ms. Roche reported she is still working on bids for the electric and heat in the Hickory Street building and will have this finalized for July s Council meeting. Ms. Roche gave an update on 901 Lincoln Street. She said after sending a letter to the property owner; David Ziats to make repair, she met with Mike Criley and the property owner s contractor. Mike Criley is going to take out part of a grassy section for drainage. There was a partial swale added at the bottom to make sure the water flows down Lincoln Street and not across. As soon as Mike Criley has a chance to do this, everyone is going to get together again to look at the situation. Ms. Roche attended a PennDOT (Pennsylvania Department of Transportation) informational meeting on May 23 rd, The Market Street Bridge Project is tentatively set to begin in January 2014, because of the deterioration of the bridge. Ms. Roche reported bids for the Paving Projects were received on June 6 th, She attended a pre-bid meeting on May 29 th, 2013 and the low bidder was Eastern Industries at $87, Mr. Bomberger said since Ms. Matter has left, he asked Ms. Shearer if she would be interested in taking a course to become a Notary Public so the Borough would have that capability back in the office. He said Ms. Shearer agreed. Bomberger/Bell: motion to pay for Lisa Shearer to take a Notary Public course PASSED Ms. Roche reported the Borough is continuing to work through mechanical issues at the Sewer Treatment Plant. Ms. Roche reported Benvenue Water System has been shut off since May 4 th, 2013 due to an undetected water leak. On May 31 st, 2013, Ms. Roche and Mr. Criley met with Dale Heckler of Arro Consulting, Inc., who checked for a water leak for Athena Spa. She said Mr. Heckler as well as everyone involved in the leak is under the assumption the leak is under the highway. The Gun Shop, The Cabin and Babylon have all drilled their own wells. Ms. Smith asked who Arro Consulting, Inc. is working with. Ms. Roche said Athena Spa. Ms. Smith asked if Athena Spa is establishing a private well service. Ms. Roche said originally Athena Spa hired Arro Consulting, Inc. to find the water leak, but at this point she is not sure if they are going to drill their own well. Ms. Roche said she received the on-site inspection report of the Sewer Treatment Plant from Patrick Bowen with DEP (Department of Environmental Protection). PESI (Pennsylvania Environmental Solutions Inc.) told Ms. Roche that the Borough needs to come up with a plan to have their samples corrected. Ms. Roche reported last week she worked with Mr. Hart of the Archeology Society at the Clarks Ferry Tavern. They dug up twelve more feet on the back side of the tavern and found many artifacts, where a privy had been, pieces of glassware and pottery. Ms. Roche reported there was a sewer back-up last week in the section of 900 to 928 N. Market Street. This is the section that is deteriorating due to a bellow where the water is collecting. She said this is not the area that had the replacement last year or the section that is scheduled for replacement this year. Page6

7 Questions Mr. Bell asked Ms. Roche if she contacted the youth regarding the painting at Cooper Field. She said she spoke with Jason and he said the youth will be here tomorrow afternoon or Thursday. They will start working on Cooper Field and the band shell and also paint the band shell. Mr. Corsnitz said at last month s meeting Council approved up to $7, for the work to be done at Well #5 for various repairs. At that time there was only one bid for $7, and since then the Borough received two more bids. The second bid was from Tri-Star Inc. in the amount of $6, This is the company that originally did the work there and the third bid was from Clinton Controls for $6, Mr. Corsnitz asked Ms. Smith if Council is required by law to take the lowest bid. Ms. Smith replied, Yes, you are required to take the lowest bid unless you have some reason to believe that the lowest bidder cannot complete the project in a timely and appropriate manner. Corsnitz/Bell: motion to move forward with Clinton Controls bid of $6, PASSED Mr. Eppley apposed the motion. Bills To Be Paid/Ratified Bomberger/Conrad: motion to pay and ratify the bills as presented to include the credit cards PASSED Solicitor s Report Ms. Smith gave updates on Litigations. The PPL Litigation is being handled for the Borough by AMP (American Municipal Power). There was an exchange of settlement terms and the objective was to get PPL (Pennsylvania Power and Light) to agree to certain financial commitments to avoid a second piece of litigation challenging their return of equity later on. At this point it will be a decision by the Borough as to whether or not the financial package is worth a settlement or not. Ms. Smith reported on the John Bruno Worker s Compensation Hearing. She said there was a hearing, but there was no hearing per se due to a stipulation submitted by Selective Insurance that Mr. Bruno agreed to. Mr. Bruno has agreed to a $145, compromise which about half of that is committed to him paying medical bills. The Borough s worker s compensation will not pay any more towards Mr. Bruno s medical bills once the $145, is exhausted. Ms. Smith said Mr. Bruno s injury has been clearly identified as a back injury. Since Selective and Mr. Bruno agreed to this settlement, this closes his worker s compensation claim. She said if Mr. Bruno suffers from continuing back issues for the remainder of his natural life, he has exhausted his opportunity to recover under worker s compensation by entering into this compromise. Ms. Smith reported there have been some changes with the Beyer Litigation. Attorney Bailey has transferred this case to Attorney Stratton, who is an individual that Attorney Bailey has called upon at times to do litigation. The Court still has not issued a procedural order on this case, but we may see a procedural order coming from the court or the court may just wait to see if anybody petitions the Court to set a hearing date. Mr. Bomberger asked if the depositions that were taken prior are still of record. Ms. Smith said, yes and nothing would change. She said discovery is closed. Mr. Bomberger asked if the videography still stands. Ms. Smith said that has not been resolved and that is an evidence question. Page7

8 Ms. Smith reported on the Breslin II Litigation. She said there was an odd settlement demand that was offered that was global in nature and not just the Breslin II, but also Breslin I. The Borough received notice of it through a party that did get notice. She said in it was this offer of, give them x amount of dollars and all issues go away. Ms. Smith said to her knowledge, no defending party has responded, which there was no legal obligation to do so. President Hammaker asked how much they were asking for. Ms. Smith said $650, that all the defending parties would have to figure out how it was going to get paid. Ms. Smith reported at the last Council meeting there was a discussion about the McGuire Insurance Sub-Division Plan. There was a question of, does McGuire s Insurance need to go through land development. She said Engineer Brown and she independently looked at the Ordinance and there is no exclusion or exception in the Borough s Sub-Division and Land Development Ordinance based on the amount of size of the proposed land development. So, McGuire s Insurance has no Ordinance Exception. Ms. Smith said also during this discussion there was a question of what the storm water management requirements might be. She said the Borough does not have a Storm Water Management Ordinance and there is limited provision in the Sub-Division Ordinance for storm water management. Ms. Smith said she still needs some information to complete the PUC (Public Utility Commission) Petition and she has asked Ms. Roche for her assistance with this. She said at the last Council meeting, Ms. Roche had found some additional information in the basement, which created more questions than it had answered. There were different numbers of extra territorial customers represented by the PUC over time and Ms. Smith can t figure out how those numbers changed and what is a true number, so she needs to get that number resolved. Ms. Smith reported she is still waiting for the staff comments for the Utility Manual. Ms. Smith said she has had some continuing conversations with the AOPC (Administrative Office of Pennsylvania Courts) about the fines. Ms. Roche provided Ms. Smith with a package of the print out of fines issued in 2012 and the first quarter for this year that Chief Pickles had provided to the Borough. Ms. Smith said this will help her connect the dots between the citations and the money that is being delivered directly to Penn Township and then coming to the Borough. She said hopefully she can identify to the AOPC what she thinks may be the source of the erratic nature of the monies going directly to Penn Township verses going to the Borough. Ms. Smith reported on the Sewer Lease Agreement. She said she is still waiting for PennVest to respond and she prompted them again this week and did not get a response. Questions Mr. Corsnitz asked Ms. Smith if she was referring to him or Ms. Matter when she said she is waiting on staff for comments on the policies. Ms. Smith said she was referring to the administrative staff who handles the billings and questions from the citizens. Engineer s Report - Mr. Brown submitted a written report. He noted that in mid-july, Pennoni Associates Inc. will be doing dry weather inspections. The inspections will be on the existing sewer system to determine what the normal flows are and try to evaluate the general conditions and the material types in the sewer systems. He said they are going to do this by Zone 1, 2 and 3, looking primarily at the manholes and the inlets. In September or October Pennoni Associates Inc. is going to pull manholes again. They will be checking on the infiltration part due to old manholes and masonry manholes where groundwater maybe leaking into the system during peak flow events. He said this groundwater eventually ends up at the Sewer Treatment Plant and gets treated. Pennoni Associates Inc. is trying to come up with a base line to identify the problem as Page8

9 far as I & I (Inflow and Infiltration). As an example from the report given, the average wastewater treated was 560 gallons a day for the month of May and the peak was at 814,000 gallons on a given day. Mr. Brown reported he is going to meet with Mr. Corsnitz to go over some talking points on the Water Distribution System and from that point Pennoni Associates Inc. is going to start developing the framework. Mr. Brown reported on the Sanitary Sewer Replacement Project. He said he received an and Glace Associates is waiting for an insurance certificate from G & R Charles. Mr. Brown said the last time he talked with Glace Associates they wanted to issue the notice to proceed on Monday, June 24 th. He said the bonding is already in and it is just a matter of receiving the insurance certificate and then Glace Associates will issue the notice to proceed. Mr. Brown reported he discussed the Market Street Bridge Replacement Project with Penn Township s Authority Engineer, Ben Shull. Mr. Shull indicated that the Authority would like the bridge to be designed to accommodate a four inch forced main. Mr. Brown said Penn Township Sewer Authority has agreed to include a forced main across the superstructure and attach it to a pump station at a later date. President Hammaker said he and Mr. Bell attended a Special JOAC (Joint Operations Advisory Committee) Meeting on June 5 th. He said there were discussions that took place, but it did not involve the Duncannon Sewer Authority or the Duncannon Borough. It turned out to be a PTMA (Penn Township Municipal Authority) issue directly with PennDOT (Pennsylvania Department of Transportation) and they will continue to work together with PennDOT on the issue. Mr. Bell said the PTMA seemed satisfied with that. Mr. Brown gave an update on the phosphorous levels. He said Pennoni sent two people to the STP to evaluate how the system is working. Mr. Brown said that those people reported that the phosphorous levels at the time they were there were between.6 and 1.2 mg/l, which given that the STP is an SBR system, those were good numbers. Mr. Brown said that the expert that gave this report believes that the phosphorous levels may range like that due to some of the water going into the STP being fresh water and some of the water has phosphorous in it. Pennoni recommends that the Borough buy phosphorous credits which can be purchased through the Chesapeake Bay Commission or PennVest. Mr. Brown thinks the phosphorous credits cost between four and seven dollars per credit. He said it would be cheaper to purchase credits than to try and fix the problem with chemicals as it would be more costly to buy chemicals than to buy credits. A lengthy discussion was held. Corsnitz/Bell: motion to look for credits and cost for credits PASSED Mr. Bomberger asked if the bid for paving was an all or nothing bid. Mr. Brown said the bid was all broken down. Mr. Brown said that in order for the Borough to be able to use liquid fuels money the bid had to be broken down. Mr. Corsnitz asked about extending the Market Street Sewer Line Replacement Project since the Borough will not be doing a section next year due to PennDot working on the bridge at the south end of Market Street. President Hammaker said that the Sewer Authority has not moved on that issue. President Hammaker asked if we were using liquid fuels money for the entire paving project. Mr. Bomberger said that was the plan but since the project bid was higher than anticipated he is struggling with how that would work. Mr. Bomberger and President Hammaker thought that the bid would be done in a way that each section would be separate so that if we couldn t do everything at one time than we could pick and choose which streets to pave and which ones to hold off on. Ms. Roche said that the project is to start July 8. Ms. Smith asked how the bid was Page9

10 stating regarding whether or not the paving all has to be done this year. Mr. Brown said there is a deadline for the project. Mr. Eppley said whatever we have money to complete; he would appreciate us getting it done. Eppley/Corsnitz: motion to continue with the entire paving project and accept Eastern Industry s bid of $87, PASSED Codes Enforcement No report submitted Break 2113 hrs. Returned 2127 hrs. Codification UNFINISHED BUSINESS President Hammaker said that originally the Borough ordered ten copies of the written Codification Manual for $60.00 per copy. However General Code contacted the Borough and said that if more copies were needed in the future each copy would then cost $ President Hammaker and Ms. Roche made the decision to go ahead and order ten more copies at $60.00 per copy. Market Street Properties Unsecure Property Covered under the Solicitor s Report.. COMMITTEE REPORTS ADMINISTRATION, FINANCE & IT Mr. Bomberger reported that the Borough is doing very well. He spoke with the Auditor today regarding the Line of Credit that the Borough has with Marysville Bank. Mr. Bomberger said that in order to keep the Line of Credit open the bank needs a copy of the 2012 Financial Audit. He said that all of the field work is done and the Auditor is finalizing their report on the 2012 Financial Audit. The Auditor, Erin Shirmer is very impressed with the progress that is being made and every Page10

11 year we are getting better. Ms. Shirmer said that the Treasurer, Clarissa Pyle, is doing a good job with the financials and the Borough should have the Audit in print by the end of June. FLEET, FACILITIES & UTILITIES Mr. Corsnitz reported that the Borough is going to have bids next month for the heat and electric installation in the new shop. He also stated that the Borough is looking into purchasing a chipper. Mr. Corsnitz has asked Ms. Roche, to put together a project to understand what it costs for the Borough to produce a gallon of water because we have not had any water rate increases in a while. He thinks we should understand what that cost is for when we go into the budget season this year as there may be a need for a water increase because the water account is low. PARKS & RECREATION Mr. Lauster reminded everyone that Boy Scout Troop #64 will be camping out on the Borough s Cove Mountain property from June 23 to June 29, He stated that the Council of Churches will sponsor a Sonfest at Duncannon Area Park. Mr. Lauster asked for Special Events Permits to be approved for the Town Wide Yard Sales on Saturday, August 1, 2013 and for National Night Out on Tuesday, August 6, Lauster/Bell: motion to approve permits for Town Wide Yard Sales and National Night Out. - PASSED Mr. Lauster reported that the picnic table tops, seats, and bleecher seats at the Duncannon Area Park have been painted black due to the graffiti. Both parks got fresh mulch and the new tube slide arrived for Duncannon Area Park. Mr. Lauster said he will be requesting the Borough Office to issue Roger Hickoff a check in a couple weeks for the homemade ice cream that he always has made for National Night Out. He also mentioned that July 12, 2013 is the deadline for the summer newsletter. Mr. Conrad said that he intends to have more contests this year at National Night Out. He said in previous years the Recreation Committee used some money out of the Recreation Fund to purchase the prizes and said they will be doing the same this year if no one objects. No one objected to the use of Recreation Fund monies to purchase prizes for contests at National Night Out. Mr. Lauster noted that National Night Out starts at 6 o clock and ends at 8 o clock. Block parties will follow the street fair. Mr. Bomberger asked what will be happening with the block party that is usually on High Street. Mr. Lauster said he will discuss that matter with persons holding the block party. PERSONNEL Mr. Bell told Council that Levi Swigart resigned effective Friday, June 7, Mr. Bell said Ms. Roche has since advertised the position in the local newspapers. Ms. Roche and Mr. Criley have reviewed previous applications that the Borough received. Ms. Roche decided to advertise the open position with a deadline for receiving applications being June 28, Mr. Bell said that Clarissa Pyle had her review and has made significant progress over the last year. 12 Bell/Corsnitz: motion to increase Clarissa Pyle s salary by three percent. PASSED Bomberger/Corsnitz: motion to ratify the phone pole agreement to hire Tanuya Matter as Independent Contractor for $35 per hour with up to 24 hours a month. - PASSED PUBLIC SAFETY & STREETS Eppley/Bomberger: motion to pay Penn Township Police $38, for July, August, and September Police protection in Duncannon. PASSED Mr. Eppley said that the Refuse Truck cannot get around the alley at Apple Tree Alley and Walnut Street. The problem is people that park on the Market Street side of Apple Tree Alley and the truck cannot make the turn. Mr. Eppley said he has a request to make a fifty foot area of that on the Market Street side of Apple Tree Alley a No Parking zone. President Hammaker asks what trash is being picked up on Apple Tree Alley. Mr. Eppley replied that some businesses put their trash at the rear of their buildings which is Apple Tree Alley. He also thinks there is a dumpster along the Alley as well. President Hammaker said that his only concern is that parking is already limited in that area and to make fifty feet of that No Parking would be taking about 2-3 more parking spaces away. Mr. Eppley said there is a parking lot in that area. Mr. Corsnitz asked how often the trash was picked up in this area. Mr. Eppley said the trash pickup is on Fridays. Mr. Conrad suggested just restricting parking in that area on Fridays and President Hammaker agreed that that would be better than restricting the already limited parking all the time. A lengthy discussion was held. Mr. Eppley asked if anyone at the meeting could contact the Churches regarding parking on Ann Street while construction is going on. President Hammaker said that the discussion at the Presbyterian Church has always been that their parking lot is always open for parking except for Sunday mornings and when there are signs present stating there are special events happening. President Hammaker said the Borough would just need to notify people that during the construction project they are welcome to park at the Presbyterian parking lot as long as they are not parked there on Sunday mornings or during special events. Mr. Bell said the same goes with the Asbury Church parking lot. Mr. Corsnitz suggested touching base with someone at the Lutheran Church because that is not that far away either. Mr. Eppley asked what would need to be done to make the left side of Ann Street heading west a No Parking area. President Hammaker said it would be as easy as putting up paper signs saying there is no parking on that side of the street during construction. Mr. Bell and Mr. Eppley think it would be a courtesy to notify the people in the area of the upcoming construction and the parking restrictions. Mr. Eppley asked if the Bridge Project that is to start January 2014 is just the deck part. President Hammaker said that PennDOT Division 8 is pushing to get the project moved forward as soon as possible. Mr. Bomberger said that PennDOT is still not going to take the bridge down until school is out. Ms. Smith said that is going to have to be confirmed because if they take the bridge out during the school year then the school bus routes will need to be changed which will have to be planned for ahead of time. Mr. Bomberger suggested that Ms. Roche contact Mike Kreiser and let him know that the Borough is getting mixed signals from Gibson Thomas and Necksa and we need to get back on the same page. A lengthy discussion was held. Mr. Eppley said he would like all four corners on Ann and Church Street painted yellow for the offset. INFRASTRUCTURE ASSESSMENT Page12

13 Mr. Conrad reported that he will get together with Mr. Corsnitz in July to try to prioritize the water projects together. SPECIAL SESQUICENTENNIAL COMMITTEE President Hammaker reported that the next Committee meeting is July 11, 2013 at 7 pm. He said everything is coming together nicely. President Hammaker noted that it looks like the celebration will be a four day event. APPOINTMENTS NEW BUSINESS Bomberger/Corsnitz: motion to appoint Lynn Roche as the Flood Plain Administrator, Health Care Administrator, and the PMRS Administrator. PASSED Mr. Bomberger would like Council to have some discussion before appointing Ms. Roche as the Open Records Office. He said currently Tanuya Matter is listed as the Open Records Officer. He would also like to hear Ms. Roche s opinion on this matter. CITIZEN ACTION FORMS President Hammaker said that there was only one form received and it was discussed earlier in the meeting. Clarks Ferry Tavern President Hammaker said there will be two meetings in July regarding the Clark s Ferry Tavern but the dates have not yet been set.
