3 P a g e 3 Pot-Of-Gold Bombardier Pot-of-Gold Bombardier (BRP) will donate $50 to a club at every scheduled meeting. The club will be chosen through a drawing during the scheduled meeting All clubs in good standing are eligible for the drawing. A Director, Alternate Director, or primary member from a club in good standing must be present in order for the club to win the monies in the pot. The membership will be verified by the business manager prior to issuing the winnings. If no member of the club is present, then the $50 will be rolled over to the next scheduled meeting and another $50 will be added to the amount. The pot will continue to grow until a winner is drawn and then the pot will start over again at $50 Maximum payout is $ The club s name that is drawn will be posted on the website. 5 P a g e 5 ~ ATV DEFINITION PROPOSAL ~ from the Landowners and Sportsmen Relations Advisory Board (LSRAB) change needed and requested by landowners with input from landowners and ATV club members: Proposed Changes and Updates to Title 12 law and definition regards to ATVs 3. All-terrain vehicle or ATV. "All-terrain vehicle" or "ATV" means a vehicle, originally designed and manufactured to be a recreational vehicle which is motor driven and capable of cross-country travel on land, snow, ice, marsh, swampland or other natural terrain. "All-terrain vehicle" or "ATV" includes, but is not limited to a multitrack, multi-wheel, low-pressure tire vehicle, a motorcycle or related 2-wheel, 3-wheel or belt-driven vehicle or an amphibious machine. An ATV width is not to exceed 65 inches. An ATV total vehicle weight is not to exceed 2000 pounds. For purposes of this subpart, "all-terrain vehicle" or "ATV" does not include any of the MOTOR vehicles defined in Title 29-A. An ATV cannot be dual registered as any MOTOR VEHICLE. 5-A. Operating any MOTOR VEHICLE as defined in Title 29-A on an ATV trail. A person may not operate any MOTOR VEHICLE as defined in Title 29-A on a designated ATV trail that is not on a gravel road system unless that use has been authorized by the landowner or the landowner's agent or it is necessitated by an emergency involving the safety of a person or property A. A person who violates this subsection commits a civil violation for which a fine of not less than $100 nor more than $500 may be adjudged. [2007, c. 202, 1 (NEW).] B. A person who violates this subsection after having been adjudicated as having committed 3 or more civil violations under this Part within the previous 5-year period commits a Class E crime. [2007, c. 202, 1 (NEW).] To address dirt-bikes, width or weight limitations on trails with special rules from the landowner, we would need the following NEW law: Operating an Unauthorized ATV on a designated ATV trail. A person may not operate an Unauthorized ATV on a trail that is posted in a manner describing the prohibited use by TYPE {KIND} or SIZE limitations/restrictions of certain ATVs. The following penalties apply to violations of this subsection. (1) A person who violates this subsection commits a civil violation for which a fine of not less than $100 nor more than $500 may be adjudged. (2) A person who violates this subsection after having been adjudicated as having committed 3 or more civil violations under this Part within the previous 5-year period commits a Class E crime. Having a simple law like this gives the landowner and the club the authority to POST certain trails with limitations and would be enforceable. Rather than relying on trying to charge the individual with TRESPASS. ~ UTV and ATV are the same ~ We are trying not to set classification of vehicles, but have one definition that defines all.
